Liability of the diocese and parish for torts committed by a clergyman against a minor: Critical gloss to the judgment of the Polish Supreme Court of 6 September 2022 (I CSKP 466/22)
W komentowanym orzeczeniu Sąd Najwyższy uznał, iż za nadużycia seksualne duchownego (wikariusza parafialnego) wobec osoby małoletniej odpowiedzialność odszkodowawczą na podstawie art. 430 Kodeksu cywilnego ponosi diecezja oraz parafia, w której duchowny ten pełnił swoją posługę. Z tezą tą polemizuje autor glosy. Zastrzeżenia budzi przede wszystkim dokonana przez Sąd Najwyższy analiza norm prawa kanonicznego (potraktowanych wybiórczo) i sposób, w jaki Sąd Najwyższy zaaplikował te normy na gruncie polskiego porządku prawnego. Sąd Najwyższy, wykazując istnienie stosunku podporządkowania pomiędzy biskupem a duchowieństwem diecezjalnym, przyjął błędne założenie, że biskup działa zawsze jako organ diecezji, czyli, inaczej mówiąc, że działania biskupa są zawsze działaniami samej diecezji. Tymczasem pojęcie „organu”, które występuje w prawie świeckim, nie funkcjonuje w prawie kanonicznym, zaś istniejące w tej materii różnice nie odnoszą się wyłącznie do kwestii terminologicznych, ale dotykają samej istoty zagadnienia. Prawo kanoniczne, mówiąc o reprezentacji podmiotów kościelnych, nie tylko nie odwołuje się do konstrukcji organu, lecz posługuje się inną siatką pojęciową. Używa pojęcia zarządcy osoby prawnej, osoby reprezentującej osobę prawną i osoby piastującej urząd kościelny. A cywilistyczne pojęcie „organu” w odniesieniu do kościelnych osób prawnych dotyczy jedynie relacji zewnętrznych. Prawo kanoniczne nie przeczy temu, że w obrocie cywilnoprawnym (i dla potrzeb tego obrotu) biskup występuje w charakterze organu diecezji, a jego działania są uznawane na gruncie prawa cywilnego za działania samej diecezji. Jeśli jednak biskup nie działa na forum externum, lecz dokonuje przewidzianych prawem czynności kanonicznych w odniesieniu do podległego jego jurysdykcji kapłana, to Kościół nie traktuje tych działań ani jako działań organu diecezji, ani też jako działań samej diecezji, lecz uznaje je za działania własne osoby sprawującej pasterski urząd biskupa. Oznacza to, że biskup jest zarówno organem diecezji (w obrocie cywilnoprawnym), jak i realizuje prerogatywy związane z biskupim urzędem pasterskim. Wskazane sfery działania, choć istnieją równolegle, nie są tożsame. To, iż diecezja ma osobowość cywilnoprawną, a jej organem w prawie polskim jest biskup, nie oznacza bynajmniej, że rozstrzygając sprawy „z elementem kościelnym”, sądy obowiązane są postrzegać diecezję oraz biskupa wyłącznie w kontekście konstrukcji cywilnoprawnej, z pominięciem całej konfesyjnej specyfiki tych podmiotów wynikającej z prawa wewnętrznego Kościoła Katolickiego. Zawarte w prawie kanonicznym regulacje własne Kościoła odnoszące się do zakresu i charakteru władzy biskupa winny być respektowane również w prawie polskim. Skoro w świetle prawa kanonicznego biskup nie działa wyłącznie jako organ diecezji i nie każda czynność podejmowana (lub zaniechana) przez biskupa jest działaniem (zaniechaniem) samej diecezji, to okoliczność ta nie może być niedostrzegana w procesie cywilnym.
