Contracts Law in Jordan and its Application in the Construction Contracts
Jordan is a country which is governed by constitutional monarchy. There are three categories of courts under the Jordanian
constitution namely the civil, religious, and special courts. The special courts include a military or state security court, police courts,
land settlement courts, an income tax court, and customs courts. The sources of law and legal structure in Jordan varies and depending
on the court category. The contracts laws is one the branches of the civil law and thus falls under the jurisdiction of the civil courts. The
Jordanian civil legal system has its foundations in the Code Napoléon, a French legal code implemented in Egypt in the early 19th
century. The civil courts include Magistrate Courts, Courts of First Instance, Courts of Appeal, High Administrative Courts and the
Court of Cassation (Supreme Court). This paper discussed the scope and principles of contracts law in Jordan and to what extent the
contract law principles are applied in construction contracts. The research methodologies applied in this paper are the doctrinal and
statutory analysis
Legal aspect of land criminal investigation: some observation
The investigation is a pre-requisite process for any prosecution proceedings.
However, the requirement of preparing an Investigation Paper (IP) is entirely
new in the Malaysian Land Administration as it has only become mandatory
with the coming into force of the National Land Code (Amendment) 2008 in
January 2009. Prior to that, a Land Administrator can compound an offender
under the National Land Code 1965 (NLC) without an IP. With the coming
into operation of sections 429A and 429B of the NLC, a Land Administrator is
now required to get written consent from Public Prosecutor before prosecuting
or compounding an offender. Consequently, many Land Administrators have
faced difficulty in offering compound or instituting prosecution proceeding due
to their lack of expertise in conducting a criminal investigation and preparing
IP. In relation thereof, this paper aims to discuss the importance of the criminal
investigation process for offenses under the Malaysian Land Law. It will begin
with the process of appointment of the Investigator. The aim is to show the
effect of producing IP in order to complete the enforcement action and to secure
the revenue of the State Government. It will also identify any inadequacies and
challenges faced by investigators while completing the investigation. This
research applies qualitative methods to achieve the objectives. Social legal
research was adopted by collecting sample data from Kelantan Land Director’s
office and also by referring to the NLC and the Criminal Procedure Code
(CPC) as primary sources. Secondary sources include books, scholarly articles
and news reports found in journals, and the Internet. It is concluded that the
government should consider enhancing the land criminal investigation
institution by empowering the IO, providing distinctive investigation
guidelines and establishing a special department for the Investigation Unit in
the Office of State Director
Economic aspects of quality of life of Bangladeshi construction workers in Malaysia
Quality of Life (QoL) measures provide a sense of how people's lives are going through the
activities and interactions between their circumstances and psychological resources. This
measurement/ evaluation is a valuable tool and a precondition for planning to improve the
socio-economic QoL or Wellbeing of the people surveyed. Researchers conducted a
qualitative study to know the economic QoL of Bangladeshi migrant construction workers in
Terengganu, who have immigrated for less than ten years in Malaysia. Researchers
triangulated the survey by two focus group discussions, 19 in-depth interviews, and
observations of four spots. The research used Atlas ti to conduct the thematic analysis of the
primary data. The result of the study shows that the workers are mostly in adverse QoL with
the effect of freedom, functioning, facilitator, and financial management. The study finally
recommends, Community-based work permit, trade union, and digital financial system toensure more freedom to improve the economic QoL of the migrant Bangladeshi construction
workers
دراسة مسائل الأحوال الشخصية التي أوردها الشيخ سعيد حوى بمصطلح
Attention to what the Muslim scholars have unanimously studied and applied it increases the
reunification of the Muslim’s. There is no doubt that a Muslim who adheres to his religion on the
approach of the nation’s ancestor clings to what the Muslim scholars agreed on, without narration
and hesitation, except that the nature of the consensus - in the non-prolonged books composed for
that often - requires a summary with which it is not possible to focus on the point of agreement of
some writers sometimes, so some readers think that some consensus are merely claims, supported
by finding a few consensus in their books that have not been proven before the scientific
investigation; For this reason, the two researchers are trying to present a study of some of the issues
mentioned in the book "The Basis in Interpretation", which was judged by the author - Sheikh
Saeed Hauwa - that it was among what scholars agreed upon, and the researchers limited
themselves to studying what was stated in the interpretation in only one formula, which is his
saying. There is a consensus on it. "The researchers found this in only five issues, and this is to
prove the sheikh's scruple and his retention. The paper holds eleven points of discussion, after the
introduction, and then followed conclusion with the findings
Food Knowledge and Practices Related to Anemic Conditions among Pregnant Women in Kuala Terengganu Malaysia
Anaemia is defined as a condition indicated by the deficiency of red blood cells (RBCs) or haemoglobin (Hb), and anaemia is
still said to be the most prevalent nutritional deficiency during pregnancy. It is a huge contributor to maternal mortality. During
pregnancy anaemia not only affects the mother but also the growing foetus, which makes it more dangerous. It has been
estimated that nearly half of pregnant women around the world are estimated to be anaemic. Previous studies done in Malaysia
found the overall prevalence of anaemia among pregnant women to be 35%. Knowledge in regard to anaemia and food
practice are factors that contribute to anaemia. This study aims to determine the relationship between food practices,
knowledge in regard to anaemic conditions among pregnant women in Kuala Terengganu. The study was based on samples
gathered from 96 pregnant women from Hiliran Health Clinic in Kuala Terengganu. Data collected was based on selfadministered questionnaire and twenty-four-hour diet recall. The data was analysed using Statistical Package for the Social
Sciences (SPSS) version 21.0. The prevalence of anaemia was found to be 40.9% and no association was found between
anaemia and sociodemographic factors among pregnant women in Kuala Terengganu. Anaemic pregnant women achieved a
higher average score of knowledge regarding anaemia as compared to non-anaemic pregnant women. In conclusion findings of
this study suggests that there is average knowledge of anaemia among the given population. Findings also suggest that the
overall population had good food practice. Furthermore, implications of the study findings, limitations, and directions for
future research were also discussed
Use of quantitative electroencephalography biomarker in characterizing mild cognitive impairment in Malaysian elderly
The elderly population rising rapidly in Malaysia and contributes to the increasing
number of cognitive problems including mild cognitive impairment (MCI). However,
due to limited information regarding this problem which may progress towards severe
neurologic degeneration, this problem rarely diagnosed and left untreated. Hence,
the use of electroencephalography (EEG) biomarker is seen to be important with the
spectral power, coherence and synchronization between the both halves of brain explain
the pathophysiology underlined. This method is becoming popular for its capabilities
in quantifying changes in brain electrical activity and provide early signs of brain
impairment. This paper reviews the incidence of mild cognitive impairment in elderly
as an early cognitive deterioration signal. It continues with the role of quantitative EEG
analysis in providing the physiological meaning of their brain. This paper also provides
the information about neurochemical changes which associated with MCI. In addition, this
paper proposes an idea of study towards examining physiology, neurochemicals, diet and
lifestyles to promote healthy lifestyle in elderly
