2021 - 2022Medical liability is an important branch of law in which, in the first place, the expectations of patients' recovery are compared with the doctor's duty to provide them with adequate and possibly decisive care. Unfortunately, medicine is not an exact science, so it happens that the patient may not always be fully satisfied with the care he has received: it is precisely in this case that the law comes into play, with the first objective of preventing dangerous situations and the second objective of guaranteeing compensation for the damage caused by that doctor who has not acted diligently, prudence, competence, and by the health company that has disregarded the contractual obligations concluded with the patient. One of the main issues that animate the debate around medical liability, object of the thesis study, is that relating to the use of Artificial Intelligence tools in medicine, these are engineering, biomedical, mechanical or IT third party elements, which support the daily work of the doctor. In our legal system, the identification of the person responsible becomes even more complex if we think of the legislative changes that have occurred in health matters, in fact there has been a transition from contractual liability for the doctor to liability, brought back by doctrine and jurisprudence, in the channel of non-contractual liability. In the health system, the use of artificial intelligence is based on virtuous results. This type of technology is able to give a percentage of risk to develop, based on certain results, certain diseases, using some characteristics of patients already hospitalized. It should be remembered that medical activity is based on the interpretation of the man's narrative, physical examination and clinical, therapeutic and diagnostic evaluations of his body. The anamnesis is the true fulcrum of the health service as it is aimed at collecting personal information to investigate the patient's malaise. The problem arises from the fact that medical science is not only based on scientific evidence but also on the specificity of the case and on the patient's narrative. Human-machine interaction in actions/omissions poses liability problems in case of damage to third parties. Responsibility, in fact, in these cases is not easy to solve. The problem is given by the fact that this new technological approach brings with it new realities that can hardly find a normative reference, even analogically, in the civil code. The starting point of this thesis study is given by the dichotomy that has been created between artificial intelligence and human intelligence. At the end of the research carried out, it will be understood that this is a false contrast. Anyone who thinks that an algorithm can override the advice of a doctor is mistaken. Technology is also fallible, and its supervision will necessarily be entrusted to man. In order to help in the health sector, an AI algorithm must guarantee performance equal to or superior to that of a human being in the specific tasks assigned to it. But many of the decisions that doctors make on a daily basis are incredibly complex and require a much more complex approach than that offered by the use of artificial intelligence in data processing. We could refer to "the autonomy of artificial intelligence" trying to identify the quantum of "contribution" of the human being: to understand when it is minimal and therefore artificial intelligence is completely autonomous even in its updates or when human intervention is essential. In the context of hospitals, however, artificial intelligence almost always needs the human contribution because it is through that contribution that the final result is reached. Here then the need will arise, in order not to charge non-existent responsibilities, to analyze the responsibility, if necessary separating the various profiles. To realize the enormous potential of AI to transform healthcare for the better, AI stakeholders, including AI leaders, physicians, patients, ethicists, and legislators, need to engage in the ethical and legal debate about how AI is successfully implemented in practice. The reconstruction of the responsibility that this thesis study is committed to achieving will proceed through jurisprudential and doctrinal orientations and the reconstruction of the strategies concerning the ethics and law of AI in health in the European Community. Although we talk about artificial intelligence systems in an all-encompassing way, they are also systems or products that have significant differences. Just think of the fact that the surgical robot is used by a subject who has a specific competence and professional training, while the driverless car could in the abstract also be driven by a person with reduced sensory abilities , to realize the differences existing in the field of artificial intelligence. In this sense, we must ask ourselves to what extent a regulatory solution that embraces all types of artificial intelligence, without making specific differentiations due to their specific characteristics and the sector where they impact, represent the preferable solution. There is currently no fully harmonised EU regulatory framework for liability in AI and robotics such as care and medical robots. However, Europe has taken several steps to address the issue of ethics and responsibility. It is difficult to establish whether the proposals made within the European Union are able to adequately respond to the multiplicity of problems caused by advanced robotics. They certainly have the merit of providing for the adoption of new legal rules for artificial intelligence. This is an essential path in order to provide certainty both to operators in the sector and to users of smart products and advanced artificial intelligence systems, with the introduction of an objective liability regime for those subjects who seem better able to contain risks and avoid or decrease their negative consequences. A multi-disciplinary approach based on mass spectrometry to disclose the potential of phytoextracts as natural cosmetics

