Facilitating Access to Out-of-Commerce Works in the Digital Single Market – How to Make Pico della Mirandola’s Dream a Reality in the European Union
Renaissance genius Pico della Mirandola dreamed of making all knowledge accessible in one place. The Proposal for a Directive on Copyright in the Digital Single Market could help Pico’s dream come true. The proposal, inter alia, aims at facilitating wider access to Europe’s cultural heritage through the introduction of a mechanism enabling the use of out-of-commerce works by cultural heritage institutions in the digital environment. After examining the key elements of this mechanism, this Opinion critically discusses the definition of the scope of search required for es-tablishing the out-of-commerce status of works, the requirement of the representative character of collective management organisations, and the non-application of the mechanism to third-country works. This Opinion also looks into the coordination between the CJEU’s Soulier decision and the Directive Proposal, with special emphasis on the sufficiency of general publicity measures, and the creation of the EUIPO’s out-of-commerce online database. In conclusion, while being supportive of the proposal and the idea of promoting more access to out-of-commerce works, this Opinion provides some suggestions for improving the text

Advance development of an automatic picking system for decentralized order picking
Der vorliegende Beitrag befasst sich mit der Vorentwicklung und ersten Integration der Komponenten eines automatischen Kommissioniersystems für die dezentrale Kommissionierung. Neben der Vorstellung der geleisteten Entwicklungsschritte für die einzelnen Module wie Bildverarbeitung, Fahrzeug und Greifer wird auf die übergeordnete Gesamtsteuerung des Systems eingegangen.The present article deals with the predevelopment and first integration of the components of an automatic picking system for decentralized picking. In addition to the presentation of the development steps for the individual modules such as image processing, vehicle and gripper, the superior system control is discussed
Intellectual Property under the Scrutiny of Investor-State Tribunals: Legitimacy and New Challenges
In 2009, C.S. Gibson was suggesting that: “With this early coverage of intellectual property in BITs, it is perhaps surprising that there has yet to be a publicly reported decision concerning an IPR-centered investment dispute. Given the trajectory of the modern economy, however, in which foreign investments reflect an increasing concentration of intellectual capital invested in knowledge goods protected by IPRs, this could soon change” (Gibson, ‘A Look at the Compulsory License in Investment Arbitration’, 2009). A couple of years later, the first investment cases dealing with IP issues were made public. In this context, this paper first addresses the conditions that have to be fulfilled in order to bring intellectual property claims in investment arbitration, by touching upon the question of the definition of an investment in theory and in practice. It also tries to shed light on some of the implications of recent arbitral awards touching upon this interaction between intellectual property and investment protection, from a legal and regulatory perspective. On the other hand, the specific situation of the European Union is scrutinized, and in particular the project put forward by the European Commission to adapt the dispute settlement system for the protection of investments
Responsibility for Data Protection in a Networked World: On the Question of the Controller, “Effective and Complete Protection” and its Application to Data Access Rights in Europe
In the current networked world, almost no system in which personal data is processed stands on its own. For example, websites and mobile applications integrate third party services for behavioral targeting, user analytics, navigation, and many other functionalities. Governments build central infrastructures to share data efficiently between different branches of government and with other organisations. This paper analyses the current system in Europe for determining who is (or better, are) responsible for observing data protection obligations in such networked service settings. In doing so we address the following problems: (1) of ambiguity in applying the concept of data controller in networked settings; and (2) of insufficiencies in the framework for establishing the extent of the responsibilities in situations of joint control. We look at how the law and regulators address these problems and how the European Court of Justice tackles these problems by applying the principle of “effective and complete protection”. The issue of joint responsibility has gained particular relevance in the wake of Wirtschaftsakademie, a case recently decided by the European Court of Justice. In this case, a Facebook fan page administrator was found to be a joint-controller and therefore jointly responsible, together with Facebook, for observing data protection rules. Following this decision, there are many more situations of joint control than previously thought. As a consequence, part of the responsibility for compliance with data protection legislation and risk of enforcement measures are moved to those who integrate external services. This will change the incentive structure in such a way that joint-controllers will place a much higher value on data protection. To explore the practical implications of the legal framework, we analyse a number of examples taken from our earlier empirical work on the right of access to reflect on the newly emerging data responsibility infrastructure. We show that the coordination of responsibilities is complex in practice because many organisations do not have a clear overview of data flows, there are power imbalances between different actors, and personal data governance is often happening in separated specialised units

