Authority of Procurement and Maintenance of Traffic Facilities and Infrastructure on National Roads
Law 32 of 2004, regional autonomy, mandates the improvement of community services and regional equity by encouraging community participation. Meanwhile, Law 22 of 2009 on road traffic and transportation mandates the maintenance of traffic infrastructure, particularly The Road Traffic Signaling Devices (APILL) on National Roads, National with Provincial Roads intersection, and National with Regency/City Roads intersection to BPTD–The representative of the Ministry of Transportation. In practice, all maintenances are by Regency/City Transportation Service, including the maintenance of the Traffic Signaling Device (APILL) at National and Provincial Roads intersection with Regency/City Roads. The study aims to evaluate Law 22/2009 and its implementing regulations. Besides, This study also attempts to determine the implementation of Traffic Signaling Devices (APILL), including its procurement and maintenance. The research method was legal research. It involved investigating related regulations to the problem under study. The study concludes the maintenance implementation of traffic signaling devices (APILL) is the best fit for the Regency/City Transportation Service. In addition, it is necessary to revise the governing rules for maintaining traffic infrastructure, the traffic signaling devices (APILL)
The Court Role in Providing E-court System Education to Community: Post-Enactment of Supreme Court Regulation Number 1 of 2019
The judicial system in Indonesia has now begun to adapt to the developments in information and technology to improve court case administration services which are realized through the digitization of court cases or known as the electronic justice system (e-court). E-court is a case processing service. It involves registration, payment of fees, and court summons via electronic media and online. The implementation of e-court in Indonesia is based on supreme court regulation No.1 of 2019 on Electronic case and trial administration in courts. This e-court system is designed to create an effective, efficient, and cost-effective Indonesian justice system for justice seekers. However, the lack of public understanding of the e-court system becomes an obstacle to implementing an e-court system in Indonesia. This research aims to analyze how the role of the court in socializing the e-court system to the public as an effort to improve case administration services in court. The research employed normative legal research and a literature study approach with the secondary assessment of legal materials and juridical data analysis. The findings revealed that the current courts are still working to improve technology-based court administration services (e-court) to the public by providing explanations and education through the official website of state court accounts spread throughout Indonesia. In addition, the court has also massively socialized the implementation of the e-court system to the public, advocates/lawyers, and court officials via online and offline. Unfortunately, for people who wish to litigate electronically at this time, it can only be done by cooperating with advocates/lawyers who have e-court access
The Government’s Prevention Efforts on Violence Against Women Human Rights Perspective
Women are vulnerable to discrimination or violence from other parties. Accordingly, the government needs to make various efforts to protect women's rights and to prevent violence. The study aims to examine the factors and the government's prevention efforts to violence against women. The study employed the normative-juridical method. The study found some factors causing violence against women, such as an individual, partner, socio-cultural, and economic factors. Meanwhile, the governments' efforts cover increasing cooperation with National Commission on Violence against Women and other stakeholders, disseminating various laws and regulations on women's legal protection, advocacy, and women empowerment
Polemics on Interfaith Marriage: Law and Civil Law Perspectives
