    Interplay Of Digital Content Directive, European Electronic Communications Code And Audiovisual Media Directive In Communications Sector

    In the near future, several new EU law acts such as the new Digital Content Directive (DCD), Electronic Communications Code (EECC) as well as the revised directive on audio-visual media services (AMVD) will be applicable to the communication sector. These directives are partly mutually exclusive but partly also cumulatively applicable. The article examines the complicated demarcation and interplay between these three directives, including their complicated interaction in case of bundle contracts, concentrating primarily on contract law issues. It shows, inter alia that subjecting number-dependent interpersonal communications services as a subtype of electronic communications services to the EECC and number-independent interpersonal communications services to the DCD results in different contractual remedies for consumers which cannot be easily justified. The article also argues that certain provisions of AMVD should be considered as part of objective conformity criteria under the DCD, entitling consumers to use contractual remedies if the content requirements are not complied with. Finally, the new rules on bundle contracts allowing consumers to terminate the whole bundle even if only one part of the bundle is affected constitute a considerable improvement in the consumer’s contractual rights compared to the previous rules

    Das Lehrbuch richtet sich an Studierende und Lehrende mit dem Ziel, eine praktische Einführung in das wissenschaftliche Arbeiten anhand eines breiten Themenspektrums zu geben. Dabei wird in der vorliegenden Auflage das Thema der Digitalisierung in erziehungswissenschaftlichen Publikationen neu aufgenommen (S. 8). Zahlreiche Kopiervorlagen im Anhang (bspw. Analysekriterien für Fachzeitschriften, Literaturangaben und eine Checkliste für eine Hausarbeit) bieten beiden Zielgruppen wertvolle Vorlagen für das wissenschaftliche Arbeiten. Es sind zudem Online-Materialien verfügbar. Das Buch beinhaltet zwölf Kapitel. Diese befassen sich mit Themenbereichen, die im Rahmen des wissenschaftlichen Arbeitens relevant sind und beleuchten neben dem Prozess auch einzelne konkrete wissenschaftliche Prüfungsleistungen. Thematisiert werden ebenso Kriterien der Bewertung der wissenschaftlichen Arbeitsweise, so dass Studierende als auch Lehrende eine Orientierung für die Anfertigung bzw. Bewertung wissenschaftlicher Arbeiten vorfinden. Im ersten Kapitel Was heißt “wissenschaftlich” arbeiten? werden zunächst in knapper Form einige Anforderungen vorgestellt, die an wissenschaftliche Arbeiten gestellt werden. Die Darstellung erfolgt jedoch nur überblicksartig. Das Kapitel zwei Die Wahl des Themas greift einen wesentlichen Bereich des wissenschaftlichen Arbeitens auf. Dieses richtet sich vornehmlich an Studierende und betont bspw. die Wahl des Themas nach Interesse und Ressourcen. An dieser Stelle wäre ein Aufgreifen der Sicht der Lehrenden für die Beratung zur Themenfindung wünschenswert. In Kapitel drei Zum Prozess des wissenschaftlichen Arbeitens werden die Arbeitsphasen, Textsorten sowie Recherchemöglichkeiten und Lesetechniken aufgegriffen. Neben der Textarbeit werden auch Grundformen des wissenschaftlichen Schreibens thematisiert. Im vierten Kapitel Die zentrale Fragestellung werden zahlreiche Fragen gestellt, die Studierenden helfen sollen, eine passende Fragestellung zu finden. Auch werden einige wenig geeignete Fragestellungen zur Illustration vorgestellt. Im Kapitel fünf Umgang mit Quellen in der Wissenschaft werden konkrete Anforderungen an Zitate benannt. Auch das Thema Plagiate wird anhand des Ethik-Kodexes in der Erziehungswissenschaft aufgegriffen. Hier wären weiterführende Hinweise zur Interpretation und konkreten Umsetzung dessen sowie zum Umgang mit Plagiaten aus Sicht der Lehrenden angebracht. Die detaillierte Vorstellung zweier Zitationsstile schließt das Kapitel ab. Kapitel sechs Sprache und Stil beginnt mit konkreten Empfehlungen für eine wissenschaftliche Sprache. Auch gendergerechte Formulierungen finden im kurzen, aber prägnanten Kapitel Raum. Das Kapitel 7 Instrumente zur inhaltlichen Analyse