    The doctrine of error in the law of Louisiana and Quebec

    The article presents the results of a comparative-legal analysis of the doctrine and practice at the contract conclusion in the mixed legal jurisdictions of the state of Louisiana (USA) and the province of Quebec (Canada). The jurisdictions in question were significantly influenced by the continental civil law tradition as well as the common law tradition. Thus it is of interest to consider how the mixed nature is reflected in the principles of error, and to the formation of which legal structures it has led to. The author offers the results of a comparative legal study of the mixed jurisdictions of Louisiana (USA) and Quebec (Canada), in which the doctrine of error has received a codified regulation. The author analyzes and compares the application of the criteria of significance of an error, in particular, such as the criteria of causality, recognizability of the error by the opposite party, apologizability of the error. The legal consequences of significant error in the state of Louisiana and the province of Quebec, which consist in the possibility to annul the contract, are considered. The study is useful for the development and improvement of the domestic doctrine of error

    ABOUT THE BOUNDARY MARKERS OF THE TRANSITION PERIODS: LYRICAL DIGRESSIONS IN THE FICTION BY ANTON CHEKHOV

    Anton Chekhov is generally acknowledged as a writer who symbolizes a transition period, marks the end of the Classical Russian literature of the 19th century and establishes the basics of the poetics of the 20th century. Scholars are traditionally focused on Chekhov’s innovations but not on the connections with the previous tradition. This contribution makes an attempt to reassess the aspect of Chekhov’s poetics which could be called historical “form’s thinking” (in Alexander Mikhailov’s terminology). I mean the features of tradition which result from historical dynamics of culture and are beyond individual principles of artistic consciousness. In the culture prior to the New Age, topos was a form which included both principles and ways of thinking. In this research I analyze lyrical digressions in the Russian fiction of the 19th century which correlate with topoi on the basis of their constitution. The strategy of lyrical digressions rests on the movement between two poles of the being: historical and eternal, individual and universal, etc. Before Chekhov, this movement was strictly hierarchical. In Chekhov’s lyrical digressions one can easily notice a shift of semantic coordinates when the concrete and the situational becomes valuable. However, the poles themselves (individual and universal) and the movement between them remain invariable. It is possible to claim that Chekhov’s poetics although discovers the boundaries of semantic dynamics of the lyrical digressions (as a constant form) is not aware of any other principle of thinking. This fact distinguishes Chekhov from his younger contemporaries and makes him the writer of the classical 19th century.     Employee’s participation in the employer’s affairs: Organizational forms and legal regulation (economic and legal aspects)

    Social partnership in the sphere of labour is one of the most important principles underlying the modern mechanism of legal regulation of social and labour relations. The significance of this principle lies in the fact that thanks to its implementation in practice, social peace in the sphere of social work is ensured and, accordingly, social stability in society as a whole. The current Russian labour legislation not only formulates social partnership as a principle of legal regulation of social labour, but also defines the main forms (directions) of implementation of this principle. Currently, the direction of social partnership is most thoroughly regulated in legislation and tested in practice, which can be conditionally defined as representative, when representatives of the main social groups in the field of labour — employees and employers, as well as the state, as the personification of general social interests, enter into a dialogue on issues of public importance and conclude this dialogue with an appropriate agreement. Another area of social partnership, which is usually defined as the participation of employees in the affairs of the employer, is rather poorly regulated in legislation, is very little widespread in practice and is practically ignored in domestic legal science. Meanwhile, as world experience shows, the system of employee participation in the affairs of the employer is a very effective means of ensuring the solution of both social and economic problems. The article analyzes the main aspects of participation. It is based on the employee’s right to participate as a subjective labour right. Its implementation is provided mainly by means of two branches of law — labour and civil (corporate). Accordingly, there are two forms of participation, although related to each other, but having an independent character — economic and organizational. The first is implemented through various options for the participation of employees in the profits and property of the employer, the second — through the participation of employees in management, including self-management of labour collectives of various levels in the structure of the employer’s enterprise

    Labour law and institutionalism: A well-forgotten old

    The article considers a set of problems related to the possibility of an institutional approach to the study of the development and functioning of labour law. An analysis of the features of institutionalism in economics, its main characteristics and differences from both neo-institutionalism and new institutionalism is given. The main features of this phenomenon are presented. Particular attention is paid to the “old” institutionalism and especially its legal direction, associated with the activities of the American scientist J. R. Commons. At the same time, the role of scientists of this direction in the development of problems of labour law, as well as in the formation of American labour and social security legislation in the first third of the 20th century, is emphasized. The author comes to the conclusion that lawyers, including the first scientists in the field of labour law, also used the institutional approach in their research. It is concluded that the institutional approach allows us to take a fresh look at the traditional problems of science and the branch of labour law, given that they are closely related to the economic processes taking place in society. It is argued that it is the institutional approach that makes it possible to reach the signs of an employment relationship, but from a slightly different angle. In this regard, it is not by chance that among the ideologists and authors of the first bills related to the regulation of labour relations in the United States in the thirties of the 20th century, supporters of institutionalism prevailed. The author connects the emerging doctrine of social partnership and the doctrine of “human relations” by F. Mayo precisely with institutional approaches to economics and law. All this makes it possible to include the institutional approach in the methodological tools of modern research into the problems of labour law

    On extension of the family of projections to positive operator-valued measure

    The problem of constructing a measure on a discrete set X taking values in a positive cone of bounded operators in a Hilbert space is considered. It is assumed that a projectionvalued function defined on a subset of X0 of the original set X is initially given. The aim of the study is to find such a scalar measure μ on the set X and the continuation of a projector-valued function from X0 to X, which results in an operator-valued measure having a projector-valued density relative to μ. In general, the problem is solved for |X| = 4 and |X0| = 2. As an example, we consider a function on X0 that takes values in a set of projections on coherent states. For this case, the question of the information completeness of the measurement determined by the constructed measure is investigated. In other words, is it possible to reconstruct a quantum state (a positive unit trace operator) from the values of the matrix trace from the product of a measure with a quantum state. It is shown that for the constructed measure it is possible to restore the quantum state only if it is a projection.     Isosceles tetrahedron and an equimomental system of a rigid body

It is shown that the system of four equal masses located at the vertices of an isosceles tetrahedron is equimomental to a given rigid body. A system of material points of equal masses located at the vertices of an isosceles tetrahedron, which is equimomental of cometary nuclei of 67P Churyumov-Gerasimenko, has been constructed
