KONTEKSTUALISASI HADIS TENTANG PENGURUSAN JENAZAH: STUDI ATAS SYARAH HADIS KITAB FATH AL-BAARI
Syarah hadis books which have existed are in the track of normative interpretation and t it less supporting our current issues. It is also happened with Fath al-Baari as one of famous and comprehensive syarah hadith book. Current issues such rejection of funeralal pray in Jakarta during governor election 2017 is the clear example. This phenomenon is related with hadith and hardly ever response by every single syarah hadis book so far. Toward this condition, it is important to see the rejection phenomenon of funeral prayer and the hadith in the contextualization method. This article will try to describe several hadith in case of funeral prayer with some interpretation based on Fath al-Baari and another syarah hadith book. To conclude, there is a contextualizationn method to give better actualization of understanding toward previous syarah hadith and avoid normative interpretation
PERAN PEMBIMBING AGAMA PADA PEMULUNG PEREMPUAN DALAM MENINGKATKAN KUALITAS AGAMA DI TEMPAT PEMBUANGAN AKHIR (TPA) SUKAWINATAN PALEMBANG
Problematika kemiskinan telah lama ada sejak dahulu kala. Pada masa lalu umumnya masyarakat menjadi miskin bukan karena kurang pangan, tetapi miskin dalam bentuk minimnya kemudahan atau materi. Peran dan kedudukan perempuan di masyarakat dahulu masih berkisar di dalam rumah tangga dan berkutat dengan 3M, yaitu Masak, bersolek, melahirkan anak. Namun, dengan adanya pergerakan kaum perempuan mendorong terjadinya perubahan yang membuat perempuan kini mampu mengekpresikan dirinya tidak hanya di ranah domestik tetapi di ruang publik. Banyak perempuan bekerja bermunculan dengan adanya kesetaraan gender. Keterlibatan perempuan dalam bekerjaa, dipengaruhi oleh beberapa sebab, yaitu:tekanan ekonomi, lingkungan keluarga yang mendukung. Dari permasalah diatas dari rendahnya pendapatan suatu keluarga mendorong kaum perempuan yang tinggal di daerah TPA Sukawinatan Palembang, untuk turut membantu perekonomian keluarga. Hal ini dilakukan dengan berbagai cara termasuk dengan menjadi pemulung perempuan. Disinggung diatas adanya fungsi religius bagi perempuan pemulung yaitu fungsi keagamaan, para pemulung perempuan perluh adanya pendidikan agama pemulung perempuan itu harus ada peran pembimbing agama didalamnya. Karena bisa jadi pemulung tersebut kurang memperhatikan menegenai masalah kewajiban sebagai seorang Perempuan muslimah, seperti melaksanakan ibadah sholat, puasa maupun zakat, yang memang itu sudah menjadi kewajiban bagi setiap muslim. Disinilah tenaga pembimbing agama berperan penting untuk merubah pola pikiran pemulung melalui intraksi yang baik antara pembimbing agama dengan pemulung perempuan dalam hal ibadah dan muamalah. Berdasarkan pandangan peneliti merasa tertarik melakukan penelitian terhadap masalah di atas dan menuangkannya pada penelitian ini yang berjudul “Peran Pembimbing Agama Pada Pemulung Perempuan Dalam Meningkatkan Kualitas Agama Di Tempat Pembuangan Akhir (TPA) Sukawinatan Palembang. Metode penelitian jenis penelitian lapang (Field reseach. Lokasi penelitian dilakukan di TPA Sukawinatan Kecamatan Sukarame Palembang. Sumber data diantaranya, pembimbing agama dan pemulung perempuan. Teknik pengumpulan data yang digunakan yaitu; observasi, wawancara, dokumentasidan analisis data kualitatif adalah upaya yang dilakukan dengan bekerja pada data, mengorganisasi data, memilah-milahnya menjadi satuan yang dapat dikelola, mensintesiskannya, mencari dan menemukan pola. Berdasarkan hasil dan analisis penelitian penulis dapat disimpulkan bahwa, Peran pembimbing agama dalam menanamkan pengetahuan keagamaan Pada pemulung perempuan dalam sebagai teladan, memberikan pemahaman, menanamkan rasa percaya diri perempuan pemulung, penyelenggara edukasional, pembangkit kesadaran masyarakat, membangun kedekatan emosional dan advokatif, dengan materi keagamaan yang diberikan meliputi aqidah, syariah dan akhlak. Bimbingan agama terhadap pemulung dalam meningkatkan pengamalan agama bisa dikatakan berhasil dilakukan walaupun tidak terlalu signifikan dikarenakan masih banyak warga pemulung yang masih belum tergerak hatinya untuk meningkatkan pengamalan agama mereka. Pemulung perempuan tetap menjalankan tugas mereka sesuai perannya dalam keluarga, perempuan pemulung memberikan konstribusi yang baik dalam hal bekerja dan membantu keperluan keluarga.

