    Studentų įsitraukimo veiksniai į nuotolines studijas Covid-19 pandemijos metu

    The article analyses the factors of students’ involvement in the organisation of studies remotely during the COVID-19 pandemic and discusses opportunities for the improvement of distance studies. There are still few studies providing a comprehensive perspective on the experience of student participation in distance studies. Thus, the purpose of this article is: according to the opinion of Lithuanian higher education students, to investigate the factors of involvement of students in the organisation of the distance study process during the COVID-19 pandemic. The issue of the study is: What are the factors that determine the positive experience of distance studies? Using a quantitative study, the current situation about distance studies was revealed, students’ feedback on the possibilities of improving distance education was examined. The findings of this study show that the successful participation of students in distance studies was mainly influenced by the study environment, physical conditions, convenient and safe learning environment, consistent study process, attractive teaching materials and student employment, i.e. combining studies with work or other activities. More satisfied with distance studies — senior course of bachelor and master students, less freshmen who lack integration and socialisation during distance studies. One of the limitations of the study is that it is a relatively small study covering higher education institutions in Vilnius, which should be extended throughout Lithuania. The results of the research will have a lasting value in the scientific discussion about the process of distance studies, the possibilities of improvement and will contribute to the improvement of the quality of distance studies

    Value-based healthcare (VBHC) is being increasingly used in health systems to describe a shift in thought from a focus on the financial definition of health care value to a mindset that incorporates the needs of individuals and societal value. VBHC includes such components as patient experience, population health, costs and provider satisfaction. The VBHC concept is based on the definition of the public value of health care - the relationship between the results (from the patients’ point of view) and the resources consumed to achieve them. Without the full support and involvement of physicians, VBHC programs cannot be implemented. No one on value-based health care program has yet been established in Latvia. This study aims to explore the level of understanding of physicians and young physicians about the VBHC

    The Nexus between Unemployment and the Shadow Economy in Lithuanian Regions during the COVID-19 Pandemic

    Under the current extreme conditions, with an increasing number of the unemployed, the size of the shadow economy is also growing. The competitiveness of municipalities depends to a large extent on their ability to manage unemployment and reduce the size of the shadow economy. A strategy selected for improving the municipal economy significantly affects the establishment and development of business. The article aims to assess the extent to which the unemployed are involved in the informal activities in Lithuanian regions during the COVID-19 pandemic. The research is based on the method of a representative quantitative survey. The research has revealed that the main critical issues are hiding income, work in the shadow labour market and “envelope” wages, while the major areas of shadow activities cover healthcare services, hairdressing and childcare. The research has also disclosed that the unemployed not only participate in the shadow labour market, but also justify income hiding and consumption of smuggled goods. The measures recommended for reducing the number of the unemployed are raising the average wage, exempting business start-ups from taxes for several years, and reducing the unemployment and other social benefits with consideration of one’s health condition

    The qualification process is of particular importance in the investigation of criminal offenses. Correct qualification creates preconditions for achieving the goals and objectives of the Criminal Code and the Code of Criminal Procedure. Adequate qualification helps to correctly determine the scope of the charge, the limits of evidence, the rights of the suspect and the accused, provides clarity on the scope of the defense. Correct qualification also creates preconditions for the application of the benefits provided by criminal law. The qualification process is not described in the law. The qualification process is mentioned in the Code of Criminal Procedure however the implementation of such process is left to law enforcement and court practice. The law provides that the court must rule on the fairness of the qualification in each case. According to Lithuanian laws and theory of criminal law individual forms of crime have a significant impact on qualification, as they determine the time of completion of the crime. In theory, there is a tendency to simplify the concept and types of a single criminal offense, considering only continuous, long-term and complex offenses as its forms. From the point of view of many, only two forms of multiple criminal acts take root in both theory and practice i.e. the ideal and the real coincidence. The article deals with the problems of qualification of offenses and delimitation process of the singular and multiple criminal acts as well as delimitation of aforementioned coincidences. Relevant situations in the investigation are addressed and particular examples of criminal cases are analyzed

    Human Reproduction in the Transhuman Era: Main Challenges for Health Law

    Since an intellectual movement called transhumanism (H+) is becoming more and more inseparable from worldwide technological progress, there is an ongoing debate about the possibilities to enhance human nature, especially its aspect related to the procreational dimension of a human being. Transhumanism is centered on the notion of morphological freedom and believes that society should implement a proactionary approach when it comes to improving the human condition. Some innovative techniques (preimplantation diagnostics, gene editing, and gestational surrogacy) are already deemed to take root in ordinary medical practice, thus, inevitably transforming the vision of human reproduction. However, transhumanism goes further and declares that all sentient entities are entitled to reproductive freedom, including through novel means (for example, creation of mind clones or solo parent children). Classical medical ethics, anthropological understanding of human procreation, and especially health care law, all face difficulties when trying to provide a solid answer to transhumanist thought. Considering this entire context, the purpose of this paper is to analyze the theoretical background of human reproduction that emerges from the transhumanist approach, and to identify the main legal challenges

    Non-Judicial Divorces and the Brussels II bis Regulation: To Apply or Not Apply?

