    The dynamic stage of the criminal legislation of the Republic of Serbia

    In the last period, in theory one more often sees the claim that both in Serbia and other European countries a dynamic can be noticed that did not exist earlier, when it comes to changes to the criminal codes. Frequent changes are the result of the adjustment to international obligations, which countries take over by ratifying certain international agreements. Besides conventions, both regional and international, of special importance for the reform is the EU acquis. Nevertheless, one should not rush with such harmonisations. Until Serbia becomes a full member of the EU, much time will pass, and many EU documents will undergo changes. In addition, it should not be forgotten that there are certain behaviours whose indirect basis for prescribing are not international obligations or internal legislation, but can be related to our environment, bad experience in Serbia, which may be a basis for criminalization of such behaviour in the Criminal Code (for example, abuse in privatization process). It is clear that the changes and amendments to the Criminal Code of Serbia started due to the needs for harmonization with international obligations, which Serbia has taken over by ratifying certain international agreements (in this case, the attention will be focused on the Council of Europe Convention on preventing and combating violence against women and domestic violence), but also due to harmonization with common standards applicable in some European countries (economic crimes). The first part of the paper attempts to find the reasons for this dynamic stage our criminal legislation is going through at the moment, but also examines the identical situation at the level of the EU and its Member States. The second part of the paper analyses the draft Law on Changes and Amendments to the Criminal Code of Serbia

    Anti–ballistic protection as an aspect of contemporary combating terrorism

    The problem of protection of humans by projectile firearms and explosive devices is old just as much as the man’s knowledge about the possible harmful effects of firearms on living organisms. Awareness of the need to wear protective ballistic equipments has been evolving along with this knowledge. Personal protection against firearms is still a fundamental question of security. One of important aspects of anti–ballistic protection represents its technical and technological development. Nanotechnology can play a vital role in defence and space systems by minimising size, weight and power consumption that are important for long–range coverage. Within security system, levels incorporating the protection against lethal weapons, nanotechnology has an irreplaceable role in the development of anti–ballistic and shatterproof armour and advanced sensors. Therefore, these applications of nanotechnology are indispensable sub–units within defence forces of a country, including here equipment for the special police forces in order to suppress terrorist activities against civilians and objects. New nanocomposite should have higher impact resistance than present fibre composite systems and should have significantly reduced weight. The aim of this work is to summarize the results of the previous research in this field and through their critical analysis indicate the possible direction for further research in order to find optimal solutions that are required for people’s safety

