Prior Disclaimer of Inheritance and Notarization by a Notary Public Under German Law
No full textUnder German law, an heir can disclaim the right of inheritance and legitime (Pflichtteil) in a contract with the decedent before inheritance begins (§2346 German Civil Code (BGB), Erbverzicht). Notarization by a notary public is required for the disclaimer contract (§2348 BGB). This study examines how the notary public is relevant to disclaimer contracts under German law.
In a series of proceeding, a notary public can help to ensure that the existence of documents related to inheritance is not overlooked after the decedent’s death, and to avoid the incorrect recognition in inheritance.
Additionally, it is understood that §2348 BGB aims to accomplish the “protective,” “warning,” and “proving” functions. Fulfilling these functions plays an important role in the argument over disclaimer contracts and notarization.
Under German law, §2348 BGB contributes to the interests of both the decedent and the disclaimer. This is distinctive compared with the purpose of requiring permission from the family court for a prior disclaimer of legitime in Japan.departmental bulletin pape

The Translation Process of Poems in the Hyakunin Isshu and the Kokin Wakashū
No full text本稿は『百人一首』と『古今和歌集』両方に選ばれている歌から二首、猿丸太夫（『古今和歌集』ではよみ人しらず）の「おく山にもみぢふみわけ鳴くしかのこゑきく時ぞあきはかなしき」（『古今和歌集』215 番、『百人一首』5 番）と在原業平の「ちはやふる神代もきかずたつた川から紅にみづくぐる／くくるとは」（『古今和歌集』294番、『百人一首』17 番）の解釈とハンガリー語訳について考察するものである。二首の現在までの様々な解釈を確認し、それぞれの歌を『百人一首』選入歌と『古今和歌集』選入歌として異なるようにハンガリー語訳する必要があるか否かについて検討した。
「おくやまに……」歌については「もみぢ」をどのように訳すかと踏み分けるのはだれかについて検討し、『百人一首』と『古今和歌集』でもみぢが指している植物と「踏み分け」の主語が異なるため、それに沿うハンガリー語訳を提案した。「ちはやふる……」歌については「みづくぐるとは」は清音か濁音か、また清濁により解釈がどのようにかわるかについて現在までの研究を確認し、『百人一首』と『古今和歌集』とで異なるハンガリー語訳と提案した。departmental bulletin pape
