Local Vs Nonlocal De Giorgi Classes: A brief guide in the homogeneous case
We give a brief and concise guide for the analysis of the local behavior of the elements of local and nonlocal homogeneous De Giorgi classes: local boundedness, local H¨older continuity and Harnacktype inequalities. In the local case, we promote a simplified itinerary in the classic theory, propaedeutic for the successive part; while in the nonlocal case, we gather recent new developments into an unitary and concise framework. Employing a suitable definition of De Giorgi classes, we show a new proof of the Harnack inequality, way easier than in the local case, that bypasses any sort of Krylov-Safonov argument or cube decomposition

The paper focuses on the relationship between the constitutive principles of Law and historical transformation. It is developed, on the one hand, with respect to the moment of constitution of the Italian nation state and, on the other hand, with respect to the historical event of feminism
Prospettive attuali di giustizia intergenerazionale: rinuncia o ripresa prasseologica?
Drawing on some recent phenomenology-based theories of intergenerational justice, this paper aims at underscoring how the dominant presentist tendency within the debate tackles the norma-tive issue of the future by merely depicting it as a continuation or extension of the present. The inability of the major philosophical theories to genuinely justify a responsibility toward future generations stems from specific factors embedded within the very premises of their arguments. Such a shortcoming is very well shown by Ferdinando Menga’s important deconstructive analyses devoted to critically investigating the contractualist, utilitarian, and natural law approaches. Yet, notwithstanding Menga’s phenomenological contribution on the matter, my conclusion will part ways from his mainstay. In what follows I will show, in fact, that his theory does not deliver a convincing motivating force as able to aptly legitimate present generations to take concrete ethical, political and also legal actions for the safeguarding of future generations. A brief concluding section will display how a good candidate to overcoming short-termism in intergenerational ethics and law can be represented by Hans Lindahl’s theory of asymmetric recognition

Relying on the perspective of a “global” Marx, which emphasizes the need to avoid separating the various levels of his theoretical and practical engagement with historical reality, this essay raises three key questions to Michael Heinrich’s Die Wissenschaft vom Wert. The first concerns the Marxian concept of science and its inherent connection to the class struggle. The second challenges the priority Heinrich places on the worker as a self-interested individual and poses the problem of its relation to the workers as a collective. The third addresses social reproduction, questioning the link Heinrich establishes between the historical preconditions of capital and its fully developed form
Tecniche di tutele e responsabilità per i danni da amianto
La vicenda dei lavoratori esposti all’amianto rimane ancora oggi una storia di diritti negati o di omissioni. Il volume raccoglie le riflessioni teorico-giuridiche in tema di amianto elaborate da diverse prospettive di studio (diritto civile, diritto del lavoro, diritto penale) e i risultati empirici dell’attività di indagine realizzata grazie alla consultazione e alla sistematizzazione di numerose sentenze, in molti casi inedite, che riguardano il contenzioso esistente in Friuli Venezia Giulia e Veneto. L’approfondimento della giurisprudenza, sia in merito al risarcimento del danno in occasione di malattie professionali dovute all’esposizione a fibre di amianto e tale da comportare la contrazione di malattie terminali, sia in relazione allo stato di disagio legato al soggetto, ha posto in luce le modalità con cui tali situazioni incidano sull’intero gruppo familiare, facendo emergere nuove forme di risarcimento riguardanti il danno da paura e la sofferenza della vittima e dei suoi familiari legata alla consapevolezza dell’esito letale della patologia

In this article I replay to some of the criticisms and develop some of the comments made at the Symposium on my book on the regulae iuris. In doing so, I emphasize the influence that the Italian Feminist Thought of the Symbolic has had on my work. In this light, I discuss the definition of the regulae iuris as general principles, a definition that refers to a subjectivist conception of law; I then discuss the “metaphysical” components of this conception, which is based on the deontological implications of being and on the “axiological resources” of the human mind. By implying, for all these reasons, an ethic of “virtue”, the regulae iuris allow us to recover the law as “impersonal”. This is my conclusion, and it also sums up the sense that being a feminist has had in my work. With its typical “infidelity” to all that is patriarchal (and the Law certainly is that, in many respects) and its constitutive search for freedom, my feminism has allowed me to free myself from some of the consolidated constructs of the Law (in particular, its current instrumental and functionalist conceptions, including the de-constructive views of the Critical Legal Studies) and to discover that, once emptied of them, something else become visible: qualities (or differences) of the Law that make it a valid resource available to everyone, in order to negotiating the sense and value of our experience. It is a movement from the inside to the outside, which reminds us that the source of the law is the human being