In the decision commented on, the Supreme Court held that for sexual abuse by a clergyman (parochial vicar) towards a minor, the diocese and the parish in which the clergyman performed his ministry are liable for damages under Article 430 of the Civil Code. The author of the gloss argues against this thesis. First, the analysis made by the Supreme Court of the norms of canon law (indicated selectively) and the manner in which the Supreme Court applied these norms in the Polish legal order raises objections. For in demonstrating the existence of a relationship of subordination between the bishop and the diocesan clergy, the Supreme Court made the erroneous assumption that the bishop always acts as an organ of the diocese; in other words, that the actions of the bishop are always the actions of the diocese itself. Meanwhile, the concept of ‘organ’, which is found in secular law, does not function in canon law. Indeed, the differences that exist on this matter do not relate solely to questions of terminology but touch on the very essence of the issue. Canon law, when considering the representation of ecclesiastical entities, not only does not refer to the construction of an organ but also does not use the same conceptual grid. It uses the concepts of an administrator of a legal person, a person representing a legal person and an ecclesiastical office holder. By contrast, the civilian term ‘organ’ in relation to ecclesiastical legal persons refers only to external relations. Canon law does not contradict the fact that in (and for the purposes of) civil law transactions, the bishop acts as an organ of the diocese, and his actions are recognised under civil law as actions of the diocese itself. If, however, the bishop does not act in the forum externum but instead performs canonical actions prescribed by law in relation to a priest under his jurisdiction, then the Church does not regard those actions either as the actions of an organ of the diocese or as the actions of the diocese itself. Rather, they are the own actions of the person exercising the pastoral office of bishop. This means that the bishop brings together in his person, as it were, two spheres of competence: he is both an organ of the diocese (in civil law dealings) and he exercises the prerogatives associated with the episcopal pastoral office. These spheres, although they exist in parallel, are not identical. The fact that the diocese has a civil law personality and its organ in Polish law is the bishop does not, by any means, signify that the courts, in deciding cases ‘with an ecclesiastical element’, are obliged to perceive the diocese and the bishop exclusively in the context of the civil law construction, ignoring the entire confessional specificity of these subjects occurring in the internal law of the Catholic Church. The Church’s own regulations contained in canon law concerning the scope and nature of the authority of the bishop should also be respected in Polish law. Since, under canon law, the bishop does not act solely as an organ of the diocese and not every action taken (or omitted) by the bishop is an action (omission) of the diocese itself, this circumstance cannot be overlooked in civil litigation
Działalność gospodarcza kościelnych osób prawnych a alienacja majątku Kościoła Katolickiego w Polsce. Problem spółek z ograniczoną odpowiedzialnością
W artykule podjęto próbę odpowiedzi na pytanie o to, czy kościelne osoby prawne mogą posiadać status przedsiębiorców w Polsce i prowadzić działalność gospodarczą. Analiza norm prawa polskiego i kanonicznego doprowadziła do wniosku, iż zarówno w prawie kanonicznym, jak i w porządku prawa polskiego, nie ma żadnych norm, które wykluczałyby kościelne osoby prawne z obrotu gospodarczego ze względu na ich religijną specyfikę. Nie oznacza to jednak, że podjęcie działalności gospodarczej przez kościelną osobę prawną jest irrelewantne w świetle prawa kanonicznego. Ta działalność gospodarcza, która odbywa się w przestrzeni prawa cywilnego, winna również uwzględniać respektowanie zasad dotyczących dóbr doczesnych Kościoła określonych w prawie kanonicznym. Oznacza więc to, iż podjęcie przez kościelną osobę prawną działalności gospodarczej w formule spółki z ograniczoną odpowiedzialnością stanowi alienację w rozumieniu prawa wewnętrznego Kościoła Katolickiego i tym samym wymaga – co do ważności – zgody stosownych władz kościelnych

The presented study is a commentary on the unpublished judgment of c. Emanuele Saturnino da Costa Gomes of March 1, 2022. The author discussed in detail the structure of the judgment in question: the course of the case, legal and factual reasons. The presen- ted judgment is an example of the increasingly common practice in Poland of appealing against judgments in the first instance directly to the Tribunal of the Roman Rota. This phenomenon, unprecedented on such a scale, may raise the question of the ratio legis of can. 1444 § 1 n. 1 CIC/83 in the context of can. 1438 n. 1-2 CIC/83, that is, the order of the degrees of appeal. Without denying the right of the faithful to consider their cases in the Holy See, and even transfer them there at every stage of the proceedings and at every stage of the dispute, it should be emphasized that the normal appellate tribunal for suffragal dioceses is the metropolitan tribunal, and for the metropolitan tribunal another diocesan court, which approved by the Holy See. Therefore, appealing against the judgments of the first instance directly to the Tribunal of the Roman Rota seems to be an extraordinary procedure, demanding some special reasons. Reducing the papal tribunal to the role of an ordinary court of second instance may raise doubts of a systemic nature.Zaprezentowane opracowanie jest komentarzem do niepublikowanego wyroku c. Apelowanie więc od wyroków pierwszej instancji wprost do Trybunału Roty Rzymskiej wydaje się być trybem ekstraordynaryjnym, domagającym się jakichś szczególnych racji. Sprowadzanie bowiem trybunału papieskiego do roli zwyczajnego sądu drugiej instancji może rodzić wątpliwości natury systemowej.

Zaprezentowane opracowanie jest komentarzem do niepublikowanego wyroku c. Emanuele Saturnino da Costa Gomes z 1 marca 2022 r. Autor szczegółowo omówił strukturę omawianego wyroku: przebieg sprawy, motywy prawne oraz motywy faktyczne. Prezentowany wyrok jest przykładem coraz częściej spotykanej w Polsce praktyki apelo- wania od wyroków w pierwszej instancji wprost do Trybunału Roty Rzymskiej. Zjawisko to, niespotykane wcześniej w takiej skali, może rodzić pytanie o ratio legis normy kan. 1444 § 1 n. 1 KPK w kontekście normy kan. 1438 n. 1-2 KPK, czyli o porządek stopni apelacji. Mediacja w kanonicznym procesie o stwierdzenie nieważności małżeństwa?
