Bu kitapta konular, üniversite birinci sınıf öğrencilerinin anlayabileceği bir açıklıkta ve sistemde işlenmiştir. Bu kitapta öğrenmeyi kolaylaştırmak amacıyla bazı konular şema ve tablolar ile özetlenmiştir. Öğrenciler bu şema ve tablolar yardımıyla konuları daha kolay bir şekilde öğrenebileceklerdir. Kitabın ikinci baskısı 4721 sayılı yeni Türk Medeni Kanununa, üçüncü baskısı 5237 sayılı yeni Türk Ceza Kanununa, 5271 sayılı yeni Ceza Muhakemesi Kanununa ve 5235 sayılı Kanuna, sekizinci baskısı 6098 sayılı yeni Türk Borçlar Kanununa, 6100 sayılı yeni Hukuk muhakemeleri Kanununa ve 6102 sayılı yeni Türk Ticaret Kanununa, ve nihayet kitabın ondördüncü baskısı, 16 Nisan 2017 referandumuyla onaylanan 6771 sayılı Anayasa Değişikliği Kanununa göre güncellenmiştir. Ayrıca sekizinci baskıda "yorum" ve "hukuk kuralları arasında çatışma sorunu" başlıklı bölümler baştan sona yeniden yazdmış ve "çeşitli yorum ilkeleri", "hukukta akıl yürütme" ve "yargı" olmak üzere kitaba üç yeni bölüm eklenmiştir. Neticede yedinci baskıda 320 sayfa olan kitabımız, sekizinci baskıda 448 sayfaya çıkmış, yani toplamda 128 sayfa genişlemiştir. Dokuzuncu baskıda kitaba "normlar hiyeraraşisi" başlıklı yeni bir bölüm eklenmiş ve çeşitli bölümlerde genişletilmiştir. Neticede dokuzuncu baskıda sayfa sayısı 56 sayfa artmıştır. Kitabın ondördüncü baskısı, toplam 16 sayfa genişletilmiştir.     According to an influential line of scholarship, Aristotle's best city has to be interpreted as a politeia 'Greek passage'. This line of thought is still dominant among German scholars. As a champion of "Aristotelian Social Democracy", Martha Nussbaum is part of this line as well. Against such interpretations, this paper substantiates the thesis that Aristotle belongs in the tradition of aristocratic political thought. That tradition goes back to Theognis, Heraclitus, and Plato. It started with a critique of both the decline of aristocratic virtues and the rise of democratic and egalitarian values. This paper demonstrates that Aristotle understands the different forms of constitution as embodiments of different conceptions of distributive justice. It shows that Aristotle has a clear preference for the aristocratic conception and, as a consequence, for aristocracy. The constitution of the best city, which he outlines in Books VII and VIII of the Politics, has to be understood as a "true aristocracy" in which the political offices are distributed according to worth (Greek passage) to the morally and intellectually best citizens

    Bu eser 5846 sayılı Fikir ve Sanat Eserleri Kanunu’nun EK 11. maddesi uyarınca İstanbul Şehir Üniversitesi görme engelli öğrencileri için yayınevinden temin edilmiştir. Diğer kişiler tarafından kullanımı kanuna aykırıdır.Anayasalcılık ile demokrasi, günümüzde en çok tartışılan, aralarındaki ilişkiler bakımından çağdaş demokrasilerde teorik ve felsefi düzeyde gerilimlere yolaçabilen kavramlardır. Ancak bu gerilimlere rağmen anayasal demokrasiler, tarih boyunca bu iki kavramı bağdaştıracak mekanizmaları geliştirmiş, çoğunluk iktidarını sınırlamış, bireyi devlete karşı koruyan sistemleri oluşturabilmiştir. Elbette ki, bunların başında temel bir fikir olan kuvvetler ayrılığı gelmektedir. Bu ilke zaman içinde farklı anlamlar kazanmış olsa da, korumuş olduğu öz; yargı organının siyasal organlar karşısında süregelen bağımsızlığıdır. Türkiye'de anayasa hukukunun önde gelen isimlerinden olan Prof. Dr. Ergun Özbudun, Anayasalcılık ve Demokrasi adlı bu eserinde, iki kavram arasındaki gerilimin tarihsel kökenini temel alarak, karşıt ilkelerin dengelenebileceğini, bunların da toplumların gelişimi ile bağdaştırılabileceğini ele alıyor. Özbudun, yaşadığımız toplumda da sürekli tartışılan, hele günümüz Türkiyesi'nin siyasal yaşamında adeta değişmez gündem maddesi olan konuyu incelerken, ülkemizin hâlâ anayasalcılık ile demokrasi arasındaki makul ve ölçülü dengeyi sağlayacak mekanizmaları oluşturamamış olduğu sonucuna varıyor. Gerçekten, Türkiye'de yakın zamanlara kadar anayasalcılık ve onun getirdiği yasal araçlar; uzun yıllar askerî ve bürokratik yapılara, seçilmişlerin iktidar organlarının hareketini sınırlama hakkı gibi görülmüş, aynı zamanda, geçmişte yaşanan askeri darbelerin gerekçesi olarak da gösterilebilmiştir. Özbudun'a göre, bugün iki ilke arasında gidip, gelen sarkacın ucu diğer yöne, anayasal denge ve mekanizmaların görmezlikten gelindiği ve zayıflatıldığı tarafa doğru bilinçli olarak çevrilmiş bulunmaktadır. Oysa sağlıklı ve sürdürülebilir, çağdaş bir demokratik rejim ancak bu iki temel unsurun makul ve ölçülü dengesinden geçmelidir. Yazarın bu özlü çalışması, demokrasi içinde gelişecek vatandaşlık ve anayasa bilincine önemli bir katkı sunmaktadır

