Aplicabilidade e consequências jurídicas do Banco Nacional de Perfis Genéticos Criminais no Brasil
Get PDFThe present article aims to present the applicability and legal implications of the use of national banks of genetic profiles for criminal purposes through an analysis of the creation and development of legal devices in the country, using the classic methodological procedure of bibliographic consultation, in an interdisciplinary perspective, having the theme related to criminal law, criminal procedure, human rights, bioethics, forensic genetics and criminology, being essential the interaction of law with other areas of scientific knowledge. The evolution of biotechnologies promotes political manifestations for the creation of laws aiming at the full use and collection of this genetic material with the purpose of elucidating crimes and the subsequent reduction of criminality. The legal protection of genetic data is fundamental to the discussions on new theories of human rights in the Democratic State of Law, however, the creation of such legal orders with the purpose of guaranteeing public security violates several individual rights and guarantees of the accused and sentenced, being worth pointing out the unconstitutionality of some legal provisions through the Extraordinary Appeal No. 973.873 / MG. The state action aimed at ensuring security, through influences of informal social controls, particularly public opinion, continues to be founded in detriment of the fundamental guarantees that sustain the democratic rule of law.O presente artigo visa apresentar a aplicabilidade e implicações jurídicas acerca da utilização dos bancos nacionais de perfis genéticos para fins criminais através de uma análise sobre a criação e desenvolvimento dos dispositivos jurídicos no país, utilizando-se do procedimento metodológico clássico da consulta bibliográfica, em uma perspectiva interdisciplinar, tendo o tema relação com direito penal, processual penal, direitos humanos, bioética, genética forense e criminologia, sendo imprescindível a interação do Direito com outras áreas de conhecimento científico. As evoluções das biotecnologias promovem manifestações políticas para a criação de leis visando a plena utilização e a colheita desse material genético com o escopo de elucidação de crimes e posterior redução da criminalidade. A proteção jurídica dos dados genéticos é fundamental para as discussões sobre novas teorias de direitos humanos no Estado Democrático de Direito, no entanto, as criações de tais ordenamentos jurídicos com o intuito de garantir a segurança pública violam diversos direitos e garantias individuais dos acusados e sentenciados, valendo-se ressaltar a arguição de inconstitucionalidade de alguns dispositivos legais através do Recurso Extraordinário nº 973.873 / MG. A atuação estatal visando a garantia da segurança, através de influências dos controles sociais informais, em destaque a opinião pública, seguem fundadas em detrimento das garantias fundamentais que sustentam o Estado Democrático de Direito
Elements of political doctrination in school everyday through actions of the school without party program: an analysis under Foucauldian optics
No full textEste trabalho de pesquisa pretende apresentar subsídios para reflexões na área da educação, sobretudo no que diz respeito ao Programa Escola sem Partido e suas aspirações na concepção de um Projeto de Lei que, apesar de se autodenominar garantidor dos direitos de pais e alunos, prevê na verdade o cerceamento das atividades de professores e demais educadores. Como metodologia de amparo para análise da massa documental coletada, empregou-se os ensinamentos de Bardin; para reflexão das possíveis influências no cotidiano escolar, foram arrolados autores interdisciplinares do porte de Paulo Freire, sobretudo quanto à sua percepção de uma educação libertadora e tendo como centro o pensador Foucault, com suas concepções sociológicas. Como resultado da presente investigação, apurou-se que, caso seja aprovado e sancionado o PL da EsP, tal medida poderá implicar um grande retrocesso nas relações humanas que envolvem o dispositivo escolar com possíveis reflexos negativos no sistema educacional brasileiro.This research work intends to present subsidies for reflections in the area of education, especially with regard to the Escola sem Partido Program and its aspirations in the conception of a Bill that, despite calling itself guarantor of the rights of parents and students, actually provides for, the restriction of the activities of teachers and other educators. As a support methodology for the analysis of the collected documents, Bardin's teachings were used and for reflection of the possible influences on school daily life, interdisciplinary authors of the size of Paulo Freire were enrolled, especially regarding his perception of a liberating education and having as its center the thinker Foucault with his sociological conceptions. As a result of the present investigation, it was found that if the ESP bill is approved and sanctioned, such a measure could imply a major setback in human relations involving the school device with possible negative effects on the Brazilian educational system

Estudo da utilização da fluoxetina e sertralina empregados em situações de emagrecimento: revisão de literatura
Get PDFObjective: to describe the characteristics of selective serotonin reuptake inhibitors (SSRIs) involved in the weight loss process, highlighting the role of the pharmacist and self-medication. Methods: this is a bibliographic review of the narrative type, used by research in scientific articles from research platforms and books. The indexes searched were sciELO – Scientific Electronic Library Online, Google academic, Pubmed, Lilacs, Dynamed, books and leaflets. The keywords searched for were: fluoxetine for weight loss, fluoxetine for weight loss, fluoxetine and obesity, sertraline for weight loss, antidepressants obesity, sertraline and body weight, SSRI treatment for obesity, aesthetics with sertraline, sertraline for binge eating, consumption of SSRIs in weight loss, self-medication with anorectics; in addition to their respective words in English: fluoxetine in weight loss, Sertraline and Obesity and sertraline obesity treatment. Results: demonstrate intensity in the prescriptions of selective serotonin reuptake inhibitors, with their use also happening in people with normal body mass, in addition, self-medication by a part of this population was identified, in addition to abusive consumption. Conclusions: through several studies that SSRI's are used for weight control helping in eating disorders, in addition, the non-rational use of these drugs was evidenced, demonstrating an increasingly necessary pharmacist's role in these situations with other professionals in the field. health.Objetivo: descrever sobre as características dos inibidores seletivos de recaptação de serotonina (ISRS) envolvidos no processo de emagrecimento, destacando o papel do farmacêutico e a automedicação. Métodos: trata-se de uma revisão bibliográfica do tipo narrativa, utilizando-se por pesquisas em artigos científicos de plataformas de pesquisa e livros. Os indexadores pesquisados foram sciELO – Scientific Eletronic Library Online, Google acadêmico, Pubmed, Lilacs, Dynamed, livros e bulas. As palavras-chave procuradas foram: fluoxetina para o emagrecimento, fluoxetina na perda de peso, fluoxetina e obesidade, sertralina na perda de peso, antidepressivos obesidade, sertralina e peso corporal, tratamento ISRS de Obesidade, estética com sertralina, sertralina na compulsão alimentar, consumo de ISRS na perda de peso, automedicação com anorexígenos; além de suas respectivas palavras em inglês: fluoxetine in weight loss, Sertraline and Obesity e sertraline obesity treatment. Resultados: demonstram intensidade nas prescrições de inibidores seletivos de recaptação da serotonina, com sua utilização acontecendo também em pessoas com massa corporal normal, foi identificado, além disto, a automedicação por uma parte desta população além de consumo abusivo. Conclusões: mediante a vários estudos que os ISRS’s são utilizados para o controle de peso auxiliando em transtornos alimentares, além disto foi evidenciado o uso não racional desses medicamentos, demonstrando necessária cada vez mais a atuação do farmacêutico frente à essas situações junto de outros profissionais da saúde
