Judge's Consideration in Proving The Elements of The Criminal Offense of Spreading False and Misleading News that Causes Consumer Damage in Electronic Transactions (Study of Decision Number 364/Pid.Sus/2023/Pn Jkt.Sel and Decision Number 782 K/Pid.Sus/2024)

    No full text
The rapid development of information and communication technology has had an impact on people's lives. One of them is the emergence of criminal acts of spreading false and misleading news that can result in consumer losses in electronic transactions. Consumers whose rights should be protected, such as the right to obtain security and correct information, are threatened by this criminal act. Proving whether or not the defendant has committed the charged act is the most important part of criminal procedure law. This thesis contains several problem formulations, namely: 1). How is the regulation of the criminal offense of spreading false and misleading news according to Indonesian positive law; 2). How to prove the elements of the criminal offense of spreading false and misleading news that results in consumer harm in electronic transactions; 3). How are the differences in judges' considerations in proving the elements of the criminal offense of spreading false and misleading news resulting in consumer harm in electronic transactions (Study of Decision Number 364/Pid.Sus/2023/PN JKT.SEL and Decision Number 782 K/Pid.Sus/2024). At the end of this study, it can be concluded that there are differences in the consideration of judges in verdict number 364/Pid.Sus/2023/ PN Jkt.Sel and verdict number 782 K/Pid.Sus/2024 seen in the verdict of the district court which decided that the defendant was not proven to have committed the crime of spreading false news, while the supreme court decided that the defendant was proven to have participated in the crime of spreading false and misleading news. The difference in the decision was motivated by the different considerations of the judges on the role of the defendant in realizing the criminal act of spreading false news. So that the Supreme Court judge disagreed with the district court's decision and was of the opinion that the district court judge ruled out the element of participation in committing a criminal offense.128 PagesSkripsi Sarjan

Problem Solving in the EX-HGU Land Of PTPN II in the Post-Shareholder’s Decree of The Minister of BUMN No. S-923/MBU/12/2021 DSPN, DSN/KPPS/94/X11/2021 on the Approval of Book-Eliminating and Asset Transfer of Ownership of EX-HGU Land

    No full text
PT Perkebunan Nusantara II (PTPN II), a state-owned enterprise (BUMN), manages land under leasehold (HGU) arrangements. A portion of this land, classified as ex-HGU land, has been subject to renewal as regulated by BPN Directives No. 42, 43, 44 of 2000 and No. 10 of 2004. These directives apply to land parcels located in Deli Serdang, Langkat, and Binjai, North Sumatera, covering an area of 5,873.06 hectares. Redistribution of this land requires official approval through asset renunciation. The renunciation process of BUMN assets must be legally certain, ensuring justice and protection for all involved stakeholders. This research addresses three key questions: (1) What are the procedures and mechanisms for the renunciation of ex-HGU land from PTPN II? (2) What are the legal foundations for granting compensation for these assets? (3) What are the legal implications following the issuance of the Minister of BUMN Decree No. S-943/MBU/12/2021 DSPN, DSPN/KPPS/94/XII/2021? This study employs a normative juridical approach supported by both primary and secondary data, analyzed qualitatively. The findings indicate that the renunciation of ex-HGU land from PTPN II requires coordination with multiple parties, including document verification, approval for asset write-off, determination of compensation, and the certification process. The transfer of ownership—based on a Normative List issued by the Governor of North Sumatera covering 25 land plots totaling 836,656 m² (83.66 hectares)—begins with the shareholder directive of PTPN II and continues through the ministerial decree, eventually assigning the land to eligible recipients identified by the B Plus Committee. This committee includes individuals, ministerial foundations, and local government representatives, with the overarching goal of enhancing community welfare. The overall process adheres to legal frameworks and includes administrative and jurisdictional verification steps.202 PagesTesis Magiste

    No full text
Nosocomial infection is a serious problem in hospitals where transmission occurs directly, through object contamination, and vector intermediaries, one of which is cockroaches that carry antibiotic-resistant pathogens, including Staphylococcus aureus, E. coli, Pseudomonas aeruginosa, and Klebsiella pneumoniae. Therefore, vector and pests control is important to prevent the spread of these infections. This study aims to analyze the control of vectors and pests at Army Hospital Pematangsiantar City. This type of research is descriptive observational with objects as many as 7 rooms. The results showed that control was only handled by one officer from the field of environmental health who was assisted by a third party, namely cleaning service with 94.7% having never received training. Materials and equipment used include abate with the active ingredient Temephos, aerosol insecticides with the active ingredients Transflutrin, Prallethrin, and Cypermethrin, heat fogging machines, automatic rat traps, and cat catcher nets. Mosquito control is carried out by installing wire mesh on vents, cockroach control uses aerosol insecticides with the active ingredients Transflutrin, Prallethrin, and Cypermethrin, cat control uses a round net-shaped cat catcher with a frame and a long handle as a handle, and rat control uses salted fish bait installed in traps. Based on the evaluation of environmental health quality standards, Aedes aegypti, Culex, and cat larvae did not meet the requirements, while cockroaches and rats did. Overall, vector and pest control at Army Hospital Pematangsiantar City is not yet in accordance with Permenkes RI No. 2 of 2023 concerning Environmental Health and No. 7 of 2019 concerning Hospital Environmental Health. Suggestions to the Army Hospital Pematangsiantar City include organizing training, appointing a special person in charge of vector control, completing tools and materials, and collaborating with competent third parties.121 PagesSkripsi Sarjan

The Effectiveness of the Combination of Fragrant Pandan Leaf (Pandanus amaryllifolius) and Papaya Leaf (Carica papaya) Extracts as a Bioinsecticide Against Houseflies (Musca domestica)

    No full text
Houseflies are one of the disease vectors that carry pathogens through mechanical contamination. The use of natural insecticides is an environmentally friendly alternative for vector control because they are biodegradable and have minimal impact on the environment. This study aims to determine the effectiveness of a combination of fragrant pandan leaf (Pandanus amaryllifolius) and papaya leaf (Carica papaya) extracts as a bioinsecticide against houseflies (Musca domestica). This study employs a quantitative approach using a true experiment method with a post-test only control design. The sample in this study consisted of 240 houseflies, with 10 flies in each test cage, and treated with extract concentrations of 20%, 40%, 60%, and 80%, a negative control (ethanol), and a positive control (pirimiphos-methyl). The experiment was repeated four times, with exposure durations of 1 hour for a total of 4 hours. The results of this study showed that the lowest mortality rate of houseflies after the use of the bioinsecticide was 17.5% (1 test fly) at a concentration of 20%, while the highest mortality rate occurred at a concentration of 80%, with 90% (9 test flies). The results of the one-way anova data analysis yielded a p-value = 0.001 (p < 0.05), indicating a significant difference among the treatments. The Post Hoc test results showed that the 80% concentration did not differ significantly from the positive control, indicating its potensial as an alternative to synthetic insecticides (pirimiphos-methyl). The probit test results showed that the estimated Lethal Concentration (LC50) for frgarant pandan leaf extract and papaya leaf extract was at concentration of 46.469%. It is expected that the results of this study can serve as a basis for the development of effective, safe, and environmentally friendly natural bioinsecticides as an alternative to synthetic insecticides in controlling houseflies.139 PagesSkripsi Sarjan
