    Validierung des mobilen Spiroergometriesystems "SpiroFit"

    Hintergrund: Die Möglichkeiten der mobilen Spiroergometrie sind durch systemseitige Limitationen insbesondere in sportartspezifischen Kontexten und im Feldeinsatz äußerst begrenzt. In dieser Studie soll das neue Spiroergometriesystem SpiroFit bzgl. der ventilatorischen und der Atemgasparameter validiert und seine grundsätzliche Eignung für den Einsatz im Feld beurteilt werden.Methoden: SpiroFit wurde an je 30 Probanden bei niedrig-intensiver Belastung auf dem Laufband und dem Fahrradergometer mit dem etablierten stationären System Quark CPET von Cosmed verglichen. Gasaustauschdaten wurden dreimal pro System, abwechselnd für je vier Minuten (Breath-by-Breath) in randomisierter und ausgeglichener Reihenfolge erfasst. Statistisch wurde auf systematische Unterschiede zwischen den Systemen, Einfluss von Belastungsart- und -intervall auf die Genauigkeit von SpiroFit sowie auf Übereinstimmung für VO2, VCO2, RQ, VT, BR, VE geprüft. Ergebnisse: VO2 und VCO2 werden von SpiroFit im Vergleich zu Quark CPET systematisch im Mittel um ~16-26 % bzw. ~30-37 % unterschätzt, während VT systematisch im Mittel um ~5 % überschätzt wird (alle p 0.7) und moderate bis sehr hohe Zusammenhänge (r > 0.66; > 0.77) der gemessenen Daten zwischen SpiroFit und Quark CPET für alle Parameter außer RQ auftraten.Diskussion: Für eine finale Beantwortung der Fragestellung müssen weitere Studien klären, (1) wie sich Aktualisierungen der Software auf die Validität von SpiroFit auswirken, (2) wie sich die Messgenauigkeit von SpiroFit bei moderaten bis maximalen Belastungen sowie diskontinuierlichen Belastungsprofilen verhält und (3) wie robust das System gegenüber externen, unkontrollierbaren Faktoren ist.Schlussfolgerung: Aktuell liefert SpiroFit keine validen absoluten Gasaustausch- und Ventilationsdaten und ist ohne Anpassungen weder in kontrollierter Umgebung noch im Feld für Leistungsstanderhebungen bzw.     Empathy, trust and self-disclosure in human-AI interaction : an experimental coaching for stress reduction

    This randomized controlled study investigates the effectiveness and psychological mechanisms ofAI-based stress coaching by comparing two chatbot conditions: an empathically designed version and a standardized version. Across three weekly coaching sessions, participants (N = 70) interactedwith one of the chatbot variants in a fully text-based format. Subjective stress levels were assessedimmediately before and after each session, while trust in the chatbot and self-disclosure weremeasured after each session. Results show that the empathic chatbot was perceived as significantly more empathic and consistently elicited higher trust than the standardized version. However, nosignificant between-group differences in stress reduction were observed, and the proposed serial mediation via trust and self-disclosure was not confirmed.     Old orogen - young topography: Constraining Late Cenozoic uplift of Variscan massifs in Central Europe

    Central European intraplate mountain ranges, including the Massif Central, Vosges Mountains, Black Forest, and Bohemian Massif, exhibit high topography despitetheir location far from active convergent plate boundaries. These landscapes displaycomplex geomorphic and thermochronological signals, such as low-relief surfaces athigh elevations, deeply incised rivers, and spatially heterogeneous cooling and exhumation histories, which cannot be explained by the Variscan orogeny alone. Theaim of this dissertation is to investigate the timing, mechanisms, and geomorphic expression of late Cenozoic uplift and exhumation in these regions, integrating landscapeevolution modeling, morphometric analysis, low-temperature thermochronology, andcatchment-wide erosion rate measurements.Morphometry and numerical models reveal that mantle plume activity and continental rifting leave distinct and diagnostic topographic, erosional, and exhumationalsignatures. Dome-shaped uplift patterns are associated with broad low-relief surfacesand high erosion rates along their flanks, whereas rifting generates asymmetric riftflanks, spatially variable erosion, and unstable drainage divides. These patterns arealso evident in catchment-wide erosion rates and long-term exhumation rates and indicate that these inherently transient landscapes differ fundamentally from collisionalorogens.New apatite (U-Th)/He data from the Upper Rhine Graben support this theoryof distinct spatial exhumation patterns. A combination of apatite (U-Th)/He andfission track data document distinct Cenozoic cooling phases linked to intraplatecompression, flexural uplift, and rift flank exhumation. However, there is no evidencefor regionally widespread Miocene reheating; instead, localized age dispersion andthermal modeling point to hydrothermal fluid circulation, especially along fault zones.These results highlight the complex interplay of regional tectonic phases and localizedfluid activity, in shaping the thermal history of rifted margins.The southern Bohemian Massif provides a complementary view on relief rejuvenation in a non-rifted setting. Its landscape is characterized by bimodal river profileswith knickpoints at 450 – 550 m elevation that separate gentle upper reaches fromdeeply incised lower gorges. Drainage divide asymmetry predicts ongoing northwardmigration of the Danube – Vltava divide, reflecting large-scale drainage reorganization. Cosmogenic 10Be erosion rates of 22 – 51 m Myr−1reveal low overall denudationbut strong spatial variability, with the highest rates in steep canyon systems. Lithological contrasts between resistant crystalline basement and weak Molasse sedimentsexert a first-order control on erosional efficiency and help explain the juxtaposition oflow-relief at higher elevations with actively incising rivers in the lower reaches underuniform uplift conditions.This thesis demonstrates that intraplate topography evolves under low-magnitude,long-wavelength tectonic forcing, where subtle mantle-driven uplift, lithological heterogeneity, drainage divide mobility, and surface process feed-backs interact to produce complex and transient landscape patterns.     Die vorliegende Diplomarbeit widmet sich der erbrechtlichen Stellung der Frau, insbesondere der Tochter, und will einen Überblick der Entwicklung über die Jahrhunderte geben. Zu Beginn der Arbeit wird auf die erbrechtliche Stellung im 18. Jahrhundert eingegangen. Eine Darstellung, unter welchen Umständen die Frau, insbesondere die Tochter, geerbt hat und wann sie erst gar nicht als Erbin in Betracht gezogen wurde, ist in allen Jahrhunderten zu finden. Zu guter Letzt wird das Erbrecht im geltenden Recht thematisiert.     Demographic pressure is leading to an ever-increasing demand for natural resources. In large parts of Sub-Saharan Africa, natural ecosystems have been transformed into agricultural land, pastures, plantations, or settlement areas. The last remnants of natural ecosystems are preserved for biological and cultural reasons. The Mijikenda Kaya forests in coastal Kenya are small forest remnants with high biological and cultural value. Given demographic pressure and a lack of awareness of the value of bio- and cultural diversity, the destruction of these forest habitats is alarming. Environmental education in schools may help to increase awareness for the need to preserve these ecosystems. In this study, we interviewed teachers from schools located around Kaya Kambe forest in coastal Kenya. We used a standardized questionnaire to analyze the degree of awareness through environmental education, teachers´ attitudes to environmental issues in general, and particularly to sacred Kaya forests. We found that environmental education is of low priority for teachers in schools assessed. One third of respondents do not incorporate environmental topics in their teaching at all. Teachers who have already had environmental education themselves and therefore have respective knowledge are prone to incorporate these topics in their lessons. However, there is hardly any reference to the conservation of Kaya forests for their spiritual heritage. Only teachers who have a relation with Kaya forests and the local culture considered the forest to be of high biological and cultural relevance and worth conserving. Our study shows that environmental education is still under-represented in schools in Kenya, and should be given a higher priority in the school curricula in order to increase awareness of the need to preserve biological and cultural diversity as well as natural resources for the future

    Stabilität von Atemmustern im Biathlonschießen und deren Einfluss auf die Trefferleistung unter varianter physischer Belastung

    In der komplexen Sportart Biathlon ist die Schießtechnik ein wesentlicher Bestandteil der Leistung. Diese besteht neben den technischen Aspekten wie Abzugsverhalten und Zielanvisierung auch aus der Atmung und dem während der Schussabgabe gehaltenen Atemstopp. Ziel dieser Arbeit ist es verschiedene Atemmuster zu definieren und (1) diese auf Unterschiede zwischen Nachwuchs- und Profiathlet*innen zu untersuchen, sowie (2) mögliche Einflüsse des Atemmusters und des stabilen Abrufens desselben auf die Trefferquote unter steigender physischer Belastung zu detektieren. Hierzu absolvierten 9 Nachwuchs- und 11 Profiathlet*innen ein Komplextraining auf Skirollern mit steigender Belastungsintensität, wobei nach jeder Belastungsstufe je 5 Schuss liegend und stehend abgegeben wurden. Die Atmung wurde mit Shirts des Herstellers Hexoskin gemessen. Es konnten die drei Atemmuster „eingeatmet“, „ausgeatmet“ und „neutral“ definiert werden, die jeweils die Tiefe der Apnoe bei Schussabgabe darstellen. Profis schießen liegend meist ausgeatmet (72.7 %), während der Nachwuchs meist mit neutralem Atemmuster schießt (55 %). Im Liegendanschlag konnten keine signifikanten Unterschiede bezüglich Stabilität des Atemmusters und Trefferleistung ermittelt werden. Im stehenden Anschlag schießen Profis signifikant besser (p = .031) mit 83 % Trefferleistung (68.9 % bei den Nachwuchsathlet*innen). Beide Gruppen schießen stehend hauptsächlich mit neutralem Atemmuster. Im liegenden Anschlag gibt es einen signifikant positiven Einfluss der Stabilität der Atmung auf die Trefferleistung (p < .001, Schätzung = .059), während gesteigerte Intensität eine negative, nicht signifikante Tendenz auf die Trefferquote hat. Das neutrale Atemmuster zeigt eine geringe positive Tendenz auf die Trefferquote. Im Stehendanschlag gibt es signifikante Unterschiede in der Stabilität des Atemmusters über die Intensitäten hinweg (p = .048, ꭕ²(3) = 7.89), die jedoch keinen signifikanten Effekt auf die Trefferquote aufweisen. Ein eingeatmetes Atemmuster im stehenden Anschlag hat einen signifikant negativen Einfluss auf die Trefferquote (p = .031) um -13,31 % über alle Athlet*innen gesehen und um -23.65 % (p = .012) bei Nachwuchsathlet*innen. Das Modell gesamt gesehen ist im stehenden Anschlag jedoch nicht statistisch signifikant. Ein stabiles Atemmuster scheint einen wichtigen Effekt auf die Trefferquote zu haben, wobei insbesondere Nachwuchsathleten davon profitieren.     The CJEU's jurisdictional conflict with ISDS and ICS : safeguarding the EU’s legal order through autonomy and exclusivity

    This thesis examines recent developments concerning the conflict between the exclusive jurisdiction of the CJEU and ISDS and ICS clauses in investment agreements. It analyzes the unprecedented legal figure of the European Union and how it seeks to maintain its autonomy by prohibiting other players, such as international courts and tribunals, from interpreting and applying EU law.This thesis starts by scrutinizing the characteristics of EU law in Chapter I, especially its autonomy, which is pivotal for safeguarding the EU law’s primacy as well as the law establishing the EU. Emphasis is put on Articles 267 and 344 TFEU and Article 19 TEU because they characterize the CJEU’s role in the European legal order and are the main source of arguments when protecting its exclusive jurisdiction. It is particularly crucial for this thesis to address the problem of autonomy of the EU’s legal order since fear of losing it is one of the CJEU’s main arguments for prohibiting ISDS clauses in intra-EU Bilateral Investment Treaties (BITs). Subsequently, after establishing what exactly the CJEU seeks to protect, it deals with the CJEU’s exclusive jurisdiction, which was determined crucial for safeguarding autonomy. Chapter II analyzes the rise, but more so the fall, of ISDS within the EU, which ended abruptly when the CJEU deemed ISDS clauses in intra-EU BITs invalid. Important legal principles that are necessary to understand the conflict of jurisdictions are explained. This includes a thorough analysis of the consent to arbitrate, how it is perfected, and the principle of Kompetenz- Kompetenz, which plays a crucial role in my own reasoning when answering the question of compatibility. The most significant cases, Achmea and its follow-up decisions, are analyzed. It elucidates the CJEU’s and ICSID tribunal’s arguments and how they have shaped the future of the investment landscape in Europe while simultaneously marking the past of intra-EU BITs.Chapter III discusses the general mechanism of the enforcement of awards, both within and outside of the EU, and the mechanism of setting aside an award, as well as the differences in the procedures under different regimes. An award that cannot be enforced, stemming from a misinterpretation of a decision-making body's competence, does not compromise the independence of any legal system, as it has no real impact. This point is crucial for the analysis, as the absence of an enforcement regime for arbitral awards would render ISDS and ICS toothless.9In Chapter IV, landmark decisions regarding disputes concerning the CJEU’s exclusive jurisdiction are analyzed, and the legal arguments the CJEU uses to assert exclusivity over EU law to protect its autonomy are put under strain. The valid legal arguments from the cases of the EEA, Mox Plant, Patent Court, WTO, and ECtHR are extracted, summarized, and molded into one rule. In Chapter V, the CETA agreement and the dispute settlement mechanism provided in its investment chapter are analyzed and implemented into the rule derived from the previously scrutinized case law. This analysis combines the arguments of traditional jurisdictional conflicts of the CJEU with other decision-making bodies with the issues arising from ISDS and ICS clauses in investment treaties and attempts to find an answer to the question of whether (or under which circumstances) modern ISDS and ICS clauses are compatible with the CJEU's exclusive jurisdiction.Jakob RegenfelderLiteraturverzeichnis: Seite 91-100Diplomarbeit Paris Lodron University Salzburg 202
