MJERE OSIGURANJA RADI IZDRŽAVANJA DJETETA U PRAVU BOSNE I HERCEGOVINE
Get PDFIzdržavanje djeteta predstavlja svakodnevno, kontinurano zadovoljenje osnovnih životnih, obrazovnih i drugih potreba djeteta. Neizvršenje ili nepotpuno izvršenje obaveze izdržavanja dovodi do prekida ovog kontinuiteta zbog čega se zaštita ugroženog ili povrijeđenog prava djeteta vrlo često ostvaruje u alimentacionom postupku, koji može potrajati mjesecima, pa čak i godinama. Kako bi se barem djelomično ublažile posljedice neizvršenja ili nepotpunog izvršenja obaveze izdržavanja djeteta, zakonodavac je normirao mogućnost određivanja mjera osiguranja. Autorica smatra za shodno da, analizirajući neka od najrelevantnijih pitanja, aktuelizira ovaj institut i posebno naglasi da sudske mjere osiguranja predstavljaju izuzetno važno pravno sredstvo koje stoji na raspolaganju sudu u alimentacionim postupcima, pogotovo u svjetlu njegovog ovlaštenja da ex officio odredi ove mjere.

ZAŠTITA PORODICE S DJECOM U SOCIJALNOM ZAKONODAVSTVU FEDERACIJE BOSNE I HERCEGOVINE
Get PDFU radu, shodno odredbama Zakona o osnovama socijalne zaštite, zaštite civilnih žrtava rata i zaštite porodice s djecom FBiH, analizirana su odgovarajuća zakonska rješenja o zaštiti porodice s djecom s posebnim osvrtom na mogućnost praktične primjene ovog instituta. Primjena federalnog Zakona, koji normira da se propisima kantona bliže uređuju uvjeti, način, postupak, organi i finansiranje prava porodice s djecom, stvara pretpostavke za diskriminaciju i povećanje siromaštva, posebno socijalno najugroženijih porodica. Ovakav zaključak proizlazi iz činjenice da su u okviru deset kantona FBiH utvrđeni različiti iznosi osnovica i naknada porodicama s djecom. Uz to, manji broj kantona, ukupno tri, još uvijek nije usvojio kantonalne zakone o zaštiti porodice s djecom, dok pojedini kantoni uopšte ne isplaćuju određene naknade, odnosno u svojim kantonalnim zakonima ne predviđaju prava koja su porodicama s djecom zagarantovana federalnim Zakonom.

TRANZICIONA PRAVDA KAO USLOV PRISTUPU EVROPSKOJ UNIJI
Get PDFTranziciona pravda je termin koji označava različite načine postupanja prema prošlim kršenjima ljudskih prava u društvima u tranziciji, a koji dovode do postkonfliktnog pomirenja u društvu. Ne podrazumijeva samo suđenja osobama koje su prekršile pravo u sukobu, već prvenstveno izgradnju održivog mira u postkonfliktnim društvima. Sastoji se od niza inicijativa kojima je cilj utvrđivanje istine o onome što se desilo u sukobu koji se zbio u prošlosti - a što, svakako, obuhvata i utvrđivanje odgovornosti počinioca i naknadu štete žrtvama zločina. U radu će poseban naglasak biti na vansudskim mehanizmima tranzicione pravde. Pokušat će se odgovoriti na pitanje da li bi uspostavljanje tranzicione pravde trebalo biti uslov za pristup Evropskoj uniji, kao i šta su države bivše SFRJ učinile po tom pitanju. Poseban akcenat bit će na državi Bosni i Hercegovini i njenim dostignućima na ovom polju.

ZAŠTITA LJUDSKIH PRAVA KROZ PRIZMU POVELJE EVROPSKE UNIJE O TEMELJNIM PRAVIMA
Get PDFU savremenom dobu postoji veliki broj konvencija i deklaracija koje proklamuju širok korpus ljudskih sloboda i prava koje su većinom nastale i dobile univerzalni značaj tek nakon Drugog svjetskog rata. Korpus proklamovanih i garantiranih ljudskih prava je danas vrlo širok, te obuhvata od ličnih, građanskih, političkih, ekonomskih, socijalnih, kulturnih prava te u novije vrijeme i praSva na zaštitu od tehnološkog razvitka, prava stranaca i izbjeglica. Posebno važnu ulogu u zaštiti ljudskih prava ima Povelja Evropske unije o temeljnim pravima koja je usvojena 07. decembra 2000. godine u Nici od strane predstavnika Evropskog vijeća, Komisije i Parlamenta i koja proklamira politička, građanska, ekonomska i socijalna prava. Već u preambuli Povelje se naglašava pravo na dostojanstvo, Povelja proklamuje ovo pravo kao temeljnu vrijednost na kojem cijela Unija (EU) počiva, te ističe da je Unija svjesna svojeg duhovnog i moralnog naslijeđa. Prema Povelji Evropska Unija se temelji na nedjeljivim, univerzalnim vrijednostima slobode, jednakosti i solidarnosti, garantuje se jednakost svih građana pred zakonom i zabranjuje se svaki vid diskriminacije na osnovu spola, rase, boje kože, etničkog ili socijalnog porijekla, genetskih osobina, jezika, vjere ili uvjerenja, političkoga ili bilo kakvoga drugog mišljenja, pripadnosti nacionalnoj manjini, imovine, rođenja, invalidnosti, dobi ili spolnog usmjerenja. Cilj rada je predstaviti trajne vrijednosti Povelje u svjetlu zaštite ljudskih prava i temeljnih sloboda kao jednog od osnovnih uvjeta za pristup Evropskoj Uniji.