    Inclusion in society is one of the priorities of EU policy. The values in sport are related to equal opportunities and fair play, which are also the European values. Community building and the fight against xenophobia and racism are one of the basic values and benefits of sport, and thus it represents the potential for a significant contribution to the integration of migrants in the EU. Under-representation of migrants and their exclusion from leadership positions in sport, and the lack of progress of minorities in positions in sports clubs and associations is a public secret in European sport. Network inclusion through sport (Sport Inclusion Network – SPIN) is a project designed to promote the inclusion and participation of ethnic minorities, migrants and other third-country nationals (including refugees) through sport across Europe. SPIN project gathers amalgam of experienced national key players in the field of combating intolerance and discrimination in sport, including the organization FairPlay-VIDC, the Italian аssociation ''Sport for All'' (Unione Italiana Sport per Tutti – CSPI), the Football Association of Ireland – FAI, the ortuguese Union of professional players (SJPF), migrant human rights organization "Mahatma Gandhi" from Hungary, multicultural Finnish sports initiative “Liikkukaa” and the German Association “Camino”, which is professionally engaged in the research of sport and youth. As a result of the SPIN project, a guide to good practice was created, which represents a set of examples of how to incorporate migrants into and through sport.     Although terrorism is a highly harmful social phenomenon which is the subject of a number of social sciences, it is interesting how much its political character influenced at the absence of its universally accepted definition. Legal, political and ideological differences between the creators of certain administrative definition of terrorism, represented a problem in finding a unified position of the international community on the constituent characteristics of the general criminal offence of terrorism, which would make it impossible to avoid the existence of the criminal prosecution of the perpetrators of these crimes, going to a country where it is not, or the second a narrower way relevant. Build effective legal mechanisms for the prevention and punishment of terrorist activities in the framework of international organizations, therefore, predominantly characterized by a sectoral approach to defining terrorism, which does not define the concept of terrorism, but individual terrorist acts defined as punishable, thus avoiding the creation of a single definition.Iako terorizam predstavlja visoko štetnu društvenu pojavu koja je predmet istraživanja brojnih društvenih nauka, interesantno je koliko je njegov politički karakter uticao na izostanak njegove univerzalno prihvaćene definicije. Pravne, političke i ideološke razlike između tvoraca pojedinih administrativnih definicija terorizma, predstavljale su problem u iznalaženju jedinstvenog stava međunarodne zajednice o konstitutivnim obeležjima opšteg krivičnog dela terorizma, čije bi postojanje onemogućilo izbegavanje krivičnog gonjenja učinilaca ovih krivičnih dela, odlaskom u zemlju u kojoj ono nije inkriminisano ili je inkriminisano na drugi, uži način. Izgradnju delotvornih pravnih mehanizama za sprečavanje i kažnjavanje terorističkih aktivnosti u okviru međunarodnih organizacija, stoga, dominantno karakteriše sektorski pristup definisanju terorizma, koji ne određuje pojam terorizma, već pojedine terorističke akte određuje kao kažnjive, izbegavajući na taj način stvaranje jedinstvene definicije. Ipak, u nekim regionalnim dokumentima (prioritetno na evropskom nivou) na terorizam se gleda kao na jedinstvenu krivičnopravnu kategoriju, bez obzira na to prema kome je upravljen i koja je država izvršenja, a koja država u kojoj se učiniocu sudi

    Sport is an integral part of social life. Through sports events, (which are organized in the form of competition), the desire to win and achieve high sports results is manifested by mobilizing physical, mental, and moral attributes. Generally, large numbers of people attend sporting events, which is why security at sporting events is fundamental to the success of any sporting event. Security at sporting events should be understood as a system of measures and activities for protection from hazards, as well as the capability of risk management and the ability to prevent dangerous situations. In today's globalized world there has been an increase in the number of security risks and threats of local, regional, and global character. The paper discusses the basic forms of risks and threats to the security of sporting events through terrorism, crime, violence, and misconduct. As safety of sport events represents a very complex activity, this paper attempts to point out the basic elements of safety principles at sport events

    Korupcija i njena kontrola u Srbiji i Evropskoj uniji

    The paper compares state of corruption and way of its control in Serbia and the EU in order to identify differences and factors that determine the extent and trend of corruption and success in its control. The analysis shows that fundamental differences don't exist in spectrum of measures implemented and problems that arise in their application between Serbia and the EU. Existing differences in perception extent of corruption by citizens are product of several factors influence, primarily the volume of direct citizens' experiences with bribery and experiences of citizens in accomplishing their rights through legal channels. Regulatory mechanisms which should ensure efficient control of corruption have a limited range, especially those governing financing of political parties and declaration of assets of public officials. The paper points to a problem with the current voluntary approach to registration of lobbying in the EU, as well as the need to improve the national system for the control of corruption in line with the experiences of the EU countries.U radu se upoređuju stanje korupcije i načini njene kontrole u Srbiji i zemljama EU kako bi se uočile razlike, odnosno faktori koji opredeljuju obim i trend korupcije i uspeh u njenoj kontroli. Analiza pokazuje da ne postoji suštinska razlika u spektru mera koje se sprovode i problemima koji se javljaju u njihovoj primeni između Srbije i zemalja EU. Postojeće razlike u percepciji građana o rasprostranjenosti korupcije proizvod su uticaja više faktora, a pre svega obima direktnog iskustva građana sa podmićivanjem i iskustva građana u ostvarivanju prava legalnim putem. Regulatorni mehanizmi koji treba da obezbede efikasnu kontrolu korupcije imaju ograničeni domet, prvenstveno oni koji uređuju finansiranje političkih stranaka i prijavljivanje imovine funkcionera. U radu se ukazuje i na nedostatak sadašnjeg dobrovoljnog pristupa registraciji lobiranja u EU, kao i na potrebu unapređivanja domaćeg sistema za kontrolu korupcije u skladu sa iskustvima zemalja EU

