No full textTindak pidana atau perbuatan pidana adalah suatu perbuatan yang tidak sesuai dengan aturan atau norma hukum yang berlaku dan dapat dikenai sanksi pidana terhadap orang yang melakukan atau yang menimbulkan terjadinya suatu perbuatan pidana atau tindak pidana. Terhadap anak yang melakukan tindak pidana sering digunakan istilah kejahatan atau Juvenile Delinquency ialah suatu prilaku jahat /dursila atau kejahatan / kenakalan anak-anak muda. Setiap tindak pidana ataupun kejahatan yang dilakukan tentu harus mendapatkan hukuman dan sanksi hukum bagi pelakunya. Meskipun telah melakukan suatu perbuatan pidana atau kejahatan tidak berarti tersangka kehilangan haknya untuk mendapatkan perlindungan hukum. Tujuan dari penelitian ini adalah untuk memperoleh data dan informasi mengenai perlindungan hukum terhadap tersangka anak yang melakukan kejahatan terkait penyelesaian perkara pidana dengan upaya diversi, untuk mengetahui apakah setiap tindak pidana atau kejahatan yang dilakukan oleh anak dapat dilakukan upaya diversi oleh Penyidik serta untuk mengetahui apakah tujuan dari dilakukannya diversi telah terlaksana sebagaimana mestinya sesuai dengan yang diamanatkan oleh Undang-undang Sistem Peradilan Pidana Anak. Berdasarkan hasil penelitian yang dilakukan oleh penulis dapat diambil kesimpulan bahwa terdapat tindak pidana atau kejahatan yang dilakukan oleh anak dibawah umur yang dilaporkan di wilayah hukum Polresta Pontianak Kota dengan jumlah 56 kasus pada tahun 2014. Sebagai upaya implementasi Undang-undang Nomor 11 tahun 2012 tentang Sistem Peradilan Pidana Anak dilakukan upaya penyelesaian perkara di luar persidangan dengan penerapan konsep diversi sebanyak 24 kasus. Tidak semua perkara pidana anak yang dapat diselesaikan dengan penerapan konsep diversi dengan alasan bahwa tindak pidana yang dilakukan oleh anak tersebut memiliki ancaman hukuman diatas 5 tahun, anak tersebut telah berulangkali melakukan perbuatan pidana atau kejahatan, serta tidak terdapat persetujuan dari pihak korban / keluarga korban. Tujuan dilakukannya upaya diversi terhadap tersangka anak selain memberikan perlindungan hukum terhadap anak yang berkonflik dengan hukum juga untuk mencapai perdamaian antara korban dan anak sebagai pelaku kejahatan, dapat menyelesaian perkara anak di luar persidangan, kemudian dapat menghindarkan perampasan kemerdekaan terhadap anak dari upaya penahanan. Anak merupakan sebuah anugerah dari Tuhan yang maha kuasa sebagai titipan yang diberikan kepada setiap orang tua. Selain itu anak juga sebagai penerus bansgsa dan memiliki tanggung jawab atas eksistensi suatu bangsa dimasa yang akan datang. Untuk itu pembinaan terhadap generasi bangsa harus selalu dilaksanakan sebaik-baiknya demi kelangsungan hidup dan pertumbuhan bangsa itu sendiri oleh karena itu anak perlu mendapatkan pembinaan sejak dini dan perlu mendapatkan kesempatan seluas-luasnya untuk dapat tumbuh dan berkembang baik secara fisik, mental dan sosial, upaya perlindungan dan pembinaan terhadap anak perlu dilakukan dengan memberikan jaminan terhadap pemenuhan atas hak-haknya serta perlakukan tanpa diskriminasi. Penyimpangan tingkahlaku dan perbuatan melanggar hukum yang dilakukan oleh anak disebabkan oleh berbagai faktor, antara lain : adanya dampak negatif dari perkembangan dan pembangunan yang cepat, arus globalisasi komunikasi dan informasi, kemajuan ilmu pengetahuan dan teknologi serta perubahan gara dan cara hidup sebagian orang tua. Berbagai faktor tersebut telah membawa perubahan sosial yang mendasar dalam kehidupan masyarakat yang pada gilirannya sangat berpengaruh terhadap nilai dan perilaku anak. Sehingga muncul istilah “anak nakal”, yakni anak yang melakukan tindak pidana. Dengan demikian dapat dikatakan bahwa yang menyebabkan anak menjadi nakal adalah faktor pendidikan keluarga yang kurang baik, pengaruh informasi melalui media yang kurang mendidik, bahkan justru menjerumuskan anak kepada perilaku jahat, serta gaya dan cara hidup sebagian orang tua yang terlalu memanjakan anaknya pengalaman buruk lainnya dapat diperoleh anak melalui pergaulan dengan teman-teman sebaya. Anak juga bisa melakukan tindak pidana karena terinspirasi dari tayangan film yang bernuansa pornografi dan pornoaksi. Sehingga dalam berbagai kasus anak di bawah umur tega memperkosa teman sepermainannya setelah menonton film porno. Meskipun demikian, anak