Secondary communication under the EU copyright acquis after Tom Kabinet: Between exhaustion and securing work’s exploitation
Since the adoption of the InfoSoc Directive, the CJEU has been dealing with a variety of questions on the interpretation of the broad right of communication to the public. A substantial share of the references for a preliminary ruling concerns secondary communication, which relies on communication initially authorised by the right holder. Despite the seemingly clear language of Article 3(3) of the InfoSoc Directive denying the exhaustion of communication right, the Court has occasionally exempted secondary acts from the authorisation of the right holder, relying on the arguments resembling the exhaustion principle of the right of distribution in respect of the tangible copies of a work. In the recent Tom Kabinet judgment, the CJEU denied the direct application of the principle in the case of the resale of e-books facilitated by the Tom Kabinet platform. Whereas the judgment is of significance to the future of the exhaustion principle under the acquis, this article focuses on its broader implications on secondary communication. The article argues that the decision is in line with the developments under the jurisprudence but is by no means a final say on the extent of exclusive control over secondary communication in the digital environment. Besides raising the question of appropriate boundaries of the exclusive rights and their role in the digital markets, the judgment invites the legislator to revise the framework and restore the legal certainty in respect of the scope of exclusive control over the work’s communication to the public

Autonom organisierte Bodenblocklager: Ein Überblick über Entscheidungsprobleme und wesentliche Herausforderungen
In autonomously organized block stacking ware-houses, Automated Guided Vehicles (AGVs) control material handling without requiring any technical in-tegration or Warehouse Management System (WMS). In this paper, we present related decision problems and provide a short literature overview for each one. We found that many existing approaches do not exploit the full potential of available flexibility. By focusing on operational decisions, we introduce the autonomous block stacking warehouse problem (ABSWP) and dis-cuss major challenges which must be tackled by future solution approaches.In autonom organisierten Bodenblocklagern über-nehmen Fahrerlose Transportfahrzeuge (FTF) den Materialtransport und benötigen dabei keine techni-sche Anbindung und Lagerverwaltungssoftware. In diesem Beitrag präsentieren wir relevante Entschei-dungsprobleme und geben für jedes einen kurzen Lite-raturüberblick. Wir stellen dabei fest, dass viele beste-hende Ansätze noch nicht das voll verfügbare Potential an Flexibilität nutzen. Mit der Fokussierung auf opera-tive Entscheidungen, präsentieren wir das Autonomous Block Stacking Warehouse Problem (ABSWP) und diskutieren die größten Herausforderungen, welche durch zukünftige Lösungsansätze zu bewältigen sind
Dimensionierung von Routenzugsystemen mit dynamischen Routen auf Basis eines Genetischen Algorithmus Titel (E): Fleet Sizing of Dynamically Routed In-plant Milk-run Vehicles Based on a Genetic Algorithm
In-plant milk-run (MR) systems enable efficient supply of assembly lines in small lot sizes. One major chal-lenge for MR systems are demand fluctuations and short-term changes within schedules. Dynamic control strategies aim at increasing flexibility and efficiency of MR systems in volatile environments. This paper presents an application-oriented approach for determining the fleet size of an MR system with dynamically controlled routes based on a genetic algorithm. The approach is evaluated and discussed using a case study from a commercial vehicle manufacturer. The results show that the approach ena-bles effective analytical dimensioning of MR systems with dynamic routes. In addition, the case study indicates that the implementation of dynamic routes can lead to a reduction in fleet size.Innerbetriebliche Routenzugsysteme (RZS) ermöglichen eine effiziente Materialversorgung von Montagelinien in kleinen Losgrößen. Eine Herausforderung für RZS sind Bedarfsschwankungen und kurzfristige Änderungen in Fahrplänen. Das Ziel von dynamischen Steuerungsstrategien ist die Erhöhung der Flexibilität und Effizienz von RZS in volatilen Umgebungen. Dieser Beitrag stellt einen anwendungsorientierten Ansatz zur Bestimmung der Flottengröße eines RZS mit dynamischen Routen basierend auf einem genetischen Algorithmus vor. Der Ansatz wird anhand einer Fallstudie eines Nutzfahrzeugherstellers evaluiert und diskutiert. Die Ergebnisse zeigen, dass der vorgestellte Ansatz eine effektive analytische Dimensionierung von RZS mit dynamischen Routen ermöglicht. Die Fallstudie legt zudem nahe, dass der Einsatz von dynamischen Routen zu einer Reduzierung der benötigten Anzahl an Fahrzeugen führen kann
Safety related sensor system for automated guided vehicles
Die Einsatzbedingungen fahrerloser Transportfahrzeuge (FTF) werden zunehmend dynamischer und deren Anzahl in Umgebungen, in denen sich auch Personen aufhalten nimmt stetig zu. Um eine sichere Zusammenarbeit zwischen FTF und Personen zu gewährleisten, bedarf es Sensorsysteme, die eine explizite Erkennung von Personen ermöglichen. In diesem Beitrag soll ein solches sicherheitsbezogenes Sensorsystem anhand eines Konzeptes und eines Demonstrators vorgestellt werden.The operating conditions of Automated Guided Vehicles (AGVs) are becoming increasingly dynamic and their number in environments where people are present is constantly increasing. In order to ensure safe cooperation be-tween AGVs and people, sensor systems are required that enable the explicit recognition of people. Planning tool for the development of suitable operating strategies of mobile-pickrobots
