    The hire clause in the standard forms of carriage of goods by sea

    U ovom se radu analiziraju pravna pitanja u predmetu hire klauzule odnosno odredbe o vozarini. Radi se o važnoj stavci u reguliranju ugovornog odnosa prijevoza stvari morem pa se smatra potrebnim ukazati na njezin sadržaj i pravne probleme. Rad je podijeljen u dva dijela. U prvom dijelu rada iznose se teorijska objašnjenja pravnih problema u predmetu vozarine (hire) isključivo sa stajališta odredbi hrvatskog pravnog izvora pomorskog prava - Pomorskog zakonika. U ovom dijelu rada sistematiziraju se ugovori o iskorištavanju pomorskih brodova, ističe se mjesto ugovora o prijevozu stvari morem unutar iste sistematizacije, iznosi se pojam, elementi i vrste ugovora o prijevozu stvari morem. Određuje se pojam vozarine, njezini elementi te ostala pravna pitanja plaćanja vozarine. U drugom dijelu rada posebno se osvrćemo na sadržaj odredbe o vozarini odnosno klauzule hire na primjeru standardnih obrazaca ugovora o prijevozu stvari morem. Ukazuje se na razloge obustave vozarine (off-hire) kao što je slučaj havarije, devijacije i sl. Utvrđivanje sadržaja klauzule hire prvenstveno se odnosi na standardne obrasce ugovora o prijevozu stvari morem kodnog naziva BALTIME i NYPE.This document analyzes the legal issues in the case of hire clause respectively regulations of hire. It is an important item in the regulation of the contractual relationship of transportation of goods by sea and it is considered necessary to point out its contents and legal problems. The work is divided into two parts. The first part outlines the theoretical explanations of legal issues in the case of freight (hire) exclusively from the standpoint of the provisions from the croatian legal sources of maritime law - the Maritime Code. This section of the work systematize the contracts of employment of ships, stands out the spot contract transporting goods by sea within the same systematization, amounts the term, elements and types of contracts transporting goods by sea. Determined the term of hire, it's elements, and other legal issues paying the hire. The second part specifically addresses the content of the provisions of freight respectively hire clause in the case of the standard forms of contracts transporting goods by sea. It points out the reasons for the suspension of hire (off-hire) as in the case of damage, deviations, etc. Determination of contents of clause hire primarily refers to the standard forms of carriage goods by sea, code-named BALTIME & NYPE

    Starija i novija čitanja Zoranićevih "Planina"

