In front of you is the Thematic Collection of Papers presented at the International Scientific Conference “Archibald Reiss Days”, which was organized by the Academy of Criminalistic and Police Studies in Belgrade, in co-operation with the Ministry of Interior and the Ministry of Education, Science and Technological Development of the Republic of Serbia, National Police University of China, Lviv State University of Internal Affairs, Volgograd Academy of the Russian Internal Affairs Ministry, Faculty of Security in Skopje, Faculty of Criminal Justice and Security in Ljubljana, Police Academy “Alexandru Ioan Cuza“ in Bucharest, Academy of Police Force in Bratislava and Police College in Banjaluka, and held at the Academy of Criminalistic and Police Studies, on 10 and 11 March 2016.
The International Scientific Conference “Archibald Reiss Days” is organized for the sixth time in a row, in memory of the founder and director of the first modern higher police school in Serbia, Rodolphe Archibald Reiss, PhD, after whom the Conference was named.
The Thematic Collection of Papers contains 165 papers written by eminent scholars in the field of law, security, criminalistics, police studies, forensics, informatics, as well as by members of national security system participating in education of the police, army and other security services from Belarus, Bosnia and Herzegovina, Bulgaria, China, Croatia, Greece, Hungary, Macedonia, Montenegro, Romania, Russian Federation, Serbia, Slovakia, Slovenia, Spain, Switzerland, Turkey, Ukraine and United Kingdom. Each paper has been double-blind peer reviewed by two reviewers, international experts competent for the field to which the paper is related, and the Thematic Conference Proceedings in whole has been reviewed by five competent international reviewers.
The papers published in the Thematic Collection of Papers contain the overview of contemporary trends in the development of police education system, development of the police and contemporary security, criminalistic and forensic concepts. Furthermore, they provide us with the analysis of the rule of law activities in crime suppression, situation and trends in the above-mentioned fields, as well as suggestions on how to systematically deal with these issues. The Collection of Papers represents a significant contribution to the existing fund of scientific and expert knowledge in the field of criminalistic, security, penal and legal theory and practice. Publication of this Collection contributes to improving of mutual cooperation between educational, scientific and expert institutions at national, regional and international level
Kриминалистичка стратегија супротстављања насиљу у породици
Закон о полицији уводи нову одредбу која се
односи на поступање полиције када је пријављено насиља у
породици. Ово је први пут у нашем правном систему да се
законом којим се уређују унутрашњи и полицијски послови
помиње поступање полиције када је пријављено неко посебно
кривично дело или прекршај. Законодавац је на овај начин
желео да нагласи важност сузбијања ове друштвено негативне
појаве. Такође, овим законом Полицијско обавештајни модел
(Intelligence Led Policing – ILP) је препознат као водећи начин
поступања, исто као и у већини полиција Западне Европе.
Његово увођење је била препорука Европске уније у Поглављу
24. Он представља начин управљања полицијским пословима
заснован на криминалистичко обавештајним информацијама.
Ratcliffe дефинише ILP као пословни модел и менаџерску
филозофију где су анализа података и обавештајни подаци
о криминалу најбитнији за објективно одлучивање у вези са
смањењем криминала и проблема, поремећаја и превенција
кроз како стратешко управљање тако и кроз ефикасну примену
стратегије које циљају озбиљне преступнике. Ако дефинишемо
стратегију као начин за реализацију дефинисаног циља, онда
циљ криминалистичке стратегије је ефикасно супростављање
криминалу и његовим индивидуалним манифестацијама.
