FOREWORD 
We are pleased to conclude Volume 49 with Book 3.  The printed 
Book is home to scholarship generated from our Fall 2025 Symposium, 
Regulating AI: Healthcare, Employment, Intellectual Property, and Ethical 
Implications in the Law.  Published in the digital version of Book 3 are 
six student Comments, which are last but certainly not least, written by 
several of our remarkable members.  The digital-only Book 2 of the 
Journal contains nine similarly outstanding Comments by our student 
members. 
The Journal’s Volume 49 Symposium Editor for the fall, Julie 
Silberfein, was inspired to host our Symposium on Artificial Intelligence 
(AI) after she wrote her own Comment on this topic.  She sought to spark 
exciting and informative conversations on how AI is impacting every 
area of the law.  The Symposium hosted many top legal scholars, 
attorneys, and professionals who contributed valuable insights to each 
panel.  We are proud of the Symposium, and hope you enjoy reading the 
articles written by some of our panelists in this Book.  
The scholarship within this Book touches on the far-reaching 
implications of AI for the legal profession.  The impact of AI on topics as 
disparate as attorney ethics, healthcare, and employment are all 
addressed by the articles in this Book.  
The first article of this Book is Artificial Intelligence for Lawyers and 
Law Students: Crutch, Craft, or Catalyst?1 by Professor David S. Kemp.  
This article addresses important questions of how law schools should 
be teaching future lawyers how to use AI, as well as how AI should be 
used to supplement legal practice.  In their article, Quantitative AI Risk 
Assessments: Opportunities and Challenges,2 David Piorkowski, Michael 
Hind, and John Richards provide an in-depth analysis of how AI models 
operate, as well as the risks and ethical concerns associated with using 
AI.  The next article, Patients Are Entitled to Moore: Determining the 
Relationship Between Phenotype, Genotype, Spleens, Data, and Informed 
Consent,3 by Dr. Charles E. Binkley, explores the impact of AI on the  
healthcare field, particularly in regard to the ethical treatment of patient

The last three articles of this Book concern the field of employment 
law.  Professor David Lopez’s article, The Quest for Algorithmic Justice in 
the Workplace: The Equal Employment Opportunity Commission and 
Other Federal Responses to AI, Technology, And Enhanced Dangers of 
Employment Discrimination,4 engages with the challenges AI brings to 
combatting discrimination in hiring and in the workplace and surveys 
the Equal Employment Opportunity Commission’s treatment of this new 
technology.  In the following article, All the Regulatory Light We Cannot 
See: The Impact of Loper Bright on Regulating Artificial Intelligence in the 
Workplace,5 Bradford J. Kelley explores the challenges of regulating the 
use of AI in the workplace in the wake of the new administrative law 
landscape produced by the Supreme Court’s decision in Loper Bright.  
The final article of this book, From Factory Floors to Courtroom 
Doors: The New Jersey Law Revision Commission Review of an Exception 
and a Defense to the Exclusive Remedy of the New Jersey Workers’ 
Compensation Act,6 is the annual submission the Journal receives from 
the New Jersey Law Revision Commission, authored by Whitney G. 
Schlimbach and Carol Disla-Roa.  This article explores New Jersey’s 
statutory scheme regulating workers’ compensation, intending to bring 
issues to the attention of the state Legislature and clarify the meaning of 
the statutes. 
The topics discussed in this symposium promise to have a 
sweeping impact on the practice of law.  Practitioners, scholars, and 
lawmakers should take heed of the insights provided here and keep 
abreast of future developments. 
To close this Foreword, we thank all our Fall Symposium 
participants and the authors for their time, effort, and expertise.  We 
sincerely hope that all will enjoy reading this Book.
