Die Abgrenzung des Streitgegenstands in der vorherigen Anhörung eines ordentlichen Verfahrens
No full textEntre otros factores, la precisa, correcta y eficiente delimitación del objeto de la controversia contribuye sustancialmente a la calidad de la sentencia que se dicte en primera instancia. Por consiguiente, esta actividad procesal, inserta en la audiencia previa como un trámite más, se revela de capital importancia. Asimismo, aquélla se encuentra disciplinada por un precepto, el art. 428 LEC, que presenta numerosos problemas, tanto por su redacción como a la hora de su aplicación en la práctica forense. Pues bien, el propósito de este trabajo es hacer inventario de todos esos inconvenientes y sugerir posibles soluciones para los mismos. En última instancia, se aspira a contribuir modestamente a la mejora de la regulación de la actividad delimitadora del objeto de la controversia y, por ende, al perfeccionamiento de esta útil herramienta que presta un servicio significativo a la calidad de la justicia civil.Among other factors the specific, accurate and efficient framing of the object of controversy clearly leads to the good quality of the initial sentence. Therefore, this procedural activity, as part of the requirements of the audience prior to it proves to be fairly important. Also, the latter is ruled by a precept, art. 428 of Civil Prosecution Law, which has a number of problems in its wording as when to be implemented in forensic law. So, the reason for this study is to take inventory of such inconvenience and to suggest likely solutions to them. All in all we aim at contributing toward an improvement of the ruling of the activity which frames the object of controversy and eventually to the improvement of such useful tool toward the good quality of civil law practice.Neben anderen Faktoren, trägt die präzise und effiziente Abgrenzung des Streitgegenstands wesentlich zur Qualität des Urteils bei, welches in erster Instanz verkündet wird. Infolge dessen hat diese Prozesshandlung, eingebettet in die vorherige Anhörung, eine herausragende Bedeutung. Daher wird diese durch die Vorschrift des Art. 428 der spanischen Prozessordnung (LEC), welche vielzählige Probleme aufweist, sowohl bezogen auf ihre Abfassung, als auch bei der Anwendung in der Gerichtspraxis. Die Absicht dieser Arbeit besteht nun darin, eine Inventarliste all dieser nachteiligen Umstände zu erstellen und mögliche Lösungen für sie anzubieten. Im Letzten besteht der Anspruch des Autors darin, in bescheidener Weise zur Verbesserung der gesetzlichen Regelungen dieser Tätigkeit der Eingrenzung des Streitgegenstands beizutragen, um dieses nützliche Werkzeug, welches einen bedeutenden Beitrag zur Qualität der Ziviljustiz leistet, zu verbessern

Get PDFThe bookends of this article are analyses of two kinds of Africa-situated visual texts. It begins with a focus on Michelangelo Antonioni’s film The Passenger (1975), a movie simultaneously about a personal and cartographic drama, involving the micropolitics of the violent life of a journalist and a space with a legacy of colonial violence, the Africa country of Chad. It ends with a focus on the photography of Santu Mofokeng, which expresses a community of sense among Black citizens in post-Apartheid South Africa.Los soportes de este artículo son análisis de dos tipos de textos visuales situados en África. Comienza centrándose en la película de Michelangelo Antonioni El Reportero (1975), un film sobre un drama personal y cartográfico simultáneamente, que implica la micropolítica de la vida violenta de un periodista y un espacio con un legado de violencia colonial, el país africano de Chad. Termina centrándose en la fotografía de Santu Mofokeng, que expresa la comunidad de sentido entre los ciudadanos negros en la Sudáfrica del post-apartheid.O suporte deste artigo são análises de dois tipos de textos visuais situados em África. Get PDFEl escritor norteamericano Don DeLillo, en un breve ensayado titulado En las ruinas del futuro, explica que ante el terrorismo internacional las sociedades amenazadas deben crear una “contra-narrativa” mediática que se oponga a los discursos del terror. En este artículo, se parte de esta idea y se analizan dos muestras discursivas de dicha “contra-narrativa” (una literaria y otra periodística) con el objeto de comprender e interpretar las estrategias retóricas (tropológicas, narratológicas y argumentativas) utilizadas en España a la hora de construir socio-discursivamente el fenómeno de los “lobos solitarios”. Los resultados del estudio revelan que la definición teórica propuesta para este fenómeno es incompleta, por lo que se hace necesario una reaproximación al fenómeno atendiendo a su construcción retórico-argumentativa.Don DeLillo, an American writer, in a short essay entitled In the Ruins of the Future, explained that threatened international terrorism societies must create a narrative response against the terror. The principal aim of this paper is describe, understand and interpret what kind of rhetoric strategies (narratological, tropological and argumentative) has used in the Spanish literature and journalism in this kind of counter-narrative. The results showed that it is necessary redefine the Lone Wolfe Terrorism concept attending to the rhetoric and argumentative construction in the social discourse

