Uluslararası insancıl hukukta tıbbi etik
Protecting human life is the common goal of Medical Ethics and International Humanitarian Law (IHL). Within the framework of International Humanitarian Law (IHL), Medical ethics plays an important role in protecting the wounded and sick affected by armed conflicts and providing health services without discrimination. In this study, the obligation to provide health services in armed conflict zones impartially and without discrimination, the prohibition of attacks on patients, wounded and healthcare personnel, the protection of healthcare facilities and the prevention of misuse of healthcare tools by the parties to the conflict, the ethical responsibilities of state and non-state actors in the conflict zone and the problems that arise in practice in conflict zones are discussed. The problem in today's armed conflicts is not the legal and principled problems in IHL rules and medical ethics, but the problems in their implementation. In fact, it is possible to reduce the problems by providing training to healthcare personnel and parties to the conflict in the conflict zone and by introducing some local regulations regarding their behavior.İnsan hayatını korumak, Tıbbi Etik ve Uluslararası İnsancıl Hukuk'un (IHL) ortak amacıdır. Uluslararası İnsancıl Hukuk (IHL) çerçevesinde, tıbbi etik, silahlı çatışmalardan etkilenen yaralı ve hasta bireyleri korumada ve sağlık hizmetlerini ayrımcılık yapmadan sunmada önemli bir rol oynamaktadır. Bu çalışmada, silahlı çatışma bölgelerinde sağlık hizmetlerinin tarafsız ve ayrımcılık yapmadan sağlanması zorunluluğu, hasta, yaralı ve sağlık personeline yönelik saldırıların yasaklanması, sağlık tesislerinin korunması ve sağlık araçlarının çatışma taraflarınca kötüye kullanılmasının engellenmesi, çatışma bölgesindeki devlet ve devlet dışı aktörlerin etik sorumlulukları ve çatışma bölgelerinde uygulamada karşılaşılan sorunlar tartışılmaktadır. Günümüz silahlı çatışmalarındaki problem, IHL kuralları ve tıbbi etik alanındaki hukuki ve ilkesel sorunlar değil, bunların uygulanmasındaki sorunlardır. Aslında, çatışma bölgesindeki sağlık personeline ve çatışma taraflarına eğitim verilerek ve davranışlarına yönelik bazı yerel düzenlemeler getirilerek bu sorunlar azaltılabilir
Revenue enti̇tlement in zurri̇ waqfs accordi̇ng to Turki̇sh ci̇vi̇l law
743 sayılı Türk Kanunu Medenisi'nin yürürlüğüyle birlikte bu kanunun yürürlüğünden önce kurulan vakıflar ile sonra kurulan vakıflar ayrı hukuki düzenlemelere tabi tutulmuştur. Söz konusu kanunun yürürlüğünden sonra kurulan vakıflar yeni vakıf olarak tabir edilmiştir. Bu vakıfların hukuki esasları ilk olarak 743 sayılı Kanuna, bu kanunun ilgasından sonra ise 4721 sayılı Türk Medeni Kanunu hükümleriyle birlikte 5737 sayılı Vakıflar Kanunu hükümlerine tabi tutulmuştur. 743 sayılı kanunun yürürlüğünden önce kurulan vakıflar eski vakıf olarak ifade edilmiş ve öncelikle 2762 sayılı Vakıflar Kanunu, bu kanunun ilgasından sonra ise 5737 sayılı Vakıflar Kanunu hükümlerine tabi tutulmuştur. Eski vakıflar, İslam/Osmanlı hukuk düzeninden Türk hukuk düzenine intikal etmiş vakıflar niteliğindedir. Zürri vakıflar, bu nitelikte bir eski vakıftır. Bu vakıflar 5737 sayılı Vakıflar Kanunu'na göre mazbut ya da mülhak vakıf niteliğindedir. Zürri vakıflarda vakıf malvarlığının gallesi anlamına gelen geliri, vakfedenle kan bağı ilişkisi içinde olan birtakım kimselere şart koşulmaktadır. Bu kimselerin lehlerine şart koşulan galleden yararlanması ise Türk hukukunda dava açma şartına bağlanmıştır. Bu davaya uygulamada galleye müstehak vakıf evladiyetinin tespiti davası denmekle birlikte çalışmamızda bu dava galle üzerinde hak sahipliği davası olarak isimlendirilmiştir. Bu dava, çalışmamızda zürri vakıflar temelinde inceleme konusu yapılmıştır. Bu kapsamda çalışmamızın ilk temel araştırması zürri vakfın hukuki yapısı üzerinde olmuştur. Bu doğrultuda zürri vakıf kavramı, hukuki niteliği, kuruluşu ve unsurları bu vakıfların kaynağı olan İslam hukukuna görev incelenmiştir. Çalışmamızın ikinci ana araştırması vakfın gallesi ve Türk hukukunda bu galleden yararlanma şartları üzerinde yapılmıştır. Bu kapsamda ayrıca galleden yararlanma kapsamındaki vakfiye şartları değerlendirilmiş ve bu bağlamda vakfiyenin yorumu ele alınmıştır. Çalışmamız kapsamındaki son ana inceleme ise galle üzerinde hak sahipliği davası üzerinde yapılmıştır. Bu dava hukuki nitelik, konu, taraflar, deliller, esasa ilişkin inceleme, hüküm ve sonuçlar bakımından incelenmiştir.With the enactment of the Turkish Civil Code No. 743, foundations established before and after this law became subject to different legal regulations. Foundations established after its enactment are termed new foundations, initially governed by Law No. 743 and later by the Turkish Civil Code No. 4721 and the Law on Foundations No. 5737. Foundations established before Law No. 743 are known as old foundations. Initially, they were subject to the Law on Foundations No. 2762 and later to the Law on Foundations No. 5737. These old foundations transitioned from the Islamic/Ottoman legal system to the Turkish legal framework. Zurri foundations fall within this category and are classified as either mazbut or mülhak under Law No. 5737. In zurri foundations, the income (galle) from foundation assets is allocated to certain individuals related to the endower by blood. However, benefiting from this income under Turkish law requires filing a lawsuit. This lawsuit, commonly called the determination of the sonship of the waqf entitled to the income, is termed in our study as the ownership lawsuit for the right to the income. Our study first examines the legal structure of zurri foundations, analyzing their concept, legal nature, establishment, and elements based on Islamic law, which originally governed them. The second focus is on waqf income and the conditions for its utilization under Turkish law. Here, the criteria for benefiting from the waqf's income and the legal interpretation of the waqf are evaluated. Finally, the study examines the right of ownership over waqf income. This includes an analysis of its legal nature, subject matter, parties, evidence, merits,vii judgment, and legal outcomes. Through this, the study aims to provide a comprehensive understanding of zurri foundations and related legal proceedings
Use of artifıcial intelligence in foundation activities: Legal regulations and application examples
Vakıflar, gerçek veya tüzel kişi vasıtasıyla mevcudiyetini ortaya koyan iyilik yapma duygusunu ve dayanışmayı, hukuk düzlemine taşımış olan ve sürekli olması sebebiyle insan ömrünün ötesinde devam edebilen, ulusların manevi gücünün ve değerinin ortaya konulmasına yardımcı olan tüzel kişiliklerdir. Vakıflar, kişisel ve içtimai ihtiyaçların karşılanması amacıyla ortaya çıkmış olsa da pek çok alanda meydana gelen gelişmelerin sonucunda içinde bulunduğu toplumların sosyo-kültürel yapısı, ekonomik olanakları ve yetenekleri ile bağlantılı olarak gelişmiş ve değişime uğramıştır. Günümüzde yapay zekâ kullanımı birçok disipline ve yaygın bir çevreye ulaştığı tartışılmaz bir gerçektir. Öyle ki, vakıfların faaliyetlerinde yapay zekâ kullanması da mümkündür. Vakıflar, faaliyetlerini icra ederken yapay zekâ yazılımları ile hız, verim, maliyet gibi katkılar elde ederken etkili ve vakfın amacına en uygun şekilde hareket edebilmektedir. Yapay zekânın hukuki kişiliği, hak ve fiil ehliyetini haiz olabilmesi yıllardır tartışılan bir konudur. Yapay zekânın hukuki kişilik statüsü olup olmadığına ilişkin olarak kişiliği kabul edenler ve reddeden görüşler bulunmaktadır. Vakfın kuruluşunda, yönetiminde, amacına uygun gerçekleştirdiği faaliyetlerinde yapay zekânın kullanımı mümkündür. Ayrıca birçok vakıf, bireyler arasında yapay zekâ kullanımının yaygınlaşması için de çalışmalar yürütmektedir. Uygulamada yapay zekâ kullanan birçok yerli ve yabancı vakıf bulunmaktadır. Yapay zekânın olumlu yönleri yanında olumsuz yönleri de bulunmaktadır. Yapay zekâ kişisel verileri, özel nitelikli kişisel verileri işlemesi ve belli algoritmalarla çalışması sebebiyle bazı hak ihlallerine de yol açabilmektedir.
