Thematic conference proceedings of international significance. Vol. 2 / International Scientific Conference "Archibald Reiss days", Belgrade, 1-2 March 2012
This International Scientific Conference is held for the second time in the con-text of initiated reforms of the security services and police education, and also in memory of one of the founders and directors of the first modern police high school in Serbia, Dr. Rodolphe Archibald Reiss, after whom the Conference was named. The Thematic Conference Proceedings contain 76 papers by eminent experts in the field of law, security, criminalistics, forensic sciences, medicine, members of national security system or participants in education of the police and army, as well as other security services. Each paper has been reviewed by two competent inter-national reviewers, and the Thematic Conference Proceedings in whole has been reviewed by four competent international reviewers. The papers published in the Thematic Conference Proceedings contain the overview of contemporary trends in the development of police educational system, development of the police and contemporary security, criminalistic and forensic concepts. Furthermore, they provide us with the analysis of the rule of law activi-ties in crime suppression, situation and trends in the above-mentioned fields, as well as suggestions on how to systematically deal with these issues. The Thematic Conference Proceedings represents a significant contribution to the existing fund of scientific and expert knowledge in the field of criminalistic, security, penal and legal theory and practice. Publication of this Thematic Conference Proceedings contrib-utes to improving of mutual cooperation between educational, scientific and expert institutions at national, regional and international level

Doprinos policijskog pregovaračkog tima zaštiti ljudskih prava u posebnim bezbednosnim situacijama
Legal right of police to use force, especially firearms, makes modern police mission seem inconsistent: in order to protect the rights of one, the police must limit the rights of others, which raises the question of optimal measures between these opposites. The most dangerous is the police action which encroaches on the right to life, thus indirectly interfering in other human rights. This applies equally to both citizens and the offenders. In an effort to minimize the possibility of eroding the right to life, the modern police forces have developed mechanisms of so-called police negotiating. Respecting the principles of legality, humanity and expertise, members of the of specialized police units engage in negotiations with the most dangerous criminals in order to prevent them in further criminal intent on one hand and in order to solve the crisis without the use of police force, on the other. In addition a notable involvement of police negotiators in prevention of suicide attempts has been observed. In this regard, the paper explores the contribution of the negotiating team of the Ministry of Internal Affairs of the Republic of Serbia to the protection of human rights in Serbia in the period 2005. - 2010.Zakonsko pravo policije da upotrebi silu, posebno vatreno oružje, čini misiju savremenih policija protivrečnom: da bi zaštitila prava jednih, policija mora da ograničava prava drugih, što nameće pitanje optimalne mere između navedenih suprotnosti. Najopasnije je delovanje policije kojim se zadire u pravo na život, čime se posredno zadire i u druga ljudska prava. Ovo se podjednako odnosi kako na građane, tako i na izvršioce krivičnih dela. Nastojeći da minimiziraju mogućnost narušavanja prava na život, savremene policije su razvile mehanizme tzv. policijskog pregovaranja. Uvažavajući principe zakonitosti, humanosti i stručnosti, pripadnici specijalizovanih pregovaračkih jedinica angažuju se u pregovaranju sa najopasnijim kriminalcima ne bi li ih sprečili u daljim kriminalnim namerama, s jedne, i ne bi li krizne situacije rešili bez upotrebe sredstava policijske prinude, s druge strane. Osim toga, zapaženo je i angažovanje policijskih pregovarača povodom sprečavanja pokušaja samoubistava. S tim u vezi, u radu je istražen doprinos Pregovaračkog tima Ministarstva unutrašnjih poslova Republike Srbije zaštiti ljudskih prava u Srbiji, u vremenu od 2005. do 2010. godine
Studije vremenskih serija za procenu zdravstvenih rizika povezanih sa kratkotrajnim izlaganjima aerozagađenju
