論保險法之損失填補原則;A Study on Principle of Indemnity in Insurance Law
[[abstract]]損失填補原則為我國保險法制所承認之上位概念,但於我國保險法制之實際適用則有所疑義,此實乃我國保險法制對於保險契約分類有所缺失所致。我國現行就保險契約之分類,採取人身保險與財產保險此分類方法,產生諸多爭議,雖大法官會議釋字第576號解釋認定人身保險並無複保險暨保險代位之適用。惟亦導致有實務見解認為實支實付型醫療費用保險具有損害填補性質,仍應有複保險規定之適用。然實支實付型醫療費用保險契約之保險標的仍為被保險人之生命、身體暨健康,其本質仍屬於人身保險,除現行法規對於保險契約之分類方法有所更迭,否則無論係日額給付或實支實付型之醫療費用給付保險均為人身保險之範疇,其性質均不具損害填補性質。 此外,現行保險法制對於保險契約之分類疑義,亦發生於海上保險與定值保險之相關問題。按海上保險具有商人保險之性質,實務運作上亦多以定值保險型態為約定之,海商法之海上保險章無特別規定時,保險法之規定則適用於海上保險。然保險法形式上雖對各式險種均有所規定,但若以消費者保險暨商人保險之性質加以區分後,我國保險法之所有規定是否均得適用於商人保險,則有所疑義。 海上保險為財產保險,自有損失填補原則之適用,但其亦具有商人保險之性質,應容許其保有較高程度之契約自由,當事人於定值保險就保險標的價額之約定,為當事人之契約自由。因此除當事人有詐欺或就重要事項為未告知或不實說明情形外,當事人基於契約自由約定保險標的之保險價額,縱使與損失填補原則有所偏離,亦應尊重之,否則將損及商業運作之實際需求與運作
從憲法上權利保障之觀點論偵查中犯罪嫌疑人之辯護權;
[[abstract]]司法院釋字第582號、第654號解釋雖已揭示刑事被告受辯護人協助之權利(辯護權)係受憲法第16條訴訟權及第8條第1項正當法律程序所保障,惟憲法第16條、第8條的保障範圍有其界限,難以涵蓋到不具審判性質、不採對審結構的偵查程序,本文研究結果認為偵查中辯護權的憲法依據應直接引用正當法律程序原則即可,毋庸與基本權規定相連結。 其次針對我國採行辯護制度之目的及偵查中辯護權的修法歷程進行說明,並分析兩公約國內法化所產生的影響,以及偵查中犯罪嫌疑人之辯護權無法落實的實務面、法規面原因。本文另就我國辯護人的法律地位與功能,在參酌德國學說理論並考量我國國情後,提出不同於通說的看法,主張我國刑事辯護人應係「具有公益性格之當事人單方??輔助者」;又基於被告在刑事程序中所具有的程序主體地位,本文認為辯護權的權利主體僅有被告,而辯護人因為具有公益性格及法律專業知?,故與辯護有關之決策權除少數根本事項以外,均應由辯護人獨立行使。 此外,本文並以偵查中辯護權的憲法依據即正當法律程序原則為基礎,重新建構、描述偵查中犯罪嫌疑人各項辯護權—包括權利告知、在場權、自由溝通權以及偵查中閱卷權等諸多重要辯護權利的應然面,並提出符合正當法律程序以及人權保障標準的具體修正建議
論我國國家級風景區域公有公共設施之國家賠償責任;
[[abstract]]公有公共設施設置及管理瑕庛所造成之國家賠償責任,既以保權人民權利不受國家機關侵害為本旨,採取無過失責任主義為法理基礎,自應對於免責事由之認定趨以嚴格,俾使人民權利受到保障,但如若因之未予妥適檢視案件之合法合理性即予作為賠償的情形過度傾斜,致生人民權利自我意識的無限上綱心理,則非僅對於納稅人不公,更是影響基層行政機關及執行公務員之士氣。因此,落實國家賠償案件之免責事由檢核,不致造成人民濫權請求賠償,方可得到真正公平正義。 有鑑於各個國家級風景區幾乎皆係設置於,具有特殊重要國家生態資源、特殊人文自然景觀範圍、國土脆弱亟需保護、水源涵養保護及水土保持區域,是以,該管理機關,皆同時具有保存國家生態資源、特殊人文自然景觀保護、國土安全保護、水源涵養及水土保持等等關諸國家安全、全民利益及國家資源保存之重大國家任務的擔負。因此,當在區域內進行公有公共設施設置,以發展觀光旅遊開發行為之時,必需受到各個環境法規的限制及相關具建設開發審核權機關之管制,方能不致形成長久重大的全民權利損害。所以,當渠等任務間發生相互拮抗或輕重排擠之影響,致成人民損害發生時,則應納入衡酌國家賠償的成立與否重要要件。如此對於管理機關推動公務的兩難處境,方可得到適當合理的解除。緣此,在判斷公有公共設施之設置或管理是否有欠缺時應考慮社會性、整體性及時代性,對於環?保護及生態保育等觀念顯已具體存於普羅大眾的知識之內,故對於公有公共設施設置及管理欠缺,司法機關實應整體衡酌,其不足與欠缺之要件究竟是否成立,方為合乎公平公正之法理原則;不應僅予考慮安全性的提升,而枉顧前揭環境保護公益。 再者,國家級風景區設置地域,因多係屬自然環境保存良好具優美天然景觀及未予開發或僅輕度開發之國土範圍,立地又多是高山、濱海等微氣候多變的環境,進入該區域之民眾,應具有相對於危險環境程度更高的注意義務,係屬合理要求,對於遊客之當事人責任應相對提升而不應將個人警覺性不足的責任,過度苛責要求由該管理機關負有國家賠償責任,方顯公平。同時區域內天然環境的不可抗力因素所含括之災害諸如雷擊、土石崩坍、洪水、土石流及落石等等不可預測之隱藏性即時災害,發生可能較於市區的遊樂區或公園明顯高出許多。對於處於我國高度自然環境之國家級風景區內的不可對抗之天然危險因子造成傷害應成為管理機關免除國家賠償責任之明確事由。其次,國家賠償案件之被害人與有過失,自身未能合於通常用法之行為,而造成權利受到侵害之事實,究否成為「免責事由」亦待深入討論
公法上金錢給付義務執行名義之審查權限研究;
[[abstract]]自設立行政執行署以來,我國行政執行之效率大增,但此追求效率之執行是否全然無缺陷或檢討之處,於執行程序上是否有可茲改進之處並且與強制執行法有何差異?本文嘗試由行政執行法第26條以及法務部相關函釋出發,得知目前公法上金錢給付義務之執行名義準用強制執行法僅可形式審查。 基於強制執行的程序保障法理上可發現,公法上金錢給付義務之一的行政處分在細緻區分後,不符合執行程序之保障法理,有難以確保執行成果和最終實體一致之可能,此時此形式審查似乎非基於法務部函釋準用強制執行法直接得出形式審查。 在考量行政執行署與移送機關間權力分立平衡、組織法上功能最適理論以及行政處分實體法上各種效力可知悉即便不基於執行程序之法理,行政執行署也有諸多理由不可介入而為全面且實質之審查。 但因我國採取行政處分不停止執行制度,未確定之處分且有瑕疵之處分,若給予強制執行將造成行政效能浪費,更甚之乃為不可回復性有重大損害的執行。故若在行政執行署執行公法上金錢給付義務之強制執行時,未確定之行政處分且執行有不可回復而有重大損害,例如不僅僅涉及財產權更有居住權等其他權力且因執行程序(拍賣安定性)不可回復時,此時應例外給予行政執行署審查權限,促使移送機關併送證卷資料,說服行政執行署為合法處分以免造成義務人不可回復之重大損害
股東權之發展與規範體系-以經營者義務及責任本位為中心;A Study on Development and Regulatory System of Shareholder’s Rights—Focusing on the Standard of Operator’s Duties and Responsibilities
[[abstract]]隨著現代股份有限公司股權大量分散之趨勢,為能有效運作公司,近一世紀以來之趨勢即為逐步強化董事會之權能,透過集中而高權之權力機關運作來推進公司運作之效率,但集中賦權之結果亦潛藏經營者違法濫權之危險,特別在對股東會有控制權能之董事,由於公司內部無人可透過內部救濟管道使該董事負責,因此時有身兼董事職位之大股東挾著優勢控制力壓迫小股東之情事發生,倘若股東權制度中對於經營者之義務及責任規範不夠周延,難以互相呼應,則權利受侵害之股東透過法律所賦予之管道欲取得救濟時將受許多不必要之阻礙而使救濟窒礙難行,股東權利之實質保障恐成為空談,因此有必要從較為宏觀之角度檢視整體股東權之規範設計與運作。 本文從股東權之基本理論出發,初步劃定經營者義務及責任本位股東權範圍後,再從英國、美國、日本個別股東權法制發展之脈絡與規範體系觀察其規範所考量之切入點以及所欲達成之規範目的,並從該觀察之研究中,探究於我國有效可行之法規範模式並試行提供粗淺之修法建議。
In order to effectively operate the company under the trend of separation of ownership and control in modern corporate, it has become a tendency to gradually strengthen the power of the board of directors in recent one century. By the means of centralizing and strengthen the power of the authority to promote the operating efficiency, but lead to the risk of abusing power by the operator. Considering that the directors who have enough shares to control the shareholder meeting may have highly possibility using their power and privilege to oppress the minority shareholders, it will be very hard for shareholders to access legal remedy if the legal regulation system of shareholders’ right in regard to the obligations of operator’s duties and responsibilities is not effective and coordinated. Therefore, it’s necessary to examine recent legal regulation of shareholder’s right from the macroscopic view. This essay starts from the basic theory of shareholder’s rights, and initially sets up the scope of the standard of operator’s duties, and then observes the purpose of regulation and legal order from the development and regulatory system in UK, U.S and Japan. At the end, exploring the viable and efficient regulation in Taiwan and providing some suggestions for amendment based on the research of this essay
使用OpenMP平行防碰撞偵測;Parallel Collision Detection with OpenMP
[[abstract]]近年來,工業 4.0 崛起,智慧工業蓬勃發展,工具機扮演重要的角色,針對五軸工具機開發防碰撞偵測程式,模擬實際機台即時碰撞偵測,以快速的運算速度去計算各軸移動的結果,判斷有無碰撞發生,避免工具機實際發生碰撞造成的巨大損失。 為了能夠模擬即時判斷防碰撞,其運算時間必須超越工具機本身加工的速度,2016 年張仁傑利用 GPU 來加速防碰撞偵測程式,但由於 GPU 的價格相當昂貴,美金 100 到 3000 不等,對於工具機都是額外成本,所以本論文將以 CPU 加速防碰撞偵測為主。 因此,我們使用 OpenMP 來實現 CPU 平行化防碰撞偵測,首先我們以 Gprof、Gprof2Dot 和 Perf 分析防碰撞偵測,分析結果可知,兩物件的偵測是否有相交是防碰撞偵測消耗最多運算資源部分,所以我們針對此部分以 OpenMP 進行最佳化,首先我們先利用 Loop-Unrolling 來加速程式,降低指令數,接下來,將兩物件的偵測分成兩部分,使 OpenMP 同步執行,並以 OpenMP loop simd construct來平行化且向量化。本論文研究結果指出,以 CPU 平行防碰撞偵測程式,將比未平行化前加速約 17 倍快
整合軟體定義網路與OpenStack之可擴充式管理系統;A Scalable Integrated SDN and OpenStack Management System
[[abstract]]隨著雲端運算的快速發展以及需求不斷增加下,導致資料中心網路變得更加龐大與複雜化,使得在硬體設備的擴充與網路管理上,皆需要耗費高額的成本與人力,而軟體定義網路與OpenStack的出現能緩解資料中心所面臨的問題。由於軟體定義網路控制器與OpenStack皆有各自的管理介面,因此要了解整體網路概況,必須在兩個管理介面做切換。除了上述的問題外,軟體定義網路控制器的管理介面通常是利用引力與斥力計算節點位置的方式顯示拓樸,用來顯示資料中心的特殊拓樸結構時會顯得混亂,例如:多重根樹狀的三層式網路拓樸。本論文提出一個整合SDN與OpenStack的可擴充式管理系統,此系統同時具有靈活性(agility)與即時性(real-time)。管理系統由網頁管理介面模組、控制器模組、OpenStack控制節點以及sFlow Agent所組成,模組之間的溝通則是採用REST API或是websocket。為了顯示大型網路拓樸,網頁管理介面依據拓樸大小,建構具有縮放機制的多層級拓樸視圖,並且提供流量監控、Flow Entry管理以及節點相關資訊;控制器模組整合自動拓樸發現、主機狀態追蹤、負載平衡、錯誤偵測等功能;而OpenStack控制節點負責監控虛擬主機和通知控制器。透過功能展示可以證實,本論文提出的管理系統具有可擴充性與可用性,並可藉由管理介面能夠進一步確認錯誤回復和虛擬主機遷移。此外,本論文也將進一步探討拓樸狀態監控機制並且進行優化,實驗結果顯示處理封包和更新狀態的時間減少80%以上。
With the rapid development and increasing demand for cloud computing, management of a cloud data center has become more and more complex. In particular, the emerging demand of dynamic and flexible network management and plug-and-play of hardware equipment becomes a great challenge to cloud data center. The appearance of Software Defined Network and OpenStack are promising solutions to the aforementioned management problems. However, the SDN controller and OpenStack management console have their own management interface, the data center managers have to switch the interface between them in order to understand the current status of network and computing resources. In addition, the network topology of a data center usually adopts a three layer hierarchical structure and consists of thousands of switches. However, the network topology auto-discovered by the SDN controller is usually displayed by calculating gravity and repulsion of network nodes which results in a messy manner. Thus, development of a management system which integrates information from SDN controller and OpenStack manager and provides scalable and structured topology view is critical to cloud data centers.In this research, we implemented a management system that integrates SDN and OpenStack to provide agility and real-time management. The management system is consisted of four modules, namely the web-based management interface, SDN controller, OpenStack manager, and the sFlow agent. RESTful API and websocket are used for communication between modules. In order to display large-scale topology, a multi-level illustration of scalable topology with zoom-in and zoom-out functionality is constructed by the web-based management interface for large size topologies. Moreover, web-based management interface also provides other functionality, such as traffic monitoring, flow management, and node information. The SDN controller offers important network control and monitoring functions, include topology discovery, host tracker, load balancing, failure recovery, and so on. The OpenStack manager is responsible for monitoring virtual machine and providing real-time information to the SDN controller. The scalability and usability of the management system is demonstrated via prototyping. Moreover, this research also explores that how to optimize the topology status monitoring (TSM) mechanism. The result shows that the time of processing packet and updating status is reduced more than 80%
混合式教學對國小自然科學習成就之影響;A Case Study of Improving the Learning Achievements on Science and Technology Education for Elementary School Students via Blended Learning
[[abstract]]混合式教學指的是結合傳統教學與線上學習的一種教學策略,由於其結合的傳統教學與線上學習的優點,因而越來越受到矚目。這篇論文以國民小學自然與生活科技課程為例,探討混合式教學對學生學習成就的影響。受限於實驗學校的班級人數限制,我們採用非對等控制組設計,共有2所學校、3-6年級的學童共106人參與實驗,其中實驗組有60人、控制組46人。實驗組在每週的自然與生活科技課中抽出一節課,讓學生進行線上自我學習,歷程14週,實驗結束後檢測其學習成就是否與控制組有顯著差異。實驗線上教學平臺採用Open edX,除提供線上學習功能外,其日誌檔亦作為分析之用。為了瞭解學習成就與學習動機與電腦應用能力的關係,實驗採用學習動機導向策略量表(MSLQ)與網路自我效能量表(OTSES)分別測量學童的學習動機與電腦應用能力。實驗結果為:1)實驗組的3-5年級學童在電腦技能上有顯著進步;2)學習動機4-6年級無顯著變化,但實驗組3年級的學童在實驗後顯著低於控制組;3)實驗組4年級及部份5年級學童在混合式教學下可得到顯著的進步。
Blended learning, where students not only attend the traditional face-to-face class, but also acquire online courses on the Internet or from media technology, is held in high regard today. In elementary school, science and technology education aims to help children use technology tools and to see how science disciplines, like math and science, are relevant to engineering. In this study, we focused on what category of learning profile contributes to a higher achievement for the science and technology subject in a blended learning environment.We deployed an Open edX server acted as the online learning platform. All online learning activities can be logged for further analysis. Moreover, we measured students’ computer skill and learning motivation to understand how they affected learning performance achievement in the blended learning environment. The participants consisted of 106 elementary school students. The students ranged from third-grade to sixth-grade. The experimental course was Science and Technology that was a compulsory course for third-grade to six-grade elementary school students. The students of experimental group can access the online learning platform anytime anywhere, but they had to login the online learning platform in school for self-learning one lesson per week. Most teaching materials within the platform were videos, quizzes, and forum. This procedure lasted for fourteen weeks and covered two sectional examinations. We adopted Online Technologies Self-Efficacy Scale (OTSES) and Motivated Strategies for Learning Questionnaire (MSLQ) to measure students’ computer skill and learning motivation respectively, and performed ANCOVA on the two questionnaires.The results indicated: 1) students’ computer skills significantly improved with the exception of the sixth-grade students; 2). there was no significant difference on learning motivation via the blended learning environment; 3). students of the experimental group with higher MSLQ and OTSES scores had improved their learning achievements than that of the control group for the fourth and fifth grades
