Integrated Water Service Management and New Dimensions of Normativity
No full textThe article aims to analyze why market and competition rules continue to be regarded, within the Italian context, as the most suitable for ensuring the efficient management of an essential resource like water and all related services for its access and use by the community.
The study examines Italian legislation over the past thirty years concerning integrated water service management, highlighting how it has been steadly influenced by economic factors.
From a sociological-legal perspective, particularly considering the social origins of the concept of normativity, it is possible to envision forms of social organization and legal institutionalization for managing a collective resource like water that account for social instances beyond economic ones.L’articolo si propone di analizzare le ragioni per le quali le regole del mercato e della concorrenza continuano ad essere considerate, nel contesto italiano, le più idonee a garantire la gestione efficiente di una risorsa essenziale come l’acqua e di tutti i servizi connessi al suo accesso e al suo utilizzo da parte della collettività.
Il lavoro prende in esame la legislazione italiana degli ultimi trent’anni in tema di servizio idrico integrato evidenziando come essa sia stata costantemente influenzata prevalentemente da fattori economici.
La prospettiva sociologico-giuridica, considerando specificamente la genesi sociale dell’idea di normatività, può essere determinante per pensare a forme di organizzazione sociale e di istituzionalizzazione giuridica relative alla gestione di una risorsa collettiva come l’acqua che tenga conto della presenza di istanze sociali diverse da quelle economiche
Digital institutions made in EU and the paradox of a regulatory anti-normativism
No full textposizionamento dell’istituzionalismo digitale nel processo di integrazione europea, quanto ciò implichi l’adesione a modelli, regole formali e informali, procedure e prassi che stabilizzano tendenze all’interno di più ampie trasformazioni sociali. Esso si interroga essenzialmente su tre questioni: a) la plausibilità dell’ipotesi di un istituzionalismo digitale alla luce dei modelli di data governance; b) i suoi presupposti di applicabilità; c) i vantaggi nell’uso di tale nozione per comprendere la posizione.This article explores the phenomenon of European digital regulation by placing it at the centre of a broader process, that of digital institutionalism, in which the use of data, their regulation, and the management and ownership of digital infrastructures produce social, political and legal effects. By questioning the plausibility of this process as unprecedented, this contribution highlights some of its peculiar features in comparison to classical institutionalism. Digital institutionalism emerged with reference to the European Data Strategy, identifying practices and processes triggered by regulatory phenomena that make technology both an institutional driver and a limit to the regulatory capacity of existing institutions. From the perspective of legal sociology, this contribution investigates the positioning of digital institutionalism in the process of European integration, examining how much this implies adherence to models, formal and informal rules, procedures, and practices that stabilize trends within broader social transformations. It essentially questions three issues: a) the plausibility of the hypothesis of digital institutionalism in light of data governance models; b) its assumptions of applicability; and c) the advantages of using this notion to understand the position

No full textNel seguire le direttrici del cambiamento imposte dalle nuove tecnologie digitali, la pubblica amministrazione si trova dinnanzi a sfide impegnative che lasciano intravedere rischi e criticità i cui impatti ricadono inevitabilmente nel rapporto con i cittadini. In questo quadro, l’articolo considera alcuni aspetti di natura istituzionale che entrano nel dibattito sul rapporto tra diritto e nuove tecnologie, conducendo l’attenzione su quei meccanismi di automatizzazione che potrebbero far perdere di vista la riflessività della decisione giuridica.In navigating the change imposed by new digital technologies, public administration faces significant challenges that hint at risks and critical issues the impacts of which inevitably affect the relationship with citizens. Sí soy tu feminista gitana: del silencio a una revolución ruidosa