    "Planine", kapitalno djelo starije hrvatske knjiţevnosti koje je proizašlo iz pera Ninjanina Petra Zoranića, moţda je najistraţivanije, ali i najzagonetnije dopreporodno hrvatsko knjiţevno ostvarenje. Usprkos višegodišnjm proučavanjima i mnogobrojnim raspravama, interpretacijama i kritičkim osvrtima najrelevantnijih domaćih ali i stranih povjesničara knjiţevnosti, pitanje Zoranićevih "Planina" i dalje ostavlja dovoljno mjesta budućim istraţivanjima, analizama i pretpostavkama. "Planine" su nepresušno vrelo nedoumica i zagonetki, te tako, samo po sebi i ţarište mnogih neodgovorenih pitanja. Upravo nekim od tih pitanja posvetit ćemo ovaj diplomski rad. Naime, sam rad je koncipiran kroz dvodijelnu strukturu. Uvjetno rečeno, u prvom dijelu rada preokupirat ćemo se, odnosno predstavit ćemo osvrt na standardna iščitavanja ovog romana. Tu prvenstveno mislimo na pozitivistička tumačenja koja su nastajala tijekom 19. st., koja promatraju "Planine" kao sukus raznorazne antičke i novovjekovne literature koja je Zoraniću pala pod ruke i koju je on u renesansnoj maniri ukomponirao u svoje djelo. U drugom dijelu (koji je po svemu sudeći manje-više istraţivačke prirode, a što je ujedno i svrha rada), dokazujemo da ovo knjiţevno ostvarenje ima i odreĎene autohtone motive i ideje koji često samo zbog oprečnog pristupa prema njima nerijetko nadilaze i napuštaju okvire onih standardnih i dogmatskih tumačenja smisla knjiţevnosti koja su se ustalila i ukorijenila unutar znanosti o knjiţevnosti."The Mountains", a unique piece in Croatian literature emerged from the pen of Petar Zoranić of Nin, perhaps is the most researched and most puzzling Croatian literary work created in the time before the Croatian literary revival. Despite long standing studies and many discussions, interpretations and critical reviews of the most relevant domestic and foreing historians of literature, question of his "The Mountains" still offers plenty of room for future research, analyses and assumptions. "The Mountains" are an inexhaustible source of doubts and riddles, thus, in itself it is the focus of many unanswered questions. Just some of these questions will be observed in this thesis. The work itself conceived trough a two-part structure. In the first part of this thesis an overview of the standard reading of the novel will be given. We primarly want to point out the positivistic interpretations that were created during 19th century and wich observed "The Mountins" as a summary of various ancient and modern literature wich Zoranić incorporated into his work in a Renaissance manner. In the second part, which is apparently of investigative nature, we prove that this literary work has a certain indigenous motifs and ideas often only becasuse of contrary approach to then. Such ideas go beyond those standard and dogmatic interpretations of ventured sense of literature and took root within the science of literature

    Financijska vrijednost marke

    Noviji razvoj u marketingu doveo je do novih izazova u upravljanju markama te je potreba za mjerenjem vrijednosti marke postala jako bitna i zato su se razvile različite metode vrednovanja koje prikazujemo u ovom radu. Unatoč činjenici da je marka postala bitan aspekt samog poduzeća, postojeći knjigovodstveni standardi pri iskazu vrijednosti tvrtke i dalje se bave uglavnom samo imovinom koja može prikazati u bilanci. Vrijednost marke vrlo se rijetko vrednuje, te se slijedom toga jednako rijetko iskazuje u poslovnim knjigama. Jedan od mogućih razloga tome može biti taj da metode koje su navedene u ovom radu (kao što su: modeli temeljeni na trošku, modeli temeljeni na diskontiranju budućih troškova, modeli temeljeni na usporedbi poduzeća neoznačenih markom, modeli temeljeni na procijeni preostalog prihoda i kombinirani savjetnički modeli) još nisu znanstveno dokazani te za niti jedan od navedenih modela ne možemo reći da je onaj „pravi“. Međutim, ne možemo opovrgnuti važnost vrednovanja marke za samo poduzeće te možemo zaključiti da vrijednost marke poteže uzročno-posljedičnu vezu za profit te time i važnost za investitore i ostale pozitivne učinke na poduzeće.The recent development in marketing has led to new challenges in managing brands and the need for measuring the value of the brand has become very important, what has contributed to the development of many research methods. Despite the fact that the brand has become an essential aspect of the company, existing accounting standards along with the statement of the company value, is still dealing mainly with tangible assets. Brand value is rarely being evaluated as it is rarely reported int he business books. One possible reason for this may be that the methods referred to in this paper as: models based on costs,models based on the discounting of the future costs,models based on a comparison of the company unmarked brand, models based on an assessment of residual income and a combined advisory models have not been scientifically proven and for any of these models can not be said that it is the right one. However, we can not deny the importance of brand valuation for the company itself, and we can conclude that the brand value pulls a causality for profit and therefore the importance for investors and other positive effects for the company

    Analitički hijerarhijski proces ili AHP metoda spada u najpoznatije i posljednjih godina najviše korištene metode za višekriterijsko odlučivanje. Njezina popularnost temelji se u prvom redu na činjenici da je vrlo bliska načinu na koji pojedinac intuitivno rješava složene probleme rastavljajući ih na jednostavnije te na dostupnosti softvera temeljenog na metodi poput Super Decisions. Ovaj rad sagledava povijesni pregled i matematičku pozadinu AHP metode, analizira njene dobre i loše strane, sagledava korištenje metode u praksi na primjeru odabira lokacije luke nautičkog turizma te prikazuje rješavanje problema softverom Super Decisions koji se temelji na AHP metodi Rad također ukratko prikazuje ostale metode višekriterijskog odlučivanja, ELECTRE, TOPSIS i PROMETHEE. Najvažniji zaključak koji proizlazi iz proučavanje literature, kao i analize primjera iz prakse je da je AHP metoda koristan alat menadžmentu u donošenju odluka koje zahtjevaju višekriterijsko odlučivanje.Analytical Hierarchy Process or the AHP method is one of the most famous and, in recent years, one of the most used methods for multiple criteria decision making. Its popularity is based primarily on the fact that it is very close to the way a individual intuitively solves complex problems by dismantling them into easier ones and the availability of software-based solutions such as Super Decisions. This paper examines the historical overview and mathematical background of the AHP method, analyzes its good and bad sides, considers the use of the AHP method in practice in the case of location selection for a nautical tourism harbor and demonstrates the Super Decisions software based on AHP method. The paper also summarizes other methods of multi-criteria decision-making, ELECTRE, TOPSIS and PROMETHEE. The most important conclusion from the study of literature, as well as the analysis of case studies is that the AHP method is a useful management tool in making decisions that require multiple criteria decision making

    The analysis of the image of Split as a tourist destination in the perception of various stakeholders

    Početkom dvadesetprvog stoljeća turističko tržište nikad nije bilo povezanije, raširenije, dinamičnije, ali i osjetljivije. Pojmovi poput globalizacije i masovnog turizma, te općenito olakšane mogućnosti i povećana pristupačnost određenim destinacijama, samo su neke od stavki koje su formirale današnji način putovanja i poslovanja u turizmu. Jedan od pojmova koji je povezan s poslovanjima turističkih destinacija je imidž turističke destinacije. Na temelju prikupljanja jedinstvenih primarnih podataka nastoje se proučiti mišljenja o gradu Splitu kao turističkoj destinaciji iz perspektive različitih dionika koji su povezani sa spomenutom destinacijom. Ispitano je 240 ispitanika, koji su bili podijeljeni u tri skupine dionika: lokalno stanovništvo, domaći turisti, dionici turističke ponude. U formiranim anketnim upitnicima ispitivali su se stavovi o određenim obilježjima destinacije i afektivne asocijacije prema destinaciji. Uz to, koristila se „Top of mind awareness“ (TOMA) metoda na temelju koje su se prikupile primarne asocijacije povezane s gradom Splitom. Izvršena je i detaljna analiza dostupnih sekundarnih podataka na temelju koje je formiran opširan teorijski temelj s ciljem pružanja boljeg uvida u samu tematiku rada. Prikupljeni rezultati prikazani su tabličnim i grafičkim prikazima, a statistička obrada podataka izvršena je u Microsoft Excel programu. Jedan od glavnih ciljeva je ispitivanje mišljenja o imidžu o gradu Splitu iz percepcije različitih dionika, uz ispitivanje razlika u mišljenjima i stavovima u odnosu lokalnog stanovništva, domaćih turista i dionika turističke ponude. Primarno istraživanje odbacilo je čak dvije od tri formirane afirmativne hipoteze, odnosno utvrđeno je postojanje razlika o imidžu grada Splita iz percepcije između domaćih turista i lokalnog stanovništva. Dodatan cilj ovog istraživanja je bio je formiranje kvalitetne teorijske podloge vezane uz problematiku rada koja, u kombinaciji s provedenim istraživanjem, može pružiti detaljniji uvid u važnost imidža turističke destinacije, te stvoriti određene temelje i prijedloge za planiranje i formiranje marketinških aktivnosti, ali i budućih znanstvenih radova, istraživanja i publikacija.At the beginning of the twentieth century the tourism market has never been more connected, expanded, dinamic and fragile. Terms like globalization and mass tourism, easier travel options and increased availability to certain destinations, are only a few factors that influenced present formation of modern ways of travel and handling business in tourism. One of the terms that is connected with tourism destinations and their business operations is tourism destination image. Based on the aquiring unique primary dana, the goal is examination of various opinions about city of Split as a tourism destination from the perspectives of the different stakeholders who are somehow connected to the mentioned destination. A total of 240 participants respones were tested, and they were divided in three stakeholder groups: local residents, domestic tourists and stakeholders who are involved in tourism supply. In formed survey, a certain attitudes about specific parts of the destination were questioned, along with affective associations about the destination. Also, the „Top of mind awareness“ (TOMA) method was used, and based on that method the primary associations about the city of Split were collected. Thorough analysis of available secondary dana was also made and based on that analysis, the extensive theoretical foundation was made with the ultimate goal of getting the better insight about the general theme of the paper. Collected results are displayed with tabular and graphical representations, and statistical analysis was made by using Microsoft Excel programme. One of the main goals of this research is to evaluate various opinions about the image of Split from the perception of various stakeholders, and also to evaluate differences in these opinions and attitudes between local residents, domestic tourists and tourism supply stakeholders. Primary research has rejected two out of three hypothesis, therefore it has been confirmed the existance of different perceptions of Split´s image between local residents and domestic tourists. Additional goal of this research was creation of high quality theorical foundation related to the paper subject which can provide detailed insight about the importance of tourism destination image, and also create certain foundations and suggestions for planning and cre ating marketing activities, along with creating foundation for future papers, research and publications