    Uticaj motivisanosti na spremnost građana Republike Srbije da reaguju na prirodnu katastrofu izazvanu poplavom

    The objective of the quantitative research was to examine the impact of the level of motivation on the preparedness of citizens to respond to natural disaster caused by flood in the Republic of Serbia. Bearing in mind all local communities in Serbia affected, or with a high risk to be affected, by flood, twenty of a total of 150 municipalities and 23 cities, as well as the city of Belgrade, were randomly selected. In the selected local communities the research was conducted in those areas that were the most endangered regarding the water level or potential risk. The survey applied the strategy of multi-stage surveying of random sampled households. The research results indicate that those absolutely motivated recorded a higher level of individual readiness to respond to floods as compared to the citizens who believe they are absolutely unmotivated. In contrast, absolutely unmotivated people do nothing to prepare for response. The originality of the research lies in the fact that Serbia has never conducted any research to examine the citizens’ preparedness to respond. The research findings can be used when creating a strategy for improving the level of citizens’ preparedness to respond. The research points to the way that should be used to drive the citizens, according to their level of motivation, in order to raise their preparedness to a higher level.Cilj kvantitativnog istraživanja predstavlja ispitivanje uticaja motivisanosti na spremnost građana za reagovanje na prirodnu katastrofu izazvanu poplavom u Republici Srbiji. Imajući u vidu sve lokalne zajednice u Srbiji u kojima se dogodila ili postoji visok rizik da se dogodi poplava, metodom slučajnog uzorka odabrano je dvadeset od ukupno 150 opština i 23 grada i grad Beograd. U odabranim lokalnim zajednicama istraživanje se obavilo u onim delovima koji su bili najugroženiji u odnosu na visinu vode ili potencijalni rizik. U samom anketnom ispitivanju bila je primenjena strategija ispitivanja u domaćinstvima uz primenu višeetapnog slučajnog uzorka. Rezultati istraživanja ukazuju na to da su apsolutno motivisani zabeležili viši nivo individualne spremnosti za reagovanje na poplave u odnosu na građane koji smatraju da su apsolutno nemotivisani. Suprotno tome, apsolutno nemotivisani građani ne rade ništa kako bi se pripremili za reagovanje. Originalnost istraživanja ogleda se u činjenici da u Srbiji nikada nije sprovedeno istraživanje kojim bi se ispitalo stanje spremnosti građana za reagovanje. Rezultati istraživanja mogu se iskoristiti prilikom kreiranja strategija za unapređenje nivoa spremnosti građana za reagovanje.     Percepcija narkomanije i narko-kriminala u opštoj populaciji i populaciji studenata KPA

