    Role of Law Influences on Modern Lifestyle Issues In Indonesia and Malaysia

    The world has evolved, cultural influences have been acculturated into a world that is very universal. The influence of western culture is becoming increasingly difficult to be limited. Modern style has taken many forms in the lives of the citizens of the country. Modern culture is a big trend that has a variety of political, social, cultural and technological. One of the modern lifestyle that is unhealthy has caused illness and even premature death. Some existing laws in order to prevent and strategies to deter have been made but the condition still prevails. As a result of unhealthy lifestyles lead to poor public health in the future. This research tried to focus on the role of law in limiting the influence of modern lifestyle related with fast food and smoking as a lifestyle in Indonesia and Malaysia. The methodology of sociological jurisprudence is edopted by connecting aspects of normative and sociological. The results of this study will describe the extent to which the laws of both countries control the culture of modern life. The Findings show aggresive laws must be in place to prevent and mitigate the consequences of the impact of lifestyle and improve public health and awareness in the future

    Analysis of Impact Air Pollution in Urban Environmental over Bogor, Indonesia

    Air pollution is very dangerous for human activity especially in the Bogor, Indonesia. The status of air pollution index in this state is dangerous over several years ago. In Indonesia, an environmental impact assessment is contained in law no. 23 of 1997 on Environmental Management and Implementation set out in Government Act no 27 of 1999. The environmental impact assessment was defined as a tool to ensure sustainable development through the effects main activities. The government policy in Bogor, Indonesia was controlled air pollution based on regulation law No. 4 (2007) and No. 9 (2012). This act described environmental and waste management, respectively. Thus, this study aimed to analyse urban environment health over Bogor Area using quantitative methods. Results showed the increasing index of air pollution over Bogor, Indonesia were impact on human health, air quality and noise pollution. There is legislation in Bogor downtown use to study positive and negative effects in the planned projects, the government in determining whether a project is feasible or not feasible. The study prepared by considering the physical, chemical, biological, socio- economic, socio- cultural, and public health condition, respectively

    Implication of Liquidation Method to Recovery Rate and Residual Asset: The Case of Rural Banks in Indonesia

    Bank liquidation is one method of bank resolution conducted by resolution authority. The bank's resolution occurs when the authority establishes a bank declared/tends to fail and there is no private sector intervention that can restore the bank's ability in a short time for normal procedures. This study aims to explain the application of liquidation on rural banks liquidated by Deposit Insurance Corporation. Indonesia (IDIC) as well as its implications for recovery rate and residual assets resulting from the liquidation process. The methodology in this research is qualitative and the nature of this research is descriptive analysis. The authors used two different types of sources. First, direct observations to IDIC office. Second, Semi-structured interviews were conducted with the chairman of liquidation team of rural banks, the official of IDIC and Auditors who engage audit on or attestation on the liquidated bank, which time informal interviews were conducted, and documents were also collected. Based on the result of this research, it is concluded that with the implementation of liquidation method, there are critical issues that require IDIC attention, such as the fraud rate that occurred before the bank was liquidated, time of submission of problem banks from Bank Supervisory Authority (BSA) to IDIC, and decrease of asset quality and flow of documentation and information of failed bank, personnel readiness, supervision, handling of liquidation assets and limitations of liquidation guidelines. The critical problem faced above will ultimately affect the recovery rate and residual assets after the liquidation process ends

    Religion, Tradition and Transcendental Communication of Coastal Communities: Formulation of Religion and Culture in the Nadran Ritual