This means that the discourse produced by the media is no longer focused on the interests of the audience as consumers, but discourse is directed at attracting market attention and obtaining economic benefits. Media idealism is increasingly eroded by the influence of the penetration of the ideology of capitalism. The ideology displayed by the mass media has an important influence in building views for certain goals to be achieved in its reporting
MAHKAMAH AGUNG, MAHKAMAH KONSTITUSI, DAN URGENSI PEMBENTUKAN PERADILAN KHUSUS PILKADA
The implication of the direct regional head election is the emergence of the results of the Regional Head Election. In the regulation of Law Number 32 of 2004, the results of the Regional Head Election were resolved by the Supreme Court. Through the decision of the Constitutional Court Number 072-073 / PUU-II / 2004 the legislators transferred the authority to the Constitutional Court with the birth of Law Number 22 Year 2007 and Law Number 12 Year 2008. However, the Constitutional Court annulled its authority with issued a decision Number 97 / PUU-XI / 2013. This article explored the resolution of the results of the Election of Regional Heads in the Supreme Court, the Constitutional Court and the discourse on the formation of a special judicial council with the legalized of the Election Law for Governors, Regents and Mayors with a statutory approach. The result of this writing is that as long as there is a final decision in the Supreme Court which is the same as the Permanent Legal Decision, so that it is possible to review the decision of the Supreme Court. In addition, as long as the Constitutional Court deals with disputes over the results of the Regional Head Election, the Constitutional Court settles cases using the sub-justice approach. After the decision 97 / PUU-XI / 2013, the urgency of the formation of special elections for the regional head elections is a necessity by taking into account the 4 elements. First, the establishment of a Special Court under the Supreme Court, second, filling the position of judge, the third special court is in the State Administrative High Court and fourth, the procedural law used is the constitutional court procedural law
MENUJU BUDAYA HUKUM (LEGAL CULTURE) PENEGAK HUKUM YANG PROGRESIF
Legal culture is one of the important aspects that must be considered by legal functionaries in carrying out law enforcement, a culture consisting of values and attitudes that can affect the way law works. By paying attention to the weaknesses that exist in this aspect of legal culture, it is expected that in the future Law Enforcement can change the paradigm not only individually but also institutionally in order to progressive Law Enforcement. Law Enforcement, who love the people and are loved by their people, make the law for humans. So that law enforcement can achieve the targets as desired, namely towards a just and prosperous society.
 
GAYA KEPEMIMPINAN KEPALA KANTOR WILAYAH AGAMA PROVINSI KEPULAUAN BANGKA BELITUNG DALAM MENINGKATKAN KUALITAS KINERJA PEGAWAI
The purpose of this study was to determine the leadership style of the Head of the Regional Office of Religion in the Bangka Belitung Islands Province in improving the quality of employee performance. It is expected that the results of this study will find new concepts about policy implementation in the effort to develop Public Administration, particularly in the quality of public services. The results of this study can be used as reference material and also as input for related parties related to research contributions in the Regional Office of Religion. Referring to the purpose of this study which is to find out and analyze the leadership style of the Head of the Religion Regional Office of the Bangka Belitung Islands Province in improving the quality of employee performance, the method used in this study is a descriptive research method or qualitative research design with a case study model. The analysis used in this study is to look at the approach of leadership style theory according to Priansa, autocratic leadership style, Democratic leadership style, and Laissez Faire leadership style. In carrying out his leadership as Head of the Bangka Belitung Islands Province Regional Religious Office, he was more inclined to use the Autocratic leadership style and the Democratic leadership style. While the leadership style of Laissez Faire, was not used because it was not appropriate for the leadership pattern used by the Head of the Religious Region Office of the Bangka Belitung Islands Province.