Marriage is seen as a bridge to a long journey that has shared visions and missions. We can not recklessly hold a wedding. There are a few things to be considered. Umumnya adalah budaya dan agama yang menjadi sorot utama ketika pemuda pemudi atau calon mempelai pria dan wanita akan melangsungkan pernikahan. Budaya merupakan hal yang juga akan dibawa ketika acara pernikahan akan dilangsungkan. Generally, culture and religion become the highlight once man and woman or prospective brides and grooms plan to get married. Culture is presented on the wedding day. However, a different culture is not allowed or prohibited. This also applies to religion. It becomes an important matter to consider before marriage. Marriage must be carried out according to each partner's religion. Thus, it is considered valid. In general, marriages are held in the same religion. However, this study will discuss massive interfaith marriages done by young people in Indonesia. The study employed a literature approach. This approach requires more reading and collecting library data. The findings generated new ideas in civil matters, the registration of interfaith marriages and the challenges of holding such marriage. The Effectiveness of Law Enforcement on Illegal Logging Based on the Value of Justice
Forests are the lungs of the earth that contribute to environmental balance. In practice, the enforcement of environmental law through various regulations, such as Forestry Law, has brought both positive and negative impacts. This study aims to find out the regulations on illegal logging and to identify the effectiveness of law enforcement on illegal logging based on the value of justice. This study was conducted in Kuningan District Regional Government, Ciremai Mountain National Park (TNGC), Kuningan District Forestry Service, Kuningan District Court, Kuningan District Police Office, and Kuningan District Prosecutors Office. This qualitative study applied an empirical juridical or socio-legal approach in order to find data relating to law enforcement on illegal logging as well as preventive and repressive actions based on justice values carried out by law enforcement officials in Kuningan District. The results showed that Illegal logging is regulated in Law No. 41 of 1999 concerning Forestry and Law No. 18 of 2013 concerning Prevention and Eradication of Forests Destruction as well as the Supreme Court Circular No. 01 of 2008 concerning Guidelines for Handling Forestry Criminal Cases. Yet, there is no Kuningan District regulation that specifically regulates illegal logging. Further, the effectiveness of law enforcement on illegal logging in Kuningan District can be seen in terms of its legal substance, structure and culture. Efektivitas Penegakan Hukum Illegal Logging Berbasis Nilai Keadilan Hutan merupakan paru paru dunia yang berkontribusi terhadap keseimbangan lingkungan. Penegakan hukum lingkungan melalui berbagi regulasi seperti undang undang kehutanan telah banyak memiliki nilai positif dalam prakteknya, akan tetapi juga ada nilai negatifnya Peneliti melakukan penelitian yang berjudul “ Efektivitas Penegakan Hukum Illegal Logging Berbasis Nilai Keadilan (Studi Di Kabupaten Kuningan) ” Lokasi penelitian dilakukan Kabupaten Kuningan yaitu pemerintah Daerah Kabupaten Kuningan, TNGC, Dinas Kehutanan Kabupaten Kuningan, Pengadilan Negeri Kuningan, Kepolisian dan Kejaksaan Negeri Kuningan. Tujuan penelitian adalah untuk mengetahui pengaturan mengenai illegal logging saat ini serta bagaimana penegakan hukum illeggal loging Kabupaten Kuningan. Metode yang dipakai oleh peneliti dalam penelitian ini adalah metode kualitatif dengan pendekatan yuridis empiris atau sosio legal dengan cara melakukan penelitian lapangan untuk mencari data mengenai penegakan hukum illeggal logging di Kabupaten Kuningan serta tindakan preventif dan represif yang dilakukan oleh aparat hukum berbasis nilai keadilan. Hasil Penelitian yaitu pengaturan Illegal logging diatur dalam Undang Undang Undang Undang No.41 Tahun 1999 Tentang Kehutanan dan Undang Undang No.18 Tahun 2013 Tentang Pencegahan dan Pemberantasan dan Perusakan Hutan sedangkan dalam peraturan lainya juga terdapat dalam Surat Edaran Mahkamah Agung No.01 Tahun 2008 Tentang Petunjuk Penanganan Perkara Tindak Pidana Kehutanan Sedangkan di Kabupaten Kuniningan belum ada perda tentang Illegal logging, Selanjutnya Efektivitas penegakan hukum illegal loging di Kabupaten Kuningan berdasarkan hasil penelitan dapat dilihat Dewan Perwakilan Rakya
