Governança corporativa: práticas de governança em empresas familiares
Get PDFA presente monografia tem como objetivo analisar o impacto das práticas de governança corporativa em empresas familiares no ambiente empresarial. Para isso, é necessário explorar as particularidades da governança corporativa e identificar as características particulares nesse tipo de organização, destacando as diferenças em relação a empresas de estrutura não familiar e avaliando como a adoção – ou a ausência – dessas práticas pode influenciar os resultados econômicos no curto, médio e longo prazo. Diante de um cenário empresarial cada vez mais competitivo, no qual pequenas e grandes empresas disputam um mesmo nicho de mercado, torna-se essencial adotar mecanismos que fortaleçam a credibilidade da gestão familiar, promovam a qualificação do ambiente de trabalho e contribuam para a sustentabilidade do negócio. Para embasar a análise, foi selecionada uma ampla bibliografia que permitirá ao leitor compreender tecnicamente a relevância da governança corporativa para empresas familiares, especialmente frente às novas exigências do mercado, como maior responsabilidade social, sustentabilidade e conformidade regulatória. Tributação e direitos fundamentais: impactos do sistema tributário na desigualdade social e econômica brasileira
Get PDFEste trabalho tem por objetivo analisar os impactos do sistema tributário brasileiro na desigualdade social e econômica, sob a ótica dos direitos fundamentais previstos na Constituição Federal de 1988. Parte-se da justificativa de que o modelo tributário atual, fortemente baseado na tributação indireta, é estruturalmente regressivo e contribui para a manutenção das desigualdades de renda no país, violando os princípios constitucionais da dignidade da pessoa humana, da igualdade e da justiça social. A hipótese central da pesquisa é a de que o sistema tributário brasileiro, ao não respeitar os princípios da capacidade contributiva, da justiça fiscal e da solidariedade, reforça a exclusão social e compromete a efetivação de direitos fundamentais. A abordagem metodológica é qualitativa, de caráter exploratório, com revisão bibliográfica e análise documental de dados legislativos, estatísticos e doutrinários. Como resultado, espera-se demonstrar a urgência de uma reforma tributária orientada por critérios de justiça distributiva, capaz de tornar a tributação um instrumento efetivo de promoção da equidade e redução das desigualdades no BrasilThis paper aims to analyze the impacts of the Brazilian tax system on social and economic inequality from the perspective of the fundamental rights established in the 1988 Federal Constitution. It is based on the premise that the current tax model, which relies heavily on indirect taxation, is structurally regressive and contributes to the persistence of income inequality, thereby violating constitutional principles such as human dignity, equality, and social justice. The central hypothesis is that the Brazilian tax system, by failing to respect the principles of ability to pay, tax justice, and solidarity, reinforces social exclusion and hinders the realization of fundamental rights. The methodological approach is qualitative and exploratory, based on bibliographic research and documentary analysis of legislative, statistical, and doctrinal sources. The justification for this research lies in the increasing relevance of social media in contemporary society and its potential capacity to shape public opinion, influence judicial decisions, and affect the social reintegration of individuals who have committed crimes. The central hypothesis of this study is that the excessive and often distorted exposure of criminal cases on social media can compromise the principles of due process, the presumption of innocence, and hinder the resocialization of the convicted, fostering virtual lynching and stigmatization. From a theoretical-methodological standpoint, the research will be based on a comprehensive bibliographic review of works by legal scholars in Criminal Law, Criminology, and related fields, as well as the analysis of specific cases reported in the media and scientific articles that address the theme. The expected results obtained include the identification of the main mechanisms by which social media exerts influence on the criminal justice system and resocialization, a critical analysis of the effects of this influence, and the proposition of reflections on possible mechanisms to mitigate its negative impact

Get PDFA guarda compartilhada tem como objetivo fazer com que ambos os genitores agreguem valores, proporcionem o adequado desenvolvimento físico e emocional da prole, valorizando a criação de vínculos afetivos de ambos os genitores com seus filhos através da convivência saudável, atribuindo a eles uma participação ativa na criação dos filhos. Para tanto, a compreensão deste instituto faz muita diferença na eficácia e clareza dos papéis de cada um. Os advogados que atuam na área de família têm o dever de esclarecer aos seus clientes os encargos, deveres, direitos e importância deste tipo de guarda, que impacta diretamente no desenvolvimento integral da criança. Há muitos percalços para que a guarda compartilhada atenda o melhor interesse da criança, visto que, ainda há impactos culturais e sociais que impedem sua eficácia plena, tais como o paternalismo, o machismo e não menos importante, a exaltação