    On the Modernity of Consciousness and Literature : Natsume Soseki in Wakayama (1)

    In 1911, Natsume Soseki gave a lecture in Wakayama entitled “The Civilisation of modern Japan.” Since the 1960s, this lecture has been regarded as Soseki’s representative critique of Japan’s modernization. In the lecture, Soseki refers to human consciousness. Soseki was interested in the flow of consciousness, and read W.James and Bergson. Soseki was not the only one to be interested in the flow of consciousness at the time. Another such person was Nishida Kitaro, who published “A Study of Good” in 1911, the same year as Soseki’s lecture. In this paper (1), I will examine the conventional view of Soseki’s lecture and confirm that for Soseki, “anti-modernity” was a literary issue

    Another Side of the Restraint of Trade Doctrine : An Analysis of the Involuntary Restraints in Mitchel v. Reynolds

    The purpose of this study is to examine the meaning of judicial analysis regarding involuntary restraints in Mitchel v. Reynolds (1711). This case has been cited as the root of the Restraint of Trade Doctrine by Antitrust cases in the U.S., but the part about involuntary restraints has not been studied so far. This paper examines the tendency of decisions in cases concerning Custom and By-Laws, going back to the cases referred to in Mitchel v. Reynolds. These are relevant to the anti-monopoly tendency of Common Law, but rather to the importance of judicial review of the laws by private entities. In this judicial review, the reasonableness of the restraint of trade has been evaluated in relation to consideration (mutual advantages), proportionality of the penalty, and freedom of trade. Custom and By-Laws are often mentioned with privileges to restrain trade, but as far as the decision cited by the Mitchel case is concerned, it is evident that the courts considered that involuntary restraints should be reviewed under the test of reasonableness. Although part of the involuntary restraints was not ratio decidendi in the case, there has been commonality with the test of reasonableness in the voluntary restraints

    STEAM教育は「流行」のひとつである。しかし、学校現場で教師の工夫により以前より豊かに行われてきた「不易」の中に、この「流行」があるのではないか。STEAM教育を特に意識してこなかったこれまでの実践報告の中においてもSTEAMの要素を探すべく、和歌山大学教育学部附属小学校の毎年発行の研究紀要から、理科、社会科をはじめとした各教科の実践の中でSTEAMの要素を探し、見つけた。STEAMの要素はいろいろな教科ですでに見られるものであるという以前より論じられていたことを、和歌山大学教育学部附属小学校紀要の検討であらためて確認できた。小学校現場の先生方はすでにSTEAM教育の実践者であったと自信を持った上で、意識を持って力強くSTEAM教育を実践できるであろう
