    Compulsory Vaccination of Covid-19: A Dilemma Between Ensuring Public Health and Respecting Individual Freedom

    In recent years, due to the COVID-19 pandemic, the world has suffered and undergone a radical transformation. At the beginning of 2020, the world was at the mercy of the COVID-19 pandemic. However, a ray of hope shone upon the world with the development of COVID-19 vaccination. Even though everyone needs to get vaccinated, it prompts a question about whether people can be forced to get vaccinated or if they should be able to choose for themselves. A welfare state must protect its citizens’ health. Despite this, citizens have reasons to be vaccinated against the virus. This paper discusses the abovementioned issue by analyzing judicial decisions, international legal instruments and contemporary data on pandemic situations. This study aimed to address the dilemma of mandatory vaccination and the independence of those who choose to vaccinate. The study revealed that a state can impose mandatory vaccination in certain situations, subject to legal and practical constraints. In contrast, individual freedom is always respected because human rights are vested in international and domestic law. While enforcing vaccination policies, an equitable balance between an authoritarian measure to protect public health and granting an exception to specific individuals, as well as honouring human rights, is the paramount approach

    The Experiences and Challenges of Online Learning Technology for Teaching during the COVID-19 Pandemic among University Undergraduate Students

    Online learning refers to teaching and learning process through asynchronous and real-time communication over the Internet and with multimedia. This study examines the perception and acceptance of online learning as an alternative way in teaching undergraduate courses at School of Technology Management and Logistics (STML) after COVID-19. It also aims at identifying factors that facilitate online learning and the challenges of online learning. To accomplish the aim, this study applied a quantitative approach, in which data were collected using an online survey involving 156 undergraduate students at STML. Results show a moderate high level of acceptance on online learning. In addition, it was found that among four main factors that facilitate online learning, Enthusiasm ranked the highest, followed by Satisfaction, Self-Efficacy, and Enhancement of Communication Skills. Besides, results also reveal that among the main challenges encountered by majority of the students, delivery speed of teaching and learning, students’ attitude, struggles and stress of online learning mode were the most common issues. Results yielded in this study add to the existing literature on the possibility of online learning as an alternative pedagogy in post COVID-1

    Prinsip Undang-undang Tanah Islam menekankan keadilan dalam semua aspek kehidupan manusia dan mengiktiraf tanah sebagai amanah Allah untuk kepentingan awam. Prinsip-prinsip ini berlandaskan alQuran dan Sunnah Nabi Muhammad SAW dalam mengawal pentadbiran dan dasar tanah, termasuk pembangunan tanah untuk pemajuan perumahan. Prinsip-prinsip ini mencerminkan keadilan Islam. Walau bagaimanapun, projek perumahan terbengkalai di Malaysia sehingga kini masih kekal merupakan isu besar yang masih belum sepenuhnya ditangani secara berkesan dalam industri perumahan negara. Perundangan semasa yang mengawal industri perumahan di Malaysia telah terbukti gagal melindungi hak dan kepentingan pembeli dalam projek perumahan terbengkalai. Justeru, kertas akademik ini ditulis bertujuan untuk menunjukkan bagaimana prinsip Undang-undang Tanah Islam dapat mengurangkan kesan negatif projek perumahan terbengkalai dan menjaga hak dan kepentingan semua pihak yang terlibat dalam pemajuan perumahan khususnya para pembeli. Metodologi kajian yang digunakan dalam kertas kerja ini adalah berdasarkan metodologi doktrin Undang-undang Islam yang disokong dengan metodologi penyelidikan sosial. Penemuan penulisan ini menunjukkan bahawa prinsip Undang-undang Tanah Islam dapat mencegah kejadian projek perumahan terbengkalai dan kesan negatifnya. Kertas akademik ini memperkenalkan perspektif baharu dan penyelesaian yang berpotensi untuk menyelesaikan masalah yang telah lama wujud ini di Malaysia dan berhasrat untuk memberi sumbangan penting kepada kesusasteraan undang-undang, pihak pembuat dan penggubal dasar serta rakyat awam dalam menangani isu projek perumahan terbengkalai di Malaysia

    Exploring the Issues of Abandoned Housing Projects in Malaysia: Investigating Islamic Urban Development Planning and Construction Legal Principles

    The principles of Islamic urban development planning and construction legal principles, deeply rooted in the al-Quran and al-Sunnah of the Prophet Muhammad (PBUH), hold immense potential. They emphasise the responsibility of doing good, ensuring public welfare and sustainable development, and preventing evil. Despite the persistent issue of abandoned housing projects in Malaysia, Islamic urban development planning and construction legal principles offer a beacon of hope. However, the current legislation governing the housing industry in Malaysia has fallen short of protecting buyers' rights and interests against abandoned housing projects, highlighting the urgent need for alternative solutions. This paper aims to demonstrate how the principles of Islamic urban development planning and construction can effectively deal with and meaningfully mitigate the negative consequences of such projects. By doing so, they safeguard the rights and interests of buyers involved in housing development. The urgency of the issue is clear, and immediate action is needed. The research methodology employed in this paper is purely based on Islamic legal doctrinal methodology. The findings indicate that Islamic urban development planning and construction legal principles can indeed protect the rights of the public, including buyers, against occurrences of abandoned housing projects and their negative consequences. With its fresh perspectives and potential solutions, this paper represents a significant and impactful contribution to legal literature. It can provide valuable insights and perspectives for policymakers in dealing with the issue of abandoned housing projects in Malaysia

    The logistics service offers a crucial role in the process of developing into the worldwide market. Several nations must enhance their logistics service operations to achieve strong performance and attain a competitive edge in the market. Logistics service quality is a crucial element in Thailand's logistics operations. It is a major feature in developing a new conceptual model for logistics service performance, which is essential for achieving competitiveness in the logistics sector. The aim of this study is to investigate the relationship between the framework of logistics service quality, logistics performance and competitive advantage of logistics service provider (LSPs) firms in Thailand. This study utilizes primary data and applies a quantitative methodology, involving the collecting and analysis of research data using a strategy that emphasizes quantification. The sample will be LSPs companies in Thailand. The future data in this study will be analyzed using the statistical software packages SPSS and Smart PLS. Partial least squares structural equation modelling (PLS-SEM) is a statistical method employed for data analysis, with the primary goal of enhancing the research model. Thus, the study presents a conceptual framework that suggests that enhancing service quality can improve the logistics performance and competitive advantage of the logistics service provider business in Thailand
