    Das Studierendenprojekt neophobia befasste sich mit der Kultivierung von Zukunftsängsten durch dystopische Unterhaltungsmedien. Das Ziel lag darin, den Einfluss dieses Genres auf die Zukunftsvorstellungen und -einstellungen sowie das zukunftsgerichtete Verhalten der Rezipienten zu untersuchen. Dazu wurde der Kultivierungsansatz herangezogen.The student project neophobia considered the cultivation of fears about the future through dystopian media. The study examined the genre dystopia and its effect on how people imagine the future, their future believes and their behaviour facing fear of the future.     Charakter und Ausdruck – Zur Stimmungserzeugung in der Architektur der Spätaufklärung

    Der seit mehr als zwei Jahrzehnten intensiv geführte Diskurs zum Atmosphärischen in der Architektur schließt eher selten eine Betrachtung seiner eigenen historischen Bedingtheit ein. Der vorliegende Beitrag zeigt, wie wesentliche Inhalte des heutigen Atmosphärenbegriffs bereits in den Entwürfen und Theorien der Spätaufklärung angelegt sind. Hierbei wird deutlich, dass in der von französischen und britischen Architekten geprägten Charakterlehre die Voraussetzungen für architektonische Stimmungserzeugungen bereits gegeben waren. Gesellschaftliche Umwälzungen führten in der Aufklärung zur Ausdifferenzierung der Bauaufgaben, was zugleich die Erweiterung des architektonischen Ausdrucksvermögens erforderte. Zur Mitte des 18. Jahrhunderts äußerte sich dieses Streben zunächst in einer Vielzahl von Entwürfen und zunehmend auch in gebauter Form. Die von einem Gebäude ausgehende Stimmung sollte nun die Emotionen der Besuchenden beeinflussen und somit den neu zu konzipierenden Bautypen der aufgeklärten Gesellschaften einen jeweils eindeutigen Charakter verleihen

    Parmi les différents types de constructions qui ont pu être désignées comme ‘existentielles’ dans la littérature, cet article s’intéresse à la prédication de localisation inverse, illustrée en français par Il y a un chat dans l’arbre. La prédication de localisation inverse, comme la prédication de localisation simple, illustrée en français par Le chat est dans l’arbre, se caractérise par son aptitude à encoder les relations figure-fond prototypiques ; elle diffère de la prédication de localisation inverse par le fait qu’elle encode la perspectivisation marquée ‘du fond à la figure’. Toutes les langues n’ont pas une construction prédicative de localisation inverse morphologiquement distincte de la prédication de localisation simple, mais dans beaucoup de langues qui pas une telle construction, l’ordre des constituants peut varier en relation avec la perspectivisation. Ce n’est toutefois pas le cas pour les langues de la ceinture soudanaise. Une particularité typologique remarquable des langues de cette zone est que la plupart d’entre elles n’ont pas une construction morphologiquement distincte pour la prédication de localisation inverse, et en même temps n’utilisent pas la variation de l’ordre des constituants pour exprimer un changement de perspective dans la prédication de localisation.Among the various types of constructions that may have been referred to as ‘existential’ in the literature, the present article deals with inverse locational predication (abbreviated as ILP), illustrated by English There is a cat in the tree. Inverse locational predication, like plain (or direct) locational predication, illustrated by English The cat is in the tree, is characterized by its ability to encode prototypical figure-ground relationships; it differs from plain locational predication in that it encodes the marked perspectivization ‘from ground to figure’. Not all languages have an ILP construction morphologically distinct from plain locational predication, but in many languages that do not have a specialized ILP construction, variation in constituent order is related to variation in perspectivization. However, this is not the case for the languages of the Sudanic belt. A remarkable typological particularity of the languages of this area is that most of them do not have a morphologically distinct ILP construction, and at the same time do not use variation in constituent order to express variation in perspectivization.Zu den verschiedenen Konstruktionstypen, die in der Literatur als existenzbeschreibend diskutiert werden, befasst sich der vorliegende Artikel mit inversen lokalen Prädikationen (abgekürzt ILP), wie z.B. Deutsch Da sitzt eine Katze im Baum. Inverse lokale Prädikation, wie einfache lokale Prädikation, z.B. Deutsch Die Katze sitzt im Baum, zeichnet sich durch ihre Fähigkeit prototypische Figure-Ground Beziehungen zu beschreiben. Sie unterscheidet sich von einfachen lokalen Prädikationen, durch die markierte Perspektive ‘von Ground zu Figure’. Nicht alle Sprachen haben eine ILP Konstruktion, die sich von der einfachen morphologisch unterscheidet. In vielen Sprachen aber, die keine spezielle ILP Konstruktion haben, werden die verschiedenen Perspektiven durch unterschiedliche Reihenfolgen der Konstituenten ausgedrückt. Das gilt allerdings nicht für die Sprachen des Sudanic Belt. Eine bemerkenswerte typologische Eigenart der Sprachen dieser Region besteht darin, dass sie weder eine spezifische morphologische ILP Konstruktionen haben, noch unterschiedliche Konstituentenfolgen, um Variation der Perspektiven auszudrücken

