Conclusions: Testing General Principles of Law in International Investment Law: between Principles and Rules of International Law
Summing up the analysis put forward in Part III of the volume on General Principles and the Coherence of International Law, the contribution aims to provide three perspectives under international investment law through which to assess whether general principles of law provide a catalyst for normative legal cohesion. The assessment in question, both on the substantive and the procedural law levels, is of a two-pronged character. First, it considers whether general principles of law may provide a factor for internal consistency within international investment law itself. Second, it tests the role played by general principles in the relationship between international investment law and public international law; namely, either in the sense of attesting mutual integration or rather testifying to some form of sub-systemic lex specialis ratione materiae or even to a hybrid and self-contained regime

Il manuale in lingua inglese “A Concise Introduction to International Law” fornisce una panoramica del funzionamento del diritto internazionale nel contesto storico-politico contemporaneo.
Attraverso tale approccio realistico, il testo analizza temi di teoria generale, quali la soggettività internazionale, le fonti del diritto, la responsabilità degli Stati, la soluzione delle controversie e l’adattamento dell’ordinamento nazionale alle norme derivanti dal diritto internazionale.

Il diritto internazionale viene presentato nel contesto politico e culturale in costante mutamento e nella pluralità delle sue dimensioni funzionali.

Formazione, accertamento e attuazione coercitiva delle regole vengono analizzate nella loro dimensione storico- sociale moderna e contemporanea, tenendo conto delle più recenti tendenze 'sovraniste'. L'analisi vuole evidenziare come le regole giuridiche internazionali incidano sui privati e sul funzionamento degli ordinamenti giuridici nazionali, e viceversa.
Varie esemplificazioni su queste tre funzioni forniscono indicazioni anche sul contenuto delle sue regole di comportamento, particolarmente sul trattamento degli stranieri e delle loro attività economiche, diritti umani uso e protezione dell'ambiente, immunità giurisdizionali, diritto del mare e tutela dei migranti, oltre al divieto dell'uso della forza.
Tali tematiche, insieme al fenomeno delle organizzazione internazionali, sono state altresì schematicamente illustrate in via introduttiva in prospettiva di futuri separati accorgimenti

Ne Ultra Petita
The contribution addresses the ne ultra petita principle as a means to govern the relationship between judicial autonomy and the autonomy of the parties’ principles. The issue is not addressed so much through the lens of the procedural rules on the conduct of the proceedings, as much as through the prism of the general principles of adjudication which dictate the boundaries of judicial, or arbitral, decision making. The focus will be on the combination between the principles of ne ultra petita and non liquet, both flowing from the consensual nature of international adjudication and arbitration, on the one hand, and the principle iura novit curia which mirrors the autonomy of the judicial function, on the other. The analysis does not draw from national legal systems, nor from commercial arbitration. Due to the significantly different configuration of the principles at issue in different jurisdictions, it will focus on international litigation as an autonomous phenomenon. It will address firstly inter-State adjudication and then international investment arbitration. Special attention will be given to the ICSID system in consideration of its unique annulment mechanism. The contribution draws from case law researched an encouragement, if not the simply the need, for international adjudicative bodies to undertake a proactive attitude in the conduct of the proceedings. More generally, potentials emerge from the analysis to the effect that not only inter-State adjudication may impact on investor-state arbitration, but also vice versa
The global water treaties and their relationship
The chapter address the relationship between the 1992 UNECE Water Counvention and the 1997 UN Watercourses Convention. It first present succinctly the principle of harmonization, with a view to demonstrating that international law aims at systemic coherence, rather than fragmentation. Second, it shows the way in which the substantive water law principles, i.e. the no harm and the equitable utilization principles, are couched in the two conventions. Third, it addresses the procedural principle of cooperation, focusing on the provisions regulating institutional cooperation and exchange of data and information. Fourth, the analysis tackles issues revolving around the rules on notification of planned measures in the light of the recent jurisprudential interpretation of such rules. Fifth, it analyses the dispute prevention and settlement mechanisms under the two Conventions. Lastly, it draws few conclusions, showing that a harmonized reading and a constructive, mutually reinforcing interpretation of the two treaty regimes in hand is not only possible, but also in conformity with the rationale of both Conventions. That accounts for the fact that, as such, the two instruments in hand contribute decisively to the consolidation of the customary law of international watercourses

Going Beyond Counting First Authors in Author Co-citation Analysis
The present study examines one of the fundamental aspects of author co-citation analysis (ACA) - the way co-citation
counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings
are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that
only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into
account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed
