Theoretical and Practical Implications of Evidence in Religion Court
In the civil procedural law, the certainty of the truth of the events proposed at the trial depends very much on the evidence carried out by the parties concerned. As a consequence, the truth is said to exist or be reached if there is a match between the judge's conclusion (the result of the process) and the events that have taken place. Whereas if the opposite happens, it means that the truth is not reached. Research conducted by the author is research based on document research (Library Research), meaning that the data that are used as a reference in this study are facts in the field that have been documented in the Court's decision. The results of this study indicate that the contribution of evidence in court is very necessary, because one of the duties of the judge is to investigate whether there is a legal relationship on which the lawsuit really exists or not. The existence of this legal relationship must be proven by the parties in court
The Empowerment of Productive Zakat Influence on Independence of The Community
Empowerment through productive zakat is the effort of the Madina Zone of Dompet Dhuafa to create an independent society by developing business that utilize the potential of the community itself. Empowerment programs are needed by the community to be able to overcome economic in a sustainable manner. The majority of Indonesia’s population is Muslim, so one of the empowerment programs that is considered relevant is the empowerment through productive zakat as practiced by Madina Zone of Dompet Dhuafa. The empowerment of community is related to self-reliance. Self-reliance can be achieved through empowerment by involving participation from the community. The purpose of this research is to identify the influence of empowerment through a productive zakat carried out by Madina Zone on community self-reliance. The method used in this study is a quantitative approach supported by qualitative data. The location of this study was in the Jampang Village, Kemang District, Bogor Regency. The results of the study showed a significant level of empowerment in participation and a significant level of participation in self-relience
Plant-Based Mediation Contribution to the Settlement of Cases at the Court
Mediation is one of the stages in the trial process. Mediation must be carried out by the parties, who are disputing civil cases in all areas of the judiciary. Mediation is a law, as the State of Indonesia is a state based on law. Article 1 of the 1945 Constitution is a constitution that regulates the form of the state of Indonesia as a constitutional state. The contribution of offline and online-based mediation to the settlement of cases in the regional courts of the Mataram Religious High Court when combined, the two seem to be insignificant in resolving cases, both offline and online mediation. The low level of success is due to the mediator factor and the factor of justice seekers. The mediator factor is assessed due to the lack of ability (skills) of the mediator, the mediator only carries out mediation according to formal legal principles, the mediator does not master role knowledge, communication science, family psychology which results in rigidity in carrying out mediation, if the mediator has multiple disciplines, of course it will spawn. better results of the implementation of mediation. The justice seeker factor is judged due to the lack of seriousness in participating in a mediation forum led by a mediator and each of them has adhered to its principles
Legal Implementation and Effectiveness of Fulfilling Post Divorce Children
In the study of Islamic law and positive law, children are the responsibility of parents until the child is an adult. But the most dominant in supporting the child is the male parent since the child came out of the mother's womb. In this study the focus is on the form of implementation and legal effectiveness of the decision on the livelihood of the child which imposes responsibilities to the father after the marriage break up due to divorce. This study aims to understand and analyze relating to the Implementation of Law and the Effectiveness of Post-Divorce Childhood Fulfillment. This study uses a qualitative approach, with the type of socio-legal studies or juridical-empirical research. The results showed that the implementation of the fulfillment of children's livelihoods after the breakup of marriage due to divorce can be said to not fully reach the target (not yet effective). So that judges are deemed necessary to take steps so that the fulfillment of children's living after divorce can be carried out, for the sake of legal certainty of children as victims of divorce from both parents
Development of Sharia Banking and Its Contributions for the Development of National Banking
The development and growth of shari'a banks after more than two decades in Indonesia is very spectacular, so that spurred the level of economic growth, but if it is related to the substance of the objectives of sharia bank establishment is the alleviation of poverty and unemployment, it will even increase. Development Effect of Teacher Professional Abilities Through Training on The Professional Competency of Teachers And Teacher Performance of State Junior High Schools in the City of Bandung
The development of teacher professional abilities through training is an effort to improve teacher performance by increasing their professional competence. The main objective of developing teacher professional abilities through training is to solve teacher performance weaknesses both at present and in the future towards a more desirable level of performance. Because the development of teacher professional abilities through training is so important and requires a lot of money, it is necessary to research to find a real effect on teacher competence and performance. The research problems formulated are: 1) dimensions of teacher professional ability development through training; 2) teacher professional competence; and 3) teacher performance. The research approach is quantitative with a sample of 335 from a population of 2,064 junior high school teachers in Bandung. Data were obtained from teachers using a questionnaire. The data is processed and interpreted using path analysis as an inferential statistical technique by first testing statistical assumptions, including transforming ordinal data into intervals and data normality testing. The study concluded that the development of teacher professional abilities can improve teacher competence and performance, which is expected to ultimately improve the quality of student learning. The implications include: 1) it is necessary to develop effective training; and 2) competence with performance is important to promote better teaching and learning. Based on these implications, there are several recommendations, namely: 1) increasing the development of teacher professional abilities through technical assistance and quality control group forums; (2) designing the development of teacher professional abilities that have a direct impact on the teaching and learning process; (3) develop a model with competency as the dependent variable; and (4) recommend the human side of the organization as a determinant factor that needs to be investigated.Â
The Concept of Human Ability (Qudratul Insan) in Islamic Education Process
This study aims to examine the concept of human ability (Qufratul Insan) in the process of Islamic education. The approach used is qualitative, namely research on the condition of natural objects, where researchers as a key instrument. The data collection technique is done by triangulation (combined), data analysis is inductive, and the results of the study emphasize the meaning rather than generalization. The results of the discussion showed that the human potential given by Allah SWT in the form of vision, hearing, and heart that all three have a relationship where hearing functions to maintain knowledge that has been found from the results of learning and learning, vision functions to develop knowledge and add research results by conducting further studies. The heart is in charge of cleansing knowledge of all bad qualities.