    Exploring the suitability of electric vehicles in the United States

    This study explores suitability of battery electric vehicles in the United States by considering their potential market share and operations costs as well as the state-specific variations in electricity generation profiles, given current government policies and the social acceptability of the technology. A performance assessment is developed to compare each state and identify major policy efforts that are needed to increase the environmental and economic competitiveness of electric vehicles. A novel multi-criteria decision-support framework, integrating Life Cycle Assessment, Data Envelopment Analysis, and Agent Based Modeling, is developed. To this end, the environmental and economic impacts of battery electric vehicles are calculated based on three scenarios: an average electricity generation mix, a marginal electricity generation mix, and a solely renewable energy mix with 100% solar. The states are classified, each requiring different policy strategies, in accordance with their performance scores. The results provide important insights for advancing transportation policies and a novel framework for multi-criteria decision-making in the future analyses

    On smartphone latent earmarks

They show that the earmarks are di erent for every person and comparatively invariant throughout in perpetuity. The earmark has been using in forensic sciences for person recognition for many years. Throughout place of murder inquiries, earmarks are used to nd the criminal. At the present times, earmarks are called evidence for the crime scene [51, 52]. Ear biometric recognition technology is recently used for earmark recognition. In this thesis, SIFT algorithm is used in system of the earmark recognition. The acquired data showed that the success rate of the earmark recognition system is 99.72%. Results of this study can be used as a resource for future works. Many ear image databases are available online. So, they are accessible to researchers. On the other hand, there is not any earmark image database available. SIFT algorithm was tested using the earmark image database that created by the researcher. The database includes 912 images belong to 50 individuals who are 29 women and 21 men. For each ear, four images were captured in three sessions by four di erent smartphones. 800 samples were collected in the rst two sessions and 112 samples in the third one. The experimental results stated that latent earmarks on the smartphone can be used for biometric recognition. Latent earmarks on smartphone are becoming visible under good lighting. So, that earmark veri cation can be performed like ngerprint veri cation on the smartphone. The success rate of earmark veri cation varies by di erent smartphone brands. It is because the materials used on smartphones'screens are di erent from each other. Also, success rates of earmark veri cation of a smartphone depend on whether the smartphone has the screen protector or not. The obtained results showed that the iPhone 6 with screen protector has the highest success rate with 99.94% among other smartphones. In future, increasing the number of people can enhance this study. People from di erent geographies can be used to investigate the e ect of genetic factors on ears.     Smart grids maturity level for natural gas networks in metropolitan cities:a case study for Istanbul

    Tezin basılısı İstanbul Şehir Üniversitesi Kütüphanesi'ndedir.Due to the increase of energy need as a consequence of rapid population growth, structuring and mega investments in metropolitan cities, optimum operation of natural gas network infrastructure has become an important goal. The fact that this goal can be realized with smart network concept has prioritized the need for new investments to be made as per smart network concept. In metropolitans, natural gas must be transmitted to customers with speci c temperatures and pressure rates. The necessity to supply natural gas sustainable and e cient way by evaluating the parameters such as weather temperatures, consumption amounts, business processes, eld equipment defects requires smart network systems. Infrastructure asset management of natural gas, which has a vital role in the cities, must be performed adequately. The purpose of this thesis is to examine the smart grid maturity and to discuss improvement potentials for companies distributing natural gas for the city. Several maturity models were compared in order to generate smart grid maturity model and accordingly smart grid maturity roadmap has been established. Field applications of four natural gas distribution companies were evaluated to determine key performance indicators which govern the maturity level and the importance rate of smart grid systems by using Analytical Hierarchy Process. Action plans were de ned according to smart grid by using GAP analysis results for companies that desire a change and development on smart grid. Additionally, smart grid maturity level of Istanbul was examined by using the established model and the comparative analysis results have been presented.     Characterization and modeling of marine channels for millimeter radiowaves

    Tezin basılısı İstanbul Şehir Üniversitesi Kütüphanesi'ndedir.In this work, we present and analyze the simulation results of millimeter-wave propagation channel performed over the sea surface for off shore ship to ship scenario. We present a channel characterization study where channel parameters such as path loss, received power, root mean square delay spread, and power delay profile are inspected by taking the ray tracing advantages of the “Wireless InSite” software. 35 GHz and 94 GHz are the bands of interest, as they have minimum water and oxygen attenuation and their performances in practice would be the best among the other frequency bands. In our study, we investigate the effect of ray spacing, Earth's curvature, and the sea surface roughness on marine channel characteristics. Our results demonstrate that 2-ray analytical model should be only used for some short ranges over the sea surface propagating at high frequencies. Besides, free space path loss model cannot predict the behavior of channel over the sea surface in high frequencies even for the short ranges. Moreover, the main time dispersion parameters of maritime channel such as mean excess delay, Root Mean Square (RMS) delay spread, coherence bandwidth (Bc), Doppler spread as well as coherence time and coherence distance have been investigated in this work. Cumulative Distribution Functions (CDFs) of time delay parameters indicate that the maritime channels can be assumed frequency non-selective as long as the bandwidth of transmitted signal does not exceed 750 MHz and 1.53 GHz at 35 GHz and 94 GHz, respectively. In addition, based on the results obtained from the Doppler spectrum, the sea channel is not affected by vessel movements and therefore the efficacy of Doppler frequency is negligible in maritime environments at these two frequencies. Consequently, the corresponding coherence times are relatively long enough not to cause distortion due to motion. As for the coherence distance, our results illustrate that the coherence distance for off shore marine channels is so large that it offers no space diversity over the sea channel.
