Cataract surgery barrier model: A framework for intervention of cataract blindness in Malaysia
Surgery can easily cure and prevent blindness due to cataract. However, cataract still poses a major
public health problem as the single most common cause of global blindness. Identifying the barriers to
access cataract surgery is essential to effectively address this problem. By utilising the interpretative
phenomenological analysis approach in this study, we identified barriers at the personal, primary care
and specialist care level. Based on these findings, a model is designed to better understand and
improve the strategy to address the barriers to improve the uptake of cataract surgery in order to prevent
cataract blindness in Malaysia
The study on the separation of ownership and control of Malaysian companies
The members own the company by virtue of their shareholding and the directors
manage and exercise control over the company’s affairs through the company’s board meeting.
Despite of segregation of powers and roles between the members and directors, there has been
inclination on the part of the members to participate to greater extent in the company’s affairs.
This paper aims to establish the legal position as between the directors and members that
reflect separation of control and ownership in the company under the common law and the
Malaysian law. The method used in this study is content analysis of the reported Malaysian
and international law cases as well as the statutory provisions in order to examine the legal
position established under the common law, the previous Companies Act 1965 and the newly
introduced Companies Act 2016. The study reveals that the separation between the two has
long been recognised and upheld by the common law as well as the Malaysian Acts. The
introduction of the section 195 of the Companies Act 2016 however allows members to raise
their voice in relation to matters which are within the powers of directors, hence the separation
becomes slightly vague. In the absence of the latest judicial decisions to test the application of section 195, further review on its application may be required in order to determine methods
to measure if a members’ recommendation is truly made in the best interests of the company
Child marriages and the right to education: The legal and social perspectives
Recently, Malaysians were alarmed with the shocking news of a marriage between
11-year-old Thai girl and a 41-year-old Kelantanese man that took place in Thailand. Though
the marriage was valid as it fulfilled all the requirements under Islamic Law, it could not be
registered in Malaysia without the consent of a Syariah Court as the bride was below the
minimum age permitted by Malaysian Law. The man was prosecuted and received a penalty,
but the girl remains as a wife. Being a wife, she would shoulder a lot of responsibilities and
must also be able to sacrifice a lot of things. It was reported that the man allowed the girl to
continue religious schooling, but it was declined by the latter. Without sufficient knowledge
and experience, the girl’s future would solely depend on her husband and the parent. Thus,
this research paper aims to study on the issue of child marriages in Malaysia and how it would
affect children legally and physiologically. This paper also intends to examine on the right to
education with special reference to married children. This research paper adopts qualitative
methodology by examining relevant statutory provisions, decided cases, international treaties
and articles from selected journals. It is therefore suggested that special care should be placed
on the married children, particularly on their right to education and their right to be able to
hold the future at their own hands
The understanding of facts in judicial process: An analysis from the Islamic perspective
The importance of understanding the factual reality (fahm al-waqi‘) has been
extensively discussed by Muslim jurists in their discussion pertaining to Islamic legal theory.
It has been accepted as an important component for the practice of ijtihad and recognized as
a valid justification for renewal of ijtihad. In light of the above, yet in a different setting, the
paper discusses the concept of al-da ‘wa and the significance of understanding the fact of a
legal dispute (fahm al-da‘wa) in Islamic trial process. It examines the significance of fahm alda‘wa by the trial judge in the trial process. The study proves that the understanding of the
facts of the cases assumes a very critical position in the trial process, the laxity of which will affect the propriety of judicial decisions and thus leading to injustice. Further, the paper argues
that the kind of facts that need to be ascertained and understood by the trial judges are not
limited to the specific occasions of the cases, rather the general circumstances and the reality
of the living conditions of the times need also to be taken into consideration. Finally, the paper
avers that the requirement to understand the facts of the cases necessitates a kind of
undertaking in the nature of ijtihad which is to be carried out by all judges regardless of their
status whether they are mujtahid (jurist) or muqallid (imitator)
Concepts and implementation of talaqqi and musyafahah methods in learning the Quran
Talaqqi musyafahah is a method of studying the Quran face to face where the delivery
and teaching method is directly from a teacher to a student. It is a method inherited by
the Prophet s.a.w from Gabriel a.s and subsequently implemented by Rasulullah s.a.w
to the companions. The companions continued this pedagogy until it is inherited as a
learning system of the Quran until today. The development of the educational system
has featured various Quranic learning systems, including distance learning, as well as
through the internet which is just a virtual learning via video in a unidirectional approach
or written basis. This modern method has raised the question of how far it meets the
talaqqi musyafahah system taught by the Prophet s.a.w. This study is aimed at
explaining the true concept and importance of talaqqi musyafahah as well as the
method of implementation in the study of the Quran. This qualitative study selected
descriptive methods by collecting and analyzing the opinions of the early and current
scholars through books, journals, and authoritative websites with respect to the topic of
debate. The study found that talaqqi musyafahah is very important in the process of
teaching the Quran because there are several words in the Quran that have different
pronunciation compared to their written forms such as as the word(فم (in al-Dzariyat: 47.
Also, there is a special method in Imam Hafs recitation technique such as reciting the
word (ها َرا َج ْم ,(َisymam or roum for the word (اَّمنَ
ْ
أَت (in Yusuf: 11, and tashil baina baina
recitation for the word (سج (in Fussilat: 44, which cannot be learned by only referring to
their writings in the mushaf and any books of tajwid. It requires talaqqi and musyafahah
from a qualified teacher. It is also important to realize the continuity of sanad which is
one of the components in reciting the Quran. In conclusion, any methods of learning the
Quran must conform to the talaqqi and musyafahah methods taught by Rasuluullah
s.a.w

Applications of maqasid al-shariah in Islamic finance an analysis
Considering the indispensability of wealth in human life, Islam
instead of negating puts special emphasis on wealth. Even
preservation of wealth is regarded as one of the ma
q
āsid al
Sharīʻah (objectives of Sharīʻah) in Islam. To guide human being
in this regard, Islam has prescribed as well as proscribed
necessary injunctions. This paper aims to shed light on three
crucial sectors pertaining to Islamic Finance namely Islamic
Banking, Islamic Capital Market and Takaful (Insurance) in the
light of maq
āsid al Sharīʻah. The author painstakingly
endeavors to prove that Islamic jurists, in delineating maq
āsid al
Sharīʻah regarding property, has intensely explicated the issues
of acquisition, investment, mobilization and expenditure of
property with special emphasis on justice, transparency,
proscription against illegal grabbing etc. He advances the
argument that proper compliance with the principles of Islamic
Finance inevitably ensures the realization of both specific and
general maq
āsid al Sharīʻah. Moreover, the paper splendidly
spells out that edicts of Islamic Finance encompass the
dynamism to warrant mobility in investment and mobilization of
Sharīʻah permitted property, ensure justice and fair distribution
of property, sweep away illegal grabbing, preserve property and
improve the faith and character of concerned persons
kesucian mahram susuan