    It is obvious that drug addiction and drug crime are the phenomena of the past, the present and the future. Any serious intentions to fight these phenomena assume serious research in order to observe the possible directions for future action of a wide range of entities involved in the fight against these social evils. In this sense, this paper presents the data from surveys completed in early 2015, on a sample of 413 respondents, related to the perception of threat of drug addiction and drug-crime to the society in Serbia. The authors of the research dealt with the respondents' views regarding the causes of drug abuse, the factors that may affect its reduction, as well as the causes of drug trafficking, the current trends and important factors for its control, with special reference to the police as an active participant in this process. The studied sample included, among others, 82 students of the Academy of Criminalistics and Police Studies based in Belgrade, in order to compare possible differences in attitudes within the general population and those who have been chosen to become police officers in the future. They used descriptive statistics and method of correlation. The research results showed that the students of the ACPS can be allocated as a separate entity, given that their views differ from the views of others respondents in the general sample, as well as the other respondents of the younger population. Specifically, the students of the ACPS have a more positive attitude when it comes to the perception of threat of drug addiction and the drug trafficking to the Serbian society, with more expressed critical attitude towards the educational system and the media, and followed by higher expectations from family in general in order to combat this social evils. Also, they are characterized by slightly favoring the role of police in fighting drug trafficking, with more accented perceptions of drug trafficking growth in the previous period of time compared to other respondents.Sasvim je izvesno da narkomanija i narko-kriminal predstavljaju fenomene prošlosti, sadašnjosti i budućnosti. Svaka ozbiljna namera suprotstavljanja ovim pojavama pretpostavlja njihovo ozbiljno istraživanje, u cilju sagledavanja mogućih pravaca daljeg delovanja širokog kruga subjekata koji su uključeni u borbu protiv ovih društvenih zala. U tom smislu, u radu se iznose podaci iz istraživanja dovršenog početkom 2015. godine na uzorku od 413 ispitanika, vezanog za percepciju ugroženosti društva u Srbiji narkomanijom i narko-kriminalom. Autor se u istraživanju bavio stavovima ispitanika vezanim za uzroke narkomanije, faktore koji mogu uticati na njeno smanjenje, kao i uzroka narko-kriminala, aktuelnih tendencija i bitnih faktora njegovog suzbijanja, s posebnim osvrtom na policiju kao aktivnog učesnika tog procesa. Istraživani uzorak činila su, između ostalih, i 82 studenta Kriminalističko-policijske akademije sa sedištem u Beogradu, kako bi se uporedile eventualne različitosti u stavovima u okviru opšte populacije i onih koji su se opredelili za policijski poziv. Rezultati istraživanja govore da se studenti KPA mogu izdvojiti kao poseban entitet, s obzirom da se njihovi stavovi razlikuju od stavova ispitanika iz opšteg uzorka, kao i ispitanika iz mlađe populacije. Naime, ti ispitanici imaju pozitivniji stav kada je u pitanju percepcija ugroženosti narkomanijom i narko-kriminalom, uz više izražen kritički odnos prema obrazovnom sistemu i medijima i veća očekivanja od porodice na planu sprečavanja ovog društvenog zla. Takođe, odlikuje ih blago favorizovanje uloge policije u borbi protiv narko-kriminala, uz izraženiju percepciju rasta narko-kriminala u prethodnom periodu u odnosu na ostale ispitanike

    Društvena stigmatizacija kao generator diskriminativnog postupanja policije - teorijske osnove

    We can easily come to the conclusion that the general settings of the theory of social interactionism, and especially the process of social labeling and stigmatization, as a concretization of those theories, can serve as a basis for explaining certain aspects of discriminatory activities in policing. And this problem is a key subject of this work, which we tried to explain in the light of three different but inter-related labeling theory. In this way, we also wanted to find their practical application in a particular social phenomenon or as it is popularly said 'to put theory into operation'. In fact, the key purpose of this paper is to show how the interaction of social subjects, which takes place at a general level, particularly categorization, classification, social stigma and stereotypes that result from these interactions, significantly shape the way the police behave. Moreover, if we take into consideration that police officers have a significant level of power to label others from the position of professional authority this theoretical concept becomes more important. To what extent (of course, empirically speaking) this social process affects in such a way and creates such consequences, it should be established by a scientific investigation of individual cases. It is certain, however, that our life often assures us of this outcome, confirming that it is not a coincidence, but the unwritten rules. And such examples should serve us as a starting point for scientific research of this phenomenon.Opšte postavke teorija socijalnog interakcionizma, a posebno društvena stigmatizacija i etiketiranje kao konkretizacije ovog naučnog diskursa, mogu poslužiti kao polazna osnova za objašnjenje uslovljenosti određenih vidova protivpravnog postupanja policije, a pre svih ponašanja koja imaju karakter diskriminacije. Upravo taj problem i predstavlja ključnu temu ovog rada, a koji smo nastojali obrazložiti posmatrajući ga u svetlosti tri različite, ali međusobno povezane teorijske koncepcije - teoriji o društvenoj stigmatizaciji Ervina Gofmana, teoriji o autsajderima Hauarda Bekera i teoriji o stereotipu kriminalca Denisa Čepmena. Na taj način smo ujedno hteli pronaći njihovu praktičnu primenu u konkretnoj društvenoj pojavi ili kako se to popularno kaže 'staviti teoriju u pogon'