Management of Character Education Based on Panca Jiwa in Pondok Pesantren Darul Muttaqien Bogor
The purpose of this study was to examine how the management of character education based on the five souls at Pondok Pesantren Darul Muttaqien Bogor. The method used in this research is descriptive method which aims to describe and describe the phenomena in the field, namely scientific phenomena. The results showed that the five souls as the foundation for character education in Islamic boarding schools contain five values, including the value of sincerity, simplicity, independence, ukhuwah Islamiyah, and the value of freedom. Where these five values must be practiced as much as possible so that the students become strong and tough Muslim personalities like buildings that have a solid foundation, and for those who can practice them well, it will be easy to meet the future as well as possible
Implementation of Regulation of The Minister of Religion Number 2 of 2012 for Islamic Education Supervisers at Schools in The Department of Education in Sukabumi Regency
Regulation of the Minister of Religion (PMA) Number 2 of 2012 concerning Madrasah Supervisors and Supervisory Islamic Religious Education (PAI) at Schools, is a policy product issued by the Ministry of Religion which gave rise to a new nomenclature, amidst the regulations of School / Madrasah supervisors, namely supervisory functional positions. PAI on Schools. This regulation has implications for the implementation of PAI supervisor duties at schools. This research was motivated by the inadequate implementation of the activities of Islamic Education Supervisors at schools in the Sukabumi District Education Office. The focus of this research is the implementation of Regulation of the Minister of Religion (PMA) Number 2 of 2012 for Islamic Education supervisors at schools in the Sukabumi District Education Office. The purpose of this research is to find out about: 1) Implementation of PMA Number 2 of 2012 for PAI supervisors in the Education Office of Sukabumi Regency; 2) Problems faced by PAI supervisors at the Education Office of Sukabumi Regency in implementing PMA Number 2 of 2012, and 3) Efforts to improve in the future in implementing PMA Number 2 of 2012. This study used a qualitative approach with descriptive methods, data collection was carried out through interviews, observation and documentation study. This is to make a systematic, factual and accurate description of the phenomenon under study. The results of the research findings show: 1) The implementation of PMA Number 2 of 2012 for PAI supervisors at the Education Office of Sukabumi Regency is not running optimally; 2) The root of the main problems faced by PAI supervisors: Policy standards; Budget; Psychological burden; Coordination; and performance appraisal. 3) Improvement efforts are made by: Directorate of PAI by compiling a draft revision of PMA Number 2 of 2012; The Sukabumi District Education Office issues a SK to assign a school supervisor to the PAI supervisor; The Ministry of Religion of Sukabumi Regency has substantially increased the pattern of guidance; PAI supervisors increase creativity and motivation in carrying out their duties and supervisory functions. Recommendations for this study are addressed to the PAI Directorate of the Ministry of Religion of the Republic of Indonesia, in the form of: PMA Revision Number 2 of 2012 so that it is relevant to the regulations of school / madrasah supervisors; Review of Islamic Religious Education (PAI) supervisor nominations in schools; Adequacy of the budget for improving the quality of supervisors; and Strengthen coordination between related institutions
Principles of Justice, Conference and Legal Accountability in Divorce Rules
The Religious Courts, in the last decade (since 2005) or since the implementation of the one roof system of judiciary, have made various improvements in the administration of justice to support efforts to reform the judiciary based on the principles of transparency and accessibility for all. the justice seeker. The Religious Courts are trying to reform several sub-systems in the judicial system that have so far not reflected equal access for justice seekers as well as protection or partiality for the rights and legal access of women, children, and the poor. The results of this study indicate that: the religious court is a place to seek justice and resolve Islamic family law problems, so in providing services to the community, it has the main task of providing fair and humane treatment to justice seekers, providing sympathetic services and assistance needed for justice seekers, and provide effective, efficient, thorough and final settlement of cases so as to satisfy the public