-----Foundations are legal entities that reveal their existence through a real or legal person and carry the feeling of mutual solidarity and doing good to others to a legal status. It also can continue beyond human life with the concept of continuity, helping to define the spiritual power and value of nations. Although foundations emerged to meet personal and social needs, they have developed and changed in connection with the socio-cultural structure, economic opportunities and talents of the societies they are in as a result of developments in many areas. Today, it is an indisputable fact that the use of artificial intelligence has reached many disciplines and a widespread environment. In fact, it is also possible for foundations to use artificial intelligence in their activities. Foundations can act effectively and in the most appropriate way for the purpose of the foundation while achieving contributions such as speed, efficiency and cost with artificial intelligence software while performing their activities. The legal personality of artificial intelligence, its ability to have rights and legal capacity has been discussed for a long time, including today. There are different views that accept or reject the status of artificial intelligence as a legal person. It is possible to use artificial intelligence in the establishment, management and activities of the foundation that are in line with its purpose. In addition, many foundations are working to spread the use of artificial intelligence among individuals. There are many local and foreign foundations that use artificial intelligence in practice. Artificial intelligence has both positive and negative aspects. Artificial intelligence can also lead to some rights violations due to the processing of personal data, special personal data and working with certain algorithms
Evaluation of the sanctions for not attending the first meeting in the mediation process within the framework of the decisions of the turkish constitutional court
Dava şartı arabuluculuk, 7036 sayılı İş Mahkemeleri Kanunu ile 1 Ocak 2018’de yürürlüğe girmiştir. Bu düzenlemeye göre, taraflar mahkemede haklı bulunsalar bile arabuluculuk sürecine katılmadıkları takdirde yargılama giderlerinden sorumlu tutulacaktır. Bu düzenlemenin hak arama özgürlüğünü ihlal ettiği gerekçesiyle 2018 yılında Anayasa Mahkemesi’ne iptal davası açılmış, Mahkeme düzenlemenin Anayasa’ya aykırı olmadığına karar vermiştir. Ancak, 14 Mart 2024 tarihli kararında, Çorum Tüketici Mahkemesi’nden gelen itirazı değerlendirerek, arabuluculuk toplantısına katılmayan tarafın tüm yargılama giderlerinden sorumlu tutulması ve vekâlet ücretinden mahrum bırakılmasını hak arama özgürlüğü ve mülkiyet hakkı bağlamında ölçüsüz bularak iptal etmiştir. Mahkeme, katılımı teşvik edecek yaptırımların orantılı olması gerektiğini, haklılık durumu gözetilmeksizin taraflara aşırı mali külfet yüklenemeyeceğini belirtmiştir. Kanun koyucunun, adalete erişimi engellemeyecek şekilde daha dengeli düzenlemeler yapması gerektiği vurgulanmıştır.Mandatory mediation as a prerequisite for litigation was introduced into the legal system with the enactment of Law No. 7036 on Labor Courts, which came into effect on January 1, 2018. According to this regulation, even if the parties are ultimately found justified in court, they will still be held responsible for litigation costs if they fail to participate in the mediation process. The regulation was challenged before the Constitutional Court on the grounds that it violated the right to seek justice. However, in its 2018 decision, the Court ruled that the regulation was not unconstitutional. In its decision dated March 14, 2024, the Court reviewed an objection from the Çorum Consumer Court and annulled the provision that imposed full costs and denied attorney’s fees to parties who failed to attend the mediation meeting, deeming it disproportionate in terms of the right to seek justice and the right to property
