Statutory leave during the notice period
No full textAwarding to the employer the power to grant to an employee statutory leave during the notice
period is very important for employers, as it eliminates the necessity of paying to the dismissed employee the pecuniary compensation for unused leave, when the actual employment during the notice period is not necessary, and even not advisable. Article 17 sec. 2 of the Act on Employment of Temporary Workers states that statutory leave is awarded to temporary worker on the days which would be his workdays, when he would not use this leave. According to sec. 3 of this article, when a temporary worker does not use his statutory leave in a period of performance of temporary work, the employment agency pays to the temporary worker monetary equivalent for this leave or its unused part. In contrast,
regulations of the Act on Employment of Temporary Workers do not award directly the employment agency, the employer of temporary worker, powers to grant statutory leave to temporary worker during the notice period. De lege lata, Article 5 of the Act on Employment of Temporary Workers is very important in this matter. The said provision states that Labor Law regulations apply with respect to matters not regulated by the Act on Employment of Temporary Workers – in the commented case art. 1671 of the Labor Code. Article 18 of the Act on Employment of Temporary Workers corresponds with the issue related to granting leave to a temporary worker during the notice period. According to this regulation,
it may happen that the employer-user will dismiss the temporary worker in such a way that the employment agency will not be able to terminate employment (due to the run of the notice period) in such a way that it coincides with the end of demand on work. In this situation, it can be said that the days accrued after the dismissal by the employer-user cannot be “days, which would be work days,” thus the employment agency cannot grant to the temporary worker statutory leave in that time.Przyznanie pracodawcy kompetencji do wyznaczania pracownikowi terminu urlopu wypoczynkowego w okresie wypowiedzenia umowy o pracę ma istotne znaczenie dla pracodawców, eliminuje bowiem konieczność wypłaty zwalnianemu pracownikowi ekwiwalentu pieniężnego za niewykorzystany urlop, gdy realne zatrudnienie go w okresie wypowiedzenia nie jest konieczne, a niekiedy nawet niewskazane. Artykuł 17 ust. 2 ustawy o z.p.t. stanowi, że urlopu wypoczynkowego udziela się pracownikowi tymczasowemu w dni, które byłyby dla niego dniami pracy, gdyby nie korzystał z tego urlopu. Zaś z ust. 3 tego artykułu wynika, że w razie niewykorzystania przez pracownika tymczasowego urlopu wypoczynkowego w okresie wykonywania pracy tymczasowej agencja zatrudnienia
wypłaca pracownikowi tymczasowemu ekwiwalent pieniężny w zamian za ten urlop lub niewykorzystaną jego część. Natomiast przepisy ustawy o z.p.t. nie przyznają wprost agencji zatrudnienia (pracodawcy pracownika tymczasowego) kompetencji do wyznaczania pracownikowi tymczasowemu terminu urlopu wypoczynkowego w okresie wypowiedzenia umowy o pracę. De lege lata istotne znaczenie w tej kwestii posiadają postanowienia art. 5 ustawy o z.p.t. Ów przepis statuuje, że w zakresie nieuregulowanym przepisami ustawy o z.p.t. stosuje się przepisy prawa pracy – w komentowanym przypadku art. 1671 k.p.
Z kwestią udzielenia pracownikowi tymczasowemu urlopu w okresie wypowiedzenia umowy
o pracę koresponduje unormowanie art. 18 ust. 2 ustawy o z.p.t. W myśl tego przepisu może się zdarzyć, że pracodawca użytkownik zrezygnuje z pracy pracownika tymczasowego w taki sposób, że agencja zatrudnienia nie będzie w stanie zakończyć zatrudnienia (ze względu na bieg okresu wypowiedzenia) w taki sposób, by zbiegło się ono z zakończeniem zapotrzebowania na pracę. W tej sytuacji uprawnione jest stwierdzenie, że dni przypadające po rezygnacji pracodawcy użytkownika nie będą „dniami pracy”, a zatem agencja zatrudnienia w tym czasie nie może udzielić pracownikowi tymczasowemu

between upbringing and politics, which is still valid. The objectifying approach of Sośnicki is expressed in
creating the theory which is outside ideology. The central notion here is the category of “state ethos” which
constitutes a set of principles becoming the life force of each group of people. An important role of the ethos
in individuals’ life and in the life of groups of people has an influence on upbringing aims. human being’s
mental characteristics which are shaped in the right way would aim at overcoming social collisions.
The pedagogical theory of Sośnicki, which was designed in the perspective of social role, undeniably enriched
and inspired the pedagogy of those times but it can contribute to educational reality of today as well.Teoria wychowania państwowego Kazimierza Sośnickiego (1883-1975) zajmuje się ciągle aktualnym problemem
relacji między wychowaniem a polityką. Podejście obiektywizujące Sośnickiego wyraża się w tworzeniu
ponadideologicznej teorii. Tutaj centralnym zagadnieniem pozostaje kategoria „etosu państwowego”, który
stanowiąc zbiór zasad postępowania, staje się, jak powtarzał Sośnicki, życiową siłą każdego zespołu ludzkiego.

and K. Sośnicki, who acquired basic competence and academic degrees under the care of K. Twardowski. his
theory of activity and works was the basis for the pedagogical historiography of B. Nawroczyński. in the case
of K. Sośnicki affinity with the Master is visible in the methodological and logical direction of research. Both
academics constructed philosophical pedagogy in the spirit of K. Twardowski, the integral part of which were

Wet nurses - hired breast-feeders in the light of the “how-to" literature from the second half of the 19th and early 20th centuries
No full textWet nurses, i.e. hired breast-feeders of babies, were the subject matter of this research. lt aims to systematize the advice that was formulated on the pages of “how-to" books regarding the search for, recruitment, and treatment of wet nurses in the homes of one’s charges. The specific duties of wet nurses that were especially expected of them are determined, as well as the errors most frequently committed in their performance, which the authors of how-to books described at length, in order to warn mothers against the incompetence of paid breast-feeders. A comparison of the views of authors of “how-to” books over nearly 70 years will allow us to determine a possible evolution of views regarding wet nursing. The “how-to" books on health, hygiene, and education from the second half of the 19th century and the early 20th century (the period approximately from 1850-1918), published in Polish areas and addressed mainly at families, especially mothers, form the source material for the research. The use of this type of literature will allow us to reconstruct the promulgated image of wet nursing without broader reference to providing help for them, which is worth confronting with the “how-to" recommendations, attempting to determine whether, and to what extent, they were reflected in everyday life (e.g. using epistolary or archival sources, and memoirs), Nevertheless, the authors of “how-to” books also referred to the practice of tending infants and young children, criticizing inappropriate behaviour of wet nurses, while the recommendations formulated by them were to remedy inappropriate behaviour occurring in reality. The issue of wet nursing has not hitherto been analysed in detail in Polish historiography. In recent years, though, a few texts or papers in which one can find more or less extensive information (the less extensive ones predominate) related to breastfeeding by wet nurses in the Polish areas in the Middle Ages, the period of Old Poland, or the partition period, have been published. Thus, it seems even more reasonable to explore this issue, which will help to fill a gap in the development of the history of breastfeeding, nursing, and tending infants and small children
