    Islamic Contracts of Finance in Malaysia

    This paper explores the legal issues that arise in several of the principal instruments currently used in Islamic financing in Malaysia. Through the document review, it is submitted that these financial instruments consist of English-Malaysian commercial law, albeit set within an Islamic periphery. A consideration of how Islamic law could affect the litigation of these instruments is also undertaken and it is further submitted that given the current statutory and judicial framework of Islamic banking in Malaysia, the effect of Islamic commercial law upon these contracts appears to be morally exhortative, rather than legally enforceable. Finally, it is concluded that Islamic law is presently consigned to the margins of these financial contracts, and the consequences that arise from this conclusion are discussed.DOI: 10.15408/sdi.v10i1.64

    Artikel ini memperlihatkan bahwa ekspansi sekolah Islam terpadu menandai tumbuhnya kelas menengah Muslim baru yang berhasrat mengekspresikan identitas keagamaan sambil memperlihatkan status, kelas, dan selera sosial mereka sebagai Muslim yang modern dan bersentuhan erat dengan globalisasi. Dengan biaya yang mahal dan berbagai fasilitas yang ditawarkan, sekolah-sekolah Islam terpadu memberikan kebanggaan sosial kepada para orang tua dan sekaligus rasa identitas sebagai Muslim yang berkomitmen. Hal-hal yang bersifat praktis, seperti waktu bersekolah yang lebih lama (full-day system) yang memungkinkan orangtua untuk menitipkan putra-putri mereka di sekolah sehabis jam sekolah biasa juga menjadi alasan penting di balik keputusan banyak anggota kelas menengah di perkotaan melirik sekolah Islam terpadu.     This is the first work in book form which attempt to portray Westren perception, particularly the Dutch, of Islam in Indonesia during a long period of 1596 to 1942. According to Steenbrink, author of this work, in the long history of Dutch colonialism in the archipelago, there can be identified four major patterns of Dutch perception of an attitude toward Islam in Indonesia.     The focus of the article is on the trends of Islamic revivalism before the sacking of Anwar, though where necessary, the Anwar issue has been mentioned briefly for reference. Specifically, this paper attempts, firstly, to understand the trend of Islamic revivalism before the Anwar Ibrahim episode; secondly, to analyze the factors and reasons that culminated in the changing of approach from confrontational to non-confrontational; and thirdly, to seek answers to several vital questions relating to the form of Islamic revivalism in the country that has been molded by this developing trend.     This article aims to provide a picture of the traditions of one of the ratib developed by the tariqah followers, namely ratlb al-Haddad, which is often linked to one of the authors and Sufi from Hadrami, Sayyid 'Abd Allah ibn 'Alwt al-Hnddad. In the Indonesian Muslim community, the tradition of rending ratib al-Haddad is believed to have its roots in the tenchings of 'Alawiyyah order. In several regions, such as Bekasi, West Jvan and in the Betawi community, for example, the reading of ratibib al-Haddad has become a tradition that is passed down from one generation to the next, and which is included on various occasions, such as major Islamic days of remembrance, and other religions celebrations.DOI: 10.15408/sdi.v10i3.62

    Neo-Modernism: A Vital Synthesis of Traditionalist and Modernist Islamic Thought in Indonesia

    This paper is concerned with exploring the early stages of a new movement is Islamic thought in Indonesian society referred to by some as Islamic neo-modernism by focusing upon the lives and writings of the four seminal neo-modernist thinkers in Indonesia: Nurcholish Madjid, Djohan Effendi, Ahmad Wahib and Abdurrahman Wahid.Whilst the later work of these intellectuals, particularly Nurcholish and Abdurrahman, is reasonably well known the extend to which their current liberal, progressive thought reflects their convictions of two, or more, decades ago is not well understood.     Rahmah al-Yunusiyah was born on December 29, 1900 and grew up in an Islamic family in Padang Panjang in West Sumatra. His father was a religious functionary of the local Isalmic court (qadi) while her gran father was a shaykh of the Nagshabandiyyah sufi order. Her oldest brother, Zainuddin Labai al-Yunusi (1890-1924) was one of the great Islamic reformers in Minangkabau. In 1915, he established the Diniyah school, the first modern Islamic school in Indonesia. In that school, Zainuddin, among other things implemented the classical learning system, co-education and modern sciences at a time when most Islamic school were stil preoccupied with traditional Islamic science.DOI: 10.15408/sdi.v4i2.78

    Institutionalization and the Unification of Islamic Courts under the New Order

    This paper analyzes the influence of the ideology of Pancasila and developmentalism against Islamic law and its institutions, especially the judiciary Islam, during the New Order.During the New Order has many legal provisions that adopt Islamic law as national positive law. It is not limited to the field of law that has traditionally been a part of the Muslims, which is related to the family, but also the wider field: the new Law on Religious Education at every level of formal education, and Law no. 7/1992 on Banking. The latter recognizes the institution mudarabah (an agreement to share in the profit and loss of a business) as one of the functions of commercial banks in Indonesia. To set the new banking activities, has issued Government Regulation no. 72/1992 in which the new Shari'ah formally used as a reference.