The Effectiveness on the Realization of the Government Internal Supervisory Apparatus Function to the Implementation of Regional Government
This paper aims to analyze the importance of supervisory function in ensuring the government effectiveness and efficiency in the realization of good governance principles. The government internal supervisory apparatus is an authorized institution or agency. In the application of supervisory function in regional government, they must be able to carry out its duty properly based on the prevailing laws and regulations. This study employed juridical-empirical method. The results showed the duties and the function are stipulated on the Government Regulation Number 60 of 2008, the government internal control system which includes the audits, reviews, evaluation, monitoring, and other supervisory activities. In addition, it is also stated in the Regulation of the Ministry of Home Affairs Number 64 of 2007, the technical guidelines and the working procedures of the provincial and regency/city inspectorate. The conclusion is the role of the government internal supervisory apparatus often faces some problems in doing their duties and functions. For instances, rampant corruption cases committed by regional officials making the effectiveness of the role of the government internal supervisory apparatus being questioned. Furthermore, their low capability and the independence issues encountered by regional government hampers the performance of the Government Internal Supervisory Apparatus which is directly responsible to regional head. This practice also seems to be able to reduce the objectivity and the independence of the regional government of internal supervisory apparatus in doing their supervisory dutiesTujuan dari penulisan ini yaitu untuk menganalisis fungsi pengawasan menjadi sangat penting dalam menjamin penyelenggaraan pemerintah yang efektif dan efisien untuk mewujudkan asas tata pemerintah yang baik (good governance). Aparat Pengawas Intern Pemerintah sebagai institusi atau lembaga yang berwenang dalam menjalankan fungsi pengawasan di pemerintahan daerah harus mampu melaksanakan fungsi pengawasan tersebut dengan baik sesuai dengan peraturan perundang-undangan yang berlaku . Metode penelitian yang digunakan yaitu yuridis empiris. Hasil penelitian menunjukan bahwa tugas dan fungsi diatir oleh Peraturan Pemerintah Nomor 60 Tahun 2008 tentang Sistem Pengendalian Intern Pemerintah, melalui audit, reviu, evaluasi, pemantauan, dan kegiatan pengawasan lainnya dan Peraturan Menteri Dalam Negeri Nomor 64 Tahun 2007 tentang Pedoman Teknis Organisasi dan Tata Kerja Inspektorat Provinsi dan Kabupaten/Kota. Simpulan bahwa Peran Aparat Pengawas Intern Pemerintah kerap kali menghadapi kendala-kendala dalam melaksanakan tugas dan fungsinya. Salah satunya adalah mengenai kasus korupsi yang marak dilakukan oleh pejabat daerah, menyebabkan dipertanyakannya efektivitas peran pengawasan Aparat Pengawas Intern Pemerintah Daerah. Selain itu, kapabilitas Aparat Pengawas Intern Pemerintah yang rendah dan masalah independensi yang dihadapi oleh Aparat Pengawas Intern Pemerintah Daerah menghambat kinerja Aparat Pengawas Intern Pemerintah yang secara langsung bertanggung jawab kepada kepala daerah. The Roles of Bank Indonesia and Financial Services Authority as Rural Banks’ Supervision Agency