The PhD scholarship was co-financed with resources from Programma Operativo Complementare Ricerca e Innovazione 2014–2020, Asse I “Capitale Umano”, Azione I.1 “Dottorati Innovativi con caratterizzazione Industriale”.2021 - 2022Plant cells represent a valid source of cosmetic ingredients since their extracts can be considered bio-sustainable, contaminant-free and standardized secondary metabolites mixtures (Barbulova et al., 2014). This PhD project has met the interest of Arterra Bioscience S.p.A in performing a broad chemical and biological characterization of some plant cell extracts in the prospective to exploit them as cosmetic ingredients. In particular, we focused on the hydrophilic extract of Oenothera biennis cells (ObHEx) and on the hydroethanolic extract of Jasminum sambac cells (JasHEx). The mass spectrometry-based chemical characterization was performed using Global Natural Products Social Molecular Networking (GNPS)(M. Wang et al., 2016) as bioinformatics tool for data organization and annotation. The biological activity of the extracts was evaluated by a panel of in vitro (global proteomics analysis and cell-based assays) and ex vivo experiments. Interesting secondary metabolites were identified in ObHEx: they belong to lignans (salvadoraside and liriodendrin) and triterpenes (myrianthic acid, arjunolic acid, asiatic acid and hederagenin), some of which previously associated with pro-collagen I production in human fibroblasts (Bonte et al., 1994; Farwick et al., 2014). Indeed, bioassays revealed that ObHEx is able, by increasing Myosin light chain kinase (MYLK) gene expression, to promote matrix collagen contraction, actin polymerization and the production of extracellular matrix proteins (Ceccacci et al., 2021). Moreover, global proteomics experiments, performed during my period as visiting PhD student at the Proteomics Platform of the INSERM US24, proved a pro-mitotic mechanism of action of ObHEx on senescent human dermal fibroblasts: it stimulates the re-entry into cell cycle of senescent cells via increase of mitotic protein expression (Ceccacci et al., 2022b). JasHEx is principally composed by phenolic acid derivatives, lignans (secoisolariciresinol, nortrachelogenin and matairesinol) and triterpenes (arjunolic acid, asiatic acid, maslinic acid, oleanolic acid and ursolic acid) (Ceccacci et al., 2022a). Biological experiments, carried out during my research period at Arterra Bioscience SpA, proved that JasHEx is able to reduce cytosolic reactive oxygen species production in stressed keratinocytes. It also showed anti-glycation activity and an extracellular matrix booster effect, by increasing collagen type I synthesis. In particular, the antioxidant properties of JasHEx were related not only to its free radical scavenging and metal chelating activities, but also to the enhancement of Nrf2/ARE pathway. This latter also explains JasHEx anti-inflammatory activity which decreased nitric oxide levels in LPS stimulated macrophages. Thus, on the basis of these results, both extracts can be considered as powerful cosmetic bioactive ingredients to counteract skin aging.

    Get PDF
2021 - 2022The doctoral research work focused on problematizing, from a philosophical legal and political point of view, certain aspects of the thinking of the two best-known and most relevant economists of the 20th century, John Maynard Keynes and Friedrich August Hayek. The economic and social philosophy analysis of the works of the two authors was put under the scrutiny of two lines of inquiry: first of the relationship between the sphere of economics and the sphere of politics, and then, closely related to the first aspect, the different declinations of the concept of crisis. In the first part of the research, moving from a philosophical questioning, the concept of the modern was investigated from the constituent character that the relationship between the Political and the Economic has assumed. Within this framework it was possible to examine mainly, two fundamental concepts of the legal philosophical lexicon: that of the individual and that of the State. In the second part, however, the same issue was analyzed in the light of the thought, first, of the Cambridge economist and later of the Viennese. In the second chapter of the thesis, in fact, three topical moments are distinguished that allow the notion of Keynesian crisis to be delineated, highlighting the tension between economic science and politics. First, the monetary question, which intensely marks Keynes' thinking between the 1920s and his death in 1946, then reflections on the crisis of the liberal order that opened with the end of nineteenth-century laissez-faire, and finally, Keynes' diplomatic work during the two world wars define three determinations of Keynesian work. In the third chapter, the figure of Hayek is developed in two directions: the purely economic work developed between the 1920s and early 1940s, when the Viennese's analysis focused on the definition of the business cycle and the identification of crisis as an intervention by public authorities in the naturalness of the cycle; secondly, however, the research focused on the works of his maturity, when the new Hayekian definition of crisis, the one revolving around the notion of catallaxy, assumes and highlights the anti-modern bearing of Hayek's political philosophy. The whole reflection is mainly aimed at relating the two authors, both, more generally, from the point of view of their intellectual and biographical relationship, and by highlighting the different normative proposal internal to their interpretation, which the two theorists developed by differentially tensioning the dyad constituted by the terms Economic and Political. N-gram Retrieval for Word Spotting in Historical Handwritten Collections

