Ostvarivanje poslova policijskog menadžmenta
This paper presents the results of an empirical study on the implementation of activities of police management in the Republic of Serbia. The results will be exhibited at the following units: (1) to the current leaders in the police of the Republic of Serbia understand and rank their managerial roles and activities, and whether they see all their significance, especially for the effective and lawful execution of police duties; (2) if police executives recognize the influential factors of their management skills (effectiveness); (3) is there a need to be in the education system of the Ministry of Internal Affairs of the Republic of Serbia, that is, forms of education and training, implementing teaching programs for acquiring knowledge in the area of police management; (4) of the existence of a legal basis for the exercise of police management processes, and the extent to which they affect the efficient and lawful exercise of its functions (tasks) and (5) on the opinions and suggestions of the respondents in the exercise of roles and activities of police management.U radu se prezentuju rezultati empirijskog istraživanja o ostvarivanju poslova policijskog menadžmenta u Republici Srbiji. Rezultati će se izložiti po sledećim celinama: (1) kako aktuelni rukovodioci u policiji Republike Srbije shvataju i rangiraju svoje menadžerske uloge i funkcije, te da li vide svu njihovu značajnost, posebno za efikasno i zakonito izvršenje policijskih poslova; (2) da li policijski rukovodioci prepoznaju uticajne faktore na njihovu menadžersku sposobnost (uspešnost); (3) da li postoji potreba da se u okviru obrazovnog sistema Ministarstva unutrašnjih poslova Republike Srbije, to jest, oblika stručnog osposobljavanja i usavršavanja, realizuju nastavni sadržaji kojima se stiču znanja iz oblasti policijskog menadžmenta; (4) o postojanju pravnih osnova za ostvarivanje procesa policijskog menadžmenta, te u kojoj meri one utiču na efikasno i zakonito ostvarivanja njegovih poslova (zadataka) i (5) o mišljenjima i sugestijama anketiranih u pogledu ostvarivanja uloga i funkcija policijskog menadžmenta

The influence of basic parameters of students population of Academy of criminalistic and police studies on evaluation of field training in summer conditions
Рад покушава да одговори на питање да ли постоји разлика у оцени појединих сегмената Теренске обуке у летњим условима које су дали студенти Криминалистичко-полицијске академије током њене евалуације, у зависности од основних карактеристика узорка студената, односно када се узорак подели на основу неке од карактеристика испитиваних студената, као и зашто те разлике постоје. У трагању за одговором, аутори су применили неколико техника статистичке методе: дескриптивну статистику (средњу оцену и стандардну девијацију), т-тест и КрускалВолисов Х тест. Анализе су показале да постоје статистички значајне разлике када се испитивани узорак студената подели по неколико критеријума, а аутори су покушали да те разлике и објасне. У раду су, на основу резултата спроведених анализа, дате и препоруке како би се организација и реализација Теренске обуке у летњим условима могле подићи на виши ниво.The study is trying to answer the question if there is a difference in evaluation of individual segments of field training in summer conditions which gave students of Academy of Criminalistic and Police Studies during it evaluation depending of basic characteristics from student’s sample in other words when we divide sample based on some characteristics of tested students as well as why there are those differences. In a search for an answer, authors have applied several techniques of statistic method: descriptive statistic (mean score and standard deviation), t-test and Kruskal-Volisov H test. Analysis have shown that there are statistical significant differences when tested student’s sample divides by criteria: (1) type of studies and constituent groups which respondents are attending; (2) half of respondents and (3) if respondents have been punished or not in the course during the study. When the sample of tested students divides by criteria of types of studies, and with that, conditionally, selected groups which students attend ,differences between grades are because of: (1) differently oriented interests from students of undergraduate studies which there aren’t with students of basic vocational studies; (2) backgrounds which students of undergraduate studies have much more than students of basic vocationally studies ; (3) better results from many types of shooting which students of basic vocationally studies have achieved; (4) different instructors who have realized individual segments