Epidemiological studies investigating the health effects of short-term exposure to air pollution most often assess the impact of variations in concentrations of air pollutants on the number of adverse health events from day to day, using regression models for analyzing time series data. Heterogeneity in the results of these studies is caused by differences in mixtures of pollutants, development level of health services, meteorological conditions, geographical location and characteristics of the population, but differences between the way regression models are formed and associated factor effect control are still present. The aim of this paper is to present the results of studies conducted in the world where the effects of air pollution on human health was investigated using time series models, and highlight the need for standardization of the regression models used in the analysis.Epidemiološke studije koje istražuju zdravstvene efekte kratkotrajnog izlaganja aerozagađenju najčešće procenjuju uticaj varijacija koncentracija zagađujućih materija u vazduhu na broj negativnih zdravstvenih događaja iz dana u dan, korišćenjem regresionih modela za analizu vremenskih serija podataka. Do heterogenosti u rezultatima ovih studija dovode razlike u sastavu smeše polutanata, razvijenosti zdravstvene službe, meteoroloških prilika, geografskog položaja i karakteristika populacije, ali i još uvek su prisutne razlike u načinu formiranja regresionih modela i kontrole delovanja pridruženih faktora. Cilj ovog rada je prikaz rezultata studija sprovedenih u svetu u kojima je uticaj aerozagađenja na zdravlje ispitivan primenom modela vremenskih serija, kao i ukazivanje na potrebu standardizacije regresionih modela koji se koriste u analizi
Koncept istrage i reforma krivičnog procesnog zakonodavstva Srbije
The topic of this article is a critical analysis of professional issues in the investigation of the concept of reform of the criminal procedure legislation in Serbia which is still ongoing. Underlying issues have been analyzed from three aspects. First, general comments about the investigation and its relevance to criminal proceedings are provided and within those the issues for a long period of criminal procedure discussed in theory and practice are specifically emphasized. For example, there is a case to investigate the relationship between the concept and its effectiveness and thus the efficiency of the process as a whole. The second aspect of analyzed issues consist of questions related to the concept of prosecutorial investigation as an essential feature of the process of reform of the criminal procedure legislation in Serbia, where arguments of prosecutorial justification of the concept of judicial investigation have primarily been analyzed along with the principles by which a legislator should be guided in the standardization of the prosecutorial concept of investigation. Finally, the third - and the key aspect consists of the issues related to review of normative elaboration of the concept of prosecutorial investigation into the new RS CPC and the draft Law on Amendments to the legal text available to Serbian expert public, and not just Serbian. The main conclusion of expert critical analysis of this group of questions that are still in the draft of the Law on Amendments to the CPC concept of prosecutorial investigation in Serbia develops in a way that is consistent with the efforts of the majority of experts in Serbia and not only Serbia.Predmet analize u radu je stručno-kritička analiza pitanja koncepta istrage u procesu reforme krivičnog procesnog zakonodavstva Srbije koja je još uvek u toku. Predmetna pitanja analizirana su sa tri aspekta. Prvo su date opšte napomene o istrazi i njenom značaju za krivični postupak i u okviru istih su posebno apostrofirana pitanja koja su već duži period predmet rasprave kako krivičnoprocesne teorije tako i prakse. Slučaj npr. sa pitanjem odnosa koncepta istrage i njene efikasnosti a time i efikasnosti krivičnog postupka kao celine. Drugi aspekt analizirane problematike čine pitanja tužilačkog koncepta istrage kao bitnog obeležja procesa reforme krivičnog procesnog zakonodavstva Srbije, i u istom su pre svega analizirani argumenti opravdanosti tužilačkog nad sudskim konceptom istrage i načela kojima treba da se rukovodi zakonodavac u normiranju tužilačkog koncepta istrage. Na kraju, treći - ključni aspekt čine pitanja prikaza normativne razrade tužilačkog koncepta istrage u novom ZKP RS i u Radnoj verziji Zakona o izmenama i dopunama ovog zakonskog teksta dostupnoj stručnoj javnosti Srbije i ne samo Srbije. Osnovni zaključak stručno-kritičke analize ove grupe pitanja je da se tek u Radnoj verziji Zakona o izmenama i dopunama ZKP tužilački koncept istrage u Srbiji razrađuje na način koji je u skladu sa većinskim zalaganjima stručne javnosti Srbije i ne samo Srbije
Metodološki okvir jednog naučnog istraživanja organizovanog kriminala i terorizma
The expansion of organized crime and terrorism in conditions of social and economic crisis, armed conflicts and political instability of the last decade of the XX century, have made it difficult for the Republic of Serbia to fully develop its institutional capacities, standards and procedures for more effective prevention and suppression of these forms of crime, as well as for the protection, help and support to the victims. At the same time, the existing standards and procedures are not fully harmonized with the standards and procedures of various forms of international integrations, towards which the Republic of Serbia inclines. This, besides the inefficiency of the state, obstructs the successful international cooperation in the field of crime investigation, as well as other forms of cooperation in the security field. Presently, the problem is being mitigated through the cooperation with the international community, certain international organizations and countries. From the aspect of Serbian candidacy for the membership in international organizations, above all European Union, this is inadmissible, due to the fact that international integrations imply both the independency and efficiency of the states in control of challenges, risks, and threats to the security. As one way for improvement of security practice, the Academy of Criminalistics and Police Studies in Belgrade started the realization of the Scientific Research Project entitled 'The Development of Institutional Capacities, Standards and Procedures for Combating Organized Crime and Terrorism in the International Integration Conditions'. Generally, this research is expected to provide the new theoretical knowledge on etiological, phenomenological, victimological and consequential dimension of organized crime and terrorism in the Republic of Serbia, as well as proposals, guidelines and solutions for strengthening the institutional capacities and harmonizing the standards and procedures of the security and criminalistic practice of the national security system with the demands of international public and criminal law.Ekspanzija organizovanog kriminala, terorizma i oružanih konflikata u uslovima društvene, ekonomske i političke nestabilnosti u poslednje dve decenije otežala je Republici Srbiji potpunu izgradnju institucionalnih kapaciteta, standarda i procedura za efikasnu prevenciju i suzbijanje ovih vidova kriminala i za zaštitu, pomoć i podršku žrtvama. Istovremeno, postojeći standardi i procedure nisu u potpunosti saglasni sa standardima i procedurama raznih oblika međunarodnih integracija kojima Republika Srbija teži. To je, s pozicije kandidature Republike Srbije za članstvo u međunarodnim organizacijama, a pre svega u Evropskoj uniji, nedovoljno, jer međunarodne integracije podrazumevaju i samostalnost i efikasnost država u kontroli izazova, rizika i pretnji bezbednosti. Kao prilog prevazilaženju takve situacije, Kriminalističko-policijska akademija u Beogradu je, pod okriljem ministarstva nadležnog za nauku u Republici Srbiji, započela realizovanje naučnoistraživačkog projekta pod nazivom 'Razvoj institucionalnih kapaciteta, standarda i procedura za suprotstavljanje organizovanom kriminalu i terorizmu u uslovima međunarodnih integracija'. Generalno, od ovog istraživanja očekuju se nova teorijska znanja o etiološkoj, fenomenološkoj, viktimološkoj i posledičnoj dimenziji organizovanog kriminala i terorizma u Republici Srbiji, kao i predlozi, smernice i rešenja za jačanje institucionalnih kapaciteta i za usaglašavanje standarda i procedura bezbednosno-kriminalističke prakse nacionalnog sistema bezbednosti sa zahtevima međunarodnog javnog i krivičnog prava
Ustavna žalba - teorijsko-pravni okvir
The expansion of constitutional complaint through the landscape of European constitutionalism in the last decade of the XX century, as well as its implementation in the Serbian constitutional system in 2006, have increased the interest of Serbian legal scholars in this legal instrument. Comparative law does not provide a uniform institutional model of constitutional complaint, and experience of the Republic of Serbia with respect to this institute is very short. As a result, many questions regarding constitutional complaint have been raised in Serbian legal theory so far. This paper offers a theoretical and legal framework of the instrument of constitutional complaint. The author firstly examines the institutional models of three countries − Germany, Austria and Spain, and, secondly, deals with some specific characteristics of other constitutional systems which have subsequently introduced this legal instrument.Širenje ustavne žalbe u okvirima evropskog konstitucionalizma poslednje dekade XX veka, ali i njeno konstituisanje u srpski ustavni sistem 2006. godine, izaziva porast interesovanja za ovim pravnim institutom. Imajući u vidu da uporedno pravo ne pruža jedinstven institucionalni model ustavne žalbe, kao i relativno kratkotrajno iskustvo Republike Srbije sa ovim institutom, ne iznenađuje činjenica da je u našoj teoriji otvoreno mnogo pitanja na ovom polju. Upravo iz tog razloga autor je nastojao da prvenstveno kroz uporednu analizu institucionalnih modela tri ugledna primera, Nemačke, Austrije i Španije, obogaćenu pojedinim specifičnostima pravnih sistema u kojima je naknadno konstitucionalizovana ustavna žalba, pruži teorijsko-pravni okvir ovog pravnog sredstva
Kriminalističke provere u finansijskim istragama
The confiscation of crime-acquired assets, as an anti-crime measure has found full recognition in the legislations of most developed European countries in the last decade of the 20th century, as an effective way of battling organized crime. In Serbian practice, this institute is relatively new; it has been recently introduced, by the relevant normative-legal framework which was adopted more than three years ago. The mentioned framework set up a special investigating entity, the Financial Investigation Unit (FIU), as the organizational unit of the Ministry of Internal Affairs, which, under the formal command of the public prosecutor, is taking a wide range of measures and actions aimed at establishing the existence of 'criminal assets'. Within the powers available to the FIU, one can find mostly traditional, already known police powers along with somewhat adapted ones specific to financial investigation and designed to gather evidence or take actions that have only informal importance. The subject of exploration here are adapted measures, including primarily background checks, comprising of a complex set of actions which confirm (or deny) the initial findings of the existence of property derived from crime. The author has analyzed the initial sources of findings about the criminal origin of property and then tried to point to the specifics of these checks in financial investigations, both in the form and contents, as well as in terms of standards that are established in this area and have marked the previous work of this investigation subject (FIU).U Srbiji je primena instituta oduzimanja imovine stečene kriminalom tekovina novijeg datuma, za razliku od većine razvijenih evropskih, gde je ovaj institut pronašao punu afirmaciju još tokom poslednje decenije 20. veka i gde je posmatran uglavnom kao efikasan vid borbe protiv organizovanog kriminala. Pravni okvir kojim je u Srbiji omogućeno efikasnije istraživanje dobiti stečene kriminalom, a koji se primenjuje nešto više od tri godine, predvideo je i osnivanje posebnog istražnog subjekta, Jedinice za finansijske istrage (JFI), organizacione jedinice zemalja Ministarstva unutrašnjih poslova, koja pod rukovodećom ulogom javnog tužioca preduzima širok dijapazon mera i radnji usmerenih ka utvrđivanju postojanja 'kriminalne imovine'. U okviru ovlašćenja kojima raspolaže JFI pronalaze se mahom od ranije već poznata klasična policijska ovlašćenja, unekoliko prilagođena specifičnostima finansijskih istraživanja, namenjena prikupljanju dokaznog materijala ili preduzimanju radnji koje imaju isključivo kriminalistički značaj. Predmet interesovanja autora su drugonavedene radnje, a među njima prvenstveno kriminalističke provere, kao kompleksan skup radnji kojima se početna saznanja o postojanju imovine stečene kriminalom potvrđuju ili opovrgavaju. Autor analizira početne izvore saznanja o kriminalnom poreklu imovine koji su najzastupljeniji u praksi, a zatim ukazuje na specifičnosti koje navedeni vid provera poprima tokom finansijskih istraga, kako u pogledu forme i sadržine, tako i u pogledu standarda koji su na ovom planu uspostavljeni i koji su obeležili dosadašnji rad ovog istražnog subjekta

EU regional policy towards the Western Balkans in the field of police affairs
Evropska budućnost zemalja Zapadnog Baikana delimično zavisi od politike EU prema tom regionu, računajući i ishode rešavanja nekih od gorućih bezbednosnih problema, poput viznog režima i suprotstavljanja organlzovanom kiminalu. Regionalna politika EU u oblasti policijske saradnje oslanja se na osnivanje i razvoj regionalnih inicijativa i postavljanje europikih standara u pitanjima unutrašnjih poslova i pravosuđa, kao ,,trećem stubu" EU. Kako bi se države regiona uspešno suprotstavile i u što je moguće većoj meri suzbile neke od osnovnih bezbednosnih problema, osnovali su autohtone inicijative poput Asocijacija šefova policija Jugoistočne Evrope (Southeastern Europe Police Chiefs Association - SEPCA), ili su ,,servirane˝ kao Inicijativa za saradnju u Jugoistočnoj Evropi (South-East Cooperation Initiative - SECI). Svakako, sve ove inicijative nalaze se u službi uzdizanja stepena bezbednosti unapređenja i policijske saradnje država Zapadnog Balkana.The European fufurre of the Western Balkans partly depends on the EU policy towards the region, including solving of some of the most pressing security problems, such as visa requirements and the combat against organized crime. The EU regional policy in the field of police cooperation relies on the establishment and development of regronal initiatives and setting of European standards in the Interior and Justice, as the Third Pillar of the EU. In order to fight successfully and stamp out as much as possible some of the basic securily problems the countries of the region have established indigenous initiatives such as the Southeastern Europe Poiice Chiefs Association (SEPCA) or "were served" as is the case with South-East Cooperation initiative (SECI). Certainly, all these initiatives are in the service of raising the level of securify and improvement of police cooperation in the Western Balkans