Banks are financial institutions to collect and distribute funds to the public. As a public trust institution, the banks must maintain the public trust. In doing so, it is needed a supervision agency called Bank Indonesia. The purpose of this study is to see and to analyze the roles and the responsibilities of Bank Indonesia as rural banks’ supervisory agency based on law No. 3 of 2004, Bank Indonesia and Act No. 21 of 2011, financial services authority. The writer employed a normative juridical approach by understanding, testing, and reviewing the secondary data. This research was a descriptive analysis describing the prevailing laws and regulations related to the authority of Bank Indonesia as a rural bank’s supervision agency. The result of the research showed the roles of of Bank Indonesia and Financial Services Authority as rural bank supervisors were not aligned with the law provisions stipulated in Bank Indonesia article 27, a direct and indirect supervisions. Meanwhile, based on Article 28 of Law No. 21 of 2011, Financial Services Authority. The role of the Financial Services Authority in the legal protection of the consumer was not limited to facilitating the consumer protection. For instances, it is not only to accomodating and becoming a mediation institution but also becoming an institution that sides the consumers and society in the legal defense activities. As the central bank, bank indonesia is responsible for the case happening in Rural banks by putting it under a special supervision bank. In addition, if the rural bank is unable to improve its financial condition within a specified time, it will be declared as a failed bank and its business license will be revoked. The forms of protection, on the other hand, undertaken by the Financial Services Authority covers the prevention protection of violation and restoration of consumer rights if for instance the consumers suffer losses.Bank merupakan lembaga keuangan yang menghimpun dan menyalurkan dana ke masyarakat. Sebagai lembaga kepercayaan masyarakat, bank harus dapat menjaga kepercayaan masyarakat, untuk menjaganya maka diperlukan badan pengawasan yaitu Bank Indonesia. Tujuan penelitian ini untuk mengetahui dan menganalisis peranan dan tanggung jawab Bank Indonesia sebagai badan pengawas terhadap Bank Perkreditan Rakyat berdasarkan Undang-Undang No 3 Tahun 2004 Tentang Bank Indonesia dan Undang-undang no 21 Tahun 2011 tentang Otoritas Jasa Keuangan. Metode pendekatan yang digunakan oleh penulis adalah metode pendekatan yuridis normatif dengan memahami, menguji, dan mengkaji data sekunder. Penelitian ini bersifat deskritif analisis, menggambarkan peraturan perundang-undangan yang berlaku dan berkaitan dengan Bank Indonesia terhadap kewenangannya sebagai badan pengawas kepada Bank Perkreditan Rakyat. Hasil penelitian adalah Peranan Bank Indonesia dan Otoritas Jasa Keuangan sebagai pengawas dan pembina terhadap Bank Perkreditan Rakyat belum sesuai dengan yang ditetapakan Undang-Undang Bank Indonesia Pasal 27 yaitu mengenai pengawasan langsung dan pengawasn tidak langsung. Sementara berdasarkan Pasal 28 Undang-Undang No. 21 Tahun 2011 tentang Otoritas Jasa Keuangan, Otoritas Jasa Keuangan peran Otoritas Jasa Keuangan dalam sistem hukum perlindungan konsumen tidak terbatas hanya dengan memfasilitasi perlindungan konsumen yakni menampung dan menjadi lembaga mediasi tetapi juga menjadi lembaga yang berpihak kepada konsumen dan masyarakat dalam bentuk kegiatan pembelaan hukum. Bank Indonesia sebgai Bank sentral bertanggung jawab terhadap kasus Bank Perkreditan Rakyat dengan memasukkan bank tersebut ke dalam Bank Dalam Pengawasan Khusus. Pada waktu yang telah ditentukan Bank Perkreditan Rakyat tidak dapat memperbaiki kondisi keuangannya. Bank Perkreditan Rakyat dinyatakan sebagai bank gagal dan dicabut ijin usahanya. The Dialectics of Garuda Totem and Covid-19 Totem in the Constitution of Indonesia
This paper aims to determine to what extent Garuda totem is faced with covid-19 totem in the constitution of Indonesia. It begins with the pandemic hit a worldwide including Indonesia, all countries are busily making effective policies. Reviewing the existing policies, the president and the regional heads have an extraordinary role. A well-saying that the king can do no wrong while carrying out his policies. Many issues concerning the existence of Garuda totem are currently being in the spot light. Thus, this study focuses on the discussion upon the struggle of Garuda totem over the new totem that has changed the policy arrangement in Indonesia. A normative legal research method sets as a basis for conducting an analysis. The