    Interrogation of a clergyman in evidentiary trial

    The article presents results of an analysis of current legislation of the Russian Federation and the Church law of the Russian Orthodox Church on the legal status of a “clergyman” and their opportunity to testify in criminal proceedings. Taking into account different points of view on this issue, it is substantiated that a clergyman of the Russian Orthodox Church cannot be interrogated as a witness in a criminal case about the circumstances that became known to him during the Sacrament of Penance. The question of the ratio of the concepts of “clergyman” and “priest” fixed at the normative level, but not equal, a pedibus usque ad caput, in essence, is considered. It is indicated that according to the canonical law of the Orthodox Church, the concept of “clergyman” is broader, with its own characteristics, which are dictated by the purpose of a particular degree of priesthood. In the article, the category of witness immunity is considered from the position of its functional orientation. An attempt has been made to substantiate the legal and moral aspects of the right to legal immunity of clergy. An attempt has been made to substantiate the legal and moral aspects of the right to legal immunity of a clergyman, through understanding the impossibility of conducting an interrogation, since this restriction of the subject of testimony is explained by the priority of social values that are protected by the provision of the law

    Dissolution of marriage during the spousal lifetime in ecclesiastical law

    The article examines the concept of dissolution of ecclesiastical marriage according to modern legislation of the Russian Orthodox Church. The author studies the origins of this concept, while special attention is paid to secular law. The grounds of dissolution of ecclesiastical marriage are specifically analyzed. The article studies the historical prerequisites for the formation of the Russian Orthodox Church concept of divorce, which determines the grounds for the termination of ecclesiastical marriage during the life of the spouses. The author comes to the conclusion that the idea of ecclesiastical marriage dissolution is consistent in general with eastern orthodox canonical tradition. The influence of the Russian Orthodox Church’s own tradition is of particular importance for the modern concept. At the same time, there are gaps in the modern provisions of ecclesiastical legislation on marriage; e. g., the legislator does not pay sufficient attention to certain new public life phenomena. In addition, the author notes that current legislation of the Russian Orthodox Church does not introduce an obligation of the laity to dissolve an ecclesiastical marriage in connection with certain circumstances considered in Eastern Orthodox canon law as grounds for divorce.     Approximation of supremum and infimum processes as a stochastic approach to the providing of homeostasis

    We consider the calculation of bounded functional of the trajectories of a stationary diffusion process. Since an analytical solution to this problem does not exist, it is necessary to use numerical methods. One possible direction for obtaining the numerical method is applying the Monte Carlo (MC) method. This involves reproducing the trajectory of a random process with subsequent averaging over the trajectories. To simplify the reproduction of the trajectory, the Girsanov transform is used in this paper. The main goal is to approximate the supremum and infimum processes, which allows us to more accurately compute the mathematical expectation of a function depending on the values of the supremum and infimum processes at the end of the time interval compared to the classical method. The method is based on randomly dividing the interval of the time axis by stopping times passages of the Wiener process, approximating the density to replace the measure, and using the MC method to calculate the expectation. One of the applications of the method is the task of keeping a random process in a given area the problem of homeostasis.This work was supported by Russian Science Foundation (project N 17-19-01038)

    Determining the structure and parameters of the human model subjected to vibration

    This article presents results from an experimental study of the frequency properties of a sitting person. This analysis shows that in order to define the structure and parameters of a human body model, it is necessary to find the only solution to the problem of determining the model parameters. Otherwise, this model cannot be used to build vibration protection systems, which is its main purpose. This problem was solved for a two-mass human model. To do this, the total model mass and although the amplitude-frequency response and input frequency impedance for both solids in the model structure are needed to be known. In addition to this, the influence of multi-articular muscles on the frequency characteristics of a human body is found using mechanical models with an arbitrary number of degrees of freedom. In particular, the possibility of the existence additional antiresonance frequencies on the upper mass is shown

    Advertising as an example of media persuasiveness with the use of modern types of narration

    The purpose of this article is to present the main persuasive function of various types of narratives based on the analysis of messages designed to influence and impel to make a decision. An additional purpose is to show that different narrative forms were used thoughtfully based on the research into intended recipient groups. The used methodology of narrative analysis in relation to media messages, the function of which is persuasion, was created on the basis of the methodology of content analysis in mediametric studies of the discipline of social communication and media, as well as related sciences, for example, visual, linguistic or semiological analysis. The relevance of the study is confirmed by the use of fresh material taken from current ratings conducted by network analysts regarding the most popular advertising messages in the Internet space and modern tools in the field of neuroscience. This made it possible to single out such types of narratives as cathectic, storytelling, celebrity, gaming and amplified narratives. Among the analyzed messages, including commercials and social campaigns, the authors highlight their distinctive features and ways of using them in the field of language and images, which makes it possible to categorize any multimodal persuasive messages, and facilitates the interpretation of this type of messages. Demonstrating the persuasiveness of the narrative as an integral feature of all messages in advertising communication leads to the conclusion that the purpose of using the narrative is to create tension and dynamics that strongly affect the viewer. Ultimately, the reason for its use is not only a reference, but also a description of the world. The narrative also has significant axiological and philosophical goals

A connection is obtained between the irregularity of all unramified extensions M/L and the ramification index eL/K for a sufficiently wide class of formal groups.     Boundary conditions for fluid-dynamic parameters of a single-component gas flow with vibrational deactivation on a solid wall

    Boundary conditions for fluid-dynamic parameters of a strongly non-equilibrium singlecomponent rarefied gas flow in the slip regime are obtained using kinetic-theory methods. The gas flow is described in the frame of the state-to-state approach assuming vibrational energy exchange as the slow relaxation process. The set of governing equations including conservation equations coupled with additional relaxation equations for vibrational state populations is presented. The gas-solid surface interaction is considered on the basis of the specular-diffusive model, and possible vibrational deactivation/excitation processes on the wall are taken into account. The obtained boundary conditions depend on the accommodation and deactivation coefficients along with the transport coefficients such as the multi-component vibrational energy diffusion and thermal diffusion coefficients; the thermal conductivity; the bulk and shear viscosity coefficients and the relaxation pressure. The dependence of boundary conditions on the normal mean stress has been obtained for the first time. In the particular case of the gas without internal degrees of freedom, the slip velocity and the temperature jump can be reduced to the well-known in the literature expressions. Implementation of the state-specific boundary conditions should not cause additional computational costs in numerical simulations of viscous flows in the state-to-state approach, since the slip/jump equations depend on the transport coefficients which have to be evaluated regardless of the boundary conditions used in the code.This work was supported by the St Petersburg State University (project ID 84912260)