    This paper aims to analyse the international consequences of private divorces, which are available in several European countries. Particular attention is drawn to the amendments suggested by the Lithuanian legislator, which intend to transfer certain functions of the courts to notaries. In particular, Lithuanian notaries would have competence in the dissolution of marriage provided there is mutual consent between spouses. The authors discuss how private divorces are regulated in different countries, whether the amendments suggested by the Lithuanian legislator would introduce a “private divorce” into Lithuanian law, and what the implications of private divorce are in private international law. In particular, the scope of application of the Brussels II bis Regulation is addressed. As yet, there is no consensus as to whether the Regulation applies to private divorces. However, the analysis in this paper shows that it would be beneficial to include such divorces in the above-mentioned Regulation. This would ensure a greater legal certainty for international couples

    This article analyzes the problematic aspects of criminal liability for fraudulent accounting. The author examines the relationship between deception and harm as elements of fraudulent accounting, and reveals the incompatibility of the delimitation of criminal and administrative liability for the management of fraudulent accounting. Forms of accounting fraud, deception, and harm, and the main elements of fraudulent accounting are considered. Based on the case law of Lithuanian courts, the evaluative criteria for the consequences of fraudulent accounting are summarized. This article analyzes the concept of accounting error and its influence on the assessment of violations of legal acts regulating accounting, as well as its differentiation from deception in accounting

    The Application of Quantitative Methods for the Modification of a Business Model in the Digital Era, with the Support of the Maple System

    CC BY-NC-ND 4.0Businesses can gain strength and thus purposefully optimize their commercial models by means of implementing open innovations. The innovation process is increasingly conditioned by the innovative activities of customers. It is necessary to perform quick, low-cost, and rational research so that outputs can be updated and implemented into business models in-time. Digital transformation supports these processes because it represents a good opportunity for free spatial-temporal communication, and for the timely interaction of the participating parties. This contribution stems from research (under the supervision of the paper’s co-author, von Böhlen, 2021) performed in the German automotive industry, and follows up on the work of Simberova and von Böhlen (2021). The aim is to perform further and more detailed analyses and to interpret facts that ensue from selected research outputs. These analyses are oriented solely towards the issue of open innovations as seen from the customer’s perspective: innovations used for scaling business models in the automotive industry. Focus is especially placed on factors and relationships which affect customers’ willingness to enter the open innovations process. The customer’s social status has been taken into account. The rate and willingness of customers to engage in innovation activities has been measured – in connection with a whole range of factors, especially financial, those based on benefits, and others. Another form of analysis was a statistical evaluation that identified the degree of interest in some selected types of benefits. The independence of selected agents that stem from the survey evaluation was also considered, and quantitative methods, mainly statistical calculations, and transparent statistical visualizations were employed for this purpose. The methods of descriptive statistics and categorical analysis were used for processing data sets in the environment of the advanced Maple System. These findings confirm that the customer is becoming a non-stationary and important source of information and possibly also a source of inferences regarding open innovations. Society is thus increasing its potential to work not only for the customer, but also with them. It is necessary to be ready to react to current pitfalls and to communicate with the customer continuously. Pertaining to implementing open innovations, these analyses have given interesting concrete output and findings regarding decision-making in the process of amplifying the business model in the automotive industry, as seen from the customer’s viewpoint, and in the era of digitization. Further, they have opened a whole range of challenges related to further analyses of the matter at hand

    CC BY-NC-ND 4.0Based on insights into economic nationalism, this article focuses on the forms of nationalism which were manifested in the relations between Lithuanians and ethnic minorities, groups, immigrants, and refugees in the independent state of Lithuania. The aim of this article is to highlight features of economic nationalism through an analysis of the relations between Lithuanians and ethnic minorities in two cases of independent Lithuania: 1) ethnic discrimination and ethnic conflicts in the 1930–1940 period; and 2) negative and religious xenophobic attitudes towards immigrants and refugees in the periods of the global financial crisis in 2008–2009 and the refugee crisis in Europe in 2015. This analysis enables us to explain the emergence of economic nationalism as well as its general and specific characteristics in Lithuania, i.e., the reasons triggering the outburst of negative, discriminatory, hostile, or religious xenophobic views of people in Lithuania towards ethnic minorities, groups, immigrants, and refugees. These views emerged during political, democratic, and refugee crises in Europe and the global financial crisis, and in some cases even resulted in physical violence against minorities – especially against Jews in the 1930s
