Ziyadah Dalam Transaksi S-Paylater di Aplikasi Shopee Perspektif Maqasidus Syari’ah
Full text linkS-Paylater is one of Shopee's sought-after features because it allows Shopee users to purchase items whenever desired without immediately burdening their financial condition. Essentially, users buy items on Shopee and pay for them at a later date, often phrased as 'buy now, pay later.' However, in practice, S-Paylater entails certain additional fees or interest ('ziyadah'), causing the prices of items through Paylater to be higher compared to cash purchases. Consequently, the legality of S-Paylater has sparked considerable debate among scholars. This article aims to bridge that debate by examining and assessing each instance of 'ziyadah' in S-Paylater transactions. The research conducted falls within the realm of qualitative field research, utilizing the Maqasid Shariah theory. The research findings indicate three types of 'ziyadah' in S-Paylater transactions: a 1% 'ziyadah' and an approximately 2.95% 'ziyadah,' both of which are considered permissible as they align with Shariah principles such as mutual consent, absence of speculation, and the absence of riba. However, a 5% 'ziyadah' imposed as a late fee is deemed impermissible due to its violation of Shariah principles, specifically riba. Nevertheless, instances of this late fee are rare and avoidable. Therefore, fundamentally, the practice of S-Paylater constitutes a legal and permissible transaction

Sehingga dengan perkembangan zaman, You Tube tidak hanya sebagai media hiburan saja namun You Tube juga menjadi alternatif baru untuk dapat memperoleh penghasilan secara mudah dan efesien. Hal tersebut terlihat dari maraknya para You Tuber yang memonetisasi akun You Tubenya agar dapat menambah finansialnya. Dalam monetisasi you tube terjadi terjadi hubungan kerjasama antara you tuber dan you tube partner program. Pada proses kerjasama tersebut masih memungkinkan terjadi beberapa masalah seperti kejelasan status transaksi bahkan bagi hasilnya.

Concerning Islamic law to avoid things that were violated, the researcher focuses on service transactions in the sharia-based lodging business that had been practised.Discussion in this study. How were service transactions in sharia-based lodging at Seven Dream Syariah Hotel Jember? How were service transactions in sharia-based lodging at Seven Dream Syariah Hotel Jember from the perspective of Islamic economic law? This research used qualitative methods. The data collected by the researcher includes primary and secondary data. While the source data was obtained through observation, interviews and documentation. Then the data were analyzed descriptively through data reduction, display and verification. Based on the results of the study, the presence of 'aqidain, mu'jir and musta'jir had reached puberty. The object of this transaction was the rental of guest rooms, meeting rooms and laundry services. In the pricing, tabaduli was due to a lack of information which results in ambiguity. The practice of this transaction was legal if the musta'jir did not object to paying the rental rate. If the mu'jir did not provide complete information and object, then the law was invalid

This research was conducted to answer the problem formulation: (1) How was the Regulation and Implementation of Traditional Markets in the Maqashid Al-Shari'ah Perspective ?, (2) What was the Regulation and Implementation of Modern Retail in the Maqashid Al-Syari'ah Perspective?The method used in this research was qualitative research with descriptive research type. Data collection techniques were interviews, observation, and documentation which blessed the formulation of the problem. The regulation and implementation of traditional markets in the view of Maqashid Al-Shari'ah can be classified into three categories. Dharuriyat, Hajiyat, Tahsiniyat. While the implementation of the regulation was not fully applicable, most of it can be applied. such as providing a parking area and a lack of keeping the place clean. While the regulation of modern retail in the view of Maqashid Al-shari'ah was classified into three categories as well. Dharuriyat, Hajiyat, Tahsiniyat. While the implementation of the regulation was still not fully realized, for example, the distance separating modern retail and traditional markets and some that did not have licenses

The data were analyzed descriptively through reduction, display and verification (conclusion). The collaboration of the Ijen Dairy Cattle Breeders Group was a type of syirkah al-inan, because each member of the group contributes capital and works with agreed wages or profit-sharing. Meanwhile, in terms of distribution of dairy cow's milk, the Ijen Makmur Dairy Farmers Group had two types of market share, namely the fixed market and the local or non-fixed market. The income from milk production that had been deposited by the farmers to the company was distributed equally or calculated equally among members after previously deducting operational costs

The practice of affiliate marketing cooperation carried out by Shopee with affiliate participants was permissible with several conditions in the principles of Islamic economic law. One form of cooperation carried out at Gronjong Wariti Water Tourism, Mejono Village, Plemahan District, Kediri Regency was investment cooperation. The cooperation agreement in this tourism business was carried out in two ways, namely an oral contract and a written contract. In the implementation of the two contracts, both orally and in writing, the pillars and conditions of the contract have been fulfilled. The implementation practice that occurred was the implementation of the mudharabah muqayyadah contract and was included in the sahih mudharabah contract. However, the existence of fraud committed by the contracting parties causes the party to sin because in the mudharabah contract the principle of justice really must be realized

No full textThis study determined to found the principles of the mudharabah muqayyadah contract agreement in the Islamic Financial Services Cooperative were following Islamic law or not? This study used a combined doctrinal (normative) and empirical (non-doctrinal) approach, interviews, observations and literature studies used to collect data. It was found that the values ??contained in the principles of the mudharabah contract agreement in the mudharabah financing product were in accordance with Islamic law based on (al-mabadi al-ammanah) a justice (al-Adalah), equality (al-Musawah), deliberation (al-Syura), mutual assistance (al-Ta'awun) and tolerance (at-Tasamuh). The factors that lead to breaking promises in mudharabah contracts were due to inadequate human resources, management of Islamic financial institutions, information systems and technology, and immorality in financing activities. The solution was to master the technical aspects, the philosophical law of Islamic economics and Islamic economic law. If there was a violation of the agreement, it would be resolved by a peace system (sulhu) then arbitration (tahkim) and by a judicial process (al-qadha)