    Data Governance in Connected Cars: The Problem of Access to In-Vehicle Data

    Through the application of the technological solution of the “extended vehicle” concept, the car manufacturers can capture exclusive control of the data of connected cars leading to serious concerns about negative effects on competition, innovation and consumer choice on the markets for aftermarket and other complementary services in the ecosystem of connected and automated driving. Therefore, a controversial policy discussion has emerged in the EU about access to in-vehicle data and the connected car for independent service providers in the automotive industry. This paper claims that this problem should be seen as part of the general question of the optimal governance of data in the ecosystem of connected and automated mobility. The paper offers an overview about this policy discussion and analyzes this problem from an economic perspective by utilizing a market failure analysis. Besides competition problems (especially on markets for aftermarket and other services in the connected car) and market failures in regard to technological choice (extended vehicle vs. interoperable on-board application platform), information and privacy problems (“notice and consent” solutions) can emerge, leading to the question of appropriate regulatory solutions. The paper discusses solutions through data portability, data rights, competition law, and recommends a sector-specific regulatory approach

    The Intersection of 3D Printing and Trademark Law

    The paper discusses the possible impact of 3D printing technology on a trademark protection system and argues that, despite some obstacles, selling certificated 3D-printable files by companies can be a reasonable new approach in order to face up to the changes brought about by this new technology. 3D printing (three-dimensional printing, counter crafting), perceived by some as a disruptive technology, is an additive manufacturing technique to create objects by joining or printing layer upon layer of material based on digital models. Certain features of this technology such as democratization and dissemination of manufacturing process, participation of hobbyists, the role of CAD files, the possibility of introducing modifications into a file, and the worldwide scope of 3D printing based on the Internet connectivity may have an impact on trademark protection to a certain extent. The paper analyzes the cases of this impact and suggests possible solutions: selling 3D-printable certificated files by trademark owners; price regulation; and better educational programs on counterfeit goods. From the hard law perspective, the solution may lie in establishing clear rules of liability for intermediary online platforms

    Digitale Technologien sind Katalysatoren um bestehende Prozesse effizienter zu gestalten, erlauben an Hochschulen gänzlich neue Möglichkeiten in Lehre, Forschung und Verwaltung und verändern unsere Gesellschaft tiefgreifend. Diese Arbeit leistet einen Beitrag dazu, die IT-Architektur der Domäne Hochschule im Kontext der Digitalisierung idealtypisch weiterzuentwickeln. Basierend auf den Rahmenbedingungen und Bedarfen an deutschen Hochschulen werden aktuelle Herausforderungen abgeleitet und anhand der Fallstudie Technische Universität München (TUM) untersucht. In einem umfassenden Ansatz werden hierbei neben dem Schwerpunkt Campus Management auch die Themenfelder IT-Strategie, IT-Governance, Digitalisierung der Lehre, IT-Sicherheit, Datenschutz, IT-Support und die geplante Fortentwicklung anhand der TUM Agenda IT betrachtet. Die Analysen zum an der TUM unter dem Namen TUMonline maßgeschneidert weiterentwickelten Campus-Management-System CAMPUSonline der Technischen Universität Graz beinhalten den Funktionsumfang, das Berechtigungsmodell, die Systemlandschaft und die organisatorische Einbettung. Der hohe Integrationsgrad des so entstandenen Systems TUMonline wird anhand der Vielzahl der angebundenen Quell- und Zielsysteme deutlich und dient anderen Hochschulen als Benchmark. Die bedarfsorientierte Weiterentwicklung wird durch regelmäßige qualitative und quantitative Evaluationen, Regelkreise und eine entsprechende Governancestruktur sichergestellt. Exemplarisch wird eine Studierendenbefragung mit 6.261 Teilnehmenden detailliert ausgewertet. Aufbauend auf den Erkenntnissen der Fallstudie und den Bedarfen und Herausforderungen an deutschen Hochschulen wird eine zukunftsweisende IT-Architektur für die digitale Hochschule vorgestellt.Digital technologies are catalysts to make existing processes more efficient. They facilitate new capabilities and opportunities in higher education teaching as well as research, administration and are changing our society profoundly. This thesis contributes to the development of the information technology (IT) architecture of Higher Education Institutions (HEIs) in the context of digitization. Based on the framework conditions and needs of German HEIs, current challenges are derived and examined using the case study of the Technical University of Munich (TUM). In addition to the focus on campus management, special emphasis lays on the areas of IT strategy, IT governance, digitalization of teaching, IT security, data protection, IT support, and the further development based on the TUM Agenda IT. The analysis of the campus management system CAMPUSonline of the Technical University of Graz, used at TUM as enhanced software under the name TUMonline, includes the scope of functions, the roles and rights model, the system landscape and the organizational embedding. The large number of connected source and target systems demonstrates the high level of integration of TUMonline. This fact serves as a benchmark for other HEIs. The demand-oriented further development is ensured by regular qualitative and quantitative evaluations, control cycles and a corresponding governance structure. As an example, a student survey with 6,261 participants is evaluated in a detailed manner. Reassuring the findings of the case study, the needs and challenges at German HEIs are elaborated and a future-oriented IT architecture for the digital Higher Education Institution is presented

