    No full text
Commercial software licensing Abstract The aim of this thesis is, using a descriptive-analytical method, to provide a comprehensive insight into the issue of software licensing based on license agreements, as well as its copyright protection. The thesis focuses on proprietary (commercial) licenses for proprietary software and does not aim to cover the issue of public licenses for so-called Free and Open Source software. The first chapter examines the concept of a computer program, or software, and the absence of its legal definition in the Czech legal system. The second chapter is devoted to the issue of copyright and other forms of protection. It analyses the historical development of legal regulation and the current concept of copyright protection of software as a literary work within the meaning of the Berne Convention; it addresses the question of which components of software are protected by copyright, as well as the specifics and shortcomings of this legal framework. A brief excursus is also devoted to the protection of software under patent law, which in certain cases can provide protection for software functionality that is not covered by copyright in its current conception. The third chapter examines the license agreement and its use in the field of software as the basic tool for the disposition of..

1 Intellectual Property Aspects of Generative Artificial Intelligence Abstract The thesis focuses on the analysis of copyright aspects of generative artificial intelligence and assesses the adequacy of the current legal framework in the context of rapid technological development. Generative AI represents tools capable of autonomously producing new textual, visual, or audio outputs based on the analysis of large volumes of input data. The central question of the thesis is the examination of the nature of these outputs, their potential originality, and the conditions under which they may be considered copyrighted works protected under Act No. 121/2000 Coll., the Copyright Act. The thesis examines the current legal framework in the Czech Republic, EU legislation including the Directive on Copyright in the Digital Single Market and the AI Act, and further provides a comparison with the legal approaches of the United Kingdom and China. Particular attention is paid to the issue of originality and creativity of generative AI outputs, the nature of input data, and the challenges of their use in training models. Input data and their protection are also analyzed in the context of exceptions such as text and data mining (TDM). The thesis explores various theoretical approaches to the allocation of authorship - to the..

Public Participation in Decisions Containing Nuclear Aspects Abstract The European Union is committed to becoming the first climate neutral continent by 2050. The energy sector in the Czech Republic currently relies on energy gained by fossil fuels, which is the largest source of carbon dioxide emissions. Nuclear energy will play a crucial role in the transition to a climate-neutral economy, if not the Czech Republic could struggle to meet its climate commitments. In time when significant investments in new nuclear sources are planned, it is essential that the national legislation sets clear rules for administrative proceedings related to making nuclear reactors operational. These rules have to comply with the constitutional law of the Czech Republic as well as with the international treaties. The Aarhus Convention Compliance Committee found that the Czech Republic repeatedly failed to meet its obligations regarding public participation in decision-making on nuclear projects. In response, the legislation was adopted in form of an amendment to the Atomic Act which came into force on 1 July 2025. This thesis examines public participation in decision-making containing nuclear aspects in the Czech Republic. The topic is analysed in the context of obligations stated by the Aarhus Convention and other..

1 Abstract This diploma thesis deals with the issue of domestic violence in the context of administrative offence proceedings, focusing on the possibilities for protecting and supporting persons at risk. The aim was to describe the specific features of administrative proceedings in cases that do not meet the threshold of a criminal offence but still have a serious impact on the dignity and safety of those affected by domestic violence. The theoretical part analyzes the legal framework, the tools of administrative sanctioning, and the roles of key institutions such as municipal authorities, the Police of the Czech Republic, courts, intervention centres, child protection services, and non-governmental organizations. The practical part presents case studies of specific instances of domestic violence handled by administrative authorities, where the persons at risk include women, men, children, elderly persons, and foreign nationals. The analysis highlighted several obstacles in the proceedings, particularly the requirement for the direct victim's consent, lack of information about available support, and limited use of protective measures that can be imposed alongside sanctions. The discussion section summarizes the main shortcomings of the current system and presents the forthcoming amendment to the Act on..

    No full text
This dissertation focuses on foreign language aptitude of young school-aged learners and its potential to predict success in foreign language learning. The aim of the research was to examine how foreign language aptitude develops in primary school pupils and whether its predictive power differs depending on the testing format (language/visual). The study had a longitudinal design - pupils were tested at the beginning of third grade (T1) and at the end of fourth grade (T2). Several factors were monitored during the study. The independent variables included foreign language aptitude, assessed through visual and language formats. Furthermore, the pupils' motivation, exposure to a foreign language, and general learning difficulties were monitored. The dependent varibles included the Cambridge Starters English language proficiency test and the term results in the 3rd grade in English subject. The results showed that foreign language aptitude develops at this age, with all monitored skills showing improvement. The strongest effect (d = 0.72) was found in the Cars subtest focused on spatial orientation. Multiple regression analysis confirmed the key role of motivation and out-of- school language exposure. Among the subtests, the language-based tasks in particular proved to be statistically significant:..

This thesis is focused on Czechs in London. Its main aim is to research how the Czechness of London Czechs is being made, what are the Czech practises and whether Czechs in London create a singular entity in the sense of community, or if their lives are individualized. Its theoretical core lays in contemporary theory; Nina Glick Schiller's theory of transnational migration, Pnina Werbner's concept of diaspora as a place of co-responsibility and performance, Benedict Anderson's theory of long-distance nationalism, and Mark Granovetter's theory of weak ties. Research was conducted via mixed methods methodology; namely I have explored findings from my quantitative research through qualitative research in the form of semi-structured interviews and autoethnography. I have found out that Czechs take various approaches to their Czechness: Whereas some people have become more patriotic trough their experience of exile which has inspired them to participate in various countrymen activities, following the Czech traditions and preserving their language the best they can, some people have a more pragmatic approach to their ethnic identity. On the question of cohesion of the Czech diaspora, interviews showed that despite Czechs in London being concentrated in chaordic structures of "islands" based on time of..

Interlocking Directorates as a Threat to Good Competition and Their Regulation in the EU

    No full text
The aim of this thesis is to introduce the reader to the problematics of interconnected directorships and their effects on competition. The author addresses the question of whether the relevant bodies succeeded in finding effective regulatory tools regarding overlapping directors, after the Commission failed to do so more than 10 years ago. The thesis is divided into two major parts. First, the author provides the reader with a general theoretical overview needed for a better understanding of the causes and the market impacts of interlocks. Here, a great deal of space is given to the companies' ownership structures and to the phenomenon of minority shareholdings, which is inherently linked to shared directorships. Furthermore, the reader has the possibility to get an insight into the underlying positive and negative effects of minority shareholdings and/or interlocks on competition. On one hand such networks can create a better environment for innovations and market development, on the other, they can have large disruptive impact. That can occur for instance through the unlawful exchange of confidential market data, the collusion through overlapping directors and via tacit or explicit agreements not to compete with each other. In the second part, the author applies the theoretical findings on the..
