In this article, the author describes the valid but conflicting
interests of certain nations with respect to direct broadcast satellites.
He highlights the view of some nations, notably the United States,
that peoples in general have a right to freely receive information
transmitted from all sources. Against this he pits an opposing view
that such transmission may violate the national sovereignty of the
receiving country. He concludes that in the interest of peace, the
rapidly advancing technology of man necessitates continuous ef-
forts towards an effective balance of these views.

The author discusses, on an article-by-article basis, the aviation
law changes made to the provisions of the Warsaw Convention by
the Guatemala Protocol. In addition, he points out the most diffi-
cult problems which will have to be surmounted before the United
States can ratify the Protocol.

Diagnosis and Prognosis

Through the use of realistic but hypothetical examples, the
author illuminates inequities in existing aviation treaties which limit
monetary recovery for injury to, or death of, passengers. After
describing means by which sophisticated air travelers can avoid
application of these treaties, he urges that radical changes be made
to protect the interests of the passenger public and aviation industry.

In this article, the author summarizes how the power of the
United States to conduct foreign relations is constituted and defined
by numerous clauses in the Constitution. After examining these
clauses in this light, he makes several conclusions. The author finds
that while constitutional limitations abound in each area of foreign
relations, there is no definitive understanding of their meaning. In
sum, he concludes that the Congress is empowered to formulate the
policy; the President conducts the foreign relations subject to the au-
thority of Congress.

Executive Claims Settlement Agreements

The author cites the increased use of executive agreements rath-
er than treaties for the conclusion of important international agree-
ments by the United States. Specifically in the area of international
claim settlement agreements, the author makes a proposal for enact-
ment of legislation which he opines would insure congressional ap-
proval of such agreements as a prerequisite to conclusion and there-
by restore the balance of power in this area between the Congress
and the Executive branch.
Sovereignty in Antarctica

The claims to sovereignty over the territory of Antarctica raise
several questions which are ripe for legal analysis in view of fu-
ture renegotiation of the Antarctic Treaty. Considering numerous
changes in the law of the sea, technological advances, and increased
activity in the area, the author advances several theories about the
future acquisition of territory in Antarctica.