tetaplah seorang anak yang memiliki jiwa, kepribadian dan emosi yang labil sehingga memerlukan peran serta seluruh lapisan masyarakat dalam berbagai peran dan kedudukan untuk menyadari betapa pentingnya anak bagi nusa dan bangsa. Perlindungan anak merupakan segala usaha yang dilakukan untuk menciptakan kondisi agar setiap anak dapat melaksanakan hak dan kewajibannya demi perkembangan dan pertumbuhan anak secara wajar baik fisik, mental dan sosial. Hukum merupakan jaminan bagi kegiatan perlindungan anak, perlindungan anak tidak boleh dilakukan secara berlebihan dan memperhatikan dampak terhadap lingkungan dari anak itu sendiri, sehingga usaha perlindungan anak yang dilakukan tidak berdampak negatif. Perlindungan anak harus dilakukan secara rasional, bertanggung jawab dan bermanfaat mencerminkan suatu usaha yang efektif dan efesien serta tidak boleh mengakibatkan matinya inisiatif, kreatifitas dan hal lain yang menyebabkan ketergantungan kepada orang lain dan berprilaku tak terkendali sehingga anak tidak memiliki kemampuan dan kemauan menggunakan hak-haknya dan melaksanakan kewajiibannya. Perlindungan hukum tidak hanya diberikan kepada anak yang menjadi korban tindak pidana ataupun korban kejahatan, namun juga diberikan kepada anak yang berkonflik dengan hukum. Going Beyond Counting First Authors in Author Co-citation Analysis

counts are defined. Co-citation counting provides the data on which all subsequent statistical analyses and mappings
are based, and we compare ACA results based on two different types of co-citation counting - the traditional type that
only counts the first one among a cited work's authors on the one hand and a non-traditional type that takes into
account the first 5 authors of a cited work on the other hand. Results indicate that the picture produced through this non-traditional author co-citation counting contains more coherent author groups and is therefore considerably clearer. However, this picture represents fewer specialties in the research field being studied than that produced through the traditional first-author co-citation counting when the same number of top-ranked authors is selected and analyzed. Reasons for these effects are discussed

Get PDF“Variations on the Author” discusses two of Eduardo Coutinho’s recent films (Um Dia na Vida, from 2010, and Últimas Conversas, posthumously released in 2015) and their contribution to the general question of documentary authorship. The director’s filmography is characterized by a consistent yet self-effacing form of authorial self-inscription: Coutinho often features as an interviewer that rather than express opinions propels discourses; an interviewer that is good at listening. This mode of self-inscription characterizes him as an author who is not expressive but who is nonetheless markedly present on the screen. In Um Dia na Vida, however, Coutinho is completely absent form the image, while Últimas Conversas, on the contrary, includes a confessional prologue that moves the director from the margins to the center of his films. This article examines the ways in which these works stand out in the filmography of a director who offers new insights into the notion of cinematic authorship
Appropriate Similarity Measures for Author Cocitation Analysis
Get PDFWe provide a number of new insights into the methodological discussion about author cocitation analysis. We first argue that the use of the Pearson correlation for measuring the similarity between authors’ cocitation profiles is not very satisfactory. We then discuss what kind of similarity measures may be used as an alternative to the Pearson correlation. We consider three similarity measures in particular. One is the well-known cosine. The other two similarity measures have not been used before in the bibliometric literature. Note that the objective for the hut study was to evaluate the IRS treatment applications for residual efficacy against Anopheles mosquitoes, including the local An. coluzzii mosquito population. Cows were only used to attract mosquitoes into the huts and no tests were carried out directly on the cows. The author checklist is intended for use with studies where experiments are carried out on animals, which is why we have had such difficulty in completing this for the hut study, as many of the questions do not relate to how the cows were used