struggle made the existence of Garuda totem hits a polemic in the indonesian constitution. This so-called totem does not just apply on religious values. The state even has its respective totem as a form of sacredness for its people. The research result on the consenquences of Garuda totem, holding the shield of Pancasila and setting its feet on Indonesia’s diversity, are indicating an inseparable bondage for the king of the country and the king of the region during 2019-nCoV which befell the worldwide, particularly Indonesia. In addition, the national emblem, Garuda Pancasila, is not just an ordinary image. It has a meaning that is coming from Indonesian cultures. It has a sacred value (holy) that must be protected and maintained its dignity by everyone who claims to be the citizens of Indonesia. This is to signify an ethic of showing the love for the country. Lastly, in order to avoid the threats to Garuda totem, the state is required to be more careful in making policiesTujuan dari penulisan ini yaitu untuk mengetahui sejauh mana totem Garuda dihadapkan pada totem Covid-19 dalam ketatanegaraan Indonesia. Berawal dari adanya pandemik yang melanda dunia termasuk Indonesia, semua negara disibukan untuk segera mengambil kebijakan-kebijakan yang efektif. Melihat kebijakan-kebijakan yang ada menempatkan Presiden dan Kepala Daerah memiliki peran yang sangat luar biasa dan dapat dikatakan sebagai the king can not do wrong dalam menjalankan kebijakannya. Permasalahan-Permasalahan yang berkenaan dengan keberadaan totem Garuda saat sekarang banyak disoroti, fokus pembahasan mencoba mengkaji pergumulan totem garuda atas totem baru yang merubah tatanan kebijakan di Indonesia. Metode penelitian hukum yang bersifat normatif sebagai pijakan dalam melakukan analisis. Adanya pergumulan atau pertarungan yang menjadikan keberadaan totem Garuda mengalami polemik dalam ketatanegaraan Indonesia. Apa yang dinamakan sebagai totem sendiri rupanya bukan hanya berlaku pada nilai-nilai keagamaan saja, bahkan sekelas negara memiliki totem masing-masing sebagai bentuk kesakralan bagi masyarakatnya. Hasil penelitian Konsekuensi totem Garuda yang memegang perisai Pancasila dan menapakan kakinya pada kebhinekaan Indonesia, sebagai bentuk ikatan yang tidak terpisahkan bagi raja negara maupun raja daerah pada saat adanya 2019-nCoV yang menimpa dunia dan Indonesia khususnya. Labang Negara yaitu Garuda Pancasila bukan hanya sebuah gambar yang biasa saja, mempunyai makna yang lahir dari budaya-budaya Indonesia, memiliki nilai sakralitas (suci) yang wajib di lindungi yang harus dipertahankan martabatnya oleh setiap orang yang mengaku sebagai warga Indonesia untuk menandakan sebuah etika yang menunjukan rasa kecintaan terhadap tanah air. The Comparison of Criminal Acts Formulation of Religion, Religious Life, and Worship Facilities: Draft of Indonesian Criminal Code and the Penal Code United Kingdom
This paper compares the policy formulation/legislation of criminal acts of religion, religious life, and worship facilities based on the new draft of Indonesian Criminal Code (RKUHP) and the Penal Code United Kingdom of 2008. This study was conducted using normative juridical methods and comparative law. The type of data employed in this study focuses on secondary data namely primary legal materials, secondary legal materials and tertiary legal materials. The data were collected through documentation and literary studies. Meanwhile, the data analysis method used in this study is qualitative and descriptive. The findings revealed the religion is fundamental and important in all aspects of human life in Indonesia. The result also showed the policy formulation/legislation of criminal acts of religion, religious life, and worship facilities stipulated on the draft of national criminal code (RKUHP) July 2018 refer to the development of policy formulation/legislation called blasphemy in England. Tulisan ini membandingkan kebijakan formulasi/legislasi mengenai tindak pidana terhadap agama, kehidupan beragama dan sarana ibadah dalam Rancangan Kitab Undang-Undang Hukum Pidana Indonesia (RKUHP) yang baru dengan Kitab Undang-Undang Hukum Pidana