Theories of Jurisdiction and Their Application
in Extradition Law and Practice

Recognizing that extradition is contingent upon subject matter
jurisdiction of the courts of the state requesting one's extradition,
the author discusses theories under which states assert such juris-
diction. Presented is an in depth analysis of the five jurisdictional
theories recognized in international law, namely: (1) Territorial;
(2) Active Personality or Nationality; (3) Passive Personality;
(4) Protective; and (5) Universality.
Border Patrol Checkpoint Operation Under
Warrants of Inspection: The Wake of
Almeida-Sanchez v. United States
James E. Leahy 62
Since the United States Supreme Court rendered its decision
in Almeida-Sanchez v. United States, fixed border patrol check-
points have been operated under authority of temporary "probable
cause" warrants issued by a "neutral and detached" Federal Mag-
istrate. The author analyzes the constitutionality of this practice
in view of recent decisions and concludes that the procedure is
consistent with opinions expressed by a majority of Supreme Court
Justices.
The World's Laws Concerning Voluntary
Sterilization for Family Planning
Purposes
Jan Stepan & Edmund H. Kellogg ------ 72
This article presents a thorough examination of the different
laws of the world which allow or deter voluntary sterilization.
To encourage universal guarantees of the now internationally rec-
ognized human right of family planning, the authors propose do-
mestic statutory provisions for implementation of voluntary sterili-
zation.

In violation of multilateral agreements some states harbor
international terrorists rather than punish or extradite them. In
search of a United Nations solution to the problem, the author
describes the infeasibility of an international criminal court. As
an alternative he discusses the possibility of holding nations liable
for damages in the International Court of Justice.
Micronesia and Free Association:
Can Federalism Save Them?

In this article, the author discusses Micronesia's acquisition of
a greater degree of self determination. Considering the choice
which Micronesian leaders must make as to which form of govern-
ment to implement, the author analyzes Federalism as a possible
alternative. In presenting the considerations which militate for
and against Federalism there, particular emphasis is placed upon
geographic, economic, political, historical and sociological factors.