of training with students of undergraduate, in other words, basic vocationally studies and (5) general resistance which students of security electoral group have toward field training. When the sample of tested students divides on half of respondents ,there are differences between mean scores which have given female students, in other words, male students because: (1) relatively poorer psycho-physical preparedness of girls for field training; (2) differences in leadership styles which have hired mentors and (3) pronounced competitive spirit which girls compared to men show during the field training. When the sample of tested students divides by criteria and if respondents during the previous studying punished or not, differences in grades which gave students of first or second group are in the first place because of resistance that punished students have to authority and discipline. It should be noted that this results should take conditionally because of large difference in size of compared groups. In a study that is based on the results of conducted analyzes concluded that organization and realization of field training in summer condition could be raised to a higher level if: (1) the content of field training should innovate since it could be more convenient for interests of students who are attending security electoral group; (2) in study programs of undergraduate has drastically decreased difference between contents which are learning students from police electoral group and contests which are learning students from security electoral group, especially from the point of general police knowledge and skills (for example; operational-police skills) which are required to every police officer; (3) to adjust contents of study program basic vocational studies so that learning of vocational subjects could begin before the realization of field training; (4) the same group of instructors, associates and professors was hired all the time during the field training so that differences in the methodology of performance individual segments of training could be avoided and (5) to preformed better psycho physical and moral student’s preparation for realization of field training
National strategy for the fight against corruption and novelties of the criminal code – de lege ferenda
Corruption represents one of the most important topics of the international criminal policy. This is why it is very important to determine if in our country, from the viewpoint of substantive criminal law, there are satisfactory solutions or criteria which are set by the international
documents that should encourage the reform of our legislation. The criminal legislation of the Republic of Serbia fulfills the standards set by the Council of Europe Criminal and Civil Law Conventions on Corruption (Evaluation Report on the Republic of Serbia Incriminations (ETS 173 and
191, GPC 2)). The recommendations given to our country on that occasion were adopted by the
Law on amendments to the Criminal Code of the Republic of Serbia in 2012. The UN Convention against Corruption suggests considering to introduce into criminal legislations a new criminal
offence “Illicit enrichment”. Our country adopted several strategic documents that are of direct significance for the fight against corruption and directly influence the future amendments to the Criminal Code. First of all, there is the National strategy for the fight against corruption for the period
from 2013 to 2018. In addition to this, on August 25, 2013, at the recommendation of the Ministry
of Justice and Public Administration, the government of the Republic of Serbia brought a Resoluti-
on to adopt the Action Plan to implement the National Strategy for the fight against corruption and
the Action plan to implement the National strategy for the fight against corruption in the Republic
of Serbia for the period from 2013 to 2018. Considering the fact that both the National strategy for
the fight against corruption and the Action plan for the implementation of the National strategy for
the fight against corruption in the Republic of Serbia for the period from 2013 to 2018 were adopted
only recently, the analysis of their content is certainly important for the future amendments to the
Criminal Code of the Republic of Serbia
Ustavnosudsko uobličavanje teritorijalne autonomije Vojvodine