Presta especial atención al juego de espejos entre países y a la resignificación esos días de los recuerdos acerca del dictador. Lo hace relacionando lo publicado con varios niveles: el contexto político e intelectual de ambos países, los estereotipos anglosajones sobre España, los mitos construidos por la dictadura y la producción historiográfica al respecto. Los periódicos analizados son los británicos The Times y The Sunday Times, The Daily Telegraph, Daily Mail y The Guardian y los estadounidenses The New York Times, Wall Street Journal, Los Angeles Times, Chicago Tribune y The Washington Post.This article analyzes the public declarations and the biographical sketches of Francisco Franco elaborated in Great Britain and United States of America at the moment of his death. This article pays special attention to the game of mirrors between countries and the resignification of memories about the dictator in those days. It does so by linking the published about Franco with several levels: the political and intellectual context of Great Britain and United States, the stereotypes about Spain, the myths built by the dictatorship and the historiographical production about the subject. The newspapers analyzed are, from Great Britain, The Times and The Sunday Times, The Daily Telegraph, Daily Mail and The Guardian and, from United States, The New York Times, Wall Street Journal, Los Angeles Times, Chicago Tribune and The Washington Post

Get PDFThis text, from a reflective perspective, articulates aspects related to the risks communication, the involvement of citizens and the place given to prevention by journalism. From a bibliographical research, it is verified that this interface is still restricted in Brazil and, from the literature discussion, the possible crosses between the culture of prevention and the journalistic coverage about risks, as well as their association with citizenship, are analyzed. Among the considerations, it points out that Journalism needs to revise its logic, focused on the present, to the concrete event, since we are living in a society oriented to the future and surrounded by risks - which requires a more preventive positioning.Este texto, de perspectiva reflexiva, articula aspectos relacionados à comunicação de riscos e ao envolvimento dos cidadãos a partir do lugar dado à prevenção pelo Jornalismo. A partir de pesquisa bibliográfica, verifica-se que essa interface ainda é restrita no Brasil e, a partir da discussão de literatura, analisam-se os possíveis cruzamentos entre a cultura da prevenção e a cobertura jornalística de riscos, assim como sua associação com a cidadania. Dentre as considerações, aponta que o Jornalismo precisa rever sua lógica, voltada para o presente, ao acontecimento concreto, já que estamos vivendo em uma sociedade orientada para o futuro e cercada de riscos – o que exige um posicionamento mais preventivo
"Saberes habitantes" en la ciudad contemporánea: narrativas barriales de una etnografía colaborativa
No full textIn this paper, we presents the results of a work experience based on collaborative ethnography in a contemporary urban environment, on historic second enlargement of Montevideo city. We focus on what we call inhabitants knowledge, by to the analysis of productions of participants. First we present the general subject of the exploration of the city together. In second step, we advance on the analysis considering the collaborative learning since the ethnographic subjectivation. Then we expose each of the cases of the considered in this experience. We conclude characterized this knowledge and reconsidering the general aspects about urban mediations.Presentamos los resultados de una experiencia de trabajo basada en la etnografía colaborativa en ambientes urbanos contemporáneos, llevada a cabo en la zona del segundo ensanche histórico de Montevideo. Nos focalizamos en lo que denominamos saberes habitantes, a través del análisis de las producciones de los participantes. En una primera parte hacemos foco en la exploración de la ciudad. Luego avanzamos en el análisis considerando los aprendizajes colaborativos desde la subjetivación etnográfica. Después nos detemos en las condiciones preexistentes según imaginarios sociales urbanos emergentes gracias a ejercicios cartográficos. Concluimos caracterizando estos saberes y retomando lo concerniente a las mediaciones urbanas
La maldición de los recursos naturales y los hidrocarburos: una revisión de literatura
Get PDFSpecialization in natural resources and its inherent challenges have been two of the most analyzed and discussed topics in the literature on development economics. This article aims to systematize the core ideas regarding the debate on the resource curse, by focusing on its four potential transmission channels and by trying to identify the features of oil and natural gas that make exporters of these raw materials prone to suffer from the curse symptoms. The institutional variable, which holds a key role in designing policies focused on the mitigation of the four transmission channels is highlighted.La especialización en recursos naturales y sus desafíos inherentes han sido dos de los temas más estudiados y discutidos por la literatura de la economía del desarrollo. El presente trabajo pretende sistematizar los ejes del debate en torno a la maldición de los recursos naturales, poniendo énfasis en sus cuatro potenciales canales de transmisión y tratando de identificar las peculiaridades del petróleo y del gas natural que llevan a los países exportadores de estas materias primas a tener tendencia a sufrir los síntomas de dicha maldición. Se insiste en la variable institucional, clave para el diseño de políticas que mitiguen sus canales de transmisión