Building higher value-added firm practices in challenging contexts: Formal networks and talent management in Turkey
Where do high-impact human resources management practices thrive, and how do they make a difference in environments with limited institutional support? This study delves into the realm of talent management (TM) in Turkey, where institutional coverage is incomplete and unstable. Drawing on survey data, we explore the conditions under which TM succeeds, supplementing previous research on internal networks by examining the impact of external networks that encompass the entire firm. We find that when firms have closer ties with customers, suppliers and competitors (and hence, the basis for formal network tie building), TM is more prevalent and more likely to be successful. While conventional wisdom in comparative institutional literature suggests that such dense ties might be less effective in emerging markets owing to the absence of advanced complementarities found in mature economies, our study challenges these assumptions. In the eyes of managers, TM is not merely a tool to overcome disadvantages; it is perceived as a source of opportunities. This prompts a critical question: what specific advantages does the emerging economy system confer on firms embracing TM? Our study seeks to unravel these dynamics and contribute to a deeper understanding of the interplay between institutional contexts and TM
Arising needs during mediation sessions, suggestions that may support the mediation settlement: “Limited arbitral authority” and “mediator as an escrow”
Arabuluculuk müzakeresinde tarafların anlaşmaya yaklaştıkları lakin anlaşmaya ulaşılamayan hallerde sorunu ortadan kaldırıcı önerilere ihtiyaç duyulabilmektedir. Nitekim arabulucunun öneride bulunması ve tarafların kabulüyle arabuluculuktan tahkime geçiş de sağlanabilmektedir. Bu noktada; tahkime geçilmiş olduğu bir halde tarafların sürpriz bir hakem kararı ile karşılaşmasını engelleyecek bir imkânın sunulabilmesi, uyuşmazlığın çözümü için fayda sağlayabilir. Çalışmamızda “Sınırlandırılmış Hakem Yetkisi” olarak isimlendirdiğimiz yöntem, arabuluculukta anlaşma anlaşma imkânı oluşmayan hallere çözüm üretilmesi hedefini taşımaktadır. Sunduğumuz yöntemdeki amaç, tarafların arabuluculuk sürecinde uyuşmazlığın çözümüne ilişkin sağladıkları yakınlaşmayı göz ardı etmeden, uyuşmazlığın çözümüne imkân vermektir. Arabuluculukta anlaşma için özellikle taşınır eşyaların tarafsız ve güvenilir bir üçüncü kişiye teslimi ihtiyacı gündeme gelebilmektedir. Uygulamada “Escrow Aracısı”,“Yediemin” olarak ifade edilebilecek bu kişi vasıtasıyla, taşınır bir eşyanın varılacak arabuluculuk anlaşması ardından kime teslim edileceği yönetilerek, salt ortada taraflar için maddi veya hukuki kıymeti bulunan taşınırın teslimi konusundaki şüphenin ortadan kaldırılması sağlanabilecektir. Tarafsız, güvenilir kişi olan arabulucunun escrow aracısı/yediemin olarak vazife üstlenmesi arabuluculukta anlaşmayı destekleyebilecektir.In a mediation process where a settlement is not reached, there is still a need for proposals that can resolve the dispute. With the Mediator's proposal and the parties' acceptance it is possible to transition from mediation to arbitration. After transitioning to arbitration, providing an opportunity that prevents the parties from facing surprise arbitral awards can be beneficial for resolving the dispute. The method mentioned as " Limited Arbitration Authority " aims to provide solutions for situations where, parties forwarded toward a settlement in mediation. The aim of the method is to allow for the resolution of the dispute within the limit determined by the parties, without disregarding mediation phase. The need for the delivery of movable property to a neutral, trustworthy third party may also arise to facilitate the parties' to reach a settlement in mediation. The mediators role as an escrow agent will enable settlements in mediation