    Quantitative analysis of land suitability of Osijek-Baranja County using geospatial technologies

    U ovom diplomskom radu izrađen je model pogodnosti poljoprivrednog zemljišta za uzgoj ječma na prostoru Osječko-baranjske županije. Model pogodnosti je rezultat višekriterijske GIS analize koja je izrađena na temelju 5 skupina kriterija: geomorfometrijskih (nadmorska visina, nagib i ekspozicija), pedoloških (tip tla, tekstura tla i kiselost tla), klimatskih (padaline, temperatura), hidroloških (ocjeditost i erozijski potencijal) te ograničavajućih faktora. Za određivanje težinskih koeficijenata koristila se AHP metoda koja omogućuje vrednovanje i usporedbu numeričkih i nenumeričkih vrijednosti. Pedološki kriteriji su imali najveće težinske koeficijente jer u najvećoj mjeri utječu na rast i razvoj poljoprivrednih kultura. Izrađeni model klasificiran je prema FAO klasifikaciji pogodnosti zemljišta u 5 klasa. S obzirom na to da se radi o pogodnosti poljoprivrednog zemljišta, izrađeni model je preklopljen s ograničavajućim faktorima koji čine 44,18 % površine županije. Model ukazuje na umjerenu pogodnost poljoprivrednog zemljišta, klasu S2 koja se prostire na 29,58 % površine Osječko-baranjske županije. Također, bitno je izražena visoka pogodnost, klasa S1 na području od 15,62 % površine županije, uglavnom na prostoru Baranje i istočnom dijelu županije. Glavni kriteriji koji su uvjetovali klase S1 i S2 bili su tip tla i kiselost tla. Klase nepogodnosti, N1 i N2 najviše se prostiru na zapadnom dijelu županije, prostoru oko Našica te krndijskom osojnom pobrđu. Razlog tome je što su ti prostori okarakterizirani kiselim tlima te velikim nagibima i nepogodnom teksturom tla. Višekriterijske analize i AHP metoda pokazale su se kao izrazito dobre metoda u izradi ovakvog modela pogodnosti poljoprivrednog zemljišta. S obzirom na to da se ječam koristi u tekstilnoj, prehrambenoj i najviše u pivarskoj industriji, dolazi do povećane potražnje za tom kulturom, pogotovo na prostorima koji imaju dugačku pivarsku tradiciju, poput grada Osijeka. Stoga je potrebno ojačati suradnju između znanstvenog i poljoprivrednog sektora kako bi se poljoprivreda podigla na višu razinu i tako postala vodeća gospodarska grana u Republici Hrvatskoj.In this thesis, a model of the suitability of agricultural land for the cultivation of barley in the area of Osijek-Baranja County has been made. The suitability model is the result of a multi-criteria GIS analysis based on 5 criteria groups: topographical (altitude, slope, aspect), pedological (soil type, soil texture, soil acidity), climatic (precipitation, temperature), hydrological (drainage and erosion potential) and limiting factors. The AHP method was used to determine the weighting coefficients, which allows the numerical and non-numerical values to be evaluated and compared. The pedological criteria had the highest weight coefficients because they mostly influence the growth and development of agricultural crops. The model is classified according to the FAO classification of land suitability in 5 classes. Considering that it is the land suitability of agricultural land, the model created is overlapped with limiting factors that make up 44.18 % of the county area. The model indicates moderate suitability of agricultural land, class S2, which covers 29.58 % of the area of Osijek-Baranja County. In addition, a high suitability, class S1, in the area of 15.62 % of the area of the county, mainly in the area of Baranja and the eastern part of the county, was significantly expressed. The main criteria that conditioned classes S1 and S2 were soil type and soil acidity. The N1 and N2 unsiutable classes are most spread in the western part of the county, the area around Našice and the Krndija north hillside. The reason is that these areas are characterized by acid soils and high slopes and unfavorable soil texture. Multi-criteria analyses and the AHP method have proven to be extremely good methods in developing this model of farmland suitability. Since barley is used in the textile, food and most of the brewing industries, there is an increased demand for this culture, especially in areas with a long brewing tradition, such as the city of Osijek. Therefore, it is necessary to intensify the cooperation between the scientific and agricultural sectors in order to raise agriculture to a higher level and thus become the leading industry in the Republic of Croatia