Криминалистичка стратегија подразумева оквир за оптималну
примену криминалистичких средстава за решавање криминалистичких проблема. На основу нових одредби
Закона о полицији можемо закључити да ће криминалистичка
стратегија нашег друштва у наредном периоду бити фокусирана
на сузбијање свих облика насиља у породици.The Law on Police introduces a new provision that refers to
the police conduct in case of reported domestic violence. This is the
first time in our legal system that the law that regulates internal and police affairs mentions police conduct in cases when a special criminal offence or misdemeanour is reported. In this way, the legislator
wanted to emphasize the importance of combating this socially neg-
ative phenomenon. In addition, this Law has recognized the Intelli-
gence-Led Policing – ILP as the leading method of conduct, same as
in most police agencies of Western Europe. Its introduction was the
recommendation of the European Union in Chapter 24. It represents
the method of police affairs management based on criminalistic and
intelligence information. Ratcliffe defines ILP as a business model
and managerial philosophy where data analysis and intelligence
data on crime are crucial for an objective decision-making related
to crime and problem reduction, disruption and prevention through
both strategic management and effective enforcement of strategies
that target serious offenders. If one defines strategy as a method for
achieving a particular goal, then the goal of criminalistic strategy is
efficient combating crime and its individual manifestations. Criminalistic strategy implies a framework for optimal application of
criminalistic measures for solving criminalistic problems. Based on
the provisions of the Law on Police, it can be concluded that in the
following period, the criminalistic strategy will be focused on combating all forms of domestic violence
Proširenje nadležnosti međunarodnih krivičnih sudova : koherentnost ili haos
Within the present paper a new phenomenon has been
elaborated - a phenomenon of expanding jurisdiction of the present
international criminal courts. At the moment there are two ad hoc
International Criminal Tribunals, one permanent International
Criminal Court and several hybrid and internationalized international
criminal courts. Ad hoc Tribunals are in the phase of transformation
into the UN Mechanism for the International Criminal Tribunals, as
a completely new forum, thus expanding Tribunals jurisdiction in
a new direction. As for the International Criminal Court, desirable
mode of its expanding is through the increase of its member states,
in the overall list of member-states. What is happening in reality
is that states are approaching ad hoc at the ICC’s docket, as the
situation directs them. Tendency in the realm of the international
criminal judiciary is that creation of new international criminal
courts is expected, although not warmly accepted. With the multiple
international criminal courts existing, in the same ratione materiae
jurisdiction, it is highly expected that the overlaps will occur as well
as the expanding of the jurisdiction that is beyond the usual terms
of norms interpretation. The focus of this paper is on a dilemma –
whether such a situation will provoke coherence or chaos.Naslovljeni rad bavi se jednim novim fenomenom –
fenomenom proširivanja nadležnosti postojećih međunarodnih
krivičnih sudova. Trenutno postoje dva ad hoc Međunarodna
krivična tribunala, jedan stalni Međunarodni krivični sud i
nekoliko hibridnih i internacionalizovanih međunarodnih
krivičnih sudova. Ad hoc tribunali trenutno su u fazi transformacije
i prenošenja nadležnosti na UN Mehanizam za međunarodne
krivične tribunale. Što se tiče stalnog Međunarodnog krivičnog
suda, poželjan model proširivanja domašaja rada ovog Suda je
kroz uvećanje država članica njegovog Statuta. No što se trenutno
dešava je uvećavanje nadležnosti nekim drugačijim pravnim
sredstvima, a ne uobičajenim i poželjnim članstvom u Sudu.