widmet sich neben der Begriffsanalyse als Instrument zur Untersuchung von wissenschaftlichen Texten auch dem roten Faden als Ausdruck dessen Stringenz. Zudem werden Beispiele für das Paraphrasieren von Textstellen gegeben sowie Elemente des Schreibvorganges vorgestellt. Auch dies erfolgt knapp, vermittelt aber einen prägnanten Eindruck von wesentlichen Aspekten. Das achte Kapitel Bearbeitung von Texten in Lehrveranstaltungen widmet sich weniger der eigenen Textproduktion, sondern der Nachbereitung von Lehrveranstaltungen und gibt einige praktische Strukturierungshilfen. Kapitel neun Referate fokussiert nun im Unterschied zur schriftlichen Arbeitsweise eine Form der mündlichen Präsentation im Studium. Hierin wird besonders die Darbietungsweise und die Aktivierung der Zuhörenden aufgegriffen. Das Kapitel zehn Schriftliche Arbeiten stellt wichtige Kriterien einer schriftlichen wissenschaftlichen Arbeit vor und fokussiert deren Bestandteile ebenso wie formale Aspekte. Das elfte Kapitel Ausblick - Alternative Leistungen stellt Möglichkeiten zum Scheinerwerb für Studierende kurz vor, die jedoch im Konkreten mit den jeweiligen Lehrenden in Bezug auf Umsetzbarkeit und Relevanz abgesprochen werden sollten. Das Buch wird vom Kapitel zwölf Die mündliche Prüfung abgeschlossen, welches sich thematisch von den vorhergehenden Kapiteln abhebt, die sich vornehmlich auf schriftliche Prüfungsleistungen fokussieren. Das letzte Kapitel gibt zahlreiche Tipps zum Umgang mit typischen Prüfungssituationen, bspw. im Falle von Wissenslücken. Das Buch behandelt inhaltlich relevante Bereiche des wissenschaftlichen Arbeitens, auch wenn nur eine kleine Auswahl getroffen wird. Der Anspruch eines übersichtlichen Arbeitsbuches ist sowohl durch die verständliche Sprache als auch durch die optische Strukturierung anhand von zahlreichen Tabellen sowie einer Zusammenfassung bedeutender Schlagworte am Anfang eines jeden Kapitels gegeben. Für eine fundierte Beschäftigung mit den Prinzipien des wissenschaftlichen Arbeitens ist jedoch die Konsultation weiterführender Literatur empfohlen. Ergänzungsmöglichkeiten liegen in Hinweisen speziell für Lehrende, wie sie Studierende konkret in den jeweiligen Phasen bzw. bei den jeweiligen Schritten des wissenschaftlichen Arbeitens unterstützen können. Letztlich jedoch scheint das Buch eher für Studierende als Lehrende geeignet

    Umweltprodukterklärungen stellen die Ergebnisse von Ökobilanzen von Produkten dar. Dabei werden über einen potentiellen Lebenszyklus Treibhausgasemissionen, Versauerungspotentiale bzw. Ressourcenverbbäuche berechnet. Ziel ist es, funktional äquivalente Produkte hinsichtlich ihrer Umweltverträglichkeit miteinander vergleichen und auswählen zu können. Neben der Wahl einer passenden funktionellen Einheit, ist die Festlegung sogenannter Bilanzierungsregeln im Rahmen einer PCR (Produktkategorie-Regel) essentiell. Welchen Einfluss die Festlegung der gewählten Parameter auf die Bilanzierungsergebnisse hat kann z. B. mittels einer Sensitivitätsanalyse geprüft werden. Diese ist optionaler Bestandteil von Ökobilanzierungen und wird im Hintergrundbericht einer PCR zur Erklärung der gewählten Parameter, den Stakeholdern zur Verfügung gestellt. Durchführung und Ergebnisse der Sensitivitätsanalyse für die Ökobilanzierung von Stetigförderern werden nachfolgend diskutiert und evaluiert.Environmental product declarations present the results of life cycle assessments of products. Greenhouse gas emissions, acidification potentials and resource consumption are calculated over a potential life cycle. The aim is to be able to compare and select functionally equivalent products with regard to their environmental preferability. In addition to the selection of a suitable functional unit, the definition of so-called assessment rules within the framework of a PCR (product category rule) is essential. The influence of the selected parameters on the results is checked within the scope of a sensitivity analysis. This can be part of LCA and is made available to the stakeholders in the background report of a PCR. The implementation and results of the sensitivity analysis for the life cycle assessment of continuous conveyors are discussed and evaluated below

