    ABSTRAKHukum di Indonesia mengatur hanya seorang Warga Negara Indonesia (selanjutnya disebut WNI) saja yang dimungkinkan mempunyai hubungan yang sepenuhnya dengan tanah (dalam hal kempemilikan/penguasaan terhadap tanah), yang dimaksud dengan ”hubungan sepenuhnya” adalah menguasai dan menggunakan tanah yang bersangkutan dengan hak milik. Dalam hal yang sangat khusus orang-orang asing boleh menguasai dan menggunakan tanah dengan Hak Milk Hak Guna Usaha (HGU), Hak Guna Bangunan (HGB) dan itupun hanya selama satu tahun.Penelitian yang dilakukan adalah penelitian hukum normatif disebut juga penelitian hukum doktrinal yang terdiri dari bahan hukum primer dan bahan hukum skunder, pada penelitian hukum jenis ini, acap kali hukum dikonsepkan sebagai apa yang tertulis dalam peraturan Perundang-Undangan (law in books) atau hukum dikonsepkan sebagai kaidah atau norma yang merupakan patokan berperilaku manusia yang dianggap pantas. Di samping sumber-sumber penelitian yang berupa bahan-bahan hukum, peneliti hukum juga dapat menggunakan bahan-bahan non-hukum apabila dipandang perlu, yaitu berupa buku-buku mengenai Ilmu Politik, Ekonomi, Sosiologi, Filsafat, Kebudayaan ataupun laporan-laporan penelitian non-hukum dan jurnal-jurnal sepanjang mempunyai relevansi dengan topik penelitian.Kebutuhan tanah dan rumah bagi Warga Negara Asing (WNA) yang bertempat tinggal di Indonesia semakin meningkat. Undang-Undang Pokok Agraria Pasal 42 dan Pasal 43, diikuti dengan Peraturan Pemerintah Nomor 40 Tahun 1996 tentang Hak Pakai, Hak Guna Bangunan dan Hak Pakai Atas Tanah, dan peraturan pelaksana lainnya seperti Peraturan Menteri Agraria/Kepala Badan Pertanahan Nasional Nomor 7 Tahun 1996 dan kemudian diganti dengan nomor 8 Tahun 1996 tentang Persyaratan Pemilikan Rumah Tempat Tinggal atau Hunian Orang Asing, tidak lain adalah untuk memberikan kemudahan yang diciptakan oleh pemerintah tersebut diharapkan akan mendapat suasana kondusif bagi pelaku-pelaku ekonomi, agar tidak ragu-ragu untuk berinvestasi di Indonesia.Perlu adanya kejelasan dalam penerapan hukum mengenai siapa saja (aparatur) yang berhak mengawasi pemakaian tanah oleh orang asing dan kejelasan serta pemberian sanksi bagi orang asing yang melakukan pelanggaran atau penyelundupan hukum dalam perolehan pemilikan hunian tempat tinggal di Indonesia. Agar setiap orang mempunyai kesadaran hukum dalam setiap sendi kehidupan bermasyarakat, tidak melakukan perbuatan yang dapat merugikan negara, orang lain dan diri sendiri. Kata Kunci : HGU, HGB, Orang Asing

    ABSTRAKHakim pengawas dan pengamat dalam melasanakan tugas pengawasan dan pengamatan sehubungan dengan pelaksanaan putusan hakim oleh jaksa selaku eksekutor tidak dilakukan secara mutlak dan langsung. Pengawasan tersebut tidak dilakukan secara langsung dan mutlak disebabkan karena antara jaksa dan hakim secara struktural berbeda, dalam hal ini jaksa tetap bertanggung jawab pada atasannya yaitu Kepala Kejaksaan Negeri. Dalam tanggung jawabnya tersebut, jaksa selaku eksekutor akan membuat berita acara pelaksanaan putusan pengadilan yang kemudian akan diserahkan pada Kepala Kejaksaan Negeri. Pengawasan lain yang tak kalah pentingnya harus dilakukan oleh hakim pengawas dan pengamat adalah terhadap terpidana bersyarat. Selama terpidana bersyarat tidak menjalani pidananya di dalam LAPAS, maka terpidana dapat bergerak bebas di masyarakat. Peran hakim pengawas dan pengamat akan diperlukan disini untuk melakukan pengawasan terhadap perilaku terpidana bersyarat. Pelaksanaan pengawasan dan pengamatan oleh hakim pengawas dan pengamat terhadap narapidana yang telah selesai menjalani pidananya dan terhadap narapidana bersyarat seperti diatur dalam Surat Edaran Mahkamah Agung Nomor 7 Tahun 1985 tentang Petunjuk Pelaksanaan Tugas Hakim Pengawas dan Pengamat dilakukan dengan cara hakim pengawas dan pengamat mengadakan kerjasama dengan aparat pemerintah desa, sekolah-sekolah, yayasan-yayasan yang berkecimpung dalam bidang sosial yang sudah biasa membantu pembinaan bekas narapidana, seperti balai BISPA, Direktorat Rehabilitasi Tuna Sosial Jenderal Rehabilitasi dan Pelayan Sosial Departemen Sosial, dsb. Beberapa kendala yang dihadapi dalam melaksanakan tugas hakim pengawas dan pengamat diantaranya adalah : Tak adanya sanksi yang jelas bagi jaksa bila hakim melakukan peneguran atas keterlambatan pelaksanaan putusan pengadilan, sehingga dalam pelaksanaan tugas jaksa selaku eksekutor peranan hakim pengawas dan pengamat tidak terlalu berarti; Tidak mengikatnya saran hakim pengawas dan pengamat yang berupa perbaikan jenis pembinaan yang diberikan kepada narapidana. Bentuk dan program pembinaan dan pembimbingan yang akan diberikan kepada narapidana pada dasarnya disusun oleh kepala LAPAS, dalam penyusunan program tersebut kepala LAPAS dapat menerima saran dari hakim pengawas dan pengamat ataupun Tim Pengamat Pemasyarakatan

    ABSTRAK Ada beberapa faktor penyebab terjadinya tindak pidana ringan di Indonesia yaitu faktor ekonomi, sosilogi, dan psikologi, ketiga fakror ini mempunyai kaitan yang erat satu sama lainnya untuk mendorong terjadinya tindak pidana ringan, artinya faktor yang satu dipengaruhi oleh faktor lain sehingga salah satu faktor tidak dapat berdiri sendiri dalam menimbulkan masalah tindak pidana ringan.Fungsi hukum acara pidana adalah melaksanakan dan menegakkan. Hukum Pidana.  Fungsi ini dapat dikatakan sebagai fungsi repressit hukum pidana, artinya jika perbuatan yang tergolong sebagai perbuatan pidana maka perbuatan tersebut harus diproses agar ketentuan-ketentuan yang terdapat di dalam hukum pidana itu dapat diterapkan kepada pelaku :  Kepolisian ; Kejaksaan dan Pengadilan Negeri.Pelaksanaan hukum itu harus menyentuh tidak hanya manusia yang sedang diadili karena pelanggaran hukum, tetapi juga menyentuh korban kejahatan, dan petugas-petugas hukum polisi, jaksa hakim dan pejabat lembaga pemasyarakatan, serta pada akhirnya seluruh bangsanya.
