The Making of "the Burgundian kingdom"
What is usually called “the Burgundian kingdom” differed in various respects from the other “successor states” of the fifth and sixth centuries. It was not a territorial entity associated with a people (as was the case for the kingdoms of the Visigoths in Aquitaine and that of the Vandals in North Africa), but was rather a region of the later Roman Empire that was controlled by members of the Gibichung family who were put in post by the imperial administration in Italy, primarily by Ricimer, to whom they were connected by marriage. They were advised by Romans, including Sidonius Apollinaris, although in collecting his letters he appears to have deliberately downplayed his role, which is most clearly stated in his epitaph. The association of
the Gibichungs with the West Roman court ended with the elevation of Julius Nepos, but they continued to act as imperial agents down to the 520s

ITALIANO: Le decisioni contenute nel Liber Sententiarum del podestà di Milano relativo all’anno 1385 (oggetto di una recente pubblicazione) sono in grado di restituirci, sia pure in forma parziale e lacunosa, un’immagine piuttosto vivida dell’amministrazione della giustizia penale nella Milano viscontea. Le sentenze, per ciò che riguarda i reati di furto e rapina qui considerati, mostrano una non frequente incidenza di tali figure criminose e nel contempo (specie per quel che riguarda il furtum) la propensione ad
una decisa risposta repressiva da parte degli organi giurisdizionali comunali. L’analisi delle stesse ha
permesso altresì di formulare qualche ipotesi ricostruttiva intorno alle norme all’epoca vigenti, che sembrano essere sostanzialmente osservate dai giusdicenti. Nell’ambito di un avanzato fenomeno di ‘pubblicizzazione’ della giustizia punitiva (che si percepisce soprattutto nella sfera procedurale), non mancano tuttavia di emergere alcune tracce della sopravvivenza di una dimensione ‘negoziale’ del penale
che si estrinseca soprattutto nelle forme delle transazioni private intorno alla pena. / ENGLISH: The decisions contained in the Liber Sententiarum of the mayor of Milan, relating to the year 1385 and now published, give us, albeit in a partial and incomplete form, a vivid image of the administration of criminal justice in Milan during the Gian Galeazzo Visconti’s government. The sentences, as regards the crimes of theft and robbery considered here, show an infrequent incidence of such criminal figures and, at the same time (in particular as regards the furtum), the propensity for a decisive repressive response by the municipal courts. The analysis of the sentences also allowed us to formulate some reconstructive hypotheses around the rules in force at the time, which seem to be substantially respected by the judges. In the context of an advanced phenomenon of ‘publicization’ of punitive justice
(which is perceived above all in the procedural sphere), there are, however, some traces of the survival
of a ‘negotiated’ dimension of criminal law, which is expressed above all in the forms of private transac-
tions around the penalty

ITALIANO: Pietro da Prezza fu rinomato notaio e dictator attivo presso la corte dell'imperatore Federico II di Svevia e dei suoi successori. La Adhortatio è la sua opera più importante, scritta in conseguenza della battaglia di Tagliacozzo e della feroce esecuzione del giovanissimo Corradino di Svevia (1268), ordinata da Carlo I d'Angiò, che nel 1266 era già divenuto signore del Regno di Sicilia sconfiggendo Manfredi a Benevento (1266). Con la sua esortazione appassionata e raffinata incita il marchese Federico di Meissen, nipote di Federico II e parente più prossimo di Corradino, a rivendicare i suoi diritti sul Regno e a punire l'infamia di Carlo I d’Angiò, che aveva compiuto un misfatto inammissibile, contrario al diritto e alla religione. Leipzig, Universitätsbibliothek 1268, particolarmente attendibile e databile tra la fine del XIV e l'inizio del XV secolo. / ENGLISH: Petrus de Pretio was a renowned notary and dictator at the court of emperor Frederick II of Swabia and his successors. The Adhortatio is his most important work, written after the battle of Tagliacozzo and the ferocious execution of the young Conradin of Swabia (1268), ordered by Charles I of Anjou, who in 1266 had already become lord of the Kingdom of Sicily (after the battle of Benevento, in 1266). With his passionate and refined exhortation, he incites the Marquis Federico di Meissen, nephew of Frederick II and closest relative of Corradino, to claim his rights over the Kingdom and to punish the infamy of Charles I of Anjou, who had committed an inadmissible crime, against the law and the religion. The edition is based on the ms. Leipzig, Universitätsbibliothek 1268, particularly reliable and datable between the end of the 14th and the beginning of the 15th century
'In aliquibus locis est consuetudo': French Lawyers and the Lombard Customs of Fiefs in the Mid-Thirteenth Century
Jean de Blanot, the enigmatic Iacobus Aurelianus, and Jean Blanc de Marseille are the first known French lawyers trained in Italy to have shown interest in one of the most famous custumals in medieval Europe, the Lombard book of fiefs known by the name of Libri Feudorum. Considering that this compilation was increasingly gaining authority in the Italian law schools, this chapter shows how these three lawyers re-elaborated these teachings and compared (or opposed) them to local bodies of norms. By observing how they developed different notions of custom and argued about the validity of the Libri Feudorum outside Lombardy, the chapter unveils the problematic dialectics between Civil law, local custom, and practice, and provides some insights into the making of the ius commune, its practical and historical roots, its geographical dimensions