da mãe/mulher no papel insubstituível nos cuidados dos filhos. To this end, understanding this institute makes a lot of difference in the effectiveness and clarity of each parent's roles. Lawyers who work in the family area have the duty to clarify to their clients the responsibilities, duties, rights and importance of this type of custody, which directly impacts the child's integral development. There are many obstacles to ensuring that shared custody meets the best interests of the child, since there are still cultural and social impacts that prevent its full effectiveness, such as paternalism, sexism and, no less important, the exaltation of the mother/woman in the irreplaceable role in caring for children. Today's society and new family structures must understand the importance of parenting for the physical, mental and emotional development of children, leaving behind the flaws of a relationship that did not survive in the context of marriage and exercising parenting fully, with affection, providing emotional security to children who suffer from the separation of their parents and significant changes in their lives. A arte na contramão da hegemonia burguesa: a resistência de manifestações político-culturais como cordel, slam e hip hop
Get PDFEste estudo explora o conceito de resistência cultural, analisando como a arte — especificamente o Hip Hop, o Slam e o Cordel — funciona como expressão político cultural de resistência na sociedade, destacando a importância dos sujeitos que produzem essas formas artísticas. A pesquisa identificou três coletivos em São Paulo: o Coletivo Teodoras do Cordel - Artevistas SP, o Slam da Guilhermina e a Batalha Dominação, todos representantes das periferias, compostos majoritariamente por negros, mulheres e LGBTs. Esses grupos atuam como mediadores do pensamento crítico, utilizando a cultura como ferramenta de transformação social. Vinculado ao Serviço Social, o estudo abordou fundamentos históricos, ético-políticos e técnicos da profissão, enfatizando o papel dos coletivos na resistência às estruturas capitalistas. Constatou-se que essas iniciativas surgiram de forma autônoma, sem apoio estatal, dependendo da coletividade e de recursos limitados. Apesar disso, desafiam a ordem vigente e contribuem para a superação das desigualdades, ainda que enfrentem obstáculos, como a falta de conscientização sobre seu potencial integração à luta mais ampla da classe trabalhadora. Concluiu-se que há necessidade de políticas públicas para fortalecer tais coletivos, já que cumprem um papel que, constitucionalmente, deveria ser do Estado. Além disso, apontou-se a importância de o Serviço Social aprofundar a cultura como mediação para abordar a questão social, abrindo caminho para novas pesquisas. A pesquisa demonstrou que, a partir do método de análise do materialismo histórico-dialético, embora esses grupos sejam alternativas contra-hegemônicas, sua efetividade requer maior articulação com outras frentes de mobilização socialThis study explores the concept of cultural resistance, examining how art—specifically Hip Hop, Slam poetry, and Cordel literature—functions as a political-cultural expression of resistance in society, highlighting the importance of the individuals who produce these art forms. The research identified three collectives in São Paulo: Coletivo Teodoras do Cordel - Artevistas SP, Slam da Guilhermina, and Batalha Dominação, all representing marginalized communities, predominantly composed of Black individuals, women, and LGBTQ+ people. These groups act as mediators of critical thought, using culture as a tool for social transformation. Linked to Social Work, the study addressed historical, ethical-political, and technical foundations of the profession, emphasizing the role of these collectives in resisting capitalist structures. It was found that these initiatives emerged autonomously, without state support, relying on community efforts and limited resources. Despite this, they challenge the prevailing order and contribute to overcoming inequalities, even while facing obstacles such as a lack of awareness regarding their potential integration into the broader struggle of the working class. The study concluded that public policies are needed to strengthen such collectives, as they fulfill a role that, constitutionally, should be the state’s responsibility. Additionally, it underscored the importance of Social Work further exploring culture as a mediation tool for addressing social issues, paving the way for new research. Construção da persona feminina: análise de conselhos amorosos no Tiktok
Get PDFO presente trabalho busca analisar o conteúdo de vídeos sobre relacionamentos amorosos na rede social TikTok no Brasil, com foco nos discursos de aconselhamento sobre o papel da mulher nessas relações. O TikTok, uma plataforma de mídia social voltada para vídeos curtos, oferece uma experiência de consumo de conteúdo com alto potencial de influência sobre comportamentos e identidades. A partir da perspectiva da Psicologia Analítica, o estudo utiliza o conceito de persona para investigar a existência de padrões nas expectativas relacionadas à identidade assumida por mulheres em relacionamentos afetivos, conforme disseminados na plataforma. A pesquisa adota uma abordagem qualitativa, baseada na coleta e análise de 30 vídeos representativos encontrados na rede social, selecionados por meio da hashtag “dicas de