This article is based on the emergence of the Supreme Court Regulation on Mediation in order to change the image of the Religious Courts from judicial paradigm to dispute resolution paradigm, including in divorce cases. The mediation in the case is imperative and the denial of mediation process in the court results in the cancellation of the decision by law. This study concludes that the alignment of the Kalisat community towards local mediation is much more due to non-legal factors which are categorized into elements of legal culture than to structural elements or legal substances. The legal culture element that is intended for example concerns the understanding of the Kalisat community on the teachings of their religion, their perceptions of the proceedings in the Religious Court in resolving divorce cases, or other factors such as the emotional closeness between them and community leaders who are local mediators

This study takes up the challenge of investigating Ibn KhaldÅ«n’s concept of tasawuf by relating it to his overwhelming idea of al-‘UmrÄn. The man has been widely known for his innovative assessment on various issues relating to society, organization, civilization and above all, forms of knowledge. He has been acknowledged as a pioneer and father of modern sociology. Nonetheless, little has been done to study his thought on Sufism and how this form of knowledge works in social context. Ibn KhaldÅ«n himself has not worked out to explain this problem. But one may reconstruct it within his comprehensive concept of al-‘UmrÄn, which is understood by some as a form of theories on social organization. It is toward this aim that this study is carried out. It argues that in Ibn KhaldÅ«n’s mind, tasawuf a) is part and parcel of his notion of social organization without which a society may not emerge; and b) society has its roots not only in material, civilisational and biological needs of both man and society, but also in their spiritual needs. This spiritual need in its turns is the very motives why many undertakes spiritual quest. It is also, socially speaking, the raison de’etre for social cohesion to emerge. Hence, Ibn KhaldÅ«n’s sociology of tasawuf as it were, has its epistemo-logical underpinning in his implicit idea of spiritual cohesion in society. &nbsp

However, the value of tolerance is not taught formally like other subjects, but rather developed through informal learning and examplary model by the kyais in both pesantrens. As the kyais in both pesantrens have inclusive views and tolerant attitudes in the context of pluralistic society, the students learn from their tolerant views and attitudes, and adopt this value in their daily activities. Using Coleman’s rational choice theory, it can be argued that the kyais of both pesantrens have consciously adopted the value of tolerance as one of the important instructional values. Therefore, it can be concluded that pesantren is the place of seeding the values of tolerance, while the learning design used by pesantrens can be called “tolerance exhibition modelâ€

    No full text
The article seeks to analyze the transaction of vegetables through wakālah method in Krisik Village Ponorogo from Islamic legal perspective. Wakālah requires four important elements: the person who gives a trust (muwakkil), the trustee (muwakkal or wakīl), the deed (muwakkal fīh), and the transaction statements (ijāb-qabūl). The transaction of vegetables in Krisik Village is done in an unusual way. In many areas, the brokers usually buy all farmers’ crops at once and pay for the farmers in-cash. In Krisik Village, the brokers, however, first of all, sell farmers’ vegetables into markets. The brokers will pay the farmers for their vegetables afterward. It means that the brokers do not pay for the farmers in-cash. It is also found that the farmers and brokers in Krisik Village make an uncommon agreement ('aqd), in which they agree to reduce the scale. The practice seems to violate a number of Quranic verses, which ask people to enhance the scales. Such a practice of reducing scale has been a "common agreement" among the Krisik people for decades. On the one hand, the practice aims at preventing the brokers from loss, while on the other the farmers do not feel aggrieved from the reduction of the scale