    Discipline as an Educational Means

    Rad se ograničava na proces nastave i proučava se iz perspektive učenika kako nastavnici uspostavljaju i održavaju disciplinu u razredu. Upravljanje razredom, odnosno uvođenje discipline, je jedna od primarnih stavki dobrog poučavanja. Disciplina primarno označava norme i pravila kojih se pojedinci pridržavaju svojom slobodnom voljom, a u školi je jedno od neophodnih odgojno - obrazovnih sredstava. Razred kao zajednica važnu ulogu pridaje nastavniku kao autoritetu i voditelju. Stav nastavnika prema učenicima i prema samom radu određuje uspješnost nastave, a bez discipline poučavanje nema smisla. No, disciplina se ne smije poistovjetiti s kontrolom koja zahtjeva neupitnu poslušnost. Zbog toga je nužno da osoba nastavnika bude izgrađena i u pedagoškom smislu te da reagira na individualne potrebe učenika. Kvalitetan odnos s učenicima karakterizira humanost, uzajamno poštivanje, prihvaćanje pravila i odgovornosti, pravednost nastavnika, briga za druge. Tako se podupire aktivno učenje, primjenjuju nastavne strategije koje potiču kritičko razmišljanje te omogućuju da se ono naučeno koristi u praksi dok učenici aktivno sudjeluju u nastavi, iskazuju zainteresiranost i iskustveno uče. Istraživanje je pokazalo da većina nastavnika ne koristi primjerena odgojno – obrazovna sredstva i metode za uspostavljanje discipline u razredu, jer nastoje kontrolirati razred, a ne uspostaviti disciplinu. Učenici srednjih škola su pomoću intervjua iskazali vlastito stajalište o disciplini u nastavi, radu nastavnika te povezanosti discipline i školskog uspjeha. Na osnovu njihovih iskaza rad prikazuje nedostatke i probleme nastavnika pri uspostavljanju discipline u razredu, a istodobno daje rješenja i prijedloge kako bi se ti problemi mogli izbjeći.The study is limited to the teaching process and is observed from the perspective of the students on how the teacher establishes and maintains discipline in their classroom. Classroom management, relatively the introduction of discipline, is one of the primary elements of good teaching. Discipline primarily marks the norms and rules that the individuals follow willingly, and is one of the necessary educational means in school. The classroom as a community plays an important role for the teacher as an authority figure and as a leader. The stand of the teacher towards their students and towards their work as well determines the success of their teaching, and without discipline, teaching does not make sense. However, discipline must not be associated with a sense of control that requires unquestionable obedience. Therefore, teachers must possess pedagogical competence and respond to the individual needs of each student. Establishing good relationships with students is characterized by humanity, mutual respect, acceptance of the rules and responsibilities, fairness of the teacher and caring for others. By establishing this, the teacher supports the active learning, applies instructional strategies that stimulates critical thinking and enables it to be learned in practice while the students are actively engaged in the teaching process. Research has shown that most teachers do not use appropriate educational tools and methods to establish proper discipline in the classroom, as they seek to control the class rather than establish discipline and rules. Trough the interviews, many high school students expressed their views on discipline in teaching, the teachers work and the relationship that exists between discipline and academic achievement. Based on their testimonies, the paper shows the shortcomings and problems of teachers in failing to establish discipline in the classroom, while at the same time provides solutions, strategies and other suggestions for these problems to be avoided