 
TOLERANSI BERMAZHAB DI FAKULTAS SYARIAH DAN HUKUM UNIVERSITAS ISLAM (UIN) RADEN FATAH PALEMBANG
This research is about Toleransi Bermazhab Di Fakultas Syariah Dan Hukum Universitas Islam (UIN) Raden Fatah Palembang, motivated by the urgency of educational institutions as a starting point to make changes need to be targeted as an agent of change (agents of change) to tolerance. Islamic universities as one model of educational institutions in Indonesia have a great opportunity to contribute to accelerate the planting of values of tolerance. So no matter how simple, steps or stages of a college institution should be appreciated for the easier change and development done.The main problem in this research is about the understanding of the students of Sharia Faculty and Law UIN Raden Fatah Palembang against tolerance bermazhab and implementation of tolerance among schools of students of the Faculty of Sharia and Fatah Law of UIN Radah Palembang. This research belongs to the type of research This research is a field research where the data collected by observing and distributing questionnaires to students of Faculty of Shari\u27ah and Law of UIN Raden Fatah Palembang. The results of this study indicate that in the educational environment especially in universities, in this case the students of the Faculty of Shari\u27ah and Law of the State Islamic University (UIN) Raden Fatah palembang, as well as the community environment, also have a lot of diversity, especially with regard to life and activity college student. Students tend to have an understanding of religious values that are influenced by the family environment in various forms of habit and environment of society with cultural background. All of which will certainly be reflected in their daily attitudes and behaviors
PERLINDUNGAN HUKUM TERHADAP ORANG JOMPO DI PANTI (STUDI KASUS DI PANTI JOMPO KOTA PALEMBANG)
Penelitian ini berjudul Perlindungan Hukum Terhadap Orang Jompo Di Panti (Studi Kasus Di Panti Jompo Kota Palembang), dilatarbelakangi oleh pemikiran yang mendasar bahwa membangun keluarga bahagia dan sejahtera merupakan tujuan setiap orang. Untuk mewujudkan keluarga yang bahagia, Islam mengaturnya dengan hak dan kewajiban antar anggota keluarga termasuk di dalamnya kewajiban anak terhadap orang tua. Sementara itu, realitas yang berkembang, banyak anak yang menitipkan orang tua ke panti jompo. Melihat kenyataan ini timbullah pertanyaan mengenai alasan anak dalam menitipkan orang yang kemudian dihubungkan dengan perlindungan hukum terhadap orang jompo di panti. Masalah utama dalam penelitian ini adalah mengenai bagaimana pola perlindungan hukum bagi orang jompo di Panti Jompo Kota Palembang, dan Apa saja langkah-langkah yang ditempuh dalam membina orang jompo di Panti Jompo Kota Palembang, serta bagaimana perspektif maqâshid al-syarî’ah terhadap pola perlindungan hukum dan pembinaan orang jompo di Panti Jompo Kota Palembang. Penelitian ini termasuk ke dalam jenis penelitian Penelitian ini merupakan penelitian lapangan dimana data-data dikumpulkan dengan cara mengamati/observasi dan wawancara .Hasil penelitian ini menunjukkan bahwa Pola perlindungan hukum orang jompo di panti adalah Perlindungan hukum yang bermakna; terdiri dari dua suku kata yaitu Perlindungan dan Hukum. Artinya, perlindungan menurut hukum dan undang-undang yang berlaku. Pengertian perlindungan hukum adalah suatu perlindungan yang diberikan terhadap subyek hukum dalam bentuk perangkat hukum baik yang bersifat preventif maupun yang bersifat represif, baik yang tertulis maupun tidak tertulis. Dengan kata lain perlindungan hukum sebagai suatu gambaran dari fungsi hukum., yaitu konsep dimana hukum dapat memberikan suatu keadilan, ketertiban, kepastian, kemanfaatan dan kedamaian. Adapun perlindungan hukum terhadap orang jompo di panti jompo dalam perspektif maqasid al-syari’ah yaitu perlindungan yang diberikan kepada orang jompo di panti oleh para petugas yang diberi tugas untuk melindungi, melalui pembinaan baik fisik maupun mental yang berkaitan dengan kemaslahatannya, bagaimana hak-hak yang tetap melekat pada orang jompo dalam kaitannya dengan hak pemeliharaan agama (hifz} al-din), hak pemeliharaan jiwa (hifz al-nafs), hak pemeliharaan akal pikiran (hifz al-‘aq)

Abstract
The financial sector in Indonesia is one of the sectors that has an important role in encouraging the improvement of the national economy and the economy of society. then, of course, institutions or agencies involved in the financial sector require clear regulation as the rules of the game. Ironically BMT as one of the micro-finance institutions actually tend to receive less attention from the government, especially regarding the regulation. Whereas regulation is one of the most important factors that affect sustainability BMT. Departing from the background, this study aims to know, examine and explain how the regulation of Baitul Maal Wat Tamwil (BMT) in the Regulations of Cooperatives Cooperatives, the Foundation Act, and the Law of Microfinance Institutions as well as why the existing BMT regulatory policy like today?
This research including the kind of research normative law, while specification this research is descriptive analytical Legal material used in covering primary, secondary, and tertiary legal materials. The collection of legal materials in this paper is done by doing literature research and document studies. The main approach is doctrinal.
Based on the results of research that the authors do can be summarized as follows: 1. The arrangement of BMT with the Law of Cooperatives is only temporary until the issuance of the Act specifically regulate the issue of BMT. 2. The foundation law can not be used as the basis of BMT regulation, because the foundation is an institution that is only oriented to social interests, while BMT has a social function as well as profit oriented. 3. The regulation of BMT in Act No. 1 of 2013 on Microfinance Institutions has provided clarity on what and how should BMT institutional, sharia aspect guidance, supervision and guarantee of customer\u27s savings, although until now there is a Government Regulation which regulates further how to guarantee mechanism of deposit in micro financial institution especially BMT. 4. Current BMT regulatory policies tend to encourage the development of BMTs towards financial institutions such as banks.