No full text“On 8M [2018] in Madrid they did try to be with the Asociación Gitanas Feministas por la Diversidad, but in the end the manifesto they read did not include our protests. We can’t go on a general strike because we don’t have jobs to go on strike”. The words of Silvia Agüero, a gypsy feminist who recovers the memory of the oppression of the gypsy community, revealed a flaw in the powerful feminist demonstration of 8 March 2018 and that continues to exist in white hegemonic feminism and with class and racial privilege, making us lose sight of the common problem of a capitalist system that hand in hand with patriarchy continues to dehumanise and keep all feminised subjects subjugated. Many of the members of the Asociación Gitanas Feministas por la Diversidad ask themselves if 8M belongs to them, if its history and genesis are not alien to the history of the Roma community, if they feel recognised in a demonstration that has its roots in Working Women’s Day. Exploring the feminist movement of recent years, the aim of this article is to observe how Antigypsyism in Spain is currently confronted by Romani women by analysing the main issues and strategies that emerge around the articulation between the feminist struggle and the struggle against Antigypsyism. From the theoretical perspective of intersectional feminism, the purpose of this work is to reveal the main themes around which Roma feminism builds its struggles and the different strategies—including artistic ones—that it employs to confront \u27payo\u27 feminism with its racial prejudices: pedagogy, denunciation, the call to action and the construction of networks and alliances.“El 8M [2018] en Madrid sí que intentó estar con la Asociación Gitanas Feministas por la Diversidad, pero al final en el manifiesto que leyeron no incluyó nuestras protestas. No podemos ir a una huelga general porque no tenemos trabajos para hacer huelga”. Las palabras de Silvia Agüero, gitana feminista que recupera la memoria de la opresión de la comunidad gitana, revelaron un fallo en la poderosa manifestación feminista del 8 de marzo de 2018 y que sigue existiendo en el feminismo hegemónico blanco y con privilegios de clase y raza, haciendo que se pierda de vista el problema común de un sistema capitalista que de la mano del patriarcado sigue deshumanizando y manteniendo sometidos a todos los sujetos feminizados. Muchas de las personas que forman parte de la Asociación Gitanas Feministas por la Diversidad se preguntan si el 8M les pertenece, si su historia y su génesis no son ajenas a la historia de la comunidad gitana, si se sienten reconocidas en una manifestación que hunde sus raíces en el Día de la Mujer Trabajadora. Explorando el movimiento feminista de los últimos años, el objetivo de este artículo es observar cómo el Antigitanismo en España es confrontado en la actualidad por las mujeres gitanas analizando los principales temas y estrategias que surgen entorno a la articulación entre la lucha feminista y la lucha contra el Antigitanismo. Desde la perspectiva teórica del feminismo interseccional, el propósito de este trabajo es desvelar los principales temas alrededor de los cuales el feminismo gitano construye sus luchas y las diferentes estrategias –incluso artísticas– que emplea para confrontar el feminismo ‘payo’ con sus prejuicios raciales: la pedagogía, la denuncia, la llamada a la acción y la construcción de redes y alianzas

Abduction and Seduction, Farewells and Reunions: Rinaldo and Armida Between Painting and Opera
No full textEssendo due delle figure centrali all’interno della Gerusalemme liberata di Torquato Tasso, non sorprende che Rinaldo e Armida abbiano goduto di larga fortuna rappresentativa in due arti sorelle della letteratura, la pittura e l’opera lirica. Un processo di riproposizione pressoché continuo, favorito dal fatto che la vicenda che vede protagonisti i due personaggi tassiani sia una storia d’amore dalle tinte tragiche e sensuali, caratteristica che non poteva che destare vasto interesse in molti maestri pittorici e librettisti operanti tra XVI e XIX secolo, stimolandone la creatività. Attraverso un esame delle ottave che narrano la storia d’amore tra il crociato Rinaldo e la maga Armida, il presente contributo intende fornire alcuni dati descrittivi e statistici preliminari relativi agli elementi che – nel passaggio dalla Liberata alla tela e al libretto d’opera – sono stati da un lato accolti, dall’altro rifiutati (oppure, terza via, rimescolati e mutati secondo il gusto di un determinato artista). Rinaldo and Armida are two of the main characters in Torquato Tasso’s masterpiece Gerusalemme liberata. It is therefore not surprising that they achieved great success in two other art forms, in addition to literature: painting and opera. From the 16th to the 19th century, the representation of the tragic and sensual love story between the crusader Rinaldo and the sorceress Armida aroused great interest among many painters and librettists. Through an investigation of the octaves recounting their love story, this essay aims to provide some preliminary descriptive and quantitative data on the elements that – during the transition from the Liberata to painting and opera – were accepted, rejected, or modified by artists and librettists