The role of concept analysis in studying English (on the basis of American political discourse)
Get PDFOnce a person sets a goal of studying the culture of some country or even of teaching it to foreign students in classrooms, he/she cannot manage without taking into account its reflection in the languages. it is the language that fixes all peculiarities of people’s world perception and becomes the storage of knowledge about it. It is in the light of such perception that a human being sees the world. Thus, one can speak about a linguistic world view. The linguistic world view is based on the set of certain concepts. A concept is a great deal broader than the lexical meaning of a word as it also includes an evaluative component. Cultures may share the same concepts or possess their own uniqueness. The latter are often referred to as national-specific concepts. These are the concepts that render the peculiarities of nation's mentality, world view and evaluation of the material world. In order to understand each other people must share the set of concepts and the same background information. This is often referred to as “common knowledge” [1.P.174-175]. At present considerable attention is drawn to discourse, especially its political variety. The analysis of national-specific concepts and the set of linguistic means which express them in political discourse seem to be of special interest in the discussion of typical cultural characteristics as political sphere is one of the constituent parts of any national culture. Thus, political discourse contributes to the understanding of the ways values have been developed. The importance of linguistic analysis of political discourse as part of culture teaching can be illustrated using materials from the African American political discourse, in which such concepts as ‘freedom’, ‘power’, ‘equality’ and ‘African American dream’ come to the fore.

Metaphor translation in subtitling
Get PDFThe paper aims to shed light on how subtitlers cope with metaphor translation. The paper presents the results of a case study on a set of English subtitles of one Croatian movie. Metaphor translation procedures were analyzed using Conceptual Metaphor Theory. There are four basic ways to translate metaphors: a. using the same conceptual metaphor, b. using a different conceptual metaphor, c. using a non-metaphorical paraphrase; and d. deleting the metaphor. In addition, a non-metaphorical expression can be translated by a metaphorical expression. Metaphors are mental, linguistic, but also cultural entities. Since translation in the contemporary age is recognized as both linguistic and cultural transfer, translating metaphors is at the core of the translation task. Many conceptual metaphors are universal and can be found in (almost) all languages, but some are culturally specific, appearing in just one language (group). This case study shows that the universality of metaphor influences the choice of a metaphor translation procedure, in a way that shared metaphors are mostly translated using the same conceptual metaphor, whereas non-shared metaphors are translated by a different metaphor or a non-metaphorical paraphrase. The paper also explores the ways in which the specifics of subtitling as a constrained type of translation influence the choice of a translation procedure. The results are compared to the results of a previous study, which dealt with the translation of metaphors in literature.

Argumentation Strategies in Negative Academic Book Reviews
Get PDFAlthough nobody would deny that academic criticism is an inherent feature of academic communication, most of the existing studies assume that due to the nature of the development of science, collaborative rhetoric is intrinsic to academic discourse and criticism is the exception rather than the rule. In order to check this hypothesis, the present pilot study investigates a sample corpus of 10 book reviews in the field of English applied linguistics that are definitely negative in character.
Scientific book reviews not only belong to the basic academic genres, but also possess a functionally determined highly evaluative character, thus being potential carriers of academic criticism. They have, unfortunately, received relatively little attention as yet. The study aims to uncover the argumentation strategies used by review writers in terms of classical Aristotelian argumentation theory.Within this theory the notion of topic plays a crucial role. There are two basic types of topoi: those based on everyday-logic generic premises and those with conventionalised conclusions, whose subgroups are used as a methodological instrument of the analysis.
The analysis leads to conclusions concerning the surface expression of the argumentation strategies used by writers, the degree to which criticism is based on objective logic and on subjective personal evaluation, the preference for certain topoi, as well as some general concerns in relation to confrontation in the academia.

What Determines the Firm’s Net Trade Credit? Evidence from Macedonian Listed Firms
Get PDFAbstract: This paper analyses the net trade credit and its determinants for a sample of 25 non-financial firms for the period 2011-2013. The sample is derived from the Macedonian Stock Exchange. The net trade credit is the dependent variable. The dependent variable is defined as the difference between trade receivables and liabilities, and then this difference is divided by total assets. The maturity structure of assets, profitability, inventory investment, cash to assets ratio, long-term financing, total debt financing, and converting sales into cash are the independent variables. This study used the Shapiro-Wilk W test for normality, Kernel density estimation, Variance Inflation Factor for multicollinearity, and the model specification link test for single-equation models. The obtained results show that more profitable firms and with higher current assets and cash ratio have positive net trade credits. The net trade credit is significantly negatively associated with inventory to total assets ratio and net cash flows from operating activities to sales. On the other hand, the net trade credit is significantly positively associated with current assets to total assets ratio and profitability