Abstrak
Sektor keuangan di Indonesia merupakan salah satu sektor yang memiliki peranan penting dalam mendorong peningkatan perekonomian nasional dan ekonomi masyarakat. maka, sudah barang tentu lembaga atau instansi yang berkecimpung di sektor keuangan memerlukan regulasi yang jelas sebagai aturan mainnya. Ironisnya BMT selaku salah satu lembaga keuangan mikro justru cenderung kurang mendapat perhatian dari pemerintah khususnya mengenai regulasinya. Padahal regulasi merupakan salah satu faktor paling penting yang mempengaruhi sustainabilitas BMT. Berangkat dari latar belakang tersebut, penelitian ini bertujuan untuk mengetahui, mengkaji dan menjelaskan bagaimana regulasi Baitul Maal Wat Tamwil (BMT) dalam Peraturan Perundang-Undangan Perkoperasian, Undang-Undang Yayasan, dan Undang-Undang Lembaga Keuangan Mikro serta mengapa kebijakan regulasi BMT yang ada seperti saat ini?
Penelitian ini termasuk jenis penelitian hukum normatif, sedangkan spesifikasi penelitian ini adalah deskriptif analitis. Bahan hukum yang digunakan dalam meliputi bahan hukum primer, sekunder, dan tersier. Pengumpulan bahan hukum dalam penulisan ini ditempuh dengan melakukan penelitian kepustakaan dan studi dokumen. Pendekatan utama yang ditempuh adalah doktrinal.
Berdasarkan dari hasil penelitian yang penulis lakukan dapat disimpulkan sebagai berikut: 1. Pengaturan BMT dengan Undang-Undang Perkoperasian hanya bersifat sementara sampai dikeluarkannya Undang-Undang yang secara spesifik mengatur persoalan BMT. 2. Undang-Undang yayasan tidak bisa dijadikan dasar pengaturan BMT, dikarenakan yayasan merupakan lembaga yang hanya berorientasi pada kepentingan sosial, sedangkan BMT memiliki fungsi sosial sekaligus profit oriented. 3. Pengaturan BMT dalam Undang-Undang nomor 1 tahun 2013 tentang Lembaga Keuangan Mikro telah memberikan kejelasan tentangi apa dan bagaimana seharusnya kelembagaan BMT, pedoman aspek syariah, pengawasan, dan penjaminan simpanan nasabah, meskipun sampai saat ini belam ada Peraturan Pemerintah yang mengatur lebih lanjut bagaimana mekanisme penjaminan simpanan dalam lembaga keuangan mikro khususnya BMT. 4. Kebijakan regulasi BMT saat ini cenderung mendorong perkembangan BMT ke arah lembaga keuangan seperti halnya perbankan.

PERLINDUNGAN HUKUM TERHADAP KONSUMEN ATAS PENGGUNAAN BAHAN FORMALIN PADA MAKANAN DALAM PERSPEKTIF HUKUM ISLAM
In food production, many producers use food technology that makes food quickly damaged, becomes durable and stays good, by adding preservatives. so that the food can remain fresh, smell and taste unchanged, not quickly damaged or rot due to exposure to bacteria / fungi, however, many manufacturers cheat by adding preservatives that are harmful to the body, and can rob human lives, such as formalin, substances Formalin is a chemical that is used for external purposes, which if consumed will cause many negative effects on the body. The use of formaldehyde is prohibited in the use of additives in food. and can be held accountable for penalties in the form of administrative sanctions and penalties. So how is the legal protection of consumers using formalin hazardous substances according to the Consumer Protection Act? And what is the view of Islamic law on the practice of using formaldehyde in food? and what is the role of relevant institutions to protect consumers from formalin-related additives in Palembang City? Legal protection for consumers of formalin substances in the form of regulations and laws, among others: business actors are held accountable for losses suffered by consumers (Article 15 of the Consumer Protection Act Number 8 of 1999. Whereas in Islamic law regarding food containing formalin ingredients) , categorized as illegitimate to be eaten because it has been mixed between the halal and the haram.Based on the Fatwa of the Indonesian Ulema Council Number: 43 of 2012 concerning Formalin Abuse and other Hazardous Substances, formalin food is prohibited because it brings harm, ie if swallowed it can irritate the stomach, nausea, vomiting, and can lead to death, while those that are related to consumer protection are: a). Drug and Food Control Agency (BPOM); b). Institute for Self-Help Consumer Protection (LPKSM); c). National Consumer Protection Agency (BPKN) and d).Indonesian Consumers Foundation (YLKI).