    One of the traditions of coastal community is nadran which is also known as larung laut or sedekah laut. This ritual uses to express gratitude to God Almighty on seafood and a prayer for asking prosperity and safety by fishermen. This ritual is begun by a puppet show, the slaughter head of male buffalo, then floated into the sea along with other substances. Coastal communities believe the buffalo head float procession is as sacred and holy that must require meeting the circumstances before and during the ritual. Otherwise, a supernatural consequence will occur. Even though the symbols use in the ritual do not imply the Islamic concept, the transcendental meaning of the symbol in a ritual philosophy interpret as the power of God. However, in the Islamic concept, it does not require the symbol to express it. Thus, based on the theological, those symbols contradict with the Islamic concept. Despite, it is it is understood that the ritual is a cultural reflection only and fluidity or flexibility of culture and religion. Therefore, there is also a mystical dimension and local belief in this tradition. The Nadran ritual shows an acculturation between local tradition and religion is harmony. The symbols used in this tradition are pre-Islamic heritages that are inherited from generation to generation. However, the meanings of such symbols refer to the transcendental meanings based on the theology and Islamic concept that express the culture. This article is a result of field research using the ethnographic method with the descriptive qualitative design based on anthropological perspective. The structural-functional approach is employed for analyzing the data. Library research, participant observation, and in-depth interview are used to collect the data

    The Development of Health Tourism Industries in Malaysia

    Health tourism industry in Malaysia was introduced in 1998. The industry is growing rapidly so it has generated a profit of RM730 million in 2014 and the number of tourists as many as 790,000 people. Currently, Malaysia has become one of the best countries in the Asia Pacific region in the health tourism industry so it can compete with developed countries such as US, UK, Costa Rica, Japan, Brazil and Singapore. There are several factors that affect the progress of health tourism industries in Malaysia for examples, all doctors including health professionals have competent international level, high-tech medical equipment, medical costs are very affordable, all health workers in Malaysia can communicate in English effectively and hospitals in Malaysia has achieved the best quality of the MS ISO 9002, Malaysian Society for Quality of Health (MSQH) and the Joint Commission International (JCI). However, the progress of the health tourism industry in Malaysia is not only caused by the availability of hospital facilities, advanced health technologies and expertise of the doctor. Other aspects also have an important role, although not directly related to health care, for example, the role of the health law to establish standards of quality health services so that doctors can work professionally, carefully, cautiously and not negligent in performing his duties. Malaysia’s one of the countries where the number of medical negligence slightly compared with other countries such as UK and US. This could increase the confident of international patients who will be treated to various hospitals in Malaysia and automatically Malaysia's reputation in the health tourism industries will getting better. When a case of medical negligence in Malaysia cannot be controlled, then this condition will damage the country's reputation, doctors, hospitals and will affect the confidence of foreign tourists who will perform the treatment in Malaysia

    Filipinazion of Indonesian Politics: Politics of Family Formation in Southeast Sulawesi

    In the post-colonial countries, a like Indonesia, a democratic political system is considered the best choice to govern. However, although Indonesia has become the third largest democracy in the world, yet still have a family politics entrenched and practiced in modern political system. In the emerging Indonesian democracies, however, family, patronage, nepotism and dynasty are also key ingredients within these politics. Some reflect generations-long traditions of political power, whilst others are generated by the opportunities presented by the democratic and electoral process itself. This paper attempts to investigate the process of the emergence of a political dynasty and how political dynasty was maintained power in Southeast Sulawesi. By using qualitative research methods, it was found that local elections as instrument for maintained and retained his power in local election, especially in Southeast Sulawesi. The victory achieved by the political families in the political contest is caused by several factors. Each political family able to maintain the loyalty of supporters, even from time to time they were able to expand the number of constituents. For a political family, they are easy to take advantage of his position with a number of manipulation and pressure. Various forms of public policy and programs manipulated as his success, intervention in selecting the electoral officer and staffs, the politicization of the bureaucracy, money politics and thuggery. The family of politicians also trying to extended their power through the assimilation process (family wedding) between politicians in a region with politicians from other regions

    Islamic Criminal Law explains criminal offence and the punishments based on Islamic Law. The aim of Islamic criminal law is to maintain peace in the societies, whether for Muslim and non-Muslim, and reform the offenders. Running the Islamic criminal law is the right of every Muslim. The Indonesian Constitution guarantees the citizen’s freedom to run their own religion. In this context, running Islamic criminal law is part of Islamic religion. The objective of this paper is to know the opportunities of the application of Islamic criminal law according to Indonesian Constitution. This qualitative study will analyze the library data by referring to the books, the regulation in Indonesia and other sources that support this issue. Thus this paper is expected to generate the information about the possibility of the application of Islamic criminal law in Indonesia according to the Indonesian Constitution which is the highest law in Indonesia