While ruling on the constitutionality of the Law on establishing the competences of the Autonomous Province of Vojvodina, the Constitutional Court of the Republic of Serbia has found 22 provisions in this law unconstitutional. That offered an opportunity of which the Constitutional Court has tried to take advantage in further considerations of the constitutional framework for territorial autonomy. However, the Court has failed since it has made some inadmissible and discreditable errors. There was no detailed constitutional analysis of the established territorial autonomy concept. Therefore, many questions remained open. One of these open questions is the legal nature of the statute of autonomous province, on which the Constitutional Court will decide when the constitutionality of the supreme legal act of Vojvodina will be brought to the attention of the Court. If the Constitutional Court had been in a good way while ruling on the constitutionality of the above-mentioned Law, it would not have had so many hesitations while ruling on the constitutionality of the Vojvodina Statute.Odlučujući o ustavnosti Zakona o utvrđivanju nadležnosti AP Vojvodine, Ustavni sud je doneo odluku kojom je proglasio neustavnim 22 odredbe ovog zakona. Bila je to prilika za Ustavni sud, koju je pokušao da iskoristi, da dalje razvija i precizira ustavni okvir teritorijalne autonomije. Međutim, u ovom svom nastojanju, Ustavni sud nije bio previše uspešan, budući da je načinio i neke nedopustive greške, dakako nedostojne ovog organa. Izostala je fina ustavnopravna analiza ustanovljenog koncepta teritorijalne autonomije, tako da su mnoga pitanja i dalje ostala otvorena. Jedno od tih otvorenih pitanja je i pravna priroda statuta autonomne pokrajine, o kojoj Ustavni sud tek treba da se izjasni kada bude odlučivao o ustavnosti najvišeg pravnog akta Vojvodine. Da je kojim slučajem bio na dobrom putu kada je odlučivao o (ne)ustavnosti pomenutog zakona, sada svakako ne bi bilo potrebe za tolikim oklevanjem kada treba da odluči o (ne) ustavnosti Statuta AP Vojvodine
Classification of natural disasters between the legislation and application: experience of the Republic of Serbia
The paper discusses the definitions of natural disasters and recommends the implementation of definitions and classifications of natural disasters in accordance with those decreed at the Centre for Research on the Epidemiology of Disasters (CRED) and Munich Re insurance Company (Munich RE) for administrative use in the Republic of Serbia. For the Republic of Serbia, the issue of natural disasters is presented both through government documents (e.g. the Law on Emergencies and the National Strategy of the Protection and Rescue in Emergencies) and the survey of the frequency and typology of disasters. Significant discrepancies exist between older and more contemporary classifications of disasters in Serbia. They are especially emphasized in comparison to the CRED and Munich RE classifications and databases. This causes problems in the monitoring, recording and assessment of the effects of natural disasters. It is proposed that definitions be adapted and implemented into legislative and other documents
Kvantitativna analiza vremenske i prostorne distribucije krađa motornih vozila na području grada Beograda
This paper presents the results of the quantitative analysis of the temporal and spatial distribution in cases of motor vehicle theft in the City of Belgrade in two observed periods: from 1995 to 2012 and from 2001 to 2011. The results were achieved using the method of content analysis, comparative methods, and statistical analysis of large-scale data on motor vehicle thefts in the Republic of Serbia and in the City of Belgrade, contained in the documents of the Ministry of Internal Affairs of the Republic of Serbia. The ongoing debates about the vehicle theft's qualification in the Criminal Code as well as a qualitative analysis (manufacturer, type, age, colour, value, and other characteristics) of stolen vehicles will be the subject of another paper. Instead, some terminological quandaries of the conceptual and category apparatus used in criminology, criminal justice and especially in scientific research in the cases of motor vehicle theft were clarified.U radu su prikazani rezultati kvantitativne analize vremenske i prostorne distrubucije krađa motornih vozila na području grada Beograda u periodu od 1995. do 2012. godine, odnosno u periodu od 2001. do 2011. godine. Do rezultata se došlo primenom metode analize sadržaja, komparativnom metodom i statističkom obradom obimnih podataka o krađama vozila u Republici Srbiji i na području grada Beograda koji su sadržani u dokumentima Ministarstva unutrašnjih poslova Republike Srbije. Aktuelne polemike o krivičnopravnom kvalifikovanju krađa vozila, kao i kvalitativna analiza (proizvođač, tip, starost, boja, vrednost i druga obeležja) ukradenih vozila biće predmet drugog rada. Umesto toga, razjašnjene su terminološke dileme pojmovno-kategorijalnog aparata koji se koristi u kriminalističkom, krivičnopravnom, a pre svega u naučnom istraživanju krađa motornih vozila