The article addresses the issue of mediation in the canonical process of declaring the nullity of marriage, analyzing the possibility and appropriateness of applying reconciliatory measures within the framework of canon law. The author compares the secular institution of mediation – rooted in Polish civil law and oriented toward compromise – with the Church’s pastoral practice, whose aim is not so much the resolution of a dispute as the discernment of truth and, where possible, the restoration of marital communion. Four key dimensions of so-called „canonical mediation” are analyzed: its nature, scope of application, expected outcomes, and the role of the mediator. The article argues that while canonical mediation does not correspond to the technical-legal model of civil mediation, it is a legitimate and meaningful expression of the Church’s pastoral mission toward couples in crisis. The reform of the canonical marriage process (Mitis Iudex Dominus Iesus) did not eliminate such pastoral efforts but invites a deeper understanding and broader implementation of reconciliatory practices. The article concludes with proposals for strengthening the role of mediation in ecclesiastical practice-through the development of diocesan family counselling services, training for clergy and judges in reconciliatory communication, and consideration of canonical mediation as a recommended (or even obligatory) preliminary phase before initiating formal judicial proceedings. Canonical mediation emerges not as a technical tool, but as an expression of the Church’s merciful care-one that seeks to heal, accompany, and uphold the truth of the Gospel in the midst of human fragility.Artykuł podejmuje temat mediacji w kanonicznym procesie o stwierdzenie nieważności małżeństwa, analizując możliwość i zasadność stosowania środków pojednawczych w świetle prawa kanonicznego. Autor zestawia świecką instytucję mediacji – zakorzenioną w polskim prawie cywilnym i nastawioną na kompromis – z pastoralną praktyką Kościoła, której celem jest nie tyle rozstrzygnięcie sporu, co rozeznanie prawdy i – tam gdzie to możliwe – odbudowanie komunii małżeńskiej. W artykule omówiono cztery zasadnicze aspekty tzw. „mediacji kanonicznej”: jej charakter, zakres zastosowania, przewidywane skutki oraz osobę mediatora. Autor wykazuje, że choć kanoniczna forma mediacji nie odpowiada cywilnoprawnemu modelowi mediacji, stanowi ona integralną część duszpasterskiej misji Kościoła wobec osób przeżywających kryzys małżeński. Zwrócono uwagę, że reforma procesu małżeńskiego (Mitis Iudex Dominus Iesus) nie wyeliminowała tej formy działania, lecz skłania do jej pogłębionego rozumienia i szerszego stosowania. W zakończeniu autor formułuje postulaty dotyczące dalszego rozwoju praktyki pojednawczej w trybunałach kościelnych – poprzez wzmocnienie roli poradni rodzinnych, formację duchownych i sędziów w zakresie komunikacji pojednawczej oraz ewentualną instytucjonalizację mediacji jako etapu wstępnego przed formalnym rozpoczęciem procesu. Mediacja kanoniczna jawi się tu jako wyraz miłosierdzia i troski Kościoła, który – na wzór „szpitala polowego” – towarzyszy, leczy i wspiera, nie rezygnując przy tym z prawdy Ewangelii
Acts of administration of ecclesiastical goods
The Code of Canon Law (Corpus Iuris Canonici, CIC), in its version enacted by Pope John Paul II, employs diverse terminology when refer- ring to acts of administration of goods. Can. 1277 of CIC refers to “acts of administration which are more important” and “acts of extraordinary administration”, while the provision of 1281 §1 and §2 of CIC points out the dierence between “acts of ordinary administration” and “acts which exceed the limit and manner of ordinary administration”. Although the terminology adopted in the Code of Canon Law clearly marks the dierence, it does not dene these terms and does not provide any list of these acts. Scholars do not provide much opinion in this matter either, leaving the issue for consideration by particular legislation and legal practice. However, the exact denition of dierences between the above-mentioned acts of admi- nistration is of great practical importance for the validity of acts related to the administration of ecclesiastical property. e article presented herein, based on an analysis of Can. 1277 and Can. 1281 §1, and §2 of CIC, indicates the existing dierences in terminology, and underlines the urgent need to develop a list of extraordinary acts of administration of ecclesiastical goods to ensure the stability of this kind of legal action, and draws attention to the criteria by which acts of extraordinary administration should be formulated.
Skarga o nieważność wyroku "per modum actionis" czy "per modum exceptionis"?
Can. 1621 CIC, necnon art. 271 Instructionis Dignitas Connubii duas formas querelae contra sententiam insanabilem distinguit: per modum actionis ac per modum exceptionis. Quae distinctio quaestiones procedurales parit. Analysis normarum in praesenti disquisitione contenta ad sequentes conclusiones perducit. Actio contra nullitatem sententiae et exceptio contra nullitatem sententiae essentialiter differunt circa terminum et modum querelae proponendae, iudicis competentiam et modum procedendi in ipsis cognoscendis. Deest tamen differentia circa indolem decisionum, quae cognitis mediis dici possunt. Tam querela nullitatis contra sententiam insanabilis nullitatis per modum actionis, quam querela nullitatis contra sententiam insanabilis nullitatis per modum exceptionis, decretum de sententiae invaliditate necessitatemque iterandi processum causare potest. Unicum distinctionis criterium inter utramque querelae formam momentum est procedendi quo querela nullitatis contra sententiam proposita est. Querela nullitatis sententiae per modum actionis accidit antequam causa devoluta sit, scilicet parte validitatem sententiae, non autem aequitatem accusante. Tunc querela nullitatis secundum normas de processu contentioso orali tractabitur.
