    Il diritto pubblico tedesco della seconda metà del XX secolo: sfide e risposte

    L’opera qui tradotta per la prima volta in italiano è il volume di Rainer Wahl Herausforderungen und Antworten: Das Öffentliche Recht der letzten fünf Jahrzehnte, in cui l’autorevole giuspubblicista effettua un’approfondita analisi del diritto pubblico tedesco dopo il secondo conflitto mondiale. L’ipotesi che è alla base di tutta la riflessione è che nella fase di fondazione del diritto pubblico tedesco, identificabile con il periodo di elaborazione e adozione della Grundgestez, siano state poste le fondamenta ideali che hanno poi plasmato il diritto pubblico nelle fasi successive, tracciando un percorso evolutivo che è rimasto ancorato alle scelte effettuate nel 1945-49 forgiandolo in modo più profondo di quanto potessero innovare le normali evoluzioni successive del diritto. Per dimostrare tale ipotesi, Wahl adotta il metodo della storicizzazione del diritto pubblico vigente, che consente di comprendere in modo più consapevole e completo la natura stessa e le peculiarità del diritto pubblico tedesco nella sua attuale configurazione. L’obiettivo è quello di individuare i “connotati costanti” (bleibende Prägungen) del diritto, attraverso un’analisi puntuale delle evoluzioni attraversate dalla fase di fondazione fino al presente. Questo libro rappresenta un’opera fondamentale sia per chi si voglia avvicinare al diritto pubblico tedesco e alla sua dogmatica, sia per chi sia già profondo conoscitore della giuspubblicistica tedesca e desideri volgere lo sguardo con interesse e curiosità verso alcune posizioni e ricostruzioni non necessariamente appartenenti alla dogmatica dominante

    Loss-of-function maternal-effect mutations of PADI6 are associated with familial and sporadic Beckwith-Wiedemann syndrome with multi-locus imprinting disturbance

    Background: PADI6 is a component of the subcortical maternal complex, a group of proteins that is abundantly expressed in the oocyte cytoplasm, but is required for the correct development of early embryo. Maternal-effect variants of the subcortical maternal complex proteins are associated with heterogeneous diseases, including female infertility, hydatidiform mole, and imprinting disorders with multi-locus imprinting disturbance. While the involvement of PADI6 in infertility is well demonstrated, its role in imprinting disorders is less well established. Results: We have identified by whole-exome sequencing analysis four cases of Beckwith-Wiedemann syndrome with multi-locus imprinting disturbance whose mothers are carriers of PADI6 variants. In silico analysis indicates that these variants result in loss of function, and segregation analysis suggests they act as either recessive or dominant-negative maternal-effect mutations. Genome-wide methylation analysis revealed heterogeneous and extensively altered methylation profiles of imprinted loci in the patients, including two affected sisters, but not in their healthy siblings. Conclusion: Our results firmly establish the role of PADI6 in imprinting disorders. We report loss-of-function maternal-effect variants of PADI6 that are associated with heterogeneous multi-locus imprinting disturbances in the progeny. The rare finding of two siblings affected by Beckwith-Wiedemann syndrome suggests that in some cases, familial recurrence risk of these variants may be high. However, the heterogeneous phenotypes of the other pedigrees suggest that altered oocyte PADI6 function results in stochastic maintenance of methylation imprinting with unpredictable consequences on early embryo health

    Ignition mechanism of flammable dust and dust mixtures: An insight through thermogravimetric/differential scanning calorimetry analysis

    Understanding flame propagation mechanism and thermal behavior of flammable dusts is of crucial importance, since they strongly affect the flammability and explosion parameters. In a previous work, we found that the volatile point of anthraquinone/nicotinic acid mixtures can be lower than the one of the pure dusts, suggesting a synergistic effect. In this work, thermogravimetric and differential scanning calorimetry analyses of anthraquinone/niacin mixtures were carried out both in open and closed cup, to explain the observed synergistic behavior. FTIR analysis on solid residue and evolved gaseous species showed that the mixtures change compositions during the thermal treatment, without undergoing any chemical transformation. The thermal behavior of dust mixtures reveals the presence of a eutectic point, resulting in a volatiles production at lower temperature and accelerating the flame propagation

    Re-framing accountability and learning through evaluation: Insights from the Italian higher education evaluation system

    Although the relation between accountability and learning is a key issue in the field of evaluation, the existing conceptualizations include significant gaps and shortcoming. This article seeks to bridge some of the identified gaps, overcoming the dichotomy between learning and accountability and the overemphasis on accountability, and offering a more nuanced account of various forms of positive and negative learning. We propose a theory-informed reconceptualization of both accountability and learning in order to develop an interpretative framework that recognizes their plurality and brings them together through evaluation. To make visible the analytical potential of our reconceptualization, we present the Italian higher education evaluation system as a source of illustrative examples. Our analysis confirms that accountability and learning are inextricably interconnected and that multiple forms of learning can be envisaged by taking into account the mutual relationship among organizational arrangements, evaluative practices and cultural codes. We argue that such kind of analysis allows to remove the taken-for-granted aspects of evaluation practices, challenging the often-implicit assumptions about their virtues as well as their weaknesses in order to see what evaluation actually does in a particular situation

    A combined neural network and model predictive control approach for ball transfer unit–magnetorheological elastomer–based vibration isolation of lightweight structures

    This study addresses the possibility of adopting semi-active magnetorheological elastomers?based isolators for protecting lightweight structures from ground vibration. The exploitation of these smart devices has the main advantage of controlling their stiffness and damping features by acting on the magnetic field generated by a coil on the basis of the actual conditions of both the lightweight structure and the surrounding environment. This allows for combining the reliability of passive devices with the benefits of active control methods. Both mechanical and control system designs could play a crucial role in the challenging problem of improving isolation performances. To solve this issue, we (i) suggest a novel ball transfer unit?magnetorheological elastomer?based isolation system prototype to obtain an improved isolation response of the lightweight structure with respect to the exclusive use of an magnetorheological elastomer and (ii) propose a novel robust combined neural network and model-predictive control approach, allowing proper functioning of the ball transfer unit?magnetorheological elastomer?based isolation system. The effectiveness of the proposed semi-active isolator in guaranteeing vibrational isolation of lightweight structures is evaluated by considering a rack cabinet composed of three storeys and subject to an El Centro earthquake. Numerical simulations confirm and disclose the efficacy of the proposed approach