Evolucija i preobražaji ljudskih prava
Since their emergence in ancient times - although in rudimentary form - human rights have continually evolved and have undergone multiple transformations. The initial stage in the development of human rights is characterised by their extremely modest and restrictive practice, as well as by the emergence of the first ideas of natural law that did not tend to change the unjust social reality. The stage of institutionalisation, which began in the Middle Ages, is characterised by the struggle to reduce the monarch's absolute power. This process has enabled a gradual recognition of human rights, primarily the guarantees of personal liberty and security. The process of constitutionalization of human rights, which began with glorious revolutions in the USA and France, was inspired by medieval ideas of natural law. At the time, the natural law theories were actualised for the first time in their history. The next stage in the development of human rights occurred after World War II, with the beginning of the process of their internationalisation and the emergence of human rights protection mechanisms at the international level. Nevertheless, in the recent decades of their development, through conversion into an ideology, human rights have increasingly become a means for manipulation. With their relativization and the growing trend of removing the line between rights and morality, there appeared interpretations that could justify (or condemn) very different life situations and thus present the basis for the application of double standards. Accordingly, human rights must be redefined and freed from association with natural law features; otherwise, they will remain a means for manipulation and pursuit of ethically (non)controversial political goals.Od njihove pojave, doduše u rudimentarnom obliku, u starom veku, ljudska prava su neprestano evoluirala i višestruko su transformisana. Početnu fazu u razvoju ljudskih prava odlikuje njihova izrazito skromna i restriktivna praksa, kao i nastanak prvih prirodnopravnih ideja koje nisu imale pretenziju da menjaju nepravednu društvenu stvarnost. Fazu institucionalizacije ljudskih prava, započetu u srednjem veku, odlikuje borba za sužavanje monarhove apsolutne vlasti. U tom procesu se postepeno zadobijaju ljudska prava, i to prevashodno garantije lične slobode i bezbednosti. Proces konstitucionalizacije ljudskih prava, započet slavnim revolucijama u SAD i Francuskoj, podstaknut je srednjovekovnim prirodnopravnim idejama. Tada, prvi put u svojoj istoriji, prirodnopravne teorije bivaju otelovljene u stvarnosti. Sledeća faza u njihovom razvoju nastupila je nakon Drugog svetskog rata, kada je došlo do procesa internacionalizacije ljudskih prava i nastanka mehanizama njihove zaštite na međunarodnoj ravni. Međutim, ljudska prava u poslednjim decenijama svog razvoja putem ideologizacije postaju sve više sredstvo manipulacije. Njihovim relativizovanjem, kao i sve prisutnijim trendom brisanja granica između prava i morala, javljaju se interpretacije koje mogu opravdati (ili osuditi) veoma različite životne situacije i tako predstavljati podlogu za primenu dvostrukih standarda. Upravo iz tog razloga, ljudska prava moraju biti redefinisana i oslobođena svih prirodnopravnih primesa, jer će, u suprotnom, ona i dalje ostati sredstvo za manipulisanje i ostvarivanje moralno (ne)spornih političkih ciljeva
Preliminary estimation of the explosive mass based on the crater resulting from the surface explosion on asphalt
In the course of court trials and for the purpose of legal proceedings, forensic engineers often produce estimations of the explosive mass based on the explosion effect. For the preliminary estimation of the explosive mass one often uses empiric formulas. This paper describes experimental surface explosions of variable mass of known explosive charge on the asphalt with the objective to make correlations between causes and consequences of an explosion. Dimensions of the resulting craters were measured and an overview of experimental tests of five equations for calculating the mass of explosive based on the dimensions of the craters is given. The asphalt surfaces were chosen since the highest number of explosions, which are the results of terrorist or some other criminal acts, occur in urban conditions where asphalt is the dominant surface. Based on the given overview it is possible to give an evaluation of equation's reliability for certain explosive masses. The paper also includes a brief review of the facts related to the position of initiation and its influence the shape and dimensions of the crater