    Methodical development of a new sorting system for polybags

    Der Beitrag beschreibt die methodische Entwicklung einer Sortieranlage für den Sendungstyp Polybag. Die Notwendigkeit dafür ergibt sich aus Herausforderungen wie bspw. höhere Energieeffizienz bei gleichzeitiger Leistungssteigerung aber vor allem aus dem starken Anstieg eines Sendungsanteils mit bisher nicht ausreichend beschriebenen physikalischen Eigenschaften – auch Polybag genannt. Diesen außergewöhnlichen Rahmenbedingungen können State-of-the-Art Systeme derzeit nur bedingt gerecht werden. Der Beitrag zeigt dazu verschiedene Modelle zur Simulation des physikalischen Verhaltens von Polybags, wie dem biegeschlaffen Verhalten mittels Mehrkörpersimulation oder Strömungssimulationen, und integriert diese direkt in den Entwicklungsprozess. Der Entwurfsprozess konzentriert sich auf einen virtuellen Entwicklungsansatz (CAE) durch verschiedene Methoden, mit anschließender Validierung der Ansätze an einem Funktionsprototypen. Daraus resultiert die Konzeptstudie des neuartiges Sortiersystem speziell für Polybags.The article describes the methodical development of a sorting system for the shipment type polybag. The need for this arises from challenges such as higher energy efficiency with a simultaneous increase in performance, but above all from the sharp increase in the proportion of items with physical properties that have not yet been adequately described - also known as polybags. State-of-the-art systems are currently only able to do justice to these extraordinary boundaries to a limited extent. The article shows various models for simulating the physical behavior of polybags, such as limp behavior using multibody simulation or flow simulations (CFD), and integrates these directly into the development process. The design process focuses on a virtual development approach (CAE) through various methods, with subsequent validation of the approaches on a functional prototype. This results in the concept study of the new sorting system especially for polybags

    Trotz steigender Anforderungen und der breiten Verfügbarkeit unterschiedlichster Softwaresysteme fehlt ein Überblick zum Digitalisierungsgrad der personellen Ressourcenplanung in der Intralogistik. Um diesen zu ermitteln, wurden zwei Fragebögen erarbeitet, anhand derer eine Datenerhebung aus den Perspektiven von softwareanbietenden und lagerbetreibenden Unternehmen erfolgt. Es werden Daten hinsichtlich Einsatz, Funktionsweise, Umfang und Implementierungsherausforderungen von Ressourcenplanungssystemen erhoben sowie erste Ergebnisse über aktuell eingesetzte Softwarelösungen zur personellen Ressourcenplanung präsentiert.Despite increasing requirements and the broad availability of different software systems, there is no overview of the degree of digitization of human resource planning in intralogistics. To determine this degree, two questionnaires were developed to collect data from the perspectives of software-providing and warehouse-operating companies. Data regarding the usage, functionality, extent and implementation challenges of resource planning systems will be collected and initial preliminary results on software solutions currently used for human resource planning will be presented

    Auslastungsorientierte Erntelogistik: Routenplanung und Disposition von Feldhäckslern, Überladewagen und Transportfahrzeugen mit Synchronisationsnebenbedingungen