    Virovitica in the Ottoman period

    Osmanska prisutnost u Virovitici započinje 1552. godine padom grada u ruke osvajača. Nakon uspostavljanja vlasti u gradu, Osmanlije ga uklapaju u ogroman administrativni aparat carstva. Time Virovitica postaje središte istoimenog kadiluka i nahije, dio Požeškog sandžaka i djelom Budimskog pašaluka (kasnije postaje dio Bosanskog, a na posljetku Kaniškog pašaluka). Kao grad na granici Osmanskog carstva, Virovitica ulazi u serhat. Vojni karakter grada se očituje i u samom pokretnom arheološkom materijalu. Prema rezultatima dosadašnjih arheoloških istraživanja u potpunosti nedostaje luksuzni materijal, a od ostalog pokretnog arheološkog materijala nailazimo na nekoliko tipova keramike, uključujući i lule turskog tipa. Komparativni materijal se najčešće može pronađi među nalazima iz Mađarske i Srbije. Pronađena je i manja količina metalnih i staklenih predmeta. Arheloškim istraživanjima također su pronađeni i ostatci arhitekture, ali nažalost ništa od toga sa sigurnošću ne možemo pripisati Osmanskom periodu. Virovitica je ponovno zauzeta 1684. godine, kada su Osmanlije zauvijek protjerani iz tog dijela Hrvatske.The Ottoman presence in Virovitica begins in 1552 with the fall of the city into the hands of the conquerors. After establishing power in the city, the Ottomans incorporate it into the vast administrative apparatus of the Empire. In this way Virovitica became the center of the kadiluk and nahia of the same name, part of the Požega sanjak and part of the Budim pashalik (later it became part of the Bosnia and later the Kaniža pashalik). As a city on the border of the Ottoman Empire, Virovitica enters the serhat. The military character of the city is also evident in the small archeological material itself. So far, following the results of archaeological excavations, luxury material is completely missing and other small finds include several types of pottery, including Turkish type pipes. Comparative material can be mostly found among finds from Hungary and Serbia. A small amount of metal and glass items were also found. Archaeological excavations have also unearthed architectural remains, but unfortunately none of them can be attributed to the Ottoman period with certainty. Virovitica was conquered again in 1684, when the Ottomans were expelled from that part of Croatia permanently
