No full textBu çalışmada, 6769 Sayılı Sınai Mülkiyet Kanunu’nda düzenlenen marka hakkına yönelik suçlar ele alınmıştır. Çalışmamızın temelini marka hakkına yönelik suçlar oluştururken; marka hukuku ile ilgili ıklandıktan sonra 6769 sayılı Sınai Mülkiyet Kanunu’nda düzenlenen marka hakkına yönelik suçlar bütün unsurları ile ve yargılama usulü bakımından incelenmeye çalışılmıştır. Ayrıca, sınai mülkiyet hakkına tecavüz eden tarafından piyasaya sürülen ürünleri kişisel ihtiyaç ölçüsünde elinde bulunduran veya kullanan kişilerin gerçekleştirmiş olduğu fiillerin başkaca bir suç konusu teşkil edip etmediği hususu da bu çalışmanın bir parçasını oluşturmaktadır. Bu noktada olması gereken hukuk açısından da değerlendirmelerde bulunulmuştur.In this study, the crimes in relation to trademark rights under the Industrial Property Law numbered 6769 are addressed. Having the crimes committed in relation to trademark rights form the basis of this study; all the aspects of the crimes regulated under the Industrial Property Law numbered 6769 regarding the trademark rights are examined, especially in terms of the judicial procedure after the general information about trademark law is provided. Also, whether the acts of the ones who possess or use the products released by the trademark infringer on the market for personal use constitute a crime under any other regulation form a part of this study. Bu anlamda Halk edebiyatının en önemli yazılı eserleri olan ?cönkler?i incelemenin amacı, gün ışığına çıkarılamamış şiirlerin ve şairlerin araştırılarak edebiyata kazandırılması ve bu alanda karşılaştırma yapabilme imkânını sağlamasıdır. Biz de bu amaca yönelik olarak Sivas Ziya Bey Kütüphanesi'nde bulunan 6707, 6722 ve 6769 nolu cönkler üzerinde çalıştık.6707 ve 6722 nolu cönklerin sayfaları aşağıdan yukarıya doğru 6769 nolu cönkte ise sayfalar sağdan sola doğru açılacak şekildedir. 6722 nolu cönk kahverengi deriden bir kapağa sahiptir ve 19x9 ebadındadır. 6707 nolu cönk 34 varaktan, 6722 nolu cönk 21 varaktan oluşur. 6769 nolu cönk ise kahverengi kumaş kapağa sahiptir ve 21 varaktan oluşur. Eserlerde genellikle ?rik'a? yazı çeşidi kullanılmıştır.19. yüzyıla ait olan bu cönklerde daha çok aruz ölçüsüyle yazılmış Alevî-Bektaşî kültürünün ve inanç şekillerinin işlendiği şiirler yer almaktadır Cönklerde toplam 37 şairin 123 adet şiiri ve 14 adet mahlassız şiir bulunmaktadır. Bunların yanında az sayıda ?mani? ve ?dua? da bulunmaktadır. Ancak bu prosedür 6769 Sayılı Kanun m. 192 hükmü gereğince Kanunun yürürlük tarihinden itibaren yedi yıl sonra uygulanmaya başlanacaktır. Bu süreçte markanın iptali yargılaması mahkemeler tarafından görülecektir. Bu çalışmada mahkemeler tarafından görülecek olan markanın iptali yargılamasında 6769 Sayılı Kanun m. 26 hükmünün nasıl uygulanması gerektiği üzerinde durulacaktır.Administrative revocation procedure with regards to the revocation of a trademark is stipulated in the Industrial Property Act no 6769. However this procedure will be put into practice seven years later following the enforcement date of the Act. Revocation of a trademark trials will be made by the courts within this period. Going Beyond Counting First Authors in Author Co-citation Analysis

counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings
are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that
only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into
account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed

Get PDF“Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship
Appropriate Similarity Measures for Author Cocitation Analysis
Get PDFWe provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature. No full text6769 sayılı Kanun’da ilk kitap olarak düzenlenen markalara ilişkin Kanun'un 25. maddesi markanın hükümsüzlük hallerini düzenlemektedir. 556 sayılı KHK'da iptal ile birlikte düzenlenen hükümsüzlük davası ayrı bir maddede düzenlenmiş ve madde ile yeni birtakım hükümler getirilmiştir. Kanun’un değişiklik amacına bakıldığında, sınaî mülkiyete ilişkin hükümlerin bir çatı altında toplanması, Anayasa Mahkemesinin iptallerinin sonlandırılması, yargılamaların daha seri hale gelmesi, daha öncelikli olarak da markalarla ilgili 2015 yılında çıkarılan 2424 Marka Tüzüğü ve 2015/ 2436 marka Direktifine, TRIPS hükümlerine daha uyumlu hale getirilmesi, doktrindeki tartışmalarla ve Yargıtay’ın içtihatlarıyla yönlendirdiğimiz ve boşluk doldurduğumuz alanların kanunla düzenlenmesi olduğunu görüyoruz. Nitekim bu amaç Kanun ile gerçekleşmiştir.Article 25 of the Law on trademarks, which was organized as the first book in Law No. 6769, regulates the invalidity of the trademarks. In 556 numbered Decree, the invalidity case that was held with the cancellation was arranged in a separate article and some new provisions were introduced with the article. Considering the purpose of the amendment of the law, the provisions regarding industrial property are gathered under one roof, the annulments of the Constitutional Court are terminated, the trials become more serial, and, first of all, the harmonization with the 2424 Trademark Regulation and the 2015/2436 Trademark Directive, TRIPS provisions. We see that the areas we direct and fill in the gap are regulated by law through the discussions in the doctrine and the case law of the Supreme Court. Our results contest some common arguments for the continued
use of first-author citation counts in the evaluation of scholars, such as high correlations between author rankings by first-author citation counts and other citation
counting methods, and high costs of using more realistic citation counting methods that are not well-supported by the ISI databases. It is argued that increasingly available digital full text research papers make it possible for citation analysis studies to go beyond what the ISI databases have directly supported and to employ more