    Agricultural contractors are logistics service providers for various field operations in agriculture. Restrictions imposed by nature, lack of personnel, high-priced agricultural machinery and small margins require contractors to make efficient use of their fleet of agricultural machinery. In order to achieve a short completion time, as is particularly necessary for harvesting, the dispatcher aims to minimize travel times between the operating locations and to increase the utilization of harvesting machines, e.g. forage harvesters and combine harvesters. This paper examines the harvesting process involving forage harvesters and support vehicles (transfer vehicles and transport vehicles). Here, if insufficient support vehicles are available, the forage harvester needs to pause operation on the field while waiting for a support vehicle that can receive the harvested biomass. Typically, teams of harvesters and support vehicles are assembled prior to the start of the harvesting process and remain in this constellation until all fields in the planning period have been harvested. In this study, we investigate the time savings when vehicles are not tied to their team and can thereby harvest each field in a new constellation of vehicles. This paper presents two mathematical models describing the harvesting process with forage harvesters, transfer vehicles and transporters with a focus on the utilization of the forage harvesters with fixed and variable team compositions, respectively. These models are solved via mixed-integer programming with the Gurobi solver.Landwirtschaftliche Lohnunternehmer sind Logistikdienstleister für verschiedene Feldarbeiten in der Landwirtschaft. Naturgegebene Restriktionen, Personalmangel, hochpreisige Landmaschinen und geringe Margen erfordern von den Lohnunternehmern eine effiziente Auslastung ihres Landmaschinenparks. Um kurze Einsatzzeiten zu erreichen, wie es insbesondere bei der Ernte notwendig ist, werden kurze Fahrzeiten zwischen den Einsatzorten und eine hohe Auslastung der Erntemaschinen, z.B. Feldhäcksler und Mähdreschern, angestrebt. In diesem Beitrag wird der Ernteprozess mit Feldhäckslern und Unterstützungsfahrzeugen (Überlade- und Transportfahrzeuge) untersucht. Dabei muss der Feldhäcksler, wenn nicht genügend Begleitfahrzeuge zur Verfügung stehen, die Ernte auf dem Feld unterbrechen und auf ein Begleitfahrzeug warten, das die geerntete Biomasse aufnehmen kann. Typischerweise werden Teams aus Erntemaschinen und Unterstützungsfahrzeugen vor Beginn des Erntevorgangs zusammengestellt und bleiben in dieser Konstellation, bis alle Felder im Planungszeitraum abgeerntet sind. Im Fokus dieser Studie steht die sich ergebende Zeitersparnis, wenn die Fahrzeuge nicht an ihr Team gebunden sind und somit jedes Feld in einer neuen Konstellation beernten können. In diesem Beitrag werden zwei mathematische Modelle vorgestellt, die den Ernteprozess mit Feldhäckslern, Übergabefahrzeugen und Transportern beschreiben, wobei der Schwerpunkt auf der Auslastung der Feldhäcksler bei fester bzw. variabler Teamzusammensetzung liegt. Diese Modelle werden mittels gemischtganzzahliger Programmierung mit dem Solver Gurobi gelöst

    The (Proposed) Transposition Of The Digital Content Directive In The Netherlands

    The Dutch bill for the transposition of the Digital Content Directive, recently submitted to the Dutch parliament, will create a new Title in the Civil Code dealing with digital content and digital services contracts. In line with Dutch legislative tradition, the bill is closely aligned with Dutch (consumer) sales law, which is amended accordingly for the transposition of the Sale of Goods Directive. The most important feature of the new title on digital content and digital services contracts is the 'open period' during which a lack of conformity may arise: as long as the consumer could reasonably expect that the digital content or service would remain to be in conformity, any lack thereof entitles the consumer to a remedy.     Implementation Of The Digital Content Directive In Poland: A Fast Ride On A Tandem Bike Against The Traffic