    Lawfulness for Users in European Copyright Law: Acquis and Perspectives

    This article analyses the emerging dynamics of the concepts of lawful user, lawful use, and lawful access in European Copyright law. It aims to demonstrate that these concepts, which are part of the EU copyright law acquis, have the potential to provide a fair solution to the controversies regarding the “rights” and “duties” of users in European copyright law. The article proposes to establish a legislative dynamic definition of lawful use in European Copyright Law. The concept must be clarified and given a broad meaning in order to cover both uses which are authorized by the right holders, but are also not restricted by law, by taking into account the legal ideals of fairness and reasonableness. This change must be accompanied by the recognition of all copyright exceptions as jus cogens and the establishment of effective procedural mechanisms to safeguard the enjoyment of lawful users’ rights

    Protecting human rights in the context of automated decision-making might not be limited to the relationship between intermediaries and their users. In fact, in order to adequately address human rights issues vis-à-vis social media platforms, we need to include the state as an actor too. In the German and European human rights frameworks, fundamental rights are in principle only applicable vertically, that is, between the state and the citizen. Where does that leave the right of freedom of expression when user-generated content is deleted by intermediaries on the basis of an agreement with a public authority? We must address this question in light of the use of artificial intelligence to moderate online speech and its (until now lacking) regulatory framework. When states create incentives for private actors to delete user-content pro-actively, is it still accurate to solely examine the relationship between platforms and users? Are we facing an expansion of collateral censorship? Is the usage of soft law instruments, such as codes of conduct, enhancing the protection of third parties or is it rather an opaque instrument that tends to be conflated with policy laundering? This paper aims to analyse the different layers of the usage of artificial intelligence by platforms, when it is triggered by a non-regulatory mode of governance. In light of the ongoing struggle in content moderation to balance between freedom of speech and other legal interests, it is necessary to analyse whether or not intelligent technologies could meet the requirements of freedom of speech and information to a sufficient degree

    Validierung von Strömungsmodellen als neuer Simulationsansatz für das Paket-Handling im Bulk-Modus

    Flow Models based on hyperbolic partial differential equations (conservation laws) are a well-established approach for the material flow simulation. Until now, they have been exclusively used for the simula-tion of cylindrical cargo. This paper investigates the application of flow models on cubical cargo as a new simulation approach for parcel logistics. Selected flow model parameters are adapted to cover this new situation. The simulation results of this macro-scopic model are compared with the microscopic Discrete Element Method (DEM) where the cargo is approximated by superquadrics. An experimental setup especially designed for the validation of the considered flow model for cubical cargo bulk flow is presented. Results of the flow model are analyzed and validated against the results of experiment and DEM for the test setting.Die Verwendung von Flussmodellen, die auf hyperbolischen partiellen Differentialgleichungen (Erhaltungsgleichungen) basieren, ist ein etablierter Modellierungsansatz für die Materialflusssimulation. Bisher wurden diese Flussmodelle nur für die Simulation von zylindrischen Stückgütern eingesetzt. Diese Veröffentlichung untersucht die Anwendbarkeit von Flussmodellen auf eckige Stückgüter als neuen Simulationsansatz für die Paketlogistik. Ausgewählte Parameter des Flussmodells werden angepasst, um die neue Geometrie der Transportgüter zu berücksichtigen. Die Simulationsergebnisse von diesem makroskopischen Modell werden mit der mikroskopischen Diskrete Elemente Methode (DEM) verglichen, bei der das Stückgut durch Superquadrics abgebildet wird. Ein spezieller Versuchsaufbau für die Validierung des Flussmodells für das Handling von eckigem Stückgut im Pulk wird vorgestellt. Die Ergebnisse des Flussmodells werden analysiert und mit den Experimentdaten und der DEM-Simulation des Versuchsaufbaus verglichen