    Get PDF
2021 - 2022Collections of handwritten documents of historical interest are often small, ranging from a few dozen to a few hundred pages, but they may have features typical of the collection itself which make them interesting for scholarly groups. Word retrieval can be complicated, as handwriting recognition techniques applied to images of such text documents can produce unsatisfactory results. To circumvent this, KeyWord Spotting (KWS) techniques promise to retrieve words without having to perform the recognition explicitly. KWS systems often require the construction of a reference dictionary consisting of words that the system can search for in the document. To do this, a dictionary must be created, and usually, a small portion of the collection is transcribed by hand. This limits the search to words from the dictionary (InVoc) and introduces the problem of OOV (Out Of Vocabulary) words, which cannot be searched for. Intuitively, increasing the cardinality of the reference dictionaries by manually transcribing new examples of words may seem an immediate way of limiting the OOV problem. As we can imagine, manually labelling pages is an expensive process that can take a lot of time. For small collections, the time required to transcribe and label even a few pages can prove to be a non-negligible obstacle, calling into question the usefulness of automated word retrieval systems. In this thesis, we will focus on a KWS system that can adapt to the lack of data. First, we show analytically, through the definition of a mathematical model, how the different components of the system affect the time of use of the KWS system by estimating the time gain that the system brings to the transcription of a small collection of handwritten historical documents. After highlighting the importance of speeding up the manual annotation process, we then propose a semiautomatic method for image annotation. In particular, we present a learning-free end-to-end approach that includes a line segmentation algorithm and an algorithm for aligning transcripts to images with handwritten text. The former can extract lines of text with a curved baseline, while the latter allows us to easily get their transcript. Finally, we propose a KWS system for word spotting that bases the search on recognizing sequences of characters (N-grams) rather than directly trying to find whole words. Studies on motor behaviour have shown that writing is the result of very fast and precise motor actions that can be automated. In the learning phase, an individual tends to develop motor programs associated with simple actions that are characterized by a high frequency of execution. It is plausible to assume that motor programs for writing develop in relation to sequences of a few characters. This would mean that each time a subject writes an N-gram to which a motor program is associated, he or she produces an ink trace that is always compatible with and similar to all others. The repeated similarity in the execution of the same movements for each N-gram could make the N-grams recognizable, making them ideal candidates for handwritten cursive recognition. The results of the experiments show how a KWS system can effectively reduce the time to the document collection transcription process. Moreover, it is shown that the process of labelling data and creating reference dictionaries is indeed an extremely costly operation and that methods that enable the acceleration of such processes are crucial. The experiments with the proposed KWS system have shown that focusing the search on the N-gram space enables the retrieval of InVoc and OOV words equally well, showing similar retrieval rates for both groups of words. Barbadian English idioms: Challenging linguistic norms in a diasporic context

    Get PDF
As a typical phenomenon affecting virtually all diaspora Englishes, also throughout the Anglophone Caribbean the centripetal forces leading to the recognition of a unified norm cohabit with the outward thrust of linguistic fragmentation – the latter encouraging the determination of territory-specific varieties of English, such as Barbadian. Bearing in mind the profound significance of phraseology for Caribbean and Barbadian English alike, this contribution aims to foreground the idiomatic features pertaining to the variety of English spoken in Barbados by means of a pilot study based on the New Register of Caribbean English Usage, from which seven culturally marked idioms are singled out and commented on. The conclusions reached by means of this metalexicographic investigation reveal that the phraseological specificities generated by Barbadians – mostly through the interplay of British English, Irish English and various West African languages from the seventeenth century onwards – evidence lexical metamorphoses which contribute to the forging of Barbadian identity, hence challenging the superimposed linguistic norms of the colonial era