公視在台灣電視劇產業扮演的角色: 以《通靈少女》為例;
[[abstract]]公共電視與HBO Asia跨國合作拍攝的迷你影集《通靈少女》,從進入公眾視線之日起,便在台灣各地掀起陣陣討論熱度,題材新穎吸睛,情節引人動容,短短幾周內,掀起了一股振奮人心的「仙姑熱潮」,在各界積極尋求台灣戲劇「絕地重生」契機的這個關鍵階段,不但注入了一劑強心針,更重要的是展示了一個實質上具備啟發作用的珍貴案例,呈現出廣大觀眾心目中真正期待的「好戲」元素,歸納了值得其他台劇在創作與製作上參考的經驗。《通靈少女》的成功,其價值遠遠超乎一個單一作品的「走紅」。本研究從公共媒體與電視劇產業發展的脈絡關係著手,並以《通靈少女》為個案研究,藉由文本分析《通靈少女》的成功因素,其內容創新或獨特的元素,最後經由分析《通靈少女》的產製條件,進一步討論公視在台灣的電視劇產業所應扮演的角色,包含影視人才培育、題材創新開發等。研究結果發現,《通靈少女》在短短 6 集的篇幅內,以本土傳統信仰(宮廟文化)做為主軸的敘事結構,廣泛地涵蓋了台灣土地上家庭、倫常、人際的核心價值,以及充滿共鳴溫度的少女青春成長心路歷程,試圖處理包括通靈宮廟、少女成長校園、與芸芸眾生這 三 條故事線,反映通靈少女謝雅真(郭書瑤飾)多面向的人生,包括她對愛情的渴望、身為通靈少女與生俱來的責任,還有親情的糾結,以及宮廟也難以免俗地受到商業操作和物質慾望的社會影響。《通靈少女》的成功,不但可以讓台灣獨特的本土文化觸達更多觀眾,刺激台灣電視劇產業重新思考內容的發展方向,也讓台灣影視人才在現今低迷的影視環境中看到一絲的曙光。《通靈少女》在相對意義上的成功,也反映公視在台灣電視劇產業扮演的獨特角色,遍及影視人才培育、影視製作及映演平台,以及台劇品牌的推廣
以機械偏掃技術應用於超音波智能輔助盲人杖之研究;Application of Mechanical Deflection Technique in Ultrasonic Smart Assisted Blind Cane
[[abstract]]由於科技的發展和應用對人類的影響日趨廣泛而深遠,1921年,人類發明了第一支導盲杖;一百年後,縱使我們手中的手機推陳出新,但盲人用的還是導盲杖,盲人擁有的輔助科技還在原地踏步。雖然目前身障礙者有許多輔助工具能改善行動上的不便,但卻大多是單價相當高的產品。本論文主要是設計一個低成本超音波智能輔助盲人杖來改善盲人杖使用效能:在導盲杖中加入超音波感測模組、雙超音波感測模組及伺服馬達掛載超音波感測模組,並實驗其各別效能。經實驗,伺服馬達掛載超音波模組,以機械轉動偏掃方式進行測距告警,有效感測上下範圍增加30度,改善單一超音波模組垂直感測範圍,避免雙超音波模組相互干擾,另懸空障礙物實驗中,可感測最小面積至25平方公分,及在感測距離200公分的條件下,無盲區感測達到面積13225平方公分。
Recently, the development and application of technology has been far-reaching and has created a wide impact on people's lives. We invented the first guide cane in 1921. Information and digital techniques have made large progressive strides in the recent century; however, the blind still use the conventional guide cane, which means that assistive technology of the blind has not made any progress.Although there are many assistive tools that can alleviate the inconvenience of actions, most related products are very expensive. To enhance the effectiveness of the state-of-the-art blind cane, this Thesis proposes an innovative design of a low-cost ultrasonic smart assisted blind cane. Mainly, the proposed guide cane has mounted an ultrasonic sensing module, a dual ultrasonic sensing module, and a servomotor. Experiments are performed for assessing its performance.The proposed guide cane had the servomotor mounted with an ultrasonic module and using mechanical deflecting rotation for distance warnings in the guide cane resulted in an increase of 30 degrees in both the upper and lower bounds of the effective sensitivity, when compared to vertical sensing range of a single ultrasonic module. We could also avoid the mutual interferences between the dual ultrasound modules. Further, in the experiment of suspended obstruction, the area of the minimum sensing was 25 square centimeters, and for a distance of 200 cm, the area was 13,225 cm2. As a result, we effectively reduced the ultrasound blind spots