    Just like two cyclists on a tandem, Directive 2019/770 (DCD) and Directive 2019/771 (SGD) ride together in the same direction. Their ultimate goal is to increase the level of consumer protection and improve the functioning of the internal market by laying down conformity standards and remedies in contracts for the sale of goods and supply of digital content and digital services. The purpose of this article is to present the way, in which the Directives concerned are scheduled to be implemented into the Polish legal system. In order to provide the necessary background, initial Polish experiences with the implementation of the EU consumer aquis are discussed. These early developments are then contrasted with the recently unveiled plans for the DCD and SGD implementation, which met severe criticism in Polish academia. Instead of an integrated approach, a “copy-paste” implementation outside of the Civil Code is proposed. This may result in a systemic disruption affecting not only consumer law, but also contract law as a whole

    Since the advent of Zimbabwe’s independence in 1980, bodies of veterans of the national liberation war have featured prominently in the southern African country’s politics, mainly at the service of the ruling Zimbabwe African National Union-Patriotic Front (ZANU-PF). This article explores the continuum of activities in which veterans’ bodies functioned as instruments which ZANU-PF relied upon in consolidating power in post-2000 Zimbabwe. It trains its lens on the agency of liberation war military veterans in the unfolding of the Fast Track Land Reform Programme (FTLRP), state funerals at National Heroes Acre and provincial heroes acres scattered across Zimbabwe, presidential send-offs and welcomes at Harare International Airport, marches in solidarity with ruling elites, and at ZANU-PF political rallies. In these spaces, bodies of war veterans functioned as vectors of partisan political views, purveyors of state-centric versions of the nation’s history, embodiments of an ideology of war and exemplars of state-sanctioned versions of patriotism. Operating in a context framed by the rise of vibrant political opposition to ZANU-PF’s political hegemony in the form of the Movement for Democratic Change (MDC), war veterans in post-2000 Zimbabwean politics served largely to contain forces that threatened the erstwhile revolutionary party’s power retention interests

    Demystifying The Role Of Data Dnteroperability In The Access And Sharing Debate

    In the current data access and sharing debate, data interoperability is widely proclaimed as being key for efficiently reaping the economic welfare enhancing effects of further data re-use. Although we agree, the role data interoperability plays for data access cannot be straightforwardly answered. First, data interoperability, as a technical mechanism, is an inherent part of some regulated data access rights. In these particular cases, data interoperability is the key enabler for efficient (re-)use of data. This example shows the relevance of addressing data interoperability within the corresponding obligation of the access right. It also reveals that interoperability becomes key from a market failure perspective if the failure stems from a lack of efficient data use or potential lock-ins. Another example where data interoperability goes hand in hand with data access regimes is digital platforms. However, digital markets have a tendency to “tipping”. Such a tendency is not natural but induced by individual practices, e.g., the obstruction to interoperability. To this end, subjecting dominant online platform companies to additional interoperability obligations and stricter monitoring could be an effective approach to control the abuse of market power. Likewise, the current EC’s ambition to pave the way towards European digital sovereignty highly depends on the design of a data interoperability policy within the context of access to and re-use of data. With this background in mind, our contribution answers the question of when and how data interoperability, as a precondition to data quality, should be addressed by the legislature. The paper brings together the technical, legal and economic aspects of data interoperability, conceptualizing it within the data sharing debate. It first elaborates on the notion of interoperability in the current data access and data governance frameworks. An analysis of the different technical interoperability facilitators and the existent legal framework that may hinder data interoperability in this context follows. The debate of APIs is still ongoing and brings on fundamental questions to the proper functioning of exclusive rights. To what extent could IPRs and trade secret protection encumber data interoperability? What would be the implications of granting IPR or trade secret protection for APIs, both in terms of raising incentives for their provision and with regard to effects on competition? The paper continues by considering the pros and cons of a more normative approach toward data interoperability. Data interoperability should be treated only as a means to an end and not as an end in itself. It should be taken as a part of the broader data sharing and access discussion, reflecting on the positive and adverse effects alike. To this end, a public law approach within the realm of a data governance solution seems more favorable. Such a governance solution could also entail a more consistent solution to conflicting IP, database sui generis and trade secrets protection in data, which is currently not thoroughly and clearly assessed either. These conflicts need a more holistic assessment of overlapping exclusive rights and their re-usability options