Inggris (The Penal Code United Kingdom) tahun 2008. Penelitian ini ditempuh melalui metode penelitian yuridis normatif dan perbandingan hukum. Jenis data yang dipergunakan pada penelitian ini dititkberatkan pada data sekunder yang terbagi dalam bahan hukum primer, bahan hukum sekunder dan bahan hukum tertier. Adapun pengumpulan data pada penelitian ini dilakukan dengan studi dokumentasi dan studi kepustakaan sedangkan metode analisa data yang dilakukan pada penelitian ini bersifat kualitatif dan deskriptif. Hasil penelitian menunjukan bahwa agama merupakan hal mendasar atau hal yang fundamental dan bersifat penting dalam seluruh aspek kehidupan manusia di Indonesia. Hasil penelitian juga menunjukan bahwa kebijakan formulasi/legislasi mengenai tindak pidana terhadap agama, kehidupan beragama dan sarana ibadah sebagaimana diatur dalam Rancangan Kitab Undang-Undang Hukum Pidana (RKUHP) nasional versi bulan Juli tahun 2018 dapat dikatakan mengacu kepada perkembangan kebijakan formulasi/legislasi mengenai “blasphemy” di Inggri
The Harmonization of the Central and Local Governments Authority: Handling Public Health Emergencies on Coronavirus Disease 2019
The global Covid-19 pandemic has made Indonesia do various ways to reduce the spread of covid-19. Through Government Regulation Number 21 of 2020, the Large-Scale Social Restrictions. The aim of this study is to know the relationship pattern of central and local governments in handling public health emergencies and harmonizing any related laws and regulations. This study used juridical normative method with the statutory approach. The study used the Large-Scale Selection of Social Restrictions policy. The findings revealed the central government as the main policy at the regional level, as a party to determine the type of steps that will be taken in handling public health emergency of Covid-19. The selection of Large-Scale Social Restrictions known as PSBB as the main way to suppress the spread of Covid-19 is based on the Regional Government flexibility. In other words, the local government can immediately oblige to apply PSBB in their regions to see the progression and to act quickly upon it. Thus, the synergy between central and local governments in handling covid-19 is indispensable. In conclusion, the implementation of PSBB in Banten Province, especially in Tangerang Raya, successfully reduce the number of positive cases of Covid-19. However, the delay in the implementation of PSBB in Banten Province makes the spread of covid-19 reach to other areas apart from Tangerang Raya.Pandemi global Covid-19 telah membuat Indonesia melakukan berbagai macam cara untuk menekan angka penyebaran Covid-19. Melalui Peraturan Pemerintah Nomor 21 Tahun 2020 tentang Pembatasan Sosial Berskala Besar, pemerintah pusat memilih untuk menggunakan. Tujuan penelitian ini untuk melihat bagaimana pola hubungan antara pemerintah pusat dan pemerintah daerah dalam hal penanganan kedaruratan kesehatan masyarakat dan mengharmoniskan peraturan perundang-undangan yang berkaitan dengan hal tersebut. Metode penelitian ini yang digunakan yaitu yuridis normatif dengan pendekatan peraturan perundang-undangan, studi kebijakan yang dikaji adalah Pemilihan Pembatasan Sosial Berskala Besar. Hasil penelitian didapatkan bahwa, Pemerintah Pusat sebagai haluan utama kebijakan di tingkat daerah menjadi pihak yang dapat menentukan langkah apa yang akan diambil dalam pengananan kedaruratan kesehatan masyarakat Covid-19. Pemilihan Pembatasan Sosial Berskala Besar (PSBB) sebagai cara utama sebagai penekan penyebaran Covid-19 didasarkan pada keleluasaan Pemerintah Daerah yang dapat langsung berkewajiban melaksanakan PSBB di daerahnya sehingga bisa melihat perkembangan sekaligus bertindak cepat dan sinergitas antara pemerintah pusat dan pemerintah daerah dalam penanganan Covid-19 sangat diperlukan. Penerapan PSBB di Provinsi Banten terutama di Tangerang Raya dapat menekan angka kasus positif Covid-19, namun keterlambatan untuk membuat keseluruhan wilayah di Provinsi Banten melaksanakan PSBB membuat penyebaran Covid-19 di Provinsi Banten mulai merambah ke deaerah-daerah yang lain selain Tangerang Raya