Opšta tendencija u domenu međunarodnog krivičnog pravosuđa
ogleda se u uvećanom kreiranju novih sudova, iako ta tendencija
nije ubedljivo prihvaćena kao dobrodošla. Umnožavanje broja
međunarodnih sudova, sa istom ratione materiae nadležnošću,
jasno je da može dovesti do preklapanja u postupanju. S druge
strane dovodi do proširivanja nadležnosti po drugim principima
određivanja nadležnosti. Stoga fokus ovog rada i jeste usmeren
ka razrešenju dileme – da li opisana situacija kreira stanje
koherentnosti ili haosa
Multiagency approach to the problem of domestic violence in the local community and the role of police
The local community is a contextual framework in which the real potential for the emancipation of citizens is realized in the best possible way, the citizen needs and their level of (in)security are realistically assessed, and the needs for prevention and response to security issues, risks and threats at the local
level are defined. Domestic violence is a phenomenon that threatens the system and the principles of the
local community and quality of life of its members. It violates basic human rights and freedoms, threatens
the institution of the family as the basic social unit, and exposes vulnerable social groups - women, children,
elderly and incapacitated persons - to the continuous, direct or indirect victimization. A successful response
to the problem of domestic violence in the community involves a complex, planned, coordinated, timely
and methodologically unified response of all agencies (institutions) in the local community. Coordination
and harmonization of their activities is formally based on the adoption of a protocol on the agency or institution response. Among the community participants designated by current legislation to be stakeholders
in the prevention and/or combating domestic violence, in addition to the prosecution, judiciary, centres for
social services, non-governmental organizations (NGOs) and others, the police have a prominent place

У раду се, кроз кратак преглед досадашњих емпиријских сазнања о породичном насиљу, указује на његове основне карактеристике у погледу жртве, учиниоца,
структуре и распрострањености. У породичним оквирима
на просторима Србије најзаступљенији облик насиља је
психичко насиље, које је скоро свака друга жена доживела у дужем или краћем периоду. Једна од специфичности
породичног насиља јесте и потврђено постојање корелације између различитих облика насиља. Истраживања су
показала да се психичко насиље комбинује са свим другим облицима насиља, а посебно са претњама, физичким
насиљем, употребом оружја и сексуалним насиљем. Најчешћи насилници су муж или партнер. Потврђено је постојање повезаности између насиља међу родитељима у примарној породици и насиља међу брачним партнерима,
односно насилници често долазе из породица у којима су
били сведоци насиља међу родитељима, најчешће оца над
мајком. Насилно понашање драматично утиче на ментално и физичко здравље жена, па тиме и на добробит породице у целини. Осећај безизлазности након вишегодишњег
циклуса насиља резултира и убиством партнера, најчешће
на спавању, када су жртве немоћније и не очекују напад.
У највећем броју случајева (86%) породице учинилаца су
породице са децом. Несклад између родитеља, размирице
и конфликти доводе до конфликта и у самом детету, с обзиром да деца по правилу воле оба родитеља и идентификују се и са једним и са другим. Одрастајући у насилном
окружењу, дете учи да у свету насиља на насиље мора одговарати насиљем. Само током протекле године убијене су
43 жене од стране својих мужева/партнера, а најчешће коришћено оружје су пиштољ и нож, што указује на чињеницу да овај највидљивији облик родно заснованог насиља
прати неадекватна реакција надлежних институција и неуспех да се трагична последица спречи.In this paper, through a brief overview of
previous empirical findings on domestic violence, its main
characteristics in terms of a victim, an offender, its structure
and distribution are indicated. Within a family on the territory
of Serbia,Psychological violence is the most common form of
violence and almost every other woman has experienced it
during longer or shorter periods. One of the peculiarities of
domestic violence is confirmed by the existence of correlations
between the different forms of violence. Studies have shown
that psychological violence is combined with all other forms
of violence, especially with threats of physical violence, use of
weapons and sexual violence. The most common perpetrators
are a husband or a partner. The existence of a connection
between the violence between the parents in victims’primary
families and violence between spouses has been confirmed.,
i.e. bullies often come from families where they have witnessed
violence between their parents, usually a father against a
mother. Violent behavior dramatically affects mental and
physical health of women, and consequently the well-being of a family as a whole. The feeling of hopelessness after many years
of experienced cycle of violence, results in killing partners,
usually while thy are asleep, during moments when victims
are weaker and do not expect an attack. In most cases 86%
of the families of the perpetrators are families with children.
The discrepancy between parents, quarrels and conflicts lead
up to conflicts within a child, since children usually love both
parents and are identified with both of them. Growing up
in a violent environment, the child learns that the world of
domestic violence must respond with violence. Just in the past
year, 43 women were killed by their husbands / partners, and
most of them used weapons, usually a gun or a knife, which
indicates that the most visible form of gender-based violence
follows an inadequate reaction of the competent institutions
and their failure to prevent tragic consequences
Obaveštajno bezbednosni sistemi Kraljevine Norveške i Švajcarske Konfederacije
Intelligence and security systems are one of the key subjects of the national security of all modern states. They are the first line of defense against global challenges and threats that have marked the XXI century. When facing these challenges and threats, both the Kingdom of Norway and Switzerland, the world-respected developed democratic states, seek to establish their own organizational intelligence and security systems in accordance with modern principles. In this paper, the author analyzes the intelligence and security systems of these two European countries, in order to identify and critically examine all aspects of their development, statutory defined cope of work, powers, competencies, as well as established forms of control and supervision by the parliamentary, execurive and judicial authorities.Obaveštajno-bezbednosni sistemi predstavljaju jedan od ključnih subjekata sistema nacionalne bezbednosti svih savremenih država. Oni su, tako reći, prva linija odbrane od globalnih izazova i pretnji bezbednosti koje obeležavaju XXI vek. U susretu sa tim izazovima i pretnjama i Kraljevina Norveška i Švajcarska, u svetskim okvirima poštovane razvijene demokratske države, nastoje da sopstvene obaveštajno-bezbednosne sisteme organizaciono ustroje po svim modernim principima. U ovom radu ce analiziraju obaveštajno-bezbednosni sistemi ove dve evropske države, s ciljem da se prepoznaju i kritički razmotre svi aspekti njihovog razvoja, zakonom definisan delokrug rada, nadležnosti, ovlašćenja, kao i oblici kontrole i nadzora koje je uspostavila parlamentarna, izvršna i sudska vlast

Personal characteristics of the perpetrator and sentencing
The subject of this paper is personal characteristics of the perpetrator, its significance for sentencing
in Criminal
Legislation,
Criminal
Law
Literature
and
jurisprudence.
In
the
first
part
of
the
paper,
the
author
will consider
the
term
and
types
of
sentencing
as well
as circumstances
which
are
relevant
for
sentencing
in our
Criminal
Legislation.
Special
attention
will be
paid
to
the
influence
of
personal
characteristics
of
perpetrator
for
sentencing.
There
is a great
number
of
dilemmas in theory
and
jurisprudence
related
to
this
topic
to
the
resolution
of
which
the
author
will try
to
contribute.
In
principle
there
is no unique
opinion
on
what
is meant
by
personal
characteristics
of
perpetrator.
If
the
perpetrator
has a profession
which
is of
high
social
importance
(policeman,
doctor,
etc.),
it
is unclear
whether
this
circumstance
should
be
taken
into
account
as mitigating
or
aggravating.
Also,
there
is a question
whether
the
unemployment
of
perpetrator
should
be
taken
into
account
in sentencing
as aggravating
or
mitigating
circumstance.
It
is
disputable
whether
the
courts
should
take
into
account
only
personal
characteristics
that
existed
in time of
execution
of
offense
or
the
ones
occurred
after
commission
of
offense
are
relevant
as well.
Finally, the results of jurisprudence research will be presented in this paper which almost always takes
personal characteristics of perpetrator as mitigating circumstance. The author will explain his critical opinion
on
court’s
proceeding
in sentencing
The role of traditional values and advertising discourse in creation of modern conflict
By careful analysis of the content of Archibald Reiss message in his book “Listen, Serbs”,
the authors study the significance and role of traditional values of Serbian people – patriotism, courage,
hospitality, honesty and respect for opponents, faith and charity, aim to, together with comparative analysis
with advertising discourse during the conflicts in ex-Yugoslavia, construct a modern model of crisis com-
munication. From the context of the symbolic organization of messages and their hidden meanings, the
authors stress the importance of communication control and information management during the conflict,
as otherwise the moral panic and chaos arise. Developing McDougall’s instinct theory that determines the
behaviour of individuals and entire social groups, the authors remind us that Reiss was the first to real-
ize the human mind as a centre of social activity responsible for further development of individuals and
nations. Starting from the assumption that the social life is primarily political and preoccupied with the
question of redistribution of power, the authors discuss the construction of the security framework within
the community, warning it of the problem of unequal access to information. By influencing the modelling
of media images of a group or society its propaganda activities is enabled, which is essential during the crisis
or emergency situation, as their number will increase in the future