    Since halal tourism becoming way of life for Muslim and non-Muslim in this world, Indonesia as a country with the largest Muslim population and have super spectacular scenery have to show up among other countries which provides halal tourism packages such as Malaysia, Japan, Thailand, Dubai, and etc. The Global Muslim Travel Index 2015 report noted that the tourist segment was worth US145billion,with108millionMuslimtravellersrepresenting10percentoftheentiretraveleconomy.Itisexpectedtogrowinworthto145 billion, with 108 million Muslim travellers representing 10 percent of the entire travel economy. It is expected to grow in worth to 200 billion with 150 million travellers by 2020 (thejakartapost.com, 2015). This fact makes halal tourism as a very potential market for some countries-even some countries with small Muslim population highly interested in offer halal tourism packages. HatiIndonesia.tr is the first halal travel guidance application in Indonesia. It will help halal travel seekers to find halal destinations, hotels, restaurants, mosques and also other features such as prayer time, qibla directions, and etc. By using HatiIndonesia.tr, all halal tourism sector will be integrated into one pack of wonderful application. HatiIndonesia.tr will give a hub for halal travel seekers with halal tourism providers. Halal tourism providers mean all vendors from micro, small, and medium enterprises to a huge vendor in form of company. Hopefully, by the existence of this application, tourism in Indonesia could be better prepared to compete in the ASEAN and also in globe’s sphere.     Fairness of Performance Evaluation Procedure on Job Performance; The Model of Outcome and Non-Outcome Based Effects

    This study was carried out to analyze the fairness of performance evaluation procedure on job performance. In particular, the study examined the following models: (1) the direct and indirect effects of procedural fairness on job performance through outcome based effect (distributive fairness); and (2) direct and indirect effects of procedural fairness on job performance through non-outcome based effect (organizational commitment and job satisfaction). The study applied a survey method with the survey subject of regent and municipal civil servants of Lampung Province. Samples determination was based on a purposive sampling technique. The study collected 204 respondents, consisting of structural officers of Satuan Kerja Perangkat Daerah (SKPD) with service term at least one year at their office. Analysis on the data used a Structural Equation Model (SEM) operated under AMOS application program. Results of the study concluded as the followings: a direct effect of fairness of performance evaluation procedure on distributive fairness, organizational commitment, job satisfaction. Such condition affected job performance. However, the direct effect of fairness performance evaluation procedure on job performance proved insignificant. The results also showed an indirect effect fairness of performance evaluation procedure on job performance through non-outcome based effect (organizational commitment and job satisfaction), but indirect effect through outcome based effect (distributive fairness) proved insignificant

    The Overview of Employee Management in Medical Record Division toward Employee Performance at Bina Kasih Pekanbaru Hospital

    The management function of POACE (Planning, Organizing, Actuating, Controlling, and Evaluation) is a system which cannot be separated from hospital management. Therefore, the whole division or unit in hospital should apply the management function itself particularly in medical record division. However, the issue appears on this research is the employee of medical record at Bina Kasih Pekanbaru Hospital conduct a double job or extra work, so that, the employee of medical record cannot focused in carry out their duty and pileup of medical records file in assembling activities. This research aim to know about the employee management in medical records division toward employee performance at Bina Kasih Pekanbaru Hospital. This research employs qualitative method and analyzed the data by inductively. Data collected by observation and in-depth interview to seven informants. The result of this research found that the employee management in medical record division does not run as expected, in which the human resource planning has not been met optimally, the organizing still using duplicate work (double job), the implementation is not accordance with SOP, the controlling and evaluation has already quite well by conducting customer satisfaction survey. Suggestion, the management of Bina Kasih Pekanbaru Hospital should increase their number of employee in medical records division, conduct training and control and evaluate their performance continuously and sustainably
