Attraverso i confini del diritto. Per una meta-fisica dell’esperienza giuridica
Il presente contributo intende sviluppare la traccia fornita dal titolo del “XXV World Congress of Philosophy – Phi¬losophy across Boundaries”, ponendo in questione, secondo l’attitudine filosofica, i confini consolidati dell’esperienza giuridica, per provare a vedere se esiste qualcosa al di là di essi, che cosa sia e quale nesso abbia con ciò che si trova al loro interno. L’indagine muove in direzione essenzialmente verticale, “passando attraverso” i confini visibili di tale espe¬rienza, la sua fisicità positiva, fatta di legislazione, dottrina e giurisprudenza, per cercare di capire se esiste qualcosa al di là, oltre, sopra o sotto, questa peculiare realtà. Quello che si propone, quindi, può anche essere definito una “meta-fisica dell’esperienza giuridica”. Essa si configura come una ricerca intorno alla giustizia, in quanto generalmente considerata senso o fondamento del diritto, e si sofferma in particolare su significato e presupposti dell’antica formula che identifica la sua opera con il «suum cuique tribuere».This contribution intends to develop the track provided by the title of the “XXV World Congress of Philosophy – Philosophy across Boundaries”, questioning, according to the philosophical attitude, the established boundar¬ies of juridical experience, in order to try to see if there is something beyond them, what it is and what connection it has with what lies within them. The investigation moves in an essentially vertical direction, ‘passing through’ the visible boundaries of such experience, its positive physi¬cality, made up of legislation, doctrine and jurisprudence, in order to try to understand whether there is something beyond, above or below, this peculiar reality. What is pro¬posed, therefore, can also be called a ‘metaphysics of legal experience’. It takes the form of a search around justice, as it is generally considered to be the sense or foundation of law, and dwells in particular on the meaning and presup¬positions of the ancient formula that identifies its work with ‘suum cuique tribuere’
I limiti della tutela dei diritti della personalità nel diritto civile e nella realtà virtuale del Metaverso
Nell’era della digitalizzazione appare assolutamente neces¬sario uno studio approfondito di quella dimensione tridi¬mensionale denominata Metaverso. Ed invero, il Metaverso può essere definito come quello spazio di vita virtuale in cui l’uomo prova a realizzare ed a ripensare in parte sé stesso, interagendo e condividendo sentimenti e pensieri a contatto diretto, seppur virtuale, con altre persone che si confronta¬no nella rete. In questo articolo si cercheranno di affrontare, da una parte, i vantaggi ed i limiti che presenta appunto la realtà virtuale – ed a tratti fittizia – del Metaverso; dall’al¬tra, si tenteranno di approfondire, in prospettiva critica ed evolutiva, i limiti di tutela dei diritti della persona presenti nel nostro ordinamento giuridico prospettando degli spunti di riflessione per eventuali riforme legislative a tutela dell’i¬dentità delle persone divenute inevitabilmente utenti di uno spazio cinetico globale.In the era of digitization, an in -depth study of that three -dimensional dimension called Metaverse appears abso¬lutely necessary. Comienzan considerando los aspectos macroscópicos de la práctica cultural y la estrategia política que afectaron la época colonial tardía y la afirmación de los estados latinoamericanos independientes, para centrarse en la construcción de una dimensión identitaria nacional y subcontinental, destacando un nuevo enfoque de la historia tanto para para sí mismo y para otros países y otras culturas. Detectan los múltiples componentes socioculturales latinoamericanos que se unen para acuñar una modernidad compleja, con aspectos similares a otras culturas occidentales, pero en un proceso singular y en muchos aspectos único que intentan revelar a través de un camino filológico o descubrirlo dentro de raíces étnicas de pueblos que se cruzan o se superponen. Pamphlet 07. CONTRAST AND HARMONY BETWEEN ANCIENT AND NEW ARCHITECTURE. From the analysis to the project
The Design Laboratory for Conservation and Recovery of Architectural Heritage addresses and develops design explorations of existing artefacts, their relationship with the context and the definition of possible volumetric extensions. This necessarily entails a reflection on the relationship between old and new, that is, between past and future history, yet to be written.
It is therefore a question of investigating the various possibilities ranging from conservative restoration practices to the grafting of new architectural and urban regeneration devices, applying the tools of architectural and structural design, deepening the relationship between memory and invention, also in relation to the problems arising from the analysis and rethinking of the existing city.
The case study identified is the former Provveditorato agli Studi of Gorizia, an Art Nouveau building designed by Zaninovich in the early 20th century as the headquarters of the Cassa Distrettuale per Ammalati. It is a strongly characterised building, located on a lot overlooking the new Valletta Park and offering the possibility of an extension capable of establishing new relationships between the pre-existing building and its urban and territorial context.
The Laboratory deals with the different scales of the project, starting from urban, architectural and structural analysis, with the aim of constantly relating the various readings and intervention hypotheses.
The workshop consists of 3 teaching modules, which operate in a closely coordinated manner, with constant seminar-type discussion moments: Architectural Design 4, Structural Problems of Historic Buildings, Architectural Restoration 2
Bernard vivo. Dall’ominizzazione permanente ai perdividui
There is no technique but techniques, and philosophical discourses operate as applications of the most relevant of them: writing. After the twelfth-century scribal revolution and the fifteenth-century reinvention of the printing press, the current digital transformation of writing is bestowing on us again that which Bernard called a (technical) prosthesis. Building upon Leroy-Gourhan’s construction of the co-evolution of human bodies and tools, Bernard underlined the paradox of emerging human techniques as an exteriorization with no prior interiority. While writing implic-itly preceded and inspired the Platonic invention of a unified and hierarchical psykhē, Plato ex-plicitly construed it as an improper by-product of the activity of the psykhē itself. Yet writing was not just added as a prosthesis but it rather acted as an enthesis, that is, a grafting intervention. It was incorporated within the human sphere of action, just like any other human and nonhuman participant to subjectivation processes. Drawing on Simondon, Bernard called these processes transindividuation. I propose instead the term perdividuation, as a reminder that we all are, as it were, an interiority which is always already traversed by exteriority. Only the technique of writing and its fundamental side effects, namely, time and space, produced the alleged closure of indi-vidual identity. On the contrary, by constructing ourselves as always already permeated perdivid-uals we may attempt at reorienting the ongoing process of hominization by questioning our sep-aration from nonhumans and other humans