This research examines the role of independent podcasting in fostering peace in society, highlighting its democratizing potential compared to traditional broadcasting. The study explores podcasting's distinctive ability to bridge divides through participatory storytelling, fostering empathy and understanding. Grounded in views of participatory culture and peace-building, the research highlights how podcasting amplifies marginalized voices and facilitates constructive dialogue on complex societal issues. Unlike traditional broadcasting, which often relies on singularly oriented discourses, podcasting operates within a flexible digital framework, enabling personalized and on-demand content that challenges mainstream discourses and nurtures subcultural communities. This study sheds light on the empowerment that podcasts provide in reclaiming and sharing narratives, and how podcasts serve as a critical medium for collective memory, encouraging open discussions on pressing issues such as inequality and discrimination. A further look at perception of personalities in typefaces: Evidence from Turkish
[ArticleInPress]Previous research conducted in English indicates that the visual appearances of different typefaces are perceived as possessing distinct characteristics, what we call “print personality” (e.g., masculine, feminine, serious, fun) to the extent that the typeface used conveys information to the reader beyond that which is expressed linguistically by the word. Recent work has found that these attributions of “print personality” also extend to typefaces written in Arabic, but one language that is distinct from both languages is Turkish. Turkish is written in a version of the Latinate alphabet containing 29 letters which include unique diacritics and is a genderless language which requires no gender associations for nouns, pronouns, or adjectives. Given that many print personalities appear to be strongly associated with gender (masculine, feminine, elegance, confidence), it remains to be determined if the association of print personalities extends to Turkish typefaces, and the pattern of any such associations. Accordingly, sixteen different typefaces were presented to fluent native Turkish readers who rated each typeface according to 22 different personality characteristics. The results indicate that, although Turkish participants readily assigned personality characteristics to different typefaces, gendered associations across different typefaces were far weaker than previously found. Implications for the generality of the existence of typeface personalities across different languages, and the effect this may have on perception of genderless languages, are discussed
Cross-cultural applicability of the Inventory of Problems–29 (IOP–29): A pre-registered German replication of Akca, Tepedelen, et al. (2023)
Assessing the credibility of psychological problems in forensic evaluations is crucial. The Inventory of Problems–29 (IOP–29) is becoming a valuable symptom validity test (SVT) worldwide and has been validated in over 15 languages. This study evaluates the German IOP–29 and fills a gap by replicating a study of Akca, Tepedelen, et al. We analysed 384 IOP–29 protocols from 128 German-speaking adults (range = 18–87 years) under three conditions: honest, random and feigned responses (post-traumatic stress disorder, PTSD; depression; schizophrenia). Statistical analyses showed that the False Disorder Probability Score (FDS) effectively discriminated between honest and feigned responses (Hedges g = 3.90), with a sensitivity of .91 and a specificity of .95 at an FDS cut-off value of ≥.50. A new index for detecting careless or random responses also showed promising results. This study confirms the utility of the IOP–29 in the German-speaking population and supports its cross-cultural applicability