Im Zentrum des Textes stehen Taktiken der Stimmungserzeugung in den so genannten Betonkirchen der 1960er und 70er Jahre. Der Analyse geht die These voraus, dass das natürlich einfallende Licht eine wesentliche Rolle bei der Entstehung von Aura, Atmosphäre oder "Sakralität" spielt. Der Raum, so die weitere Überlegung, wird dadurch zum Rezipienten von Phänomenen, die mit dem philosophisch-ästhetischen Konzept der Erhabenheit beschreibbar werden
Historia de la enfermería de salud pública en España y el contexto internacional
La investigación analiza los factores del contexto internacional que influyeron en la profesionalización de la enfermería de salud pública en España. Se han utilizado fuentes del archivo de la Sociedad de Naciones, de la Organización Mundial de la Salud y de la fundación Rockefeller. También artículos e informes elaborados por las autoridades sanitarias, por los médicos higienistas y por las enfermeras. Los resultados ponen de manifiesto que el impulso de la Fundación Rockefeller y de los organismos internacionales en Europa influyó en la profesionalización de la enfermería de salud pública en España. Dicho proceso se truncó por el estallido de la guerra civil y la dictadura franquista. El Franquismo frustró los esfuerzos institucionales tanto nacionales como internacionales, reorientó la acción sanitaria utilizando a las enfermeras como vehículo ideológico y acentuó la brecha de género. Frente a la consolidación de la enfermería de salud pública a lo largo del siglo XX en el ámbito internacional, en España se produjo el proceso inverso. La enfermería sufrió un importante deterioro disciplinar, se primó su carácter auxiliar y su desarrollo se ciñó casi exclusivamente al ámbito hospitalario, lo que acentuó el aislamiento y obstaculizó su profesionalización
Material Care Studies
Mit diesem Beitrag wird in groben Zügen umrissen, was unter Material Care Studies im Sinne einer Thematisierung und Erforschung von Pflege und Care mit Blick auf ihre materielle Seite, also ihre Dinge, zu verstehen ist und welche neuen Einsichten und Erkenntnisse dieser Zugang eröffnen kann. Ein weitgefasstes Verständnis von Pflege und Care bildet den Ausgangspunkt der Material Care Studies, d.h. die Betrachtung materialer Dinge, die in der Kranken- oder Altenpflege, in der Unterstützung von Menschen mit Behinderungen, in Operationssälen u.v.m. zum Einsatz kommen. Wir argumentieren, dass Material Care Studies nicht nur von den aktuellen objekttheoretischen Zugängen der Material Culture Studies ausgehen sollten, sondern insbesondere das materielle kulturelle Erbe der Pflege und entsprechende sammlungstheoretische Ansätze in die Diskussion um Pflegedinge einbeziehen müssen. Darüber hinaus sind Material Care Studies explizit gendersensibel, nicht zuletzt aufgrund der historischen Genese der Pflege hin zu einem vermeintlich weiblich konnotierten Wirkungsfeld. Material Care Studies als neues Wissenschaftsfeld begründen sich in der besonders materiellen, dinglichen und körperlichen Prägung der Interaktionen in Kontexten von Pflege und Care. Sie geben Antworten auf die vielen bisher offenen Fragen zu den Wirkungsformen konkreter Materialitäten in Pflege und Care
Atmosphäre als Haltung – Für eine wahrnehmungsorientierte Lehre in Städtebau und Architektur
In einer Zeit, in der Emotionalität quantitativ anhand der „likes“ in sozialen Medien gemessen wird, bietet der Stadtraum eine wichtige materielle Gegenwelt des konkreten und unmittelbaren Erlebens. Im Stadtraum ist der Mensch körperleiblich und sinnlich anwesend und bei sich, hier ist er nicht austausch- oder wegklickbar. Um aber gestalterisch mit ihm umzugehen, bedarf es der Ausbildung einer urbanen Empathie, welche Architektinnen und Architekten in die Verantwortung nimmt, das gesellschaftliche Miteinander auch als eine sinnliche Teilhabe am öffentlichen Raum zu behandeln und zu vermitteln.
Der Sketch Carpet, erstmals im Wintersemester 2018/19 am „Stadt/Studio“ des Instituts für Architektur und Raumentwicklung der Universität Liechtenstein erprobt, versteht sich als Dokumentationsmöglichkeit erlebter sinnlicher Qualitäten von architektonischen Räumen und als Reflexionsebene für die verschiedenen subjektiven Erlebensweisen einer räumlichen Situation. Das „Stadt/Studio“ will dank dieses Instruments zum Katalysator einer stadträumlichen Entwicklung und zum Impulsgeber einer öffentlichen Diskussion darüber werden