relacionamento”, buscando compreender de que forma tais narrativas contribuem para a construção de uma persona feminina idealizada nas relações afetivas. Por meio desta, observou-se a presença de discursos que reforçam exigências de censura emocional, racionalidade estratégica e adesão a papéis de gênero tradicionais, revelando como a linguagem das redes sociais perpetua discursos tradicionais pautados na validação masculina, tornando-os mais sutis e eficazesThis paper analyzes the content of videos about romantic relationships on the social media platform TikTok in Brazil, with a focus on advice-oriented discourses about the role of women in these relationships. TikTok, known for its short-form video content, offers a highly engaging user experience with significant potential to influence behaviors and shape identities. Drawing on Analytical Psychology, the study uses the concept of the persona to investigate recurring patterns in the expectations surrounding the identities assumed by women in romantic relationships, as portrayed on the platform. The research adopts a qualitative methodology, involving the collection and analysis of 30 representative videos selected on the social media using the hashtag “#dicasderelacionamento” (“relationship tips”), aiming to understand how these narratives contribute to the construction of an idealized female persona in romantic contexts. Acompanhamento terapêutico na escola: um olhar psicanalítico sobre os desafios e singularidades de uma prática emergente
Get PDFEste trabalho teve como objetivo investigar a prática do Acompanhamento Terapêutico (AT) no contexto escolar, orientado pela ética da psicanálise, analisando seus fundamentos, características, desafios e efeitos. Para tanto, realizou-se uma pesquisa teórica baseada em revisão de literatura, com análise de livros, artigos científicos e relatos de caso publicados. A seleção dos textos priorizou produções que discutissem o AT na escola, especialmente sob orientação psicanalítica. O método incluiu fichamentos e análises conceituais a partir de três eixos principais: a história e fundamentos do AT; sua articulação com a psicanálise; e a inserção do AT no campo da educação inclusiva. Nos resultados, o trabalho apresentou os principais conceitos que sustentam o AT como clínica do laço social e dispositivo ético de circulação. Em seguida, foi caracterizada a prática dentro da escola, bem como discutidos os atravessamentos que marcam a atuação do at na escola, como a relação com professores, família e instituição, assim como os riscos de sua função ser confundida com um papel disciplinar ou normativo. Por fim, foram analisados dois casos clínicos extraídos da literatura – “Menino Dinamite” e “Caso Gustavo” – que ilustraram os efeitos possíveis da presença do AT na escola e seus impasses. Inexigibility of bidding in service procurement and its treatment under anti-corruption administrative sanctioning law: an analysis of Judgments from the Audit Offices
No full textEste trabalho se concentra em investigar o tratamento da inexigibilidade na contratação de serviços sob a perspectiva do Direito Administrativo Sancionador Anticorrupção, considerando a jurisprudência dos Tribunais de Contas. A pesquisa se justifica pela relevância acadêmica de aprofundar a análise das exceções ao princípio da licitação e pela importância social de garantir a transparência e a responsabilização na gestão de recursos públicos, dado o aumento na relevância da temática de contratações por inexigibilidade com questionamentos sobre a real inviabilidade de competição e a observância dos princípios administrativos. A utilização da inexigibilidade de licitação na contratação de serviços, em alguns casos, não observa os requisitos legais e os princípios da administração pública, podendo configurar mecanismo para contornar as regras licitatórias e ensejar a aplicação de sanções no âmbito do Direito Administrativo Sancionador Anticorrupção. Este trabalho pretende, então, verificar em que medida a legislação vigente e os julgados dos Tribunais de Contas preveem ou remediam, atos de improbidade administrativa e/ou de corrupção praticados por Agentes Públicos ou particularesThis work focuses on investigating the treatment of inexigibility of bidding in service procurement from the perspective of Anti-Corruption Administrative Sanctioning Law, considering the jurisprudence of the Audit Offices. This research is justified by the academic relevance of deepening the analysis of exceptions to the principle of mandatory bidding and by the social importance of ensuring transparency and accountability in the management of public resources, given the increasing relevance of the topic of procurement through inexigibility with questions regarding the actual infeasibility of competition and the observance of administrative principles. The use of inexigibility of bidding in service procurement, in some cases, fails to observe legal requirements and the principles of public administration, potentially constituting a mechanism to circumvent bidding rules and give rise to the application of sanctions within the scope of Anti-Corruption Administrative Sanctioning Law. This work, therefore, intends to verify the extent to which current legislation and the judgments of the Audits Offices foresee or remedy acts of administrative misconduct and/or corruption committed by Public Agents or private individual
