    Policing Abortion in Poland The Role of Street-Level Law Enforcement Bureaucrats in Shaping Anti-Abortion Policy

    The criminalization of abortion inevitably involves law enforcement agencies in the implementation of reproductive health policy. It entails the policing of certain aspects of abortion care services, their providers, and their clients. Frontline law enforcement officials involved in policing illegal abortions (i.e., police officers and prosecutors), as any other streetlevel bureaucrats (SLBs), possess discretionary power which can be used with either beneficial or detrimental outcomes to policy clients. As several reported incidents in Poland indicate, law enforcement SLBs may use their discretion to impose restrictions and sanctions on abortion that go beyond the provisions contained in the anti-abortion policy’s design. This paper presents a qualitative case study of two real-life examples of the use of discretion by law enforcement SLBs in implementing anti-abortion policy in Poland. Drawing on theoretical frameworks of streetlevel bureaucracy and reproductive justice, it aims to demonstrate that law enforcement SLBs’ use of discretion may not only enforce anti-abortion policies, but also reinforce their restrictiveness and punitiveness. The research contributes to the scholarship advocating the decriminalization of abortion

    Cet essai commence par une analyse de nombreux lieux communs sur le genre féminin qui se manifestent dans les oeuvres littéraires et les épigraphes consacrées aux femmes comme par exemple le fait d'être domiseda, de tricoter, les éloges pour le discours bas et modéré, l'exaltation de la pudicitia. A travers une série d'exempla (de la documentation littéraire, épigraphique et juridique) l'a. explique que si les femmes étaient douées d'autonomie individuelle (et appartenaient aux élites) et choisissaient spontanément de s'éloigner du modèle idéal de mulier les stéréotypes étaient complètement inversés : la femme n'était plus domiseda et silencieuse mais absolument 'virile', s'éloignant ainsi de la modération et de l'équilibre dans le langage pour devenir obsédante et pour tourmenter avec ses cris exagérés les contreparties masculines. Si au début elle était un modèle de vertu et de pudicitia elle devient maintenant une véritable prostituée même si son appartenance à un rang élevé devrait la protéger des jugements injurieux

    This essay focuses on Neratius' point of view on the juridical elaboration concerning the legatum of instrumentum. In more specific terms, it starts by analyzing the places where the legatum of fundus instructus and of fundus cum instrumento are dealt with to compare the importance of the first one to the second one. Moreover, the object of the legatum of domus instructa and the connection with the notion of supellex are stressed. Finally, the essay concludes by describing Neratius' idea on the legatum of the instrumentum tabernae