Ein Großteil der heutigen Kommissioniersysteme wird nach wie vor manuell oder nur teilautomatisiert betrieben. Der zunehmende Personalmangel führt jedoch dazu, dass Unternehmen vermehrt mobile Kommissionierroboter einsetzen, die gemeinsam mit dem Mensch kommissionieren. Diese Arbeit zeigt auf, dass sich die bisherigen Untersuchungen nur auf ein Teilgebiet der mobilen Kommissionierroboter beschränken. Insbesondere die Leistungsentwicklung bei einer gemeinsamen Arbeitsumgebung sowie die Auswirkung auf bekannte Steuerungsstrategien wurden bisher nicht näher untersucht. Im Rahmen dieser Arbeit wird ein erstes Konzept für ein solches Planungstool vorgestellt. Darüber hinaus zeigen erste Ergebnisse, dass eine getrennte Zonierung durchaus Leistungszuwächse generieren kann, jedoch zur Auswahl der optimalen Kombination beider Agenten (Mensch & Roboter) wirtschaftliche Aspekte herangezogen werden müssen.The majority of today's order picking systems are stil operated manually or only partially automated. However, the increasing lack of personnel is forcing companies to use more mobile picking robots that pick together with humans. This work shows that the research conducted so far is limited to only a part of the field of mobile picking robots. In particular, the performance development in a common working environment and the effect on existing control strategies have not been investigated in detail so far. Within the scope of this work, a first concept for such a planning tool is presented. In addition, first results show that a separate zoning can generate performance increases, but that economic aspects have to be consideredwhen selecting the optimal combination of both agents (human & robot)
Concepts for the use of knowledge-based engineering in intralogistics system planning
Im vorliegenden Beitrag wird die Entwicklung einer neuen Methode aus dem Bereich des Knowledge-based Engineerings dargestellt, die gezielt die Spezifika und Randbedingungen der Planung intralogistischer Sys-teme adressiert. Durch die Nutzung der Methode wird die Möglichkeit eröffnet intralogistische Systeme effi-zient zu planen und dabei eine breite Informationsba-sis zu nutzen. Technische Informationen werden dadurch in einer frühen Planungsphase zugänglich gemacht. Abschließend zeigt der Beitrag prototypische Implementierungen der Methode, die eine dreidimen-sionale Planung intralogistischer Systeme in einer web-basierten Umgebung ermöglichen.This contribution shows the development of a new Knowledge-based Engineering method addressing the specifics and boundary conditions of the planning of intralogistic systems. By the use of this methodology the possibility arises to efficiently plan and design in-tralogistic systems using a broad information base, thus making technical information accessible in an early phase of the planning process. In the end of this contribution prototypical implementations of the method are introduced, showing a web based system enabling the planning of an intralogistic system within a three dimensional environment
Blockchain-based cyber-physical production systems
Durch cyberphysische Produktionssysteme (CPPS) können dynamische Produktionsräume mit skalierbaren Modulen realisiert werden. Eine Problematik liegt vor allem in einer unternehmensübergreifenden Integration solcher Systeme. Die Technologie der Blockchain (BC) bietet dafür große Potentiale.
Aufgrund der Vielzahl an möglichen Umsetzungen wird jedoch eine Testumgebung zur Untersuchung und Entwicklung geeigneter Lösungen benötigt. In dem Beitrag werden die dafür erforderlichen Voraussetzungen analysiert.Darüber hinaus wird eine geeignete Testumgebung inklusive der technischen Ausstattung und der dezentralen Selbststeuerungsmethode eines CPPS vorgestellt. Diese ermöglicht in Zukunft die Erforschung BC-basierter CPPS.Cyber-physical production systems (CPPS) allow the realization of dynamic production areas with scalable modules. One of the main problems is the cross-company integration of such systems. The technology of the blockchain (BC) offers great potential for this purpose. Due to the large number of possible implementations, however, a test environment is needed to investigate and develop suitable solutions. In this paper the necessary prerequisites are analyzed. Furthermore, a suitable test environment including the technical equipment and the decentralized selfcontrol method of a CPPS is presented. Calibration of Automated Guided Vehicles and Fleets – State of the Art and Challenges
Fahrerlose Transportfahrzeuge nehmen durch ihre Effizienz in der Industrie einen immer größeren Stellenwert ein. Hieraus resultiert eine erhöhte Nachfrage bei den Produzenten. Um diese zu bedienen, ist es notwendig die Fertigungsprozesse zu optimieren. Eine Möglichkeit bietet hierbei die Kalibrierung, da heutzutage jedes Fahrzeug weitgehend einzeln und manuell eingestellt werden muss. Eine Optimierung dieses Prozessschritts würde durch die Skaleneffekte einen erheblichen Beitrag zur Effizienzsteigerung beitragen. Dieser Artikel analysiert daher mithilfe einer Literaturrecherche die verschiedenen Arten von Kalibrierung und inwieweit diese automatisiert werden können. Ergänzend dazu wird untersucht, ob nicht nur Einzelfahrzeuge kalibriert werden können, sondern dies gleichzeitig für eine gesamte Flotte durchgeführt werden kann.Automated Guided Vehicles are becoming more and more important in the industry due to their efficiency. This results in an increased demand on the producers’ side. In order to serve this demand it is necessary to optimise the production processes. One possibility is calibration, since nowadays each vehicle must be adjusted individually. An optimisation of this process step would make a considerable contribution to increase the efficiency through economies of scale. This article therefore analyses the different types of calibration and the extent to which they can be automated. In addition it is researched whether it is not only possible to calibrate single vehicles, but to do this simultaneously for an entire fleet